The U.S. has made it mandatory for all television broadcasting to shift from traditional analog to digital TV. It will provide very good picture quality and reception but the only problem is that for this the viewers require cable television or satellite or a digital box, which is posing a problem due to cost.

While these homes can now begin to enjoy the numerous benefits of the technology, regulators and industry experts are working to craft responses to problems, both actual and anticipated, that the technology creates. Mindful of the piracy issues that came with the popularity of digital file formats in the music industry, the FCC addressed piracy in the digital TV context by endorsing the use of 'broadcast flags' on all digital TV transmissions in a 2003 Notice of Proposed Rulemaking. In her Note, Debra Kaplan describes the workings of broadcast flags, the applications of the flags in practice, and the concerns that accompany their use. She explains and supports the FCC's jurisdiction to regulate the digital TV industry, addresses how the FCC might work to ensure the use of flags, analyzes the impact of the widespread use of broadcast flags from both a copyright and public policy perspective, and details potential alternatives. These alternatives are ultimately rejected, and the Author concludes by arguing that the flags strike the appropriate balance between protecting content creators and encouraging the widespread dissemination of information.

DIGITAL [...], After having recently adopted a variety of complex decisions concerning the digital television transition, the Federal Communications Commission ('FCC') may be poised in the next year to address the issue of mandatory cable carriage of digital broadcast television signals. In this regard, it may reasonably consider the possibility of crafting digital carriage rules for public television stations first without ruling positively or negatively on carriage of commercial stations. This action may legitimately be based on the unique legislative and factual differences between the noncommercial and commercial service and would be constitutionally permissible. This Article sets forth the legal basis for a 'public-television-first' approach. Andrew D. Cotlar first discusses the digital television build-out and describes the role of public television stations that build-out. He then explains the FCC's 2001 ruling on digital cable carriage and its impact on public television stations. Lastly, Cotlar argues that a 'public-television-first' approach is a reasonable, content-neutral, and therefore constitutionally permissible exercise of the FCC's authority to address the unique needs and circumstances of public television stations.
