The article examines the application of trademark law to purchased keywords and online trademark infringement cases and reflects that courts should presume a low standard of consumer care and sophistication in online trademark case and protect the interests of the public. It highlights the U.S. Court of Appeals for the Ninth Circuit decision in Network Automation, Inc. v. Advanced Systems Concepts, Inc. that trademark law should adopt high sophistication for Internet consumers.

Abstract

This article discusses how the United States Senate has passed a bill that would strengthen the Freedom of Information Act (FOIA), closing any loopholes. The vote ended a deadlock on the measure and has brought the FOIA one step closer to reform. The aim of the legislation is to create a tracking system for FOIA requests. Expanding current reporting standards for agency compliance, establishing penalties for agencies that do not respond to requests within the limits of the law, and enabling requesters to collect attorney fees if necessary are aspects that are included within the legislation.

This article discusses Freedom of Information laws, the fighting over alleged government and agency abuse of these laws, and how governments are beginning to defend themselves against these assertions. Citizen watchdogs in Texas and journalists in Virginia have become the targets of restrictive state laws that are aimed at curtailing public records requests. In June 2007, the Town Council of Herndon, Virginia passed an ordinance seeking to charge requesters an hourly rate for the staff who fill these requests, which would then consequently increase the cost of public records requests.

This article discusses how technology has revolutionized how information is created and stored and the impact that computers and databases have had on media access. Journalists have found that acquiring digital records has become an obstacle because of the format, not the content. Public officials and agencies have a variety of lawful reasons for denying digital public records, which parallel those for paper documents. Agencies are nor required to create a record if what is requested does not exist, nor are they obligated to reprogram data to meet the requester's needs.
