Abstract

In the last 30 years, the ECtHR has developed its own approach to the “Namibia exception”, namely the possibility to grant legal effects to acts or documents issued by an entity born in violation of a jus cogens norm. The legal reasoning of the ECtHR is simultaneously based on the protection of the human rights of the inhabitants of the affected territory and on the aim to avoid the creation of a vacuum within the Council of Europe. By analysing a broad corpus of domestic courts’ decisions and governmental staetments, one can demonstrate that (1) the specific concern for the inhabitants’ human rights is not reflected by general States practice and (2) those few States that use a reasoning similar to that used by the ECtHR are the States involved in the violation of the jus cogens norm., info:eu-repo/semantics/nonPublished

Abstract

This thesis studies the existence and the extent of EU Member States' obligations, under international and European human rights law, in the context of humanitarian visa applications introduced within their diplomatic or consular representations abroad by third-country nationals in need of international protection. Analyzing the concepts of jurisdiction, positive obligations to protect and applicability of the EU Charter of Fundamental Rights, this thesis concludes that EU Member States can be required to issue the requested humanitarian visas in order to grant safe and legal access to their territory when there is no other alternative effectively protecting the applicants from remote, but foreseeable, risks of harm, in accordance with their obligation of non-refoulement., Doctorat en Sciences juridiques, info:eu-repo/semantics/nonPublished

14. The European Union Should Not Ignore the Female Face of Forced Labour

Abstract

This article discusses the European Commission’s proposal for a regulation to ban products from forced labour in the European Union (EU) of September 2022. It argues that the Commission failed to conduct an impact assessment which could have addressed gender dimensions. This was omitted because the proposal would be ‘urgent’. While not atypical—the EU has often turned a blind eye to women’s issues—the gender-blind nature of the proposal is unfortunate. At least three indicators of forced labour that are used by the International Labour Organization—including the two most common indicators vulnerability and wage non-payment—have a differentiated impact on women. Drawing from the three-step framework in the Gender Guidance of the United Nations Working Group on Business and Human Rights, this article suggests a way to start discussions to include a gender perspective in the regulation., SCOPUS: ar.j, info:eu-repo/semantics/published

Abstract

Un droit africain des affaires harmonisé ;des investissements sécurisés par le droit. Telle est l’ambition de l’OHADA. L’efficience de cette ambition tient en partie de l’efficacité du droit des entreprises en difficulté, car ce droit que l’on pourrait qualifier de droit de la pénurie est au cœur des préoccupations des investisseurs, qui sont les créanciers actuels ou potentiels. Justement, cette thèse décrypte et met en perspective le régime de protection des créanciers. Elle évalue le niveau et les garanties de protection à eux accordées dans les procédures de l’Acte uniforme portant sur les procédures (collectives) d’insolvabilité (AUPC) révisé de 2015. Sur fond d’une démarche méthodologique mêlant technique juridique et théorie analytique du droit, l’analyse, sans opter pour le droit comparé au sens strict, sollicite souvent les droits belge et français lorsqu’il s’agit de préciser certains concepts ou de proposer des solutions, le cas échéant. Le résultat de la synthèse est pour le moins mitigé. Si l’on peut notamment déplorer l’approche douteuse en matière de délais impératifs de déroulement des procédures, le régime superficiel des procédures simplifiées et l’absence explicite d’interdiction des paiements dans les procédures curatives, le régime général de protection, applicable à tous ou à la plupart des créanciers, est dans l’ensemble satisfaisant. Les conditions d’ouverture et les effets des procédures sont mieux précisés, les procédures sont plus rapides, mieux encadrées et devraient être moins coûteuses, et l’aspect international est moderne. S’agissant des garanties, les privilèges pourraient dans l’ensemble être améliorés. Le privilège de la masse profite parfois à des créances non utiles à la procédure. Abstract

La présente thèse dresse une histoire juridique contextuelle des programmes de traités bilatéraux d'investissement (TBI) en Europe occidentale entre 1959 et 1989. Les TBI sont des accords internationaux, habituellement entre deux États, par lesquels les parties conviennent de règles juridiques spécifiques et de procédures de règlement des différends pour régir les investissements réalisés par les ressortissants d'une des parties au traité sur le territoire de l'autre partie au traité. Depuis 1959, plus de 3 000 de ces accords ont été signés. Au cours des deux dernières décennies, les TBI sont devenus beaucoup plus politisés et controversés en raison de l'augmentation des litiges entre investisseurs et États devant des tribunaux arbitraux internationaux, la compétence du tribunal étant souvent fondée sur un article d'un TBI qui prévoit une offre de recours à l'arbitrage en cas de litige. Plus de 1000 affaires ont ainsi été rendues publiques, donnant régulièrement lieu à des arbitrages d'une valeur de plusieurs millions de dollars. Dans cette thèse, j'analyse les débuts des programmes de TBI. Ma thèse répond à trois questions, à savoir (1) comment le régime des TBI s'est-il développé entre 1959 et 1989 ;(2) pourquoi les pays d'Europe occidentale ont-ils négocié et signé des TBI au cours de cette période et (3) quel rôle, quelle signification et quelle importance relative les négociateurs et les acteurs du monde des affaires d'Europe occidentale ont-ils accordé aux règles et aux dispositions juridiques incluses dans ces accords ?La thèse utilise une approche d'étude de cas comparative pour répondre à ces questions, analysant la politique de trois négociateurs ouest-européens importants de ces traités :la République fédérale d’Allemagne, la Suisse et les Pays-Bas. Abstract

It is widely taught that the way in which the occupation took place has no effect neither on the rights and obligations of the occupied territories (OT), the inhabitants and the occupied State, nor on the rights and duties of the Occupying Power (OP). No matter whether the occupation is a consequence of a lawful use of force or an illegal aggression: the rights and duties that rely upon the several actors should be the same. However, since the occupation results from an illegal use of force, States and International Organisations (IO’s) have a legal duty not to recognise the consequences of this illegal use of force (see art. 41, par. 2, ARSIWA). This is the case, for instance, in illegally annexed Ukrainian territories or in Nagorno-Karabakh. Therefore, one can ask to what extent the effective control of the OP can produce legal effects. As a matter of principle, under the so-called “Namibia Exception” States and IO’s can recognise some acts linked to the day-to-day life of the inhabitants of the OT, like the registration of birth, death and marriage certificates (cf. ICJ, Namibia Advisory Opinion, 1971, par. 125).How can one deal with both sets of rules: occupation law on one side, and duty not to recognise the consequence of an illegal use of force on the other side ?Two main issues are at stake in my research:(1) Which acts adopted by an illegal OP are recognised by other States and on which basis ?(my preliminary results show that the criteria of “day-to-day life” or “ordinary administration” are not satisfactory to explain the decisions of recognition adopted by municipal courts. 1. On désigne généralement par « exception Namibie » la possibilité de reconnaître certaines conséquences d’une violation grave d’une norme de jus cogens, malgré l’existence d’une obligation coutumière de non-reconnaissance des conséquences d’une telle violation grave. Cette possibilité a été formulée par la Cour internationale de Justice (CIJ) dans un avis de 1971 sur les conséquences juridiques de la présence de l’Afrique du Sud en Namibie malgré une résolution contraire du Conseil de sécurité des Nations Unies — d’où son nom. D’après la CIJ, l’obligation de non-reconnaissance « ne devrait pas avoir pour conséquence de priver le peuple namibien des avantages qu’il peut tirer de la coopération internationale (…). [La nullité qui découle de l’obligation de non-reconnaissance] ne saurait s’étendre à des actes, comme l’inscription des naissances, mariages ou décès à l’état civil, dont on ne pourrait méconnaître les effets qu’au détriment des habitants du territoire » en question. 2. La possibilité de reconnaître des effets juridiques à certaines conséquences d’une violation grave d’une norme impérative de droit international était en réalité déjà présente dans des décisions de juges nationaux et se manifestait également dans des pratiques gouvernementales avant sa consécration par la CIJ dans son avis précité de 1971. Reste à voir comment les juges internes ont été influencés par cette formulation adoptée par la CIJ, et inversement. 3. En amont, il est assez aisé, nous semble-t-il, de montrer l’influence d’une jurisprudence états-unienne bien précise sur la formulation finalement retenue par la CIJ. En aval, on peut alors se demander si les juges internes se sont saisis de cette formulation frappée désormais du sceau de la CIJ ou bien s’ils l’ont ignorée. S’ils y font référence, est-ce plutôt pour suivre la position exprimée par la CIJ ou pour s’en affranchir ?
