Immigration officers are active in both Dutch and Belgian immigration detention centers. Their task is to contribute to the forced return of detained migrants without residence permits. There are, however, clear differences between the Netherlands and Belgium in terms of policy, organizational structure and prescribed tasks of these ‘return agents’. This article describes these differences and shows how this leads to different working practices. The immigration officers in the Netherlands put more pressure on detainees in order to convince them to cooperate with their forced return. This mainly leads to more frustration among detainees. The social assistants in Belgium, however, state that working on return is difficult. They therefore make little or no attempt to persuade detainees to leave. Although this leads to a better living environment in the detention center, it does not alter the feelings of injustice experienced by detainees.

How children’s rights and more specifically the right to complain functions in youth institutions remains fairly unexplored territory. Nevertheless, insight into the role of the right to complain in practice is of the utmost importance. Children and young people do have certain rights, following international treaties and also often national regulations, but whether and how those rights ultimately improve the participation and legal/power position of children remains underexposed. Therefore, in this contribution the authors argue for an ‘empirical children’s rights perspective’, in which children’s rights are not mere legal-theoretical touchstones, but tools that actors (both professionals and minors) mobilize (or not) in a given context. From such an empirical children’s rights perspective, understanding the practice and context in which children’s rights (should) be applied is very important. Indeed, an empirical children’s rights perspective starts from the premise that it is the context that determines how professionals and minors mobilize (or not) children’s rights. The Flemish complaint law in juvenile institutions is, from an empirical children’s rights perspective, a unique case, because it has only had a formal basis since 2017. Thanks to the empirical research that the authors have conducted (observations and interviews), this contribution offers, on the one hand and foremost, important insights into the functioning of the right to complain in a Flemish youth institution. On the other hand, this contribution also sheds light on the changes and problems the authors observe in the transition from an informal to a formal right to complain in Flemish youth institutions. Furthermore, the unexpected impact of the COVID-19 pandemic on the introduction of formal complaint law is also discussed in this contribution. In their conclusion, the authors emphasize the importance and implications of an ‘empirical children’s rights perspective’ both in terms of research and the idea and theory of children’s rights themselves.

Van 2 tot 9 november 2021 bracht het Europees Comité ter preventie van foltering en onmenselijke of vernederende behandeling of bestraffing (CPT) een ad hoc bezoek aan België. Het doel van het bezoek was om na te gaan of de situatie in de Belgische gevangenissen verbeterd was na het laatste periodieke bezoek van maart-april 2017. Tijdens het ad hoc bezoek in 2021 werden de gevangenissen van Antwerpen, Lantin, Sint-Gillis en Ieper bezocht. In zijn rapport van dit bezoek, dat op 29 november 2022 verscheen, besteedt het CPT bijzondere aandacht aan de materiële detentieomstandigheden, het terugkerende probleem van de overbevolking, de activiteiten, de gezondheidszorg (waaronder de situatie in de psychiatrische annexen) en ten slotte de personeels- en arbeidsomstandigheden (CPT, 2022a). We gaan in deze bijdrage dieper in op enkele belangrijke bevindingen uit het rapport en enkele reacties van de Belgische overheid.

N/A, Along with seventy other participants, including magistrates and journalists, I spend two days trial runs in the prison of Haren prison. What does this immersion mean and what does it do to a person? This contribution gives, on the basis of a detailed report, an impression of my experiences3 during my short stay of 32 hours in the largest prison of Belgium.

The use of bodycams can lend to greater legitimacy, transparency, and accountability with regard to police-citizen interactions. However, they ought not be considered a panacea, and need to be understood in their fuller context. The footage they produce is not the only bearer of truth about police-citizen encounters, rather it ought to be considered as an additional perspective on what happens in such encounters.

While research has increasingly focused on the role of digitalisation in prisoners’ detention experiences, the impact of the digitalisation of the prison regime on the discretionary power of prison officers has been understudied. By using an ethnographic approach in one digital Belgian prison, qualitative interview data are used to investigate the prison officer’s coping strategies in response to the digitalisation of prison life. It is found that the gatekeeping role of prison officer’s has been partly stripped away but also that the impact of digitalisation on the prison officer’s discretionary power depends on how digital technologies are implemented. Moreover, the study reveals that not all official goals regarding the digitalisation are met and highlights the need of supporting prison officers when implementing new technologies in prison.

De auteurs bespreken de bepalingen inzake de externe rechtspositie voor veroordeelden zonder recht op verblijf in België. Ook deze bepalingen waren de afgelopen vijftien jaar regelmatig aan veranderingen onderhevig. Het centrale argument van hun bijdrage is dat deze veranderingen het recht op re-integratie voor deze groep gedetineerden uitholden, ten behoeve van doelstellingen van migratiecontrole enerzijds en met het oog op het beperken van de overbevolking in de gevangenissen anderzijds.

Met het Vlaamse Jeugddelinquentiedecreet van 2019 werd het positief project als nieuwe afhandelingsmogelijkheid naar aanleiding van een jeugddelict geïntroduceerd. Het positief project houdt in dat minderjarigen zelf een plan met engagementen opstellen naar aanleiding van het door hen gepleegde jeugddelict. In dit artikel worden ervaringen met het positief project van veertien HCA-medewerkers en enkele jongeren, ouders en jeugdadvocaten in kaart gebracht. Op basis van de interviews wordt duidelijk dat het positief project veel potentieel in zich draagt: het biedt jongeren de kans om, vertrekkend vanuit hun eigen krachten en ideeën, maar ondersteund vanuit de context, hun verantwoordelijkheid op te nemen. Niettemin komen doorheen de interviews ook verschillende uitdagingen en knelpunten aan bod, zoals de uitdagende zoektocht naar de specifieke rolinvulling door de ondersteunende HCA-medewerkers, de beperkte bekendheid en de beperkte toepassing van het positief project, de verschillen tussen arrondissementen die tot rechtsongelijkheid en/of een gevoel van onrechtvaardigheid bij jongeren kunnen leiden, de beperkte vrijwilligheid van het aanbod, de variërende betrokkenheid van jeugdadvocaten en de mogelijke implicaties daarvan voor rechtswaarborgen zoals het vermoeden van onschuld en de proportionaliteit van de reactie, en de delicate positie van eventuele slachtoffers.

In dit boek staat de uitdagende, soms onvoorspelbare praktijk van kwalitatief onderzoek voeren centraal. Op basis van concrete getuigenissen en blikverruimende voorbeelden bieden de auteurs praktijkgerichte handvaten aan zowel studenten kwalitatief onderzoek als aan (beginnende) kwalitatieve onderzoekers. Dit boek vormt daarom een mooie aanvulling op bestaande basishandboeken kwalitatief onderzoek. Hoewel het boek zich primair richt op criminologen, zijn de voorbeelden en tips & tricks ook relevant voor studenten en onderzoekers in de ruimere sociale wetenschappen.

Op 30 september 2022 werd de gevangenis van Haren ingehuldigd door een trotse minister van Justitie.d Dit artikel blikt terug op de lange totstandkoming van Haren als grootschalig gevangeniscomplex, op de politieke keuzes en de reacties uit de samenleving en de academische wereld. Is deze nieuwe gevangenis wel zo ‘nieuw’ als ze wordt voorgesteld? En volstaat een nieuw gebouw om de lovenswaardige intenties te realiseren?

In de Belgische gevangenissen is sprake van een toenemende vergrijzing. In acht jaar tijd is het aantal 60-plussers binnen de gevangenismuren verdubbeld van 247 in 2012 naar 496 in 2021 (Vlaams Parlement, 2021). Deze groep is tot op heden nog relatief klein, wetende dat de totale gevangenisbevolking al jaren rond de 11.000 schommelt. Toch zijn structurele maatschappelijke en penale ingrepen nodig voor deze vaak vergeten doelgroep. En net zoals in de samenleving, bestaat er in een gevangeniscontext niet zoiets als ‘de oudere’ en gaat het om een heel diverse groep.
