Dissertação de Mestrado em Direito apresentada à Faculdade de Direito O presente trabalho tem como intuito analisar a relação entre o ambiente e migrações humanas. Para isso, inicialmente aborda-se a evolução da matéria ambiental nos movimentos internacionais para a sua proteção, alcançando o reconhecimento de direito humano pelas vias existentes, principalmente, pelos Sistemas Regionais de Direitos Humanos, especificamente, o europeu e o americano. Com esta análise sob a perspectiva de um Direito Internacional Ambiental, parte-se para o estudo do tratamento do ambiente em dois países: Brasil e Portugal. Para isso é realizada uma abordagem das previsões constitucionais para o ambiente e as leis específicas da matéria em ambos os Estados. Dada essa estrutura, são analisados os conceitos e algumas especificidades sobre degradação e dano ambiental, vulnerabilidade do ambiente e humana. Destarte é alcançada a matéria das migrações, perpassando a sua estrutura existente, abrangendo o Direito Internacional dos Refugiados, Direito Internacional dos Direitos Humanos e Direito Internacional Humanitário. A partir dessa construção, disserta-se sobre os deslocados ambientais: no intuito de interagir o conceito existente no principal documento de proteção (Convenção de 1951 para os Refugiados) e os instrumentos de direitos humanos, é realizada a abordagem sobre a relação dos fatores ambientais degradantes ensejarem o movimento migratório compulsório humano. Para isso, são colocadas as expressões mais utilizadas pela literatura e a opção desta pesquisa pela utilização ‘deslocados ambientais’. Com isso, fomenta-se o estudo dos projetos existentes para proteção aos que se deslocam por razões ambientais, tanto internamente quanto ao cruzarem fronteiras internacionais. São apontadas as manifestações mais atuais sobre o tema, incluindo recente recomendação do Comitê de Direitos Humanos da ONU, e são utilizados relatórios de pesquisas que apontam os números de pessoas deslocadas por fatores ambientais nos últimos anos. O estudo do caso prático ocorrido em Mariana, Minas Gerais, Brasil, promove a reflexão sobre a falta de estrutura para esses indivíduos deslocados e aponta a necessidade de unir o arcabouço existente em matéria dos direitos humanos em prol de uma proteção imediata e a necessidade de um estímulo para a construção de uma tutela específica. The purpose of this study is to evaluate the relation between the environment and human migrations. We begin by addressing the evolution of environmental issues within the global movement for the protection of the environment, and the recognition of access to an adequate environment as a human right, specifically on the part of the European and Inter-American Human Rights Systems. Based on such analysis from the perspective of the International Environmental Law, we examine the constitutional and statutory approach on the matter in Brazil and Portugal and then analyze the concepts and peculiarities regarding environmental degradation and deterioration, and environmental and human vulnerability. Our research moves on to the issue of migrations, encompassing their actual structure, the International Refugee Law, the International Human Rights Law, and the International Humanitarian Law, and elaborates on the environmentally displaced people. In an attempt to combine the concept included in the key protection document (the 1951 Refugee Convention) and the human rights instruments, it examines the relationship between the causes of environmental degradation and forced migration. For such an end, we lay out the expressions most commonly used by legal scholars, as well as our option to use the term ‘environmentally displaced person’ in this paper. This study analyses the existing projects that aim to protect those who migrate, either within the country or across borders, due to environmental causes. It also refers to the most recent statements regarding the matter, including the UN Human Rights Committee’s recommendation, and draws on reports on the quantity of environmentally displaced people in recent years. The case study related to the disaster that occurred in Mariana, Minas Gerais, Brazil, leads us to reflect on the lack of structure available for such displaced people and points to the need of deploying the human rights framework for their immediate safeguard and the creation of specific protection.
