Objectives The nature of the annulment sanction regulated in art. 9 u.k.u.r. raises a number of doubts in both doctrine and case law. Despite the recent amendment to the provision, these doubts have not been removed. The purpose of the article is to try to define the legal nature of the annulment sanction from art. 9 u.k.u.r. Material and methods The publication uses a dogmatic and legal method as appropriate for analyzing legal provisions. To the small extent necessary to indicate the changes that have occurred over the past year, a historical and legal method has been used. Results The results of the tests indicate that the annulment of Art. 9 u.k.u.r. its construction resembles the invalidity of art. 58 of the Civil Code, but it does not have the features of absolute nullity. Moreover, it would be pointless to repeat the sanction, which was regulated in art. 58 of the Civil Code and applies in civil law as a basic provision. Since the legislator decided to repeat and regulate the annulment sanctions separately in u.k.u.r. its character should be understood differently. Conclusions The analyzes carried out and the results presented give rise to an indication of the need to clarify the nature of the sanction which the legislator applied in art. 9 of the Act on shaping the agricultural system. The changes could properly allow the correct application of sanctions.

The legislator assumed that an application should be submitted for retirement and disability benefits from the general insurance system. When determining the form and content of the application, the legislator did not directly specify its legal nature, which is important for both the applicant and the pension authority. The specific nature of the benefit application implies legal consequences in terms of legal, factual and technical actions undertaken by the pension authority after submitting the benefit application. By analyzing the existing legal norms of a procedural nature, it is possible to determine these effects and, through their prism, determine the nature of an application for a pension benefit as an important element of a legal transaction. The development of the market relations in Ukraine had caused radical changes in socioeconomic life, which led to the introduction of new categories in business turnover. The main foundations of the legal solution of these issues have been reflected in the Civil code of Ukraine, which, however, is currently in the stage of permanent renewal. The practice of law enforcement confirms that, in connection with the significant renewal of the system of private legislation, there is an objective need for theoretical analysis and scientific generalization of the existing realities. In the context of the above, it is worth emphasizing the great importance that the legal actions play at the present time, in connection with which it is advisable to also take into account their place in the system of legal facts. A legal action is an action of a person aimed at acquiring, changing or terminating civil rights and obligations. They are divided into unilateral, bilateral and multilateral. A unilateral legal action is the deed of one party, which may be represented by one or more persons. A bilateral or multilateral legal action is an agreed deed of two or more parties. The general provisions on obligations and contracts shall apply to legal relations arising from unilateral legal actions, if this does not contradict the acts of civil legislation or the essence of the unilateral legal acton. At the same time, in judicial practice, sometimes there are difficulties associated with the qualification of certain deeds as legal actions. Legal actions, of course, will continue to be one of the most common grounds for the emergence, change and termination of civil legal relations, and the correct definition of the legal nature of a person’s deeds as a legal action is extremely important for the correct resolution of disputes between participants in civil transactions, compliance with the principles of legality, reasonableness, good faith and justice. In the conditions of the development of economic processes and modern technologies, the methods of performing legal actions, the requirements for their form, will be improved, and therefore it seems important in the future to update the approaches to the methods of protecting the rights and interests of their participants. In the work, the author analyzed the ideas of the philosophers of Ancient Greece and Ancient Rome, in which the first ideas about law, its operation and effectiveness were formed. It was noted that the historical doctrinal analysis of law is an important method of studying law, which allows studying legal institutions and processes, on the one hand - in the sequence in which they arose, developed and changed each other, and, on the other hand - how they were perceived and understood what place they occupied in the history of legal thought. The current state of scientific understanding of the specified category is a consequence of the long-term formation of a multifaceted worldview perception of the specified phenomenon, which developed historically. Therefore, the answer to the question: how and when the category «action of law» arises, as it was perceived by thinkers and philosophers of the past, is mandatory for research in legal science, since, using the historical-legal method of scientific knowledge in combination with the method of logical analysis, we have the opportunity to follow important changes in the legal doctrine, its certain improvement, to analyze for ourselves the existing legal ideas about the operation of the law and to use them in the practical plane. Based on the analysis of the views of philosophers (Socrates, Plato, Aristotle, Seneca, Cicero, etc.), the conclusions were drawn that: 1) in the ideas of the thinkers of Ancient Greece and Rome, the effect of law has not yet received its categorical distinction, while at the same time, they present the characteristics of law, which are provided from the point of view of the process and consequences of its spread to the territory of the respective state and to the population living there; 2) the teachings of antiquity about the state and the law were based on idealistic concepts of eternal justice, and the issue of its achievement and provision through the proper operation of the law had a secondary character; 3) significant attention in the views of thinkers was paid to natural law, and the question of the effectiveness of law mainly concerned positive (written) law, as such, which ensures the inviolability of the laws of nature by society and individuals; 4) legal ideas of thinkers laid not only the worldview basis for understanding the operation of law, but also influenced the further development of: a) worldview perception of law as an activity-oriented phenomenon; b) scientific knowledge of law as a functional phenomenon endowed with a set of regularities. Historically, swimming pools have been a focal point of racial tension. Discrimination and segregation are inextricably tied to the history of public swimming usage in the United States. Pools are public spaces that are physically and visually intimate. History has revealed that both de jure (enacted through the law by the government) and de facto (occurs through social interaction) discrimination have contributed to segregatory practices in the United States. The purpose of this article is twofold: 1) to examine the social pattern of discrimination that has stymied the growth of swimming in communities of color in the United States; and 2) to examine key legal cases that helped to mitigate discriminatory practices in the use of public swimming pools in the United States. Landmark cases such as Plessy v. Ferguson, Brown v. Topeka, and Dawson v. Mayor and City Council of Baltimore each helped to cast a bright light on the practice of segregation and public swimming pools. In spite of the history of discrimination and segregation relative to public swimming pools in the United States, citizens, stakeholder groups and professional associations must be advocates to ensure that public pools are protected and that the patterns of discrimination and "neuvosegregation" do not persist. Microfinance plays a vital role in assisting small and medium entrepreneurs to continue their businesses. This article discusses the importance of legal action against defaulting borrowers and the execution of legal action taken in Malaysia. Identifying the importance and execution of the legal action in Malaysia helps to understand the effectiveness of the legal process implemented against defaulting borrowers. The legal process implemented is also described in this article to help us understand the types of legal action against defaulting borrowers. This study is a doctrinal study of pure law. The data was obtained from relevant statutes, books, articles, and interviews methods covering five major microfinance institutions, including banking and non-banking. Finally, this study shows the implementation of legal action in microfinance institutions based on Foundation, Private Trust Body, Government Agency, Community Bank, and Cooperatives Bank where the findings of the study showed an increased repayment amount for each institution. This study will help Malaysia strengthen the national legal system to balance the needs of borrowers without distracting the importance of microfinance institutions. [ABSTRACT FROM AUTHOR]

Some legal practices, despite the creation in the world of credit and their identification by the Shari'a and the law, do not have the present effect and until the provisions and the necessary components of their complement are annexed, they are lacking a legal effects. These actions are considered to be correct for competency. Although, they have potential for full legal action. All the irrevocable and revocable contracts and financial unilateral acts, can be recognized as correct competency and with similar concepts, "the theory of contract management" and "relative nullity" has shared points in foreign law, but it also has differences. Volition, capacity and consent are the fundamental requirements of competency as legal action. The effects of competency is different in contracts which have "Mora'a" and "Moqouf" invalidity.Incompleteness of contract may lead to the revocation or termination of the contract or, in rare cases, to be ineffective. Competency in condition contrary to the requirement of contract, assuming relinquishing this condition, leads to survival of the contract, In terms of recognizing a desirable element and main goal of the contract, which has the ability to survive without the condition. Assurance of the titles also is effected by competency based on the jurisprudential theory, but in civil cod it should be distinguished; knowing as effect of competency wherever is considered as result of a void contract and effect of authenticity in articles that is considered as result of a proper contract. Introduction: Child sexual abuse is a disturbing reality and a major public health problem. Indeed, it is a subject that has long been treated as taboo, with dramatic consequences on physical and mental health as well as on social wellbeing of the victims. The purpose of this study was to highlight the epidemiological and clinical features as well as the legal aspects of child sexual abuse. Methods: we conducted a retrospective descriptive study at the psychiatric outpatient service of the University Hospital of Monastir over a period of 12 years and 6 months. All children younger than 18 years diagnosed with suspected or confirmed sexual assault were included. Results: a total of 93 children, victims of sexual abuse were enrolled. The average age of patients was 10 years, with a standard deviation of 3.9 years. Sex-ratio M/F was 0.9. The most common sexual contact was touching (47,3% of cases). The majority of abusers were male (93,5%). In more than half of the cases (53,8%) they were relatives of the child and in 28% of cases intrafamilial abuse was reported. Initial psychiatric assessment showed mental disorders in 70% of cases. Conclusion: sexual abuse is a very broad field of violence which varies widely in nature and intensity. Although, in some types of sexual abuse occasionally there is a lack of physical traces, the emotional and psychological impact is ubiquitous and characterized by numerous clinical manifestations. Purpose: Quality physical education (PE) reaches many objectives (e.g., knowledge, physical fitness, and physical skills) and could provide at least half the dose of recommended daily physical activity for youths if their opportunity to learn is provided according to national professional recommendations (min/week) and related state mandates. A 2015 California class-action lawsuit required affected schools to post data indicating they scheduled PE time meeting the state mandate of 200 min per 10-day period. The extent to which schools posted PE schedules on their websites and demographic factors related to their compliance was investigated in this study. Method: We performed a quantitative, cross-sectional content analysis of the websites of 37 school districts plus a random sample of 860 elementary schools in them. Z tests were used to analyze frequencies/proportions and associations among demographic (e.g., Hispanic enrollment, PE specialist) and PE schedule variables (e.g., schools meeting state-mandated PE time). Results: Twenty-two districts (59.4%) had websites with ≥1 page/document related to PE opportunities. Only 11% of schools posted PE schedules, an event that was associated with employing a PE specialist (p = .01). Of schools posting schedules, 68% specified a PE volume that met the state mandate. Meeting the mandate was independently associated with enrolling a minority of Hispanic students (p = .02). Conclusion: Websites can provide information about the importance/occurrence of PE; however, schools in the lawsuit did not use the potential of their websites to inform constituents either about the lawsuit or their PE programs. The author has presented different conception of dualistic divide on causation and non-causation legal actions. The analyses focuses on need to abandon that dualistic divide. The main argument is ambiguity word of causae. Author’s view is based on polish conventional legal actions theory. It professes that each legal action has got constructional and consequential principles, which are sufficient to describe consideration of them.
