The objective of this retrospective observational study was to study the long-term outcome of exercise capacity and quality of life during management of patients with COPD treated by home-based PR.Methods: Home-based PR was administered to 211 patients with COPD (mean age, 62.3±11.1 years; mean forced expiratory volume in 1 second, 41.5%±17.7%). Home-based PR was chosen because of the distance of the patient’s home from the PR center and the patient’s preference. Each patient was individually managed by a team member once a week for 8 weeks with unsupervised continuation of physical exercises on the other days of the week according to an individual action plan. Exercise conditioning, therapeutic patient education, and self-management were included in the PR program. The home assessment comprised evaluation of the patient’s exercise capacity by a 6-minute stepper test, Timed Up and Go test, ten times sit-to-stand test, Hospital Anxiety and Depression score, and quality of life (Visual Simplified Respiratory Questionnaire, VQ11, Maugeri Respiratory Failure 28).Results: No incidents or accidents were observed during the course of home-based PR. The 6-minute stepper test was significantly improved after completion of the program, at 6 months and 12 months, whereas the Timed Up and Go and ten times sit-to-stand test were improved after PR and at 6 months but not at 12 months. Hospital Anxiety and Depression and quality of life scores improved after PR, and this improvement persisted at 6 months and 12 months.Conclusion: Home-based PR for unselected patients with COPD is effective in the short term, and this effectiveness is maintained in the medium term (6 months) and long term (12 months). Home-based PR is an alternative to outpatient management provided all activities, such as exercise conditioning, therapeutic education, and self-management are performed. 3. International arbitrators are humans after all : the psychology of arbitral decision-making

Abstract

The thesis offers a behavioural analysis of international arbitration by digging deeply into the psychology of judgment and decision-making. It aims to understand how arbitrators really make their decisions and how this behaviour then influences the content of arbitral awards and outcomes of disputes. It therefore responds to the epistemology of legal realism by using a behavioural law and economics methodology and endorses the indeterminacy of the law and the bounded rationality of individuals. Despite mastering legal reasoning, international arbitrators are still human beings and their psychology will therefore influence their decision-making. To account for this, the thesis creates two behavioural models of arbitral decision-making building on psychological theories and the US judicial decision-making literature when relevant: one cognitive and the other social. Each heuristic model maps out as many behavioural influences that may impact the decision-making of international arbitrators acting as sole arbitrators or as members of an untenured tribunal. This theoretical application of psychology to international arbitration for creating these models in the first place is then followed by an empirical evaluation of specific cognitive, motivational, and social influences. This evaluation, addressing how arbitrators process the information presented to them by the parties, allows for a comprehensive view of the bounded rationality of individuals, while considering the extent of these behavioural factors in international arbitration. The test of these cognitive, motivational, and social (here, group decision-making) theories applied to the arbitral framework consists in semi-structured interviews conducted with members of the arbitral community (i.e., international arbitrators and tribunal secretaries), a qualitative analysis of investment arbitral awards available to the public, and a comparative analysis of the judicial and arbitral frameworks. The thesis concludes on the impact of behavioural influences on arbitral decision-making, identifies areas for future research, and formulates brief prescriptions (e.g., procedural interventions, institutional design, and training) in order to control the behavioural influences that are conducive to decision-making errors and promote the ones that are rather beneficial.

10. Reviewing the Arbitration Act 1996

Abstract

The (English) Arbitration Act 1996 is currently under review by the Law Commission as it turns 27 this year. This article analyses its Consultation Paper released in September 2022, and which contains preliminary recommendations for an update of the Arbitration Act. This analysis reveals that some issues considered by the Law Commission are not new since they had already been identified by the Departmental Advisory Committee on Arbitration Law prior to the adoption of the Arbitration Act 1996. In fact, some of these concerns were unable to be settled back in the 1990s, and still are to some extent 27 years later. For other issues, however, the Law Commission attempts to draw on recent developments in arbitral practice and contemporary challenges (such as climate change and technological advances) though at times failing to integrate them in an updated Act. 12. Biased or Not Biased? Arbitral Decision-Making and Arbitrators’ Preferences

Abstract

International arbitration is a means of dispute settlement often privileged over litigation. One reason for this lies in the possibility for the parties to appoint their own arbitrator. However, despite party-appointed, international arbitrators should still be independent and impartial. Yet, parties spend considerable time and resources to appoint the ‘right’ arbitrator. Since partisanship is prohibited, why is this the case and what makes a ‘right’ arbitrator then? The psychological and judicial literatures have both already extensively demonstrated that one’s initial preferences and background do influence their decision-making to even determine legal outcomes, with or without their conscious awareness. Against this background, the article investigates the use of confirmatory strategies in arbitral decision-making; strategies which could be consciously used (amounting to partisanship) but which are also inherent to human cognition and thus intuitively used. This behavioural analysis of arbitration is supported by qualitative analyses using semi-structured interviews and arbitral awards.

Abstract

This post-hoc analysis of the AIRFLOW-2 trial investigated the changes in airway CT-parameters after targeted lung denervation (TLD) and whether these changes are associated with treatment response. In the treatment group (n = 32), an improvement in air trapping was significantly associated with an improvement in residual volume (RV). Furthermore, improvements in Pi10 and airway lumen were significantly associated with an improvement in both RV and FEV1. Our results could suggest that when improving airway characteristics like decreasing airway wall thickness and increasing the airway lumen, this leads to less air trapping and an improvement in clinical outcomes.

Abstract

Rationale: Targeted lung denervation (TLD) is a novel bronchoscopic treatment for the disruption of parasympathetic innervation of the lungs. Objectives: To assess safety, feasibility, and dosing of TLD in patients with moderate to severe COPD using a novel device design. Methods: Thirty patients with COPD (forced expiratory volume in 1 s 30-60%) were 1:1 randomized in a double-blinded fashion to receive TLD with either 29 or 32 W. Primary endpoint was the rate of TLD-associated adverse airway effects that required treatment through 3 months. Assessments of lung function, quality of life, dyspnea, and exercise capacity were performed at baseline and 1-year follow-up. An additional 16 patients were enrolled in an open-label confirmation phase study to confirm safety improvements after procedural enhancements following gastrointestinal adverse events during the randomized part of the trial. Results: Procedural success, defined as device success without an in-hospital serious adverse event, was 96.7% (29/30). The rate of TLD-associated adverse airway effects requiring intervention was 3/15 in the 32 W versus 1/15 in the 29 W group, p = 0.6. Five patients early in the randomized phase experienced serious gastric events. The study was stopped and procedural changes made that reduced both gastrointestinal and airway events in the subsequent phase of the randomized trial and follow-up confirmation study. Improvements in lung function and quality of life were observed compared to baseline values for both doses but were not statistically different. Abstract

This article introduces the findings of social psychology, especially group psychology, into the study of investment arbitration. It argues that arbitrators as members of small groups (i.e. tribunals or divisions in an Investment Court) might be subjected to a number of influences inherent to such collective settings—factors already proven to be at play in domestic courts. In turn, identifying those factors provides an opportunity to reduce their impact on the decision-making of legal adjudicators through the implementation of adequate remedies. Adopting one of the most popular models of group decision-making—groupthink— this article discusses the manifestations and implications of this theory for Investor-State Dispute Settlement both in its ad hoc and institutionalized forms. Specifically, it claims that the Investment Court defended by the EU and generally posited in some agreements might not be that different from the current system from a socio-psychological perspective, and hence could be further improved.

Abstract

This chapter assesses the introduction of artificial intelligence in international arbitration. The contention is that it would not only reinstate confidence in the arbitral system—from the perspective of the parties and the general public—and participate in the development of the rule of law, but also engage with broader systemic considerations in enhancing its legitimacy, fairness, and efficiency. Yet, before addressing the why, what, and how of this proposition, a definition of artificial intelligence is warranted. It should be noted at the outset that this concept has a variety of meanings. Despite the lack of consensus on its meaning, the chapter will thus treat artificial intelligence as encompassing both semi-autonomous and autonomous computer systems dedicated to assisting or replacing human beings in decision-making tasks. It presents the conclusions of two extensive research programs respectively dealing with the performance of statistical models and naturalistic decision-making. From that behavioural analysis, the introduction of artificial intelligence in international arbitration be discussed against the general considerations of international adjudication and the specific goals pertaining to international arbitration.

Abstract

International audience; Rationale: Lumacaftor-ivacaftor is a CFTR (cystic fibrosis transmembrane conductance regulator) modulator combination recently approved for patients with cystic fibrosis (CF) homozygous for the Phe508del mutation.Objectives: To evaluate the safety and effectiveness of lumacaftor-ivacaftor in adolescents (≥12 yr) and adults (≥18 yr) in a real-life postapproval setting.Methods: The study was conducted in the 47 CF reference centers in France. All patients who initiated lumacaftor-ivacaftor from January 1 to December 31, 2016, were eligible. Patients were evaluated for lumacaftor-ivacaftor safety and effectiveness over the first year of treatment following the French CF Learning Society's recommendations.Measurements and Main Results: Among the 845 patients (292 adolescents and 553 adults) who initiated lumacaftor-ivacaftor, 18.2% (154 patients) discontinued treatment, often owing to respiratory (48.1%, 74 patients) or nonrespiratory (27.9%, 43 patients) adverse events. In multivariable logistic regression, factors associated with increased rates of discontinuation included adult age group, percent predicted FEV1 (ppFEV1) less than 40%, and numbers of intravenous antibiotic courses during the year before lumacaftor-ivacaftor initiation. Patients with continuous exposure to lumacaftor-ivacaftor showed an absolute increase in ppFEV1 (+3.67%), an increase in body mass index (+0.73 kg/m2), and a decrease in intravenous antibiotic courses by 35%. Patients who discontinued treatment had significant decrease in ppFEV1, without improvement in body mass index or decrease in intravenous antibiotic courses.Conclusions: Lumacaftor-ivacaftor was associated with improvement in lung disease and nutritional status in patients who tolerated treatment. Adults who discontinued lumacaftor-ivacaftor, often owing to adverse events, were found at high risk of clinical deterioration.

Abstract

The doubly-labeled water method uses naturally occurring stable isotopes of water ([H.sub.2] 18O and [D.sub.2]O) to assess energy expenditure, body composition and water flux in animals and humans. The technique is relatively noninvasive (a few blood or urine samples over 2 wk) and is performed in free living conditions during a period of between 5 and 20 d. This is the first report of the use of the method in three cats and two dogs. The measured energy expenditure during 11 d was 207 [+ or -] 12 and 263 kJ [center dot] [kg.sup.-1] [center dot] [d.sup.-1] for cats and dogs, respectively. These values were 30 and 10% lower, respectively, than NRC recommendations for energy requirement (NRC 1985, NRC 1986). The percentage body fat was 23 [+ or -] 5% in the three cats and 35% in the two dogs used in this study. The water output (urine + breath) was 36 [+ or -] 4 ml [center dot] [kg.sup.-1] [center dot] [d.sup.-1] for the cats and 60 ml [center dot] [kg.sup.-1] [center dot] [d.sup.-1] for the dogs. Of the water output, 23% (cats) and 17% (dogs) was lost as insensible water loss. The precision and accuracy of the method are discussed in relation to the assumptions made with this technique and by comparison with published values. Abstract

Cats conjugate their bile acids with taurine but are unable to synthesize sufficient quantities of this amino acid to meet their needs. To maintain the same blood taurine level, canned foods must contain more taurine than dry foods. In the present study we examined the effect of soluble fiber on fecal bile acid excretion and taurine status and compared the quantity and profile of fecal bile acids in cats fed canned and dry diets. In a cross-over design, 10 adult cats were fed a typical canned diet containing 0.25% kappa carrageenan with or without the addition of 0.5% guar gum (2.5% on a dry matter basis) for 6 wk. All cats were then transferred to a dry diet. The addition of guar gum to the canned diet had no significant effect on taurine status, but the dry diet, which contained less taurine than the canned diet, resulted in an increase in plasma taurine. With the dry diet, total bile acid excretion was reduced by [approximately]65%. The profile of bile acids in feces was also radically different with a marked decrease in secondary bile acids. This work suggests that when canned rather than dry diets are fed, the conversion of primary to secondary bile acids is greater and is indicative of an alteration in the activity of the gut flora that may lead to an increase in taurine degradation. Rationale: Targeted lung denervation (TLD) is a bronchoscopic radiofrequency ablation therapy for chronic obstructive pulmonary disease (COPD), which durably disrupts parasympathetic pulmonary nerves to decrease airway resistance and mucus hypersecretion.Objectives: To determine the safety and impact of TLD on respiratory adverse events.Methods: We conducted a multicenter, randomized, sham bronchoscopy-controlled, double-blind trial in patients with symptomatic (modified Medical Research Council dyspnea scale score, ≥2; or COPD Assessment Test score, ≥10) COPD (FEV1, 30-60% predicted). The primary endpoint was the rate of respiratory adverse events between 3 and 6.5 months after randomization (defined as COPD exacerbation, tachypnea, wheezing, worsening bronchitis, worsening dyspnea, influenza, pneumonia, other respiratory infections, respiratory failure, or airway effects requiring therapeutic intervention). Blinding was maintained through 12.5 months.Measurements and Main Results: Eighty-two patients (50% female; mean ± SD: age, 63.7 ± 6.8 yr; FEV1, 41.6 ± 7.3% predicted; modified Medical Research Council dyspnea scale score, 2.2 ± 0.7; COPD Assessment Test score, 18.4 ± 6.1) were randomized 1:1. During the predefined 3- to 6.5-month window, patients in the TLD group experienced significantly fewer respiratory adverse events than those in the sham group (32% vs. 71%, P = 0.008; odds ratio, 0.19; 95% confidence interval, 0.0750-0.4923, P = 0.0006). Between 0 and 12.5 months, these findings were not different (83% vs. 90%; P = 0.52). The risk of COPD exacerbation requiring hospitalization in the 0- to 12.5-month window was significantly lower in the TLD group than in the sham group (hazard ratio, 0.35; 95% confidence interval, 0.13-0.99; P = 0.039). There was no statistical difference in the time to first moderate or severe COPD exacerbation, patient-reported symptoms, or other physiologic measures over the 12.5 months of follow-up.Conclusions: Patients with symptomatic COPD treated with TLD combined with optimal pharmacotherapy had fewer study-defined respiratory adverse events, including hospitalizations for COPD exacerbation.Clinical trial registered with www.clinicaltrials.gov (NCT02058459).

43. Y a-t-il une place pour l’exploration à l’exercice chez l’asthmatique ?

Resume L’asthme est une maladie inflammatoire chronique qui s’exprime par des situations cliniques variees allant de l’asthme intermittent a l’asthme persistant severe avec des degres divers de controle de la maladie. Malgre le developpement des therapeutiques, une partie des patients asthmatiques, quel que soit leur severite, presentent une dyspnee d’effort inexpliquee. L’epreuve fonctionnelle a l’exercice (EFX) peut permettre de mieux apprehender les mecanismes de cette dyspnee et de faire la difference entre la part liee au syndrome obstructif et la part liee a des facteurs aggravants. Nous avons effectue une etude preliminaire chez 64 patients repartis en deux groupes, presentant soit un asthme persistant leger a modere soit un asthme persistant severe. Bien que le VEMS des asthmatiques severes soit plus bas, il n’y avait aucune difference d’aptitude aerobie entre les deux groupes. En revanche, il existait une reponse ventilatoire differente entre les deux groupes avec l’apparition d’une hypoventilation alveolaire relative chez les asthmatiques severes et une tachypnee plus marquee chez les asthmatiques legers a moderes. Dans ce dernier groupe, on observait egalement un deconditionnement plus frequent. Dans plus de la moitie des cas, le facteur limitant n’etait pas lie a l’obstruction bronchique mais a une hyperventilation inappropriee, un deconditionnement, une dysfonction des cordes vocales, une cardiopathie ou une hypertension pulmonaire, justifiant d’adapter la prise en charge sans majorer le traitement anti-asthmatique. L’EFX a donc toute sa place dans l’exploration de la dyspnee des patients asthmatiques. Elle permet de guider les therapeutiques en donnant la possibilite de diminuer les traitements antiasthmatiques s’il existe un facteur aggravant associe et en proposant une rehabilitation respiratoire chez les patients les plus susceptibles d’en beneficier.

Abstract

International audience; Introduction: The 6-min stepper test (6MST) has been used as an alternative to the 6-min walk test (6MWT) to assess exercise tolerance in patients with interstitial lung disease (ILD). Recent data suggest that the tests may involve different energy pathways and cardiorespiratory responses. We thus aimed to compare the cardiorespiratory responses of ILD patients during the 6MWT and the 6MST.Methods: Thirty-one patients with ILD were randomized to perform both tests in the order 6MST → 6MWT (n = 16) or 6MWT → 6MST (n = 15). Gas exchange, HR, and pulse O2 saturation (SpO2) were measured continuously, and dyspnoea, leg discomfort, and blood lactate concentration were assessed before and immediately after each test.Results: Oxygen uptake (V˙O2) was lower (P = 0.002) and respiratory equivalent ratio for O2 (V˙E/V˙O2) and RER were higher (both P < 0.001) during the 6MST compared with the 6MWT. The 6MST was also associated with higher blood lactate concentrations (6MST, 4.16 ± 1.95 mmol·L; 6MWT, 2.84 ± 1.17 mmol·L; P = 0.01), higher leg discomfort scores (6MST 5 ± 3 points, 6MWT 3 ± 2 points; P < 0.001), and smaller decreases in SpO2 (6MST -5% ± 5%, 6MWT -9% ± 6%; P < 0.001).Conclusions: ILD patients exhibited greater ventilatory responses and lower arterial O2 desaturation during the 6MST compared with the 6MWT. The higher lactate concentrations and perceived muscle fatigue observed during the 6MST may indicate the presence of intertest differences in active muscle metabolism that could contribute to the distinct cardiorespiratory responses.

Abstract

Background: Exercise-induced arterial O 2 desaturation impacts the management of interstitial lung diseases (ILD). Recent data suggest that arterial O 2 desaturation is more severe during the 6-minute walk test (6MWT) than during the 6-minute stepper test (6MST) in ILD patients. Aims: We hypothesized that a higher ventilation (VE) during the 6MST facilitates the alveolo-arterial oxygen diffusion, minimizing O 2 desaturation. Our aim was to investigate differences in ventilator responses and gas exchange during 6MST and 6MWT. Methods: Twenty-nine patients with ILD performed a 6MWT and a 6MST in a random order. Gas exchange, heart rate (HR), and oxygen pulse saturation (SpO 2 ) were measured continuously and leg discomfort (LD) was quoted on a 10-point Borg Scale, before and at the end of each test. Results: At rest no difference in HR, VE and VO 2 was observed before both tests. As expected, the decrease in SpO 2 was significantly lower during the 6MST than during the 6MWT (-5 ± 5% vs -9 ± 7%, p 2 ) was lower (p=0.01), but VE/VO 2 and respiratory exchange ratios were higher during 6MST than during 6MWT (p vs 3 ± 2, p=0.003). Conclusion: The higher VE/VO 2 ratio may have contributed to the lower O 2 desaturation during the 6MST. The higher muscle fatigue perceived during 6MST, possibly also indicated differences of active muscle metabolism, which probably contributed to the different ventilatory responses and arterial O 2 desaturation between both tests.

Abstract

International audience; In support of the international effort to obtain a reference sequence of the bread wheat genome and to provide plant communities dealing with large and complex genomes with a versatile, easy-to-use online automated tool for annotation, we have developed the TriAnnot pipeline. Its modular architecture allows for the annotation and masking of transposable elements, the structural, and functional annotation of protein-coding genes with an evidence-based quality indexing, and the identification of conserved non-coding sequences and molecular markers. The TriAnnot pipeline is parallelized on a 712 CPU computing cluster that can run a 1-Gb sequence annotation in less than 5 days. It is accessible through a web interface for small scale analyses or through a server for large scale annotations. The performance of TriAnnot was evaluated in terms of sensitivity, specificity, and general fitness using curated reference sequence sets from rice and wheat. In less than 8 h, TriAnnot was able to predict more than 83% of the 3,748 CDS from rice chromosome 1 with a fitness of 67.4%. On a set of 12 reference Mb-sized contigs from wheat chromosome 3B, TriAnnot predicted and annotated 93.3% of the genes among which 54% were perfectly identified in accordance with the reference annotation. It also allowed the curation of 12 genes based on new biological evidences, increasing the percentage of perfect gene prediction to 63%. TriAnnot systematically showed a higher fitness than other annotation pipelines that are not improved for wheat. As it is easily adaptable to the annotation of other plant genomes, TriAnnot should become a useful resource for the annotation of large and complex genomes in the future.

The objective of this retrospective observational study was to study the long-term outcome of exercise capacity and quality of life during management of patients with COPD treated by home-based PR.Methods: Home-based PR was administered to 211 patients with COPD (mean age, 62.3±11.1 years; mean forced expiratory volume in 1 second, 41.5%±17.7%). Home-based PR was chosen because of the distance of the patient’s home from the PR center and the patient’s preference. Each patient was individually managed by a team member once a week for 8 weeks with unsupervised continuation of physical exercises on the other days of the week according to an individual action plan. Exercise conditioning, therapeutic patient education, and self-management were included in the PR program. The home assessment comprised evaluation of the patient’s exercise capacity by a 6-minute stepper test, Timed Up and Go test, ten times sit-to-stand test, Hospital Anxiety and Depression score, and quality of life (Visual Simplified Respiratory Questionnaire
