This study investigates the tensile failure mechanisms in granitic rock samples at different scales by means of different types of tests. To do that, we have selected a granitic rock type and obtained samples of different sizes with the diameter ranging from 30 mm to 84 mm. The samples have been subjected to direct tensile strength (DTS) tests, indirect Brazilian tensile strength (BTS) tests and to two fracture toughness testing approaches. Whereas DTS and fracture toughness were found to consistently grow with sample size, this trend was not clearly identified for BTS, where after an initial grow, a plateau of results was observed. This is a rather complete database of tensile related properties of a single rock type. Even if similar databases are rare, the obtained trends are generally consistent with previous scatter and partial experimental programs. However, different observations apply to different types of rocks and experimental approaches. The differences in variability and mean values of the measured parameters at different scales are critically analysed based on the heterogeneity, granular structure and fracture mechanics approaches. Some potential relations between parameters are revised and an indication is given on potential sample sizes for obtaining reliable results. Extending this database with different types of rocks is thought to be convenient to advance towards a better understanding of the tensile strength of rock materials.

Nuestros jueces civiles deben tener claridad, para evitar que se pierda el objetivo principal, cual es la obtención de un título ejecutivo en el menor tiempo posible.

Para su ejecución, se usó como metodología la entrevista semiestructurada, participando de ella un total de treinta y dos académicos de diez países de América Latina y Europa. Los resultados se estructuran en torno a los argumentos a favor y en contra del precedente como posición teórica; a narrar cómo se comportan los tribunales vértice y el resto frente a los precedentes; y, finalmente, a conocer los obstáculos que impiden seguir correctamente los precedentes.

A $\vee$-complement of a subgroup $H \leqslant \mathbb{F}_n$ is a subgroup $K \leqslant \mathbb{F}_n$ such that $H \vee K = \mathbb{F}_n$. If we also ask $K$ to have trivial intersection with $H$, then we say that $K$ is a $\oplus$-complement of $H$. The minimum possible rank of a $\vee$-complement (resp. $\oplus$-complement) of $H$ is called the $\vee$-corank (resp. $\oplus$-corank) of $H$. We use Stallings automata to study these notions and the relations between them. In particular, we characterize when complements exist, compute the $\vee$-corank, and provide language-theoretical descriptions of the sets of cyclic complements. Finally, we prove that the two notions of corank coincide on subgroups that admit cyclic complements of both kinds.

El presente trabajo aborda una problemática muy contingente en nuestro ordenamiento jurídico: el derecho al recurso y su impacto en procedimientos civiles y comerciales, a tenor de qué ha de entenderse como un proceso que se caracterice por otorgar una genuina tutela judicial efectiva. Para ello, la principal tesis que se sostiene es que la Constitución Política de Chile consagra, específicamente, en concordancia con los tratados internacionales aplicables a nuestro país, un derecho al recurso que contemple una revisión amplia al modo que se vislumbra para el recurso de apelación. En el presente artículo consideramos que esa tesis no puede extrapolarse al procedimiento arbitral, pues el sistema recursivo de aquel es restrictivo, para destacar, entonces, que la jurisdicción estatal contempla una forma alternativa de enjuiciamiento y, en especial, de control y revisión de los fallos de primera instancia. Este fenómeno resultaría compatible con nuestro sistema constitucional y con el Sistema Interamericano de Derechos Humanos.

12. Energy Absorption of Aluminium Extrusions Filled with Cellular Materials Under Axial Crushing: Study of the Interaction Effect

This investigation focuses on the interaction effect during the quasi-static axial crushing of circular and square thin-walled aluminium extrusions filled with polymeric foam or cork. The increment in the absorbed energy due to interactions between materials was assessed using a validated numerical model calibrated with experimental material data. Simulations were run with variable cross-section dimensions, thickness, and foam density. The results were used to adjust the parameters of design formulas to predict the average crush forces of foam- and cork-filled thin-walled tubes. The analysis of the energy dissipation per unit volume revealed that the highest increments due to the interaction between materials appeared in the foam-filled square extrusions. Energy dissipation increased with higher density foams for both cross-sections due to a stronger constraint of the aluminium walls, and thus a reduction of the folding length. Thinner tube walls also delivered a higher improvement in the energy dissipation per unit volume than those with thicker walls. The contribution of friction was also quantified and investigated.

A multi-sensor and multi-scale monitoring tool for the spatially explicit and periodic monitoring of eutrophication in a small drinking water reservoir is presented. The tool was built with freely available satellite and in situ data combined with Unmanned Aerial Vehicle (UAV)-based technology. The goal is to evaluate the performance of a multi-platform approach for the trophic state monitoring with images obtained with MultiSpectral Sensors on board satellites Sentinel 2 (S2A and S2B), Landsat 8 (L8) and UAV. We assessed the performance of three different sensors (MultiSpectral Instrument (MSI), Operational Land Imager (OLI) and Rededge Micasense) for retrieving the pigment chlorophyll-a (chl-a), as a quantitative descriptor of phytoplankton biomass and trophic level. The study was conducted in a waterbody affected by cyanobacterial blooms, one of the most important eutrophication-derived risks for human health. Different empirical models and band indices were evaluated. Spectral band combinations using red and near-infrared (NIR) bands were the most suitable for retrieving chl-a concentration (especially 2 band algorithm (2BDA), the Surface Algal Bloom Index (SABI) and 3 band algorithm (3BDA)) even though blue and green bands were useful to classify UAV images into two chl-a ranges. The results show a moderately good agreement among the three sensors at different spatial resolutions (10 m., 30 m. and 8 cm.), indicating a high potential for the development of a multi-platform and multi-sensor approach for the eutrophication monitoring of small reservoirs.

El presente trabajo realiza una revisión acerca de las principales características y elementos que rodean a la institución de la autotutela en nuestro entorno, como un método de resolución del conflicto. Efectivamente, con carácter general se trata de una forma proscrita de solucionar un diferendo jurídico y pretendemos, de algún modo, señalar su conveniencia en algunos casos. De esta revisión se concluye que el principal elemento, que permite señalar una prohibición general de uso como método de resolución del conflicto, es la violencia. Adicionalmente, se describe y propone adoptar entre nosotros una figura autotutelar: la repossession.

Con el fin de analizar la influencia de las aguas subterráneas de la escombrera exterior de la antigua mina de lignito de As Pontes (Galicia) sobre el lago minero adyacente se ha procedido a hacer una caracterización hidrogeológica de la misma. Para ello, ha sido necesario hacer diferentes ensayos hidráulicos en distintos puntos representativos de la escombrera para estimar los parámetros hidrodinámicos e identificación de las distintas unidades hidrogeológicas, las cuales se pueden describir como independientes. En el presente trabajo se concluye que la cobertera externa de la escombrera presenta valores de permeabilidad característicos de un limo arcilloso distribuidos espacialmente de manera homogénea, por lo que se minimiza la posible infiltración y su posible percolación a posiciones más profundas, y su posterior descarga al lago por los taludes contiguos. La influencia de la descarga subterránea es nula.

Sin duda, una de las preocupaciones más importantes que motivan la reforma es la necesidad de agilizar el cobro efectivo de la deuda habiéndose constatado la ineficacia de las gestiones preparatorias y la excesiva demora en la consecución de un título ejecutivo en el modelo actual. Con ese propósito se incorpora esta institución que no es desconocida en nuestro sistema procesal.

Una de las que más llama la atención es la consolidación de la eliminación de la decimonónica figura de la casación mediante la incorporación del recurso extraordinario. Proponemos una descripción dogmática de los principales elementos característicos de este medio de impugnación que nos permita ir conociendo, a la postre, el nuevo rol que se ha otorgado a la Corte Suprema como ente unificador de jurisprudencia.The bill of the Code of Civil Procedure of Chile features great novelties. Strikingly, the draft consolidates the elimination of nineteenth centuries' cassation by incorporating the Extraordinary Appeal into the system. We propose an academic description of the main elements of this legal remedy to allows the understanding of the new role given to the Supreme Court as the unifying entity of jurisprudence.

El proyecto de Código Procesal Civil en actual tramitación en el Congreso Nacional de Chile incluye una singular innovación en el ámbito recursivo. Se trata del recurso extraordinario, cuya finalidad es, en esencia, unificar la jurisprudencia en materia civil. Esta pretensión presenta indudables ventajas asociadas a la igualdad en la aplicación de la ley, a la seguridad jurídica, a reducción de costes económicos y a la legitimidad del Poder Judicial. Sin embargo, y al mismo tiempo, el cumplimiento de su finalidad unificadora se encontrará con obstáculos insalvables si mantiene el diseño normativo con que actualmente cuenta. Tales obstáculos se relacionan con una determinada concepción y con una determinada práctica del Derecho en la familia europeo-continental en general y en el ámbito jurídico chileno en particular.The draft of the Civil Procedure Code which is in revision in the Chilean National Congress contains a unique innovation in the recursive scope. This is an extraordinary remedy whose purpose is, in essence, to unify the civil jurisprudence. This claim presents clear advantages associated with the equal application of the law, legal certainty, reducing economic costs and the legitimacy of the judiciary. However, while fulfilling its unifying purposes, it will encounter insurmountable obstacles if it is kept the current policy. These obstacles are related to a specific concept and a particular practice of law in continental- European family and in the legal Chilean field in particular.

Insight into how environmental change determines the production and distribution of cyanobacterial toxins is necessary for risk assessment. Management guidelines currently focus on hepatotoxins (microcystins). Increasing attention is given to other classes, such as neurotoxins (e.g., anatoxin-a) and cytotoxins (e.g., cylindrospermopsin) due to their potency. Most studies examine the relationship between individual toxin variants and environmental factors, such as nutrients, temperature and light. In summer 2015, we collected samples across Europe to investigate the effect of nutrient and temperature gradients on the variability of toxin production at a continental scale. Direct and indirect effects of temperature were the main drivers of the spatial distribution in the toxins produced by the cyanobacterial community, the toxin concentrations and toxin quota. Generalized linear models showed that a Toxin Diversity Index (TDI) increased with latitude, while it decreased with water stability. Increases in TDI were explained through a significant increase in toxin variants such as MC-YR, anatoxin and cylindrospermopsin, accompanied by a decreasing presence of MC-LR. While global warming continues, the direct and indirect effects of increased lake temperatures will drive changes in the distribution of cyanobacterial toxins in Europe, potentially promoting selection of a few highly toxic species or strains.

El proyecto de Código Procesal Civil en actual tramitación en el Congreso Nacional de Chile incluye una singular innovación en el ámbito recursivo. Se trata del recurso extraordinario, cuya finalidad es, en esencia, unificar la jurisprudencia en materia civil. Esta pretensión presenta indudables ventajas asociadas a la igualdad en la aplicación de la ley, a la seguridad jurídica, a reducción de costes económicos y a la legitimidad del Poder Judicial. Sin embargo, y al mismo tiempo, el cumplimiento de su finalidad unificadora se encontrará con obstáculos insalvables si mantiene el diseño normativo con que actualmente cuenta. Tales obstáculos se relacionan con una determinada concepción y con una determinada práctica del Derecho en la familia europeo-continental en general y en el ámbito jurídico chileno en particular.

Learning algorithms for energy based Boltzmann architectures that rely on gradient descent are in general computationally prohibitive, typically due to the exponential number of terms involved in computing the partition function. In this way one has to resort to approximation schemes for the evaluation of the gradient. This is the case of Restricted Boltzmann Machines (RBM) and its learning algorithm Contrastive Divergence (CD). It is well-known that CD has a number of shortcomings, and its approximation to the gradient has several drawbacks. Overcoming these defects has been the basis of much research and new algorithms have been devised, such as persistent CD. In this manuscript we propose a new algorithm that we call Weighted CD (WCD), built from small modifications of the negative phase in standard CD. However small these modifications may be, experimental work reported in this paper suggest that WCD provides a significant improvement over standard CD and persistent CD at a small additional computational cost.

La restrictiva y formalista interpretación que las Cortes han dado al recurso de nulidad laboral en cuanto instrumento de control de lo decidido por un juez monocrático de primer grado, en los hechos ha tornado en incontrolables buena parte de las sentencias, con clara afectación no solo del reconocimiento que debe darse al derecho de acceso a un recurso previsto en la legislación ordinaria, sino que también de la interdicción del desborde de las atribuciones de un sentenciador solitario en el sentido que marcan los límites que imponen el respeto a las llamadas reglas de la sana crítica y el deber de motivación de los fallos. Partiendo de la necesaria superación del espejismo de la infalibilidad judicial, se revisan los criterios interpretativos excesivamente restrictivos y formalistas que se han instalado en una serie de cortes de apelaciones representativas, al momento de conocer y resolver respecto de los recursos de nulidad laboral, y se propone una salida diversa, equilibrada y proporcional a la que la praxis judicial ha instalado con la finalidad que la causal relativa a la sana crítica quede inoperante y reducida a un control vacío de contenido efectivo y formalista.

Financiado para publicación en acceso aberto: Universidade da Coruña/CISUG [Abstract:] We have designed and built a versatile testing device to perform hydraulic fracturing experiments under true triaxial conditions. The device, based on a stiff biaxial frame that can be installed in a servocontrolled press, can accommodate cube rock samples of up to 150 mm-edge. Using a low-permeability rock known as Blanco Mera granite, we have performed a series of tests across a range of confining pressures including hydrostatic, normal, and strike-slip regimes. We have verified the applicability of two simple fracture mechanics-based models for the interpretation of experimental results, and we have determined the value of tensile strength of the rock from the injection curves recorded. The orientation of the hydraulically-triggered fractures with respect to the applied stress has also been analyzed. Although the models proposed by Rummel and Abou-Sayed provided reasonably satisfactory results, especially for hydrostatic and strike-slip tests, the presence of heterogeneities and defects in the rock matrix may have a strong influence on the fracture behavior and, therefore, affect the interpretation of hydrofracturing tests. The realtime follow-up of neutrino events is a promising approach to search for astrophysical neutrino sources. It has so far provided compelling evidence for a neutrino point source: the flaring gamma-ray blazar TXS 0506+056 observed in coincidence with the high-energy neutrino IceCube-170922A detected by IceCube. The detection of very-high-energy gamma rays (VHE, $\mathrm{E} > 100\,\mathrm{GeV}$) from this source helped establish the coincidence and constrained the modeling of the blazar emission at the time of the IceCube event. The four major imaging atmospheric Cherenkov telescope arrays (IACTs) - FACT, H.E.S.S., MAGIC, and VERITAS - operate an active follow-up program of target-of-opportunity observations of neutrino alerts sent by IceCube. This program has two main components. One are the observations of known gamma-ray sources around which a cluster of candidate neutrino events has been identified by IceCube (Gamma-ray Follow-Up, GFU). Second one is the follow-up of single high-energy neutrino candidate events of potential astrophysical origin such as IceCube-170922A. GFU has been recently upgraded by IceCube in collaboration with the IACT groups. - Abstract
The presence of clay and other non-calcite minerals in chalk reservoirs creates challenges in interpreting rock-physical data. The impact of this insoluble residue (IR) fraction on geomechanical and rock-physical properties of chalk is difficult to assert because it can be load-bearing or in suspension within the pore space. Also, the elastic properties of this clay-rich fraction are not well known. This knowledge is essential when performing quantitative seismic interpretation and geomechanical modelling of the reservoir. Here we present a method to derive elastic properties of the IR fraction using standard petrophysical logs and the Isoframe rock physics model.

- Abstract
Traditionally, the interpretation of rock-mechanical test results and geomechanical reservoir performance focus on describing stress. Rock strength is typically defined as the peak stress attained before failure. Nevertheless, while rock strength in chalk is strongly dependent on properties such as porosity, cementation and saturating fluid, failure strains are remarkably similar for different specimens and saturating fluids when testing under oedometer conditions (Figure 1A). We propose a method to derive the elastic strain of a formation using petrophysical logging data. We can assess how susceptible to pore collapse each interval is by comparing present levels of elastic strain along a borehole against geomechanical testing data.
