In this paper, we propose an account of how perceptual evidence might allow us to draw justified conclusions about the existence of composite objects. We call the thesis at issue PERCEPTUAL ADEQUACY, and argue that a specific, naïve realist picture of the phenomenal character of perception provides us with a straightforward way to defend it. The claim that we have empirical evidence for the existence of macroscopic composites cannot be propped up merely by the plausible claim, granted by many, that our perceptual experiences have composites-presenting phenomenology. Rather, a specific account of the nature of the phenomenology is needed so that it can provide the required evidence. We propose a way to accomplish this: one on which in the good cases it would be constituted by the presentation of the truth-makers of the relevant ontological claims. We argue, further, that this potential defence of a feasible empirically-informed approach to metaphysics is preferable to the best alternative, one based on an object-dependent version of intentionalism about perceptual consciousness. In the Iranian legal system, use of legislative history (including parliamentary materials) in legal interpretation is quite prevalent. Judges and jurists always try to remain faithful to the legislative history and refrain from giving any interpretation contrary to it. Despite the role of legislative history in interpretation, it's been widely neglected in our legal literature. The following paper explores this matter with regard to Iranian law. It develops arguments based on legal theory, constitutional law, and thus affords deeper insight into the current discussion on legal methods. Despite the role of legislative history in legal interpretations, its nature, types and criteria are unclear and unresolved. In this paper, first a precise definition of legislative history and its types is provided, and then the validity of legislative history is discussed, and explained how legal schools can invoke legislative history based on the assumptions they have previously accepted. In the second part, the main criteria for applying legislative history in legal interpretation is stated. People who, by intention or negligence, deceive themselves put other people at risk of being misinformed. The paper argues that this kind of misinforming other people is to be avoided for largely the same reasons for which lying is to be avoided – regardless of what exactly these reasons are. This makes the ethical evaluation of self-deception in part dependent on the ethical evaluation of lying. Realist theories of legislative intent can be divided between aggregative theories (on which legislative intent is what some proportion of legislators intend) and common intent theories (on which legislative intent is a unanimous intent among legislators). In this article, we advance and defend an alternative realist conception of legislative intent: the rational unity account. On this account, the legislature is an agent with a distinctive 'rational point of view'—a concept we adopt from social ontology. The legislature's rational point of view is shaped by its procedures and structures, in ways not determined by either a common intention held by legislators or an aggregation of the intentions of legislators. We explain how our view improves on existing accounts. We then apply it to three cases to demonstrate its implications for legal interpretation. According to a family of metasemantics for demonstratives called intentionalism, the intentions of speakers determine the reference of demonstratives. And according to a sub-family I call proximal intentions (PI) intentionalism, the intention that determines reference is one that occupies a certain place—the proximal one—in a structure of intentions. PI intentionalism is thought to make correct predictions about reference where less sophisticated forms of intentionalism make the wrong predictions. In this article I argue that this is an illusion: PI intentionalism also suffers from predictive inadequacy. In Sect. 1, I present the problem of predictive inadequacy for intentionalism and an ad hoc response to it. In Sect. 2, I sketch a version of PI intentionalism that aims to provide the most principled response to this problem. In Sect. 3, I explain why PI intentionalism cannot solve the problem after all. The sensory colors that figure in visual perceptual experience are either properties of the object of consciousness (naïve realism, sense-data theory), or properties of the subject of consciousness (adverbialism) (Section 1). I consider an argument suggested by the work of A. D. Smith that the existence of certain kinds of perceptual constancies shows that adverbialism is correct, for only adverbialism can account for such constancies (Section 3). I respond on behalf of the naïve realist that naïve realism is compatible with the existence of such constancies, so long as naïve realism adopts the view that sensory colors are relational properties of physical objects, not intrinsic properties (Section 4). Both Nietzsche and La Rochefoucauld rejected metaphysical principles, such as the Kantian moral imperatives, and adopted psychology as their first philosophy. In this article I explore their views of self-love and of the will to power as the first principles of human motivation. Although both thinkers reduce actions to egoistic motives, they define the human drives and passions differently. While Nietzsche criticizes La Rochefoucauld's view of a self-love-oriented intention as the principal cause of deeds, his interpretation is reductionist seeing that La Rochefoucauld also gives a quasi-expressivist account of deeds based on multiple drives. Unlike La Rochefoucauld, Nietzsche claims that there is no preexisting intention before or behind deeds, but rather that the doer expresses herself in and through her deeds. He laments that La Rochefoucauld's concept of self-love is overshadowed by Christianity and criticizes him for condemning secular virtues as postlapsarian vices in disguise. Egoism, for Nietzsche, is a drive that is ingrained in the psyche for self-elevation. By comparing and contrasting their views, I conclude that self-love for La Rochefoucauld is pure self-affirmation at the expense of other drives or other agents, while Nietzsche's notion of the will to power is a master-drive's organization of other drives in service of the grander project of the self, which at the same time allows the subordinate drives to express themselves and fulfill the functions proper to their own nature. This interpretation sheds light on the key concept of egoism and the will to power in Nietzsche's moral psychology, as well as on the first principles of human action in Nietzsche and La Rochefoucauld. In this paper I test major analytic theories of interpretation, including anti-intentionalism, the value-maximizing theory, actual intentionalism, and hypothetical intentionalism, against Li Shang-yin’s poem ‘The Ornamented Zither’. I argue that, based on the results of the test, all of these theories face grave difficulties. If their supporters want their accounts to be sustained in the debate over interpretation, they need to address the worries I raise.

I argue that what speakers mean or express can be determined by their implicit or unconscious states, rather than explicit or conscious states. Further, on this basis, I show that the sincerity conditions for utterances can also be fixed by implicit states. This is a surprising result, which goes against common assumptions about speech acts and sincerity. Roughly, I argue that the result is implied by two plausible and independent theories of the metaphysics of speaker meaning and, further, that this is a robust basis on which to make an inference, with a fair degree of confidence, about the relationship between expression and implicit attitudes. This article explores various theories of interpretation, such as anti-intentionalism and intentionalism, by analyzing Li Shang-yin's poem 'The Ornamented Zither'. The author argues that these theories face challenges when applied to the poem. The article provides an introduction to Li Shang-yin and the poem, summarizes six popular interpretations, and highlights potential inadequacies in mainstream interpretation theories. This article aims to highlight the role of embodied mental representations or embodied schemas in both perception and filmmaking/viewing by foregrounding three premises: (1) perception is inferential and relies on prior embodied schemas; (2) filmmakers (authors) do not merely reproduce reality but equally impose body-based schemas onto the parts of a film in order to convey meanings; and (3) these schemas, as presented by the formal design of the work, may enrich the viewers' experience by allowing them a privileged look into the embodied creative-thinking processes of filmmakers. It will be argued that viewers are prompted to peek into these processes because the representational embodied concepts, as cued by the films, are grounded in shared sensory-motor capacities that scaffold all abstract thinking and reasoning. My purpose is to refute the intentionalist approach to perception. Drawing from mainstream literature, I identify a principle on which any version of intentional theory relies. My paper is a detailed attack on the truth of the principle. In the first section I will introduce terminology and will taxonomize various statements of the intentional view. In the second section I will briefly outline a sketch of the skeletal intentionalist theory that develops from the assumption of the principle alone. Then, in the third section, I will advance my reasons against this theory. In the fourth section, I will set forth an intuitive and definitive counterexample to the adequacy of the principle of intentionalism to accounting for ordinary perception. Moving from this, in the fifth section, I will provide some reasons explaining why intentionalism is condemned at being unsuccessful. Is it possible to have a definition of a professional artist in the 21st century? In an era of absolute democratization of artistic forms, can anyone become the author of a work if he wants to be one? The article provides an overview of the definition of a professional artist over the past few centuries and traces the processes that have shaped or modified this definition in the modern world. The analysis refers to the field of institutional theory and examines two specific events of the last six months in Sofia, which serve to demonstrate the thesis that the popular image, formed by television among the mass audience, defined by Theodor Adorno as the halo effect of previous experiences, can give almost professional status to any face, familiar enough from the small screen. In the specific case the exhibitions MO! and DIS/HARMONIES are an illustration of the active influence of television programs not only on the mass viewer, but also on the professional practice in Bulgaria. We draw such conclusions after their authors Maria Sylvester and Ruth Koleva, known for their active participation in entertainment reality formats, were presented in one of the most famous and defined as professional spaces for contemporary art in Bulgaria – the galleries Structura and Credo Bonum. These curatorial decisions are an upto-date example indicative of the phenomenon of television careerism, which, despite the emergence of streaming platforms and the respective decreasing number of television viewers in the last few years, continues in the logic of its action, described decades ago by Nathalie Heinich and Theodor Adorno. Despite the more general nature of the thesis, the article is a critical analysis on the border with sociological studies of art and specifically addresses the problem of the contemporary art professional. According to intentionalism, the semantic reference of the uses of demonstratives is fixed, at least partly, by the speaker’s referential intention. In this paper, I argue against the possibility of the existence of a semantic convention of this sort. My argument is placed in the Lewisian framework of signaling games and consists of several steps that correspond to four anti-intentionalist arguments, already present in the literature, that have proven inconclusive when employed separately and without being set in the mentioned framework. In performing an act of assertion we are sometimes responsible for more than the content of the literal meaning of the words we have used, sometimes less. A recently popular research program seeks to explain certain of the commitments we make in speech in terms of responsiveness to the conversational subject matter. We raise some issues for this view with the aim of providing a more general account of linguistic commitment: one that is grounded in a more general action‐theoretic notion of responsibility. This paper presents a novel argument against intentionalism about demonstrative reference. The term ‘intentionalism’ is used to denote the view saying that the referent of a demonstrative expression is determined by the speaker’s intention. My argument focuses on ‘mismatch cases’, roughly, the cases in which the speaker’s intention determines a different object from the one which appears to be the referent in the light of contextual factors. The opponents of intentionalism claim that intentionalism yields simply incorrect reference predictions in these cases. Many intentionalism defenders claim to the contrary, i.e. that the relevant kind of intention fixes the referent in line with the contextual factors and thus the theory provides correct predictions. I will argue that this strategy is objectionable as the concept of the relevant referential intention is genuinely parasitic on non-intentional accounts of demonstrative reference. The argument from appearance for the content view or intentionalism attracts a lot of attention recently. In my paper, I follow Charles Travis to argue against the key premise that representational content can be 'read off' from a certain way that a thing looks to a subject. My arguments are built upon Travis's original objection and a reinterpretation of Rodrick Chisholm's comparative and noncomparative uses of appearance words. Byrne, Schellenberg and others interpret Travis' 'visual looks' as Chisholm's comparative use, and appeal to the noncomparative use as an alternative to avoid Travis's objection. I demonstrate that they misunderstand both Chisholm and Travis. Both the comparative use and the noncomparative use are semantic notions, while 'visual looks' is a metaphysical one. Although Chisholm's appearance objectivism –– that appearance expressions attribute appearances to ordinary objects –– is close to 'visual looks', appearance objectivism is not exceptional to the noncomparative use as Byrne interprets. In the end, I also show that Byrnean's conception of distinctive visual gestalt cannot exclude contrary representational contents, because a distinctive visual gestalt can be shared by different kinds of things. Besides, Byrne and others do not explain why a distinctive visual gestalt should be presented as 'being instantiated'. Therefore, I conclude that representational content cannot be read off from a certain way that a thing looks to a subject; the argument from appearance thus fails. [ABSTRACT FROM AUTHOR]

As artefacts, the worlds of digital games are designed and developed to fulfil certain expressive, functional, and experiential objectives. During play, players infer these purposes and aspirations from various aspects of their engagement with the gameworld. Influenced by their sociocultural backgrounds, sensitivities, gameplay preferences, and familiarity with game conventions, players construct a subjective interpretation of the intentions with which they believe the digital game in question was created. By analogy with the narratological notion of the implied author, we call the figure to which players ascribe these intentions ‘the implied designer’. In this article, we introduce the notion of the implied designer and present an initial account of how appreciators ascribe meaning to interactive, fictional gameworlds and act within them based on what they perceive to be the designer’s intentions.

Speech act theorists tend to hold that the illocutionary force of an utterance is determined by one interlocutor alone: either the speaker or the hearer. Yet experience tells us that the force of our utterances is not determined unilaterally. Rather, communication often feels collaborative. In this paper, I develop and defend a collaborative theory of illocutionary force, according to which the illocutionary force of an utterance is determined by an agreement reached by the speaker and the hearer. This theory, which builds upon linguistic and sociological work on adjacency pairs and conversational interaction, can accommodate the complexity of speaker intentions (which may be disjunctive, indeterminate, and/or inconsistent over time), and renders speech act theory more compatible with theories of common ground. We motivate five constraints on theorizing about sensory experience. We then propose a novel form of naturalistic intentionalism that succeeds where other theories fail by satisfying all of these constraints. On the proposed theory, which we call structure matching tracking intentionalism, brains states track determinables. Internal structural features of those states select determinates of those determinables for presentation in experience. We argue that this theory is distinctively well-positioned to both explain internal-phenomenal structural correlations and accord external features a role in fixing phenomenology. In this paper we present a solution to Saul Kripke’s Puzzle About Belief (in: Margalit (ed) Meaning and use, Dordrecht, 1979) based on Kaplan’s metaphysical picture of words (Proc Aristotelian Soc 64:93–119, 1990, J Philos 11:504–529, 2011). Although it is widely accepted that providing such a solution was one of the main incentives for the development of Kaplan’s theory, it was never presented by Kaplan in a systematic manner and was regarded by many as unsatisfactory. We agree with these critiques, and develop an extension of Kaplan’s theory by introducing the notion of “conservative” word uses, as well as arguing for the restriction of Kripke’s Disquotational Principle only to such uses. This restriction allows us to solve Kripke’s Puzzle by arguing that the assent of the puzzle’s protagonist does not allow disquotation and ascription of corresponding inconsistent belief, as it contains the non-conservative use of a proper name. At the end of the paper, we defend two of Kaplan’s theses that we find essential for our argument to work: that individuation of word tokens involves taking into account the intention of the speaker, and that different uniquely referring proper names of the same shape should be regarded as different homonymous words. As part of their regular activities, courts attach meaning to legal texts to determine the normative situation of the parties to the dispute. The activity of attributing meaning to legal texts by the courts is commonly called authoritative interpretation of law. In many cases, the meaning attributed to the text by the court deviates significantly from what laymen and even lawyers would expect, and the deviations themselves are explained in different ways in legal theory. In the purpose of explanation, the terms creation and application of law, extensive and restrictive interpretation, secundum, praeter and contra legem adjudication are used. This paper introduces and explains the concepts of interpretation, construction and their relationship, as possible explanations of situations in which authoritative judicial interpretations deviate from the expectations of the professional and lay public. For this purpose, contemporary textualist and intentionalist (cognitivist) conceptions of interpretation and construction are presented and compared with contemporary skeptical (realist, antiformalist) conceptions. Despite the simplicity and intuitive acceptability of some cognitivist views, skepticism is shown to provide a better theoretical basis for considering the application and creation of rights by courts. The very distinction between interpretation and construction proves to be a useful theoretical tool for explaining the actions of courts, as well as for specifying existing theoretical distinctions.

In recent years, there has been an increasing interest among philosophers of memory in the questions of how to characterize and to account for the temporal phenomenology of episodic memory. One prominent suggestion has been that episodic memory involves a feeling of pastness, the elaboration of which has given rise to two main approaches. On the intentionalist approach, the feeling of pastness is explained in terms of what episodic memory represents. In particular, Fernández (2019) has argued that it can be explained in terms of memory representing itself as being caused by a past perceptual experience. On the metacognitive approach, which we have recently developed in (Perrin et al., 2020), the feeling of pastness results from the monitoring and interpretation of the processing features of episodic remembering. In this paper, we show that the metacognitive approach should be preferred over the intentionalist approach. We argue that intentionalism, and Fernández’ causal self-referential view in particular, ultimately fail as accounts of the feeling of pastness. The difficulties faced by intentionalism allows us to single out three constraints that any satisfactory account of the temporal phenomenology of episodic remembering needs to meet. We conclude by arguing that the metacognitive view satisfies those constraints in a neat way, and as such, that it should be preferred over intentionalism. [ABSTRACT FROM AUTHOR]

In this paper I give an overview of the recent developments in the phenomenalism – intentionalism debate and try to show that the proposed solutions of neither sides are satisfying. The claims and arguments of the two parties are rather vague and attribute to intentional and phenomenal properties either a too weak or a too strong relationship: too weak in the sense that they establish only mere coexistence, or too strong in the sense that they attribute some a priori conceptual connection to intentional and phenomenal properties. I also compare these theories to other theories developed for solving the mind–body problem and argue that these former are much less elaborated. In the end of the paper I try to explain that all of this is not just a contingent feature of the topic, but has deep conceptual roots: intentionality and phenomenal consciousness are two quite distinct concepts on two quite distinct levels. There is an eminent tradition of thought that sees in the phenomenon of time something contradictory. This tradition has been recently revived by some contemporary proponents of dialethism – the view that there are true contradictions. In this paper, I will contribute to this line of thinking by tracing the first steps of a dialethic account of time-consciousness. In particular, I will argue that the experiential flow of time can be accounted for in the framework of an intentionalist approach to temporal perception if we conceive of time-consciousness as a quasi-multiplicity, i.e., a multiplicity of non-self-identical parts, hence the embrace of dialethism. Section 1 introduces dialethism, discusses Priest's dialethic theory of motion and time, and motivates the project of a dialethic account of time-consciousness. Section 2 introduces the intentionalist approach to time-consciousness and distinguishes pure intentionalism from sense-data intentionalism; both subscribes to a certain Principle of Simultaneous Awareness but interprets it differently. In Sect. 3, I offer an in-depth analysis of this principle and identify its core as the requirement of self-unification, i.e., the requirement that time-consciousness unifies itself in flowing without any higher-order act of unification. Section 4 then argues that pure intentionalism can satisfy this requirement by embracing dialethism. I conclude by noting how the dialethic account of time-consciousness incorporates a central extensionalist insight within an intentionalist outlook. [ABSTRACT FROM AUTHOR]

The manner of reading and interpreting historical texts is one of the central pillars of the methodology and history of thought. The main question in this field is how to study and understand the concepts and meanings of the thinkers in the study of the history of thought? Quentin Skinner is one of the founders of the Cambridge School of History and Political Thought, whose work is of philosophical importance, presenting new and influential ideas. Skinner considers the question of how different and conflicting perspectives are to be adapted, which can be still a central issue in contemporary political thought. He has attempted to use the traditional methods of historical research with an intentional approach, to draw attention to their differences, to reconstitute their beliefs, and to be as aware of the processes of the formation of problems and events as possible, to understand the way things are going. He hopes that by examining and evaluating the history of competing theories, he will be able to play a part in these widespread conflicts, regardless of his historical interest. This article will attempt to introduce and review the first volume of the book Visions of Politics: On Methodology. The importance of the critical reading of this series of articles in this book is that it now reflects his intellectual transformation as classical writings.

This article reviews the enactive approach to perception, which defends the role of objects, the subject and the environment in the configuration of the phenomenal character of perception, that is, the qualitative dimension of experience. Initially the case of hallucination and its implications in the understanding of the phenomenal character of perception is retaken. Then, two positions within analytic philosophy of perception, representationalism and disjunctivism, are critically explored. Finally, enactivism is presented as a more promising alternative.

Harman famously argues that a particular class of anti-functionalist arguments from the intrinsic properties of mental states or events (in particular, visual experiences) can be defused by distinguishing “properties of the object of experience from properties of the experience of an object” and by realizing that the latter are not introspectively accessible (or are transparent). More specifically, Harman argues that we are or can be introspectively aware only of the properties of the object of an experience but not the properties of the experience of an object and hence that the fact that functionalism leaves out the properties of the experience of an object does not show that it leaves out anything mentally relevant. In this paper, I argue that Harman’s attempt to defuse the anti-functionalist arguments in question is unsuccessful. After making a distinction between the thesis of experiencing-act transparency and the thesis of mental-paint transparency, (and casting some doubt on the former,) I mainly target the latter and argue that it is false. The thesis of mental-paint transparency is false, I claim, not because mental paint involves some introspectively accessible properties that are different from the properties of the objects of experiences but because what I call the identity thesis is true, viz. that mental paint is the same as (an array of) properties of the object of experience. The identification of mental paint with properties of the object of experience entails that the anti-functionalist arguments Harman criticizes cannot be rightly accused of committing the fallacy of confusing the two.

One of the most influential traditional objections to Adverbialism about perceptual experience is that posed by Frank Jackson's 'many property problem'. Perhaps largely because of this objection, few philosophers now defend Adverbialism. We argue, however, that the essence of the many property problem arises for all of the leading metaphysical theories of experience: all leading theories must simply take for granted certain facts about experience, and no theory looks well positioned to explain the facts in a straightforward way. Because of this, the many property problem isn't on its own a good reason for rejecting Adverbialism; and nor is it a puzzle that will decide amongst the other leading theories. The contemporary discussion on the subjective character of conscious experience is characterized by a stark contrast between higher-order intentionalism, according to which any state of awareness depends on the instantiation of intentional properties by mental states, and anti-intentionalism, according to which the inner awareness constitutive of subjective experience is fundamentally different from ordinary instances of external or introspective awareness, in that one's experience is not given to the subject as an ordinary intentional object. The purpose of this paper is to outline the most fundamental dimensions of variation among the different kinds of higher-order theories and to show, by providing a comprehensive analysis of the logical space available, that these seemingly incompatible views can be reconciled within an intentionalist framework. Uptake is typically understood as the hearer's recognition of the speaker's communicative intention. According to one theory of uptake, the hearer's role is merely as a ratifier. The speaker, by expressing a particular communicative intention, predetermines what kind of illocutionary act she might perform. Her hearer can then render this act a success or a failure. Thus the hearer has no power over which act could be performed, but she does have some power over whether it is performed. Call this the ratification theory of uptake. Several philosophers have recently endorsed an alternative theory of uptake, according to which the hearer can determine the nature of the act the speaker performs. According to this theory, if the hearer regards an utterance as illocutionary act y, then it is act y, even if the speaker intended to perform act x. Call this the constitution theory of uptake. The purported advantage of this theory is that it identifies a common but underanalysed way in which speakers can be silenced. I argue that despite its initial intuitive pull, the constitution theory of uptake should be rejected. It is incompatible with ordinary intuitions about speech, it entails a conceptual impossibility (the unintentional exercise of normative powers), and it has unsavoury political implications, entailing that marginalised speakers barely qualify as agents. Naïve Realism claims that veridical perceptual experiences essentially consist in genuine relations between perceivers and mind-independent objects and their features. The contemporary debate in the philosophy of perception has devoted little attention to assessing one of the main motivations to endorse Naïve Realism–namely, that it is the only view which articulates our 'intuitive' conception of perception. In this paper, I first clarify in which sense Naïve Realism is supposed to be 'naïve'. In this respect, I argue that it is put forward as the only view which can take our introspective knowledge of perception at face value, and I identify the two (alleged) key features of such introspective knowledge. Second, I challenge the claim that one of these features-namely, that it seems as one could not be in the same perceptual state unless the putative objects of perception existed and were perceived–is introspectively evident. Consequently, I argue that a view of perceptual experience–such as Intentionalism–which denies that this feature is true of perception can still take introspection at face value. This undermines the claim that Naïve Realism is the only account which accommodates our intuitions on the nature of perception. [ABSTRACT FROM AUTHOR]
