According to certain authors, the genetic tests entail the exclusion of agents from the insurance market. For that reason, several individuals advocate in the name of ethical principles to ban the use of genetic tests on the market. However if for the ethical reasons, the information remains private, the contract of solidarity which insures a complete mutualization of the risk and an access equal to all to the insurance market can be threatened. The agents themselves can use this information either to lower their premium if they are low risk agents either to increase their insurance demand if they are high risk agents. This situation can induce an adverse selection phenomenon. In this article, we look for the consequences of ethical principles on the insurance market. We show that sometimes it is rational to let genetic information as public information., Les tests génétiques entraînent selon certains auteurs l’exclusion d’agents du marché d’assurance. Pour cette raison, plusieurs individus prônent au nom de principes éthiques, l’interdiction de l’usage des tests génétique sur le marché. Cependant, si l’information génétique reste privée, le contrat de solidarité qui assure une mutualisation complète du risque et un accès égal à tous au marché d’assurance peut être menacé. Les agents eux- mêmes peuvent utiliser cette information génétique soit pour faire baisser leur prime lorsqu’ils ont un bon patrimoine génétique soit pour accroître leur demande d’assurance en cas de gènes défectueux dans leur patrimoine héréditaire. The genetic tests spread in almost all the domains of the society. However, several authors following the example of Penacino and al. (2003) pull the alarm bell and draw the attention on the deceptive results that the genetic tests can engender. On the insurance market, the lack of reliability of the genetic tests is sometimes one of the reasons evoked by the insurers to go without the genetic information. In our analysis, we show that the use of the genetic tests, even with a lack of reliability, will not prevent the insurance market from working well. First of all, we characterized the insurance market. Because of the error on a test, the low-risk agents keep present in the spirit that they have a chance to be high-risk agent and the high-risk agents the hope to have a chance to be good risk. Consequently, the market will consist of pessimistic low-risk agents and optimistic high-risk agents. Then, we tried to determine contracts offered on the market. When the insurer has no same faiths as the agents, the offered contracts can go of a pooling contract to a menu of partial insurance contracts. On the other hand, if the insurer has the same faiths as the policyholders, he offers to the optimists a full insurance contract and at the pessimists a contract with partial coverage. The full insurance contract of the optimists is however different from the full insurance contract of Stiglitz (1977 ) in the sense that the agents have a higher utility., Longtemps considérés comme fiables, les tests génétiques se répandent dans quasiment tous les domaines de la société. Sur le marché d'assurance, le manque de fiabilité des tests génétiques est parfois l'une des raisons évoquées par les assureurs pour se priver de l'information génétique. Dans notre analyse, nous montrons que l'utilisation des tests génétiques même avec un manque de fiabilité n'empêchera pas le marché d'assurance de bien fonctionner. Tout d'abord nous avons caractérisé le marché. A cause de l'erreur sur un test, les bons risques gardent présent à l'esprit qu'ils ont une chance d'être mauvais risque et les mauvais risques l'espoir d'avoir une chance d'être bon risque. Par conséquent, le marché sera composé de bons risques pessimistes et de mauvais risques optimistes. Ensuite, nous avons cherché à déterminer les contrats offerts sur le marché. Lorsque l'assureur n'a pas les mêmes croyances que les agents, les contrats offerts peuvent aller d'un unique contrat à un menu de contrats d'assurance partielle. En revanche, si l'assureur a les mêmes croyances que les assurés, il offre aux mauvais risques optimistes un contrat de pleine assurance et aux bons risques pessimistes un contrat à couverture partielle. Le contrat de pleine assurance des mauvais risques optimistes est cependant différent du contrat de pleine assurance de Stiglitz (1977) en ce sens que les agents ont une plus grande utilité.

Informational asymmetries in insurance markets can be overcome by offering dynamic contracts with experience rating. Such a result has been theoretically demonstrated by Cooper and Hayes (1987) in both monopolistic and competitive environment and is widely used by practitioners. The purpose of this article is to extend the Cooper and Hayes results to take into account the Bayesian updating of beliefs by the insurers. It is motivated by the observed fact that, in health insurance markets, some diseases have higher recurrence probabilities for gene carriers than for non-carriers. We show that, in a two-period monopolistic setting, the updating of beliefs in the second period is detrimental to the high risks that have supported a disease in the first period: these individuals can no longer get full insurance as they did in the Cooper and Hayes setting. When allowing entrants, experience rating is no longer available to supply contracts to high risk individuals. Competition is still beneficial to all individuals but detrimental to the incumbent company that is forced to forsake its profits to keep its clientele., Sous certaines hypothèses, les asymétries d'information sur un marché d'assurance peuvent être résolues par l'offre d'un menu de contrats dynamiques permettant de tenir compte des informations révélées, notamment de la sinistralité des assurés, au cours du temps. L'objectif de cet article est d'étendre le modèle de Cooper et Hayes (1987), lorsque l'assureur révise les probabilités de sinistre des assurés au cours du temps. En effet, en assurance santé, certaines pathologies ont des probabilités de récidive plus importantes, lorsque les individus sont porteurs d'un gène altéré. On envisage tour à tour les situations de monopole et de concurrence. En situation de monopole, on montre que la déformation de la probabilité nuit fondamentalement aux mauvais risques sinistrés de première période. En effet, au cours de la seconde période, ces agents n'obtiennent plus l'assurance complète comme dans les prédictions de Cooper et Hayes (1987), mais une assurance partielle, et voient leur utilité baisser. En revanche, les bons risques obtiennent toujours l'assurance partielle. En outre, l'ensemble des assurés est tarifé à l'expérience. A contrario, l'entrée de compagnies concurrentes annihile la tarification à l'expérience des mauvais risques. Cette situation est cependant bénéfique pour tous les assurés, mais nuit à la compagnie installée qui est obligée de renoncer à son profit monopolistique pour garder une partie de sa clientèle.
