2. Mitigating the Negative Impact of Certain Erosion Events: Development and Verification of Innovative Agricultural Machinery.

Abstract

This paper aims to solve the problem of erosion sediment that negatively affects the quality of fallowed soil through the development of a new type of agricultural machinery. The transported erosion sediment will be quantified locally to evaluate the danger of these negative effects on the fallowed soil and on the functionality of the grass cover. Subsequently, a new type of machinery will be proposed for the remediation of eroded sediment and conservation of the fallowed soil. In various fallow research areas with different management methods (such as biobelts, grassed valleys, and grassed waterways), agricultural land affected by eroded sediment was examined, and appropriate machinery was designed to rehabilitate the stands after erosion events. By identifying the physical and mechanical properties of the soil, as well as the eroded and deposited sediment/colluvium, the shape, material, attachment method, and assembly of the working tool for the relevant mobile energy device were designed. The developed tool, based on a plow–carry system using a tractor, features flexible tools that separate the eroded sediment from the fallow land surface, transfer it over a short distance, and accumulate it in a designated area to facilitate subsequent removal with minimal damage to the herbaceous vegetation. The calculated erosion event was 196.9 m3 (179.0 m3 ha−1), corresponding to 295 tons (268.5 t ha−1) deposited from the area of 90 ha. Afterward, the proposed machinery was evaluated for the cost of the removal of the eroded sediment. Based on experience from the field, we calculated that 174 m3 per engine hour results in EUR 0.22 m−3. From the performed experiment, it is evident that the proposed machinery offers a suitable solution for eroded sediment removal locally, which prevents further erosion and subsequent sediment deposition in water bodies where the costs for sediment removal are higher. Moreover, we have proven the potential negative impact of invasive plant species because their seeds were stored in the sediment. Finally, it is credible to state that the proposed agricultural machinery offers an effective solution for the eroded sediment relocation, which subsequently can be used for other purposes and monetized. This results in an increase in the profitability of the erosion sediment removal process, which is already in place at the source before further transportation to aquatic systems where the costs for removal are significantly higher. Abstract

The organisation of occupational pension schemes in Germany is a topic worthy of further investigation, as there is an opportunity to benefit from the experience of other countries and increase the prevalence of such schemes. For instance, how might the participation and commitment of employees in company pension schemes in Germany be enhanced through the examination of international models? It is crucial to investigate how the occupational pension scheme diverges from those of other leading countries. These questions can serve as a foundation for a more comprehensive inquiry into how Germany could enhance its occupational pension scheme in light of international experience. The extant literature primarily addresses occupational pension schemes at the national level. It is evident from an analysis of the existing literature that occupational pension provision is becoming an increasingly significant aspect of the German pension landscape. This is due to the fact that an increasing number of employees view occupational pension provision as an important supplement to the statutory pension. Consequently, there has been a notable increase in the willingness to take out a pension, with figures more than doubling over the past three years. [ABSTRACT FROM AUTHOR]

6. Structural funding and disadvantage of regions: Public and non-public beneficiaries

Abstract

This article concerns the analysis of transparency of public procurement using mathematical methods. With transparency in public procurement relates type of award procedures. Transparency in the use of restricted award procedure and open procedure is analyzed by ANOVA model. There are another aspects leading to less transparency in the field of public procurement. One of them is bid rigging cartels. This non-transparency aspect is evaluated through the Kuhn-Tucker model. Disertační práce je věnována problematice projektů partnerství veřejného a soukromého sektoru a alternativních forem jejich financování. Charakterizovány jsou projekty partnerství veřejného a soukromého sektoru obecně, ale i z pohledu jejich uplatnění v zahraničí a v České republice. Zvláštní pozornost je věnována identifikaci problémů spojených s projekty partnerství veřejného a soukromého sektoru a návrhům jejich řešení. V práci jsou dále vymezeny a zhodnoceny možné zdroje financování projektů partnerství veřejného a soukromého sektoru, a to odpisy, nerozdělený zisk, bankovní úvěry, finanční leasing, podnikového dluhopisy, prioritní akcie, kmenové akcie a dotace ze zdrojů Evropské unie. Posouzeno je rovněž využití mezaninového financování jako potenciálního zdroje financování projektů partnerství veřejného a soukromého sektoru a v kontextu procesu realizace projektů partnerství veřejného a soukromého sektoru je vytvořena metodologie jeho získání., The dissertation is devoted to the issue of public private partnership projects and alternative forms of their financing. Public private partnership projects are defined in general, but also in terms of their application abroad and in the Czech Republic. The presented study analyzes a sample of public contracts, based on data from the Journal of Public Contracts and the Official Journal of European Union (Tender Electronic Daily) in relation to the Czech Republic and selected countries. We are dealing with the following fundamental research question: 'does the final price of public contracts depend on the type of public procurement procedure either open or restricted?' The next important question is about the setting of the tender condition influencing the number of suppliers. The last question is 'what is the share of small and medium size enterprises (SMEs) in the number of suppliers?' The result is based on regression economic model of transparent tender procedure, which gives the exact probability of winning of SMEs in public procurement as explained value form on relevant explaining variable as portion of SMEs in public procurement. Práce se zabývá hodnocením ekonomické efektivnosti veřejných stavebních projektů. V úvodu práce je provedeno odůvodnění nutnosti sledovat ukazatele efektivnosti veřejných stavebních investic ve vztahu k možnostem stabilizace veřejných rozpočtů. Dále je rozebrán historický vývoj a současný stav právní úpravy vztahující se k investování veřejných prostředků do stavebních projektů. Následuje rozbor dostupných metod hodnocení ekonomické efektivnosti veřejných investic. V rámci práce byl proveden výzkum mezi představiteli nejvýznamnějších veřejných investorů v ČR. Byl zkoumán jejich přístup k hodnocení efektivnosti stavebních investic. Abstract

This bachelor thesis deals with the issue of brownfields and its revitalization in the Czech Republic. The main goal is to provide general overview of this topic, which is closely related to sustainable development and land-use planning. Theoretical part is focused on definition of related concepts and includes most frequent origin of brownfields in the Czech Republic. Practical part includes the comparison of two brownfields in the city of Ostrava. Both are listed buildings: Ostravica-Textilia and The Vítkovice Lower Area. The example of Ostravica-Textilia shows laxity of public and state administration. For 17 years, there has not been found a single prosperous investor, therefore Ostrava city and current owner should agree on repurchase or dispossession of the site. With help of EU funds and state grants the complex of buildings should be repaired to save its historical and cultural quality and value.

Abstract

The bachelor's thesis deals with financial management of the municipality Červený Újezd. The aim of this thesis is to find out if the municipality of Červený Újezd managed from 2006 to 2015 with surplus, deficit or balanced budgets. Municipal budgets were analyzed to achieve the aim. It was found that the municipality managed with a surplus of 21 301 076 Kč during ten years. It was stated that the municipality managed efficiently.

In the theoretical part, the basic terms are explained. Part of the thesis is the analysis and subsequent comparison of the conclusion of contracts in the private and public sector. The practical part deals with the errors occurring during the conclusion of contracts in the public sector. Finally, recommendations are made to improve contracting in public administration.

Abstract

The last two decades have witnessed a rapid development of various forms of Public-Private Partnerships in Europe. Transport belongs to sectors where PPPs have been most visible and transformative. Yet not all countries have embraced the new method in the same manner. As some initial studies indicate, their PPP readiness varies quite significantly. At the same time, PPP as a product of New Public Management appeared to be in ideological conflict with several new competing paradigms in the field of public policy and public administration. So far, however, no single study has shown how these compatibility issues are dealt with in practice and how (un)successful in reality the European countries are at implementing transport PPPs. This is mostly due to difficulties in formulating appropriate and comparable evaluation criteria. At the same time, with many projects it was simply a bit too early to say whether the original expectations had been met. This study uses a negative definition of PPP success and establishes the failure rate for each country from the sample. In doing so, it only takes into account projects that were abandoned or seriously distressed and modified in advance stages of the procurement process. Abstract

The project analyzes current legislation on usury in the Czech Republic and the financial literacy of the adult population. On 1 Dec. 2016, an amended Act on Consumer Loans entered into force and this project examines it. The project compares Czech legislation on usury with selected European Union countries. Czech legislation is similar with German and Portugal legislation, especially in terms of civil law. The most effective legislation can be considered in Spain, which explicitly stipulates allowed interest rate limits. Based on that, Czech legislation on usury should be adjusted. The research results show a correlation between respondents' highest-achieved level of education and their financial literacy levels. The research also finds that the number of court distraints (property seizures) and the willingness to borrow money is lower among respondents with university-level education than for respondents with secondary and basic school education. When comparing our findings with research by STEM/MARK dating from 2010, it is clear that the financial literacy of the adult population in the Czech Republic has not changed significantly since that time.

Abstract

This thesis analyzes the impact of high schools on the political thinking of students. For the analysis are used theoretical concepts of assumptions of indoctrination of educational system. Furthermore empirical indicators, which can draw attention to the indoctrination of the educational system. Also there is an experiment which was created for the analysis and is taking place at 22 high schools in three regions of the Czech Republic. Results of the analysis indicate that the problem of indoctrination in the education system is very serious, however, difficult to prove. The analysis failed to confirm the effect of high schools on the political thinking of students, but managed to make a picture of the danger of indoctrination in the education system, about its potential and options.

Abstract

The efficient competition protection is EU's crucial key objective in order to provide smooth functioning of the local competition and the internal market. Within different segments of the competition I focused on the state aid issue, which is a specific area of the EU competition law. Providing any state aid inevitably influences the market enviroment and carries a considerable risk of the competition distortion. It effects the trade between Member States as well. The main aim of this diploma thesis is not only to describe the European legislation related to state aids, but also its impact on the Czech legal system. The Community state aid rules stem from Articles 107 - 109 of the Treaty on the Functioning of the European Union and their main purpose is to prevent any selective advantages to certain market players. This thesis also focuses on reforms and modernization of the state aid control system, in particular to the State Aid Action Plan.

Abstract

This thesis deals with public procurement law in the Czech Republic. It captures the latest trends in public procurement law, together with the amendment to the Public Procurement Act, which entered into force on 1 April 2012. The opening chapter introduces the concepts that are closely related to the issue of public procurement and corruption. There are explained key institutional control mechanisms in the Czech Republic and criminal liability of corruption. The analytical part of this thesis describes the changes, which the amendment brought into the Public Procurement Law. These changes are mainly assessed in terms of impact on the suppression of corruption. This thesis presents and analyzes the arguments of proponents and opponents of the amendment. The analysis is accompanied by a brief look at the development of legislation on public procurement in the European Union in general and in two selected countries of the European Union. The conclusion contains a summary assessment of the issue along with an outlook for a possible further developments in the legal regulation of public procurement. Based on the analysis, the thesis leads to the conclusion that the amendment of public contracts, despite some shortcomings, is leading to a more transparent procurement environment.

The bachelor's thesis deals with creation and realization of a local government's budget. The aim of the theoretical part is to present methods of budget creation and principles and rules, which must be observed by budget. The thesis also presents a budget composition, e.g. the sorting system of incomes and expenditures, which is essential for the practical part of the thesis. The practical part deals with budgets of town Říčany in the period of 2008--2013. There is an income-expenditures analysis of respective time period and identification of local government's economy. Further in the text, there is a SWOT analysis of situation in town, that means analysis of strengths, weaknesses, opportunities and threats of Říčany town. The last part discusses a suggestion for improvement of the budgetary process in the Czech Republic in terms of fulfillment of municipality's development.

The theoretical part defines public goods and means of their security. The following defines the public-private partnership. Than there is the evaluation of public procurements and Public Private Partnership projects in a legal and financial aspects. The practical part describes legal security and financing of Public Private Partnership project Aquapark Olomouc along with SWOT analysis and risk analysis. The analysis above leads to the identification of problematic points of the project. Finally, suggestions are formulated to solution of identified problems and evaluate whether, in this particular case, public-private partnership has been effective.

Abstract

The aim of the thesis is to describe the real estate legislation in selected areas and to summarize the differences between the legal real estate in the Czech Republic and the Russian Federation. This theme was chosen in order to highlight the diversity of real estate legal institutions in both countries. A common feature of the legislation in both countries is that their skills are performed in a professional manner in accordance with applicable standards and regulations of the country. The thesis is divided into six chapters. The first chapter deals with the characteristics of real estate in the Czech Republic. The main resource of law in this field is the Law No. 344/1992 Coll. Cadastre. The second chapter deals with the characteristics of real estate in Russia. The third chapter discusses the changes which currently rules the Land of the Russian Federation passed. The old provisions of the Act are replaced by more modern and the law generally becomes easier. A special feature of the Russian legislation, the institute cadastral engineer, which is entirely devoted in the fourth chapter. The fifth chapter describes the specific differences in the area of real estate law in both countries, and the last sixth chapter deals with the future developments in this area of law in both countries

The subject of this thesis focuses on Public Procurement, precisely on the structure of legal regulations. This thesis broaches certain issues of the law, imperfections in the law and how the law is interpreted in practice. The aim is to understand the deeper issues of these legal regulations. The backbone of this legal regulation is the law 137/2006 Coll. on public procurement. This law is one of the preventive legal standards; among other purposes it prevents wastage of public funds. However, ensuring flawless application of The Act is not as easy a task as it would seem at first sight and the second part of this thesis is therefore devoted to identifying the most common errors in application of this law. Decisions of the Office for Protection of Competition, consultations with experts, and case studies were used for identification of these errors and common types of misconduct are also presented. The conclusion will deal with the amendment to the Public Procurement Act.

This thesis deals with the issue of electronic public procurement. The aim of this thesis is to confirm or disprove the following hypotheses. The first hypothesis of this dissertation is the claim that the current legislation constitutes an adequate legal basis for the implementation of electronic public procurement. The second hypothesis states that the electronic public procurement is more efficient and more transparent than the public procurement without electronization. Examining the first hypothesis was chosen in order to determine whether it is necessary to change the law for the possibility of fully electronic public procurement. The second hypothesis, then, in essence asks whether electronization of public procurement improves the efficiency of public procurement and whether it contributes to increase the transparency of public procurement.

The dissertation describes the current situation of Public Private Partnership (PPP), and then analyzes the development of this concept in the Czech Republic from 2004 to the present time, especially regarding to the implementation of Governmental policy in the field of Public Private Partnership declared in the key resolutions of the Government, institutional ensure and number and volume of the implemented projects. This dissertation also defines the main causes of failure of Public Private Partnership in the Czech Republic. This graduation thesis "Public Procurement of Local Selfgovernment" describes the problems of public procurement. The core subject is the difficulty to observe the law on public procurement. This work includes a case study that mainly evaluates the process of a specific public procurement carried out by a local selfgovernment and the method used to appraise the bids. In order to obtain further information on public procurement at the municipal level, the paper includes a survey addressed to the public administration. The work concludes with a SWOT analysis on public procurement.
