This book analyses the accountability of European home States for their failure to secure the human rights of victims from host States against transnational enterprises. It argues for a reconfiguration of the relationship between multinational enterprises and individuals, both of which have been profoundly changed by globalisation. Enterprises are now supranational entities with numerous affiliates all over the world. Likewise, individuals are increasingly part of a global community. Despite this, the relationship between the two is deregulated. Addressing this gap, this study proposes an innovative business and human rights litigation strategy. Human rights advocates could file a test case against a European home State, at the European Court of Human Rights, for its failure to secure the rights of victims vis-à-vis European multinational enterprises. The book illustrates why such a strategy is needed, and points to the lack of effective legal remedies against European multinationals. The goal is to empower victims from developing countries against European States which are failing to hold multinational enterprises accountable for human rights abuses.

This book explores the relationship between multinationals and developing countries. Some of multinational's corporations claim to be taking steps to improve their CSR practices through the use of voluntary initiatives such as codes of conduct, environmental certification, social audits, fair trading and social investments. However, that kind of voluntary initiative may be limited in some developing countries where companies are not subjected to the same pressures and market opportunities that make many corporations responsible in developed countries. The challenge for corporate social responsibility (CSR) in developing countries is guided by a vision distilled into the UN Millennium Development Goals. Unfortunately, these global aspirations remain far from being met in many developing countries today. The book also examines the promotion of corporate environmental and social responsibility in specific developing countries. While concepts like corporate social responsibility have become more fashionable in many developing countries, they have essentially been introduced from abroad. Thus, on one hand, the lack of interest within some developing countries is not surprising considering the current context of economic, political and social crisis, which generates other priorities. On the other hand, an institutional framework supportive of CSR practices has emerged in some developing countries. In these countries, corporate policies to promote responsible social and environmental behaviors have been increasingly important among foreign-based companies.

The human rights issues have long played an important role in the strategies of, and the roles played by, corporations around the world. Although much literature on human trafficking focuses on sex trafficking, a great deal of human trafficking results from migrant workers, compelled - by economic deprivation in their home countries - to seek better life opportunities abroad, especially in agriculture, construction and domestic work. Such labour migration is sometimes legal and well managed, but sometimes not so – with migrant workers frequently threatened or coerced into entering debt bondage arrangements and ending up working in forced labour situations producing goods for illicit markets. This book fills a substantial gap in the existing literature given that labour trafficking is a much more subtle form of exploitation than sex trafficking. It discusses how far large multinational corporations are involved, whether intentionally or unintentionally, in human trafficking for the purposes of labour exploitation. They explore how far corporations are driven to seek cheap labour by the need to remain commercially competitive and examine how the problem often lies with corporations'subcontractors, who are not as well controlled as they might be. The end of the Cold War and the virtual disappearance of communism have completely altered the world economy. Multinational Corporations in Political Environments advances and tests a theory of why foreign corporations leave host states. Theories of international business have often ignored the complexity of corporate decisions about leaving foreign countries, generally assuming that the economic and competitive reasons that prompt multinational corporations to enter host states also explain their subsequent reasons for leaving. Alternatively, this book proposes a theory of how different stakeholders'values and ethics shape multinationals'strategic leaving behaviors. Tested in South Africa when US multinationals were facing diverse pressures from stockholders, governments and consumers to leave, the research provides a prism to isolate how different stakeholders'actions influenced multinationals'behaviors. Detailed analyses of subsidiary-level archival data over a period of four crucial years revealed that the multinationals engaged in diverse forms of leaving reflecting their involvements, strategies and stakeholders'influences. The research, the first to test which stakeholders'strategies, including boycotts and sanctions, influenced multinationals and which did not, and to identify their effects on multinationals'behaviors, has enormous implications for policy makers, managers and social activists.
