Abstract

Drawing on Indigenous peoples'struggles against settler colonialism, Theft Is Property! reconstructs the concept of dispossession as a means of explaining how shifting configurations of law, property, race, and rights have functioned as modes of governance, both historically and in the present. Through close analysis of arguments by Indigenous scholars and activists from the nineteenth century to the present, Robert Nichols argues that dispossession has come to name a unique recursive process whereby systematic theft is the mechanism by which property relations are generated. In so doing, Nichols also brings long-standing debates in anarchist, Black radical, feminist, Marxist, and postcolonial thought into direct conversation with the frequently overlooked intellectual contributions of Indigenous peoples.

This series consists of opinion reports and appendices prepared for court cases involving Indian land claims filed against New York State by the Cayuga Indian Nation, the Seneca-Cayuga Tribe of Oklahoma, the Seneca Nation of Indians, and the Tonawanda Band of Seneca Indians. Reports were authored by consulting expert Dr. Alexander von Gernet. They are entitled "The Historical Context of the Cayuga Treaties with the State of New York" and "Aboriginal Use and Occupancy of the Niagara River Environs."

Abstract

Francis E. Leupp directs Theodore Roosevelt's attention to a recent Supreme Court decision regarding a large monetary claim by the Sac & Fox Tribe of the Mississippi in Iowa against the Sac & Fox Nation in Oklahoma. The decision vindicated the Roosevelt administration's stance on the dispute and Leupp felt "a thrill of pride" over his association with the administration.

This document is a bill enacted by the Senate and the House of Representatives of the United States of America on January 26, 1798. In the bill, Congress allocates no more than 25,880.00 to be used to pay all costs of any treaty or treaties held with the Indians that claim land in the state of Tennessee. The bill also states that the 25,880.00 will be paid out of money in the Treasury of the United States that is not appropriated elsewhere.
