22. Interviewing vulnerable suspects arrested for homicide offences : the working practices of detectives and third parties

Abstract

The aim of this research is to critically explore the working practices of detectives and third parties involved in the detention and interviewing of vulnerable suspects, who have been arrested on suspicion of committing homicide (and attempted murder) offences in England and Wales. Vulnerable suspects (juveniles under 18 years of age and adults with a mental health condition or mental disorder (Code C PACE)) are over-represented within the criminal justice system (Loucks, 2007; Bradley, 2009) and are at a higher risk of making false confessions or being unable to act in their best interests during a suspect interview (Gudjonsson, 2003). Those who are arrested on suspicion of committing homicide offences can be detained in custody for up to 96 hours and may experience lengthy and complex interviews, potentially exacerbating their vulnerability. Therefore, it is important to explore how these interviews take place and whether the safeguards that vulnerable suspects are entitled to enable fair treatment. This research explores what takes place prior to and during the suspect interview and the working practices of detectives and third parties (e.g., the appropriate adult (AA) and legal advisor). To achieve this aim, a case study design was employed. Fieldwork was undertaken between July 2018 and January 2020. 125 police suspect interviews and 29 custody records were analysed for 27 vulnerable suspects on 26 investigations, across three police forces. This was supplemented with 37 semi-structured interviews with police officers, AAs and legal advisors. This research identified that detectives and third parties do not always adhere to the rules and guidance which govern the detention and interviewing of vulnerable suspects. Theoretical explanations include police culture and pro-social rule-breaking and these highlight the tensions between the crime control objectives of the police, which prioritise obtaining an evidential account from a suspect, and the due process or welfare objectives of third parties. The research concludes that vulnerable suspects are not always treated fairly, and the implications of these findings for policy and practice are explored. This thesis proposes that the rules which govern the practices of detectives and third parties need to be defined clearly, and that when breaches occur those responsible are held accountable. Proposals also include specialist training (similar to a 'Tier' system) for AAs to prepare them for participation in major crime interviews.

Abstract

To effectively protect critical infrastructure, it is essential to identify vulnerable areas for priority protection. The use of geographic information systems has increased over the last few decades for crime activity and the identification of delinquency hotspots. This study analyzes the areas of a power grid that are exposed to a higher than the average risk of terrorist attacks. One of the concerns for operation managers and policy makers is that subversive groups may have “inside” information to perform the attacks and create a critical failure that puts more pressure on the operational condition of the power grid. We use exploratory spatial data analysis (ESDA) and information from the Colombian power grid to prompt the question: why hotspots emerge in some parts of the power grid, but not in others? The theoretical framework of attacks in the power grid operation exists but need to be corroborated with historical events that reflect such possible way of action. To this end, we perform a Getis-Ord Gi* hotspot analysis to direct attention to areas that are both under attack and critical in terms of operational risks that could affect the reliability and provision of critical services such as power generation and distribution. This subnational case study of Colombia uses data from XM and InterColombia (managers and operators of the Colombian power grid) to identify the areas of electrical infrastructure that have been most attacked and explain the motivations at the local level that the subversive groups have had to attack these areas.

30. Utilising routine population healthcare data for epidemiological research and quality improvement in care : application of a national acute kidney alerting system as a proof of concept

Abstract

Acute kidney injury (AKI) is a global health issue known to cause avoidable harm and death. Improvement in its prevention and management is therefore considered an important goal for the healthcare sector. While improvement science states that without measurement, improvement is not possible, at the outset of this research, the epidemiology of AKI was also not fully understood. Whereas numerous studies had described AKI that is developed during hospitalisation, less had focused on that developed in the community. This healthcare informatics thesis centres on the proposed utilisation of routine serum creatinine (SCr) data for informing both the epidemiology of AKI, and improvement in care for patients who develop and/or are at risk of AKI. It follows the recent implementation of an automated laboratory-based electronic alerting system for AKI across the entire Welsh National Health Service which, in addition to its primary purpose of aiding early intervention, also had potential to be applied as a centralised system of data collection. The first of three projects documented in the portfolio style thesis involves development of processes to systematically extract, cleanse and classify data on electronic (e)-alerts transmitted by the algorithm of the aforementioned system. This author's work results in a data set which is suitable for analysis and enables reliable identification of all AKI occurring in the Welsh population, including that which is hospital and community acquired. Following this is project two and presentation of a series of peer-reviewed studies by the author which, by utilising the described novel data set, include some of the first comprehensive, population-based descriptions of AKI and its associated factors known to date. Project three follows with further practical examples of work by the author to demonstrate the potential of the same data set. It begins with studies by the author which, in helping end-users better understand the significance of AKI e-alerts, could allay speculation healthcare providers and professionals may have regarding their clinical utility. It closes by presenting a prototype of a tool which, via application of statistical process control techniques and indicators developed by the author, provides a means to robustly measure, and identify variation in, quality of healthcare provision related to AKI in Wales, a mechanism which did not exist prior. The original contribution to knowledge is the methodological development of a new national data source for AKI, and the demonstration and conclusion that these large validated data provide unique opportunity to reliably inform the epidemiology of, and quality improvement in healthcare provision for, AKI. Work on and of this scale and scope is yet to be achieved elsewhere. This thesis therefore significantly adds to the literature to which it relates. To validate its contribution, and support its overall conclusion, the peer-reviewed status of the author's 14 published works appended and presented throughout are offered. Finally, while the work here concerns SCr and AKI, it is also presented as a wider proof of concept which in theory could be replicated for other routine laboratory-based healthcare data, to improve the epidemiological understanding and management of other health conditions.

Abstract

Although Colombia is well known for its persistent leftist guerrilla conflict, the country also suffers from paramilitary violence. This study examines the potential factors related to persistent paramilitary violence in the form of human rights violations. How has paramilitary activity, and its causes, changed over time? Why does it persist in some areas after Uribe’s demobilization process but not in others? We use multilevel modeling to explore the determinants of paramilitary human rights violations. A varied range of aspects potentially associated with the paramilitary presence at the municipal level for the period 2002–2015, such as state presence, resources, greed, grievances and conflict are analyzed. The study uses information about paramilitary human rights violations from the Centro de Investigación y Educación Popular (CINEP). Results suggest that the demobilization process reduced the initial paramilitary motivation to fight against leftist guerrilla. However, other factors such as coca cultivation or ranching remained significantly related to the paramilitary activity. The analysis at the municipal level provides clear warnings for continued violence cycles threatening any undergoing or future peace processes or demobilizations and calls for a more nuanced concept of state capacity to understand paramilitary violence.

Abstract

The oil and gas sectors in Colombia are significant components of the Colombian economy, attracting approximately 20% of the FDI, and providing almost a fourth of total government revenues. These sectors of critical infrastructure have suffered systematic targeting from guerrilla internal conflict. For example, the hydrocarbons infrastructure was attacked 829 times between 2007 and 2015. With data from the Ministry of Defense and data from CINEP (Centro de Investigación y Educación Popular), we compare spatial patterns of pipeline attacks with violent activity of the two main leftist guerrilla groups, the ELN and the FARC. We use local indicators for spatial association (LISA) to determine overlapping among high activity and presence (hot spots) of guerrilla presence and pipeline attacks. We identify vulnerable areas of the pipeline infrastructure that the government should prioritize for protection, and examine if areas of attacks are related to the general presence and activity of guerrilla groups or if there is evidence of strategic targeting of the pipelines.

Abstract

On August 13-14, 2019, the Healthcare Nutrition Council and the ASN held the Medical Foods Workshop: Science, Regulation, and Practical Aspects. Medical food products help patients manage their disease and improve their quality of life. Yet many hurdles exist to getting patients new products. In this workshop, participants addressed some of these hurdles, with specific emphasis on topics like the statutory term distinctive nutritional requirements, the regulatory term modification of the diet alone, the role of clinical guidelines, the requirement that medical foods be used under medical supervision, and differentiation of foods for special dietary use from medical foods, as well as product innovation and future research. Real-world examples were discussed for intractable epilepsy, diabetes, end-stage renal disease, and inflammatory bowel disease.

Abstract

The electrical system serves as the fundamental base of a country's economic activity, and it is therefore, a likely target for cyberattacks. As the modern economy continues its evolution towards greater digitization and interconnectedness, policymakers must outline and enforce regulations protecting those critical assets, without which the economy would suffer. The Texas Interconnection, due to being independently operated and to a large-extent legislated by the state of Texas, enjoys a simpler regulatory environment than its national counterparts. We exploit this relative independence to offer policy solutions to better protect Texas against a cyberattack on its electric grid. Specifically, ERCOT and the PUCT have the authority and ability to streamline and simplify the potentially confusing protocols enforced by NERC to make adoption more likely. We also discuss grant programs for smaller utilities and the role of cyber-insurance in helping utilities navigate the difficulties in understanding the protocols so that compliance can occur.

Abstract

In 2005 a company in charge of repairing electric transmission towers made a deal with guerrilla militants to demolish the towers. This company thrived, because the attacks were attributed to guerrilla groups, who commit these attacks often. However, the number of attacks increased significantly, raising alarms and leading to the discovery of the plot. We model this situation as a game between contractors and the power transmission company, and show how misaligned incentives enabled contractors to profit by colluding with guerrilla groups. We also analyze how to modify the contractual policies reducing the incentives to collude with guerrillas. In particular, the transmission company can prevent attacks by creating competition and exploiting market inefficiencies.

Abstract

Intimate partner stalking (IPS) is a significant public health and public safety issue, yet it remains a largely understudied area especially related to effective practices for victim engagement and response. This study uses systematic review methods to assess the range of criminal justice responses to IPS victimization and the extent to which these responses are successful in promoting survivor safety, well-being, and justice. Multiple scholarly and gray-literature databases were searched to locate studies on criminal justice responses to IPS. Over 336 records were reviewed dating back to 1993 and screened for inclusion in the study, resulting in a final sample size of 22 studies. Findings identify both formal and informal strategies used by the criminal justice system to address IPS. However, pervasive barriers exist including a lack of knowledge and training on stalking, difficulties in investigation and prosecution, and negative perceptions of victims. Successful strategies for mitigating IPS were linked to increased training of law enforcement and prosecution and the granting and enforcement of civil protective orders. Complexity of charging decisions was identified as a challenge for criminal justice entities and methodological and definitional issues make stalking a difficult area to study. Despite numerous barriers in effectively responding to victims of IPS, recommendations for improving responses across the criminal justice system include enhanced training and periodic refreshers across criminal justice entities, coordinated reviews of IPS cases, and better incorporation of the stalker's criminal history to strategically pursue charges., Author(s): Bethany L.
