The purpose of the research. The purpose of the article consists in determination of the current international legal regime of the territory of Crimea for further proper argumentation of Ukraine’s position in interstate disputes with the Russian Federation. Main content. Various forms of foreign military presence on the territory of a state have been studied, such as: occupation, conquest, deployment of foreign military bases, annexation, etc. Determined are signs that characterize the legal regimes of occupation and annexation and their international regulation. Methodology: Review of materials and methods based on analysis of documentary materials of the annexation of Crimea on the part of Russia. Conclusions. Characteristic features of annexation being currently a kind of aggression crime include unilateral declaration of state sovereignty over a territory which have not been a part of this state, as well as the legitimation of annexation through de facto ownership of a territory and international recognition of this fact. According to the international law, there is currently no legal mechanism for the transfer of sovereignty over territory to an aggressor through annexation. The purpose of the research is to highlight methodological approaches to understanding principles of law in the contextof modern globalization transformations. Main content. Their ontological, epistemological and axiological nature are revealed, in particular, links of the principles of law with human existence, science and other ways of world perception are being traced. Methodology: The methodological basis of the research is the dialectical method of scientific knowledge, through the application of this method considered were legal, functional, organizational and procedural aspects of methodological approaches to understanding of principles of law in the context of modern globalization transformations. Conclusions. The classification of the principles of law was singled out and a brief description of their types — universal principles, civilizational principles, and right-family principles and possibilities of separating principles of the national legal system was provided., El propósito de la investigación es resaltar enfoques metodológicos para comprender los principios del derecho en el contexto de las transformaciones de la globalización moderna. Se revela su naturaleza ontológica, epistemológica y axiológica, en particular, se rastrean los vínculos de los principios del derecho con la existencia humana, la ciencia y otras formas de percepción del mundo. Metodología: La base metodológica de la investigación es el método dialéctico del conocimiento científico, a través de la aplicación de este método se consideraron los aspectos jurídicos, funcionales, organizativos y procesales de los enfoques metodológicos para la comprensión de los principios del derecho en el contexto de las transformaciones de la globalización moderna. Méthodologie: La base méthodologique de la recherche est la méthode dialectique de la connaissance scientifique, à travers l'application de cette méthode, ont été considérés les aspects juridiques, fonctionnels, organisationnels et procéduraux des approches méthodologiques de compréhension des principes de droit dans le contexte des transformations de la mondialisation moderne. Revelam-se a sua natureza ontológica, epistemológica e axiológica, em particular, vão-se traçando ligações dos princípios do direito com a existência humana, a ciência e outras formas de percepção do mundo. Metodologia: A base metodológica da pesquisa é o método dialético do conhecimento científico, por meio da aplicação deste método foram considerados os aspectos jurídicos, funcionais, organizacionais e processuais das abordagens metodológicas para a compreensão dos princípios do direito no contexto das transformações da globalização moderna. Conclusões. Destacou-se a classificação dos princípios do direito e fez-se uma breve descrição de seus tipos — princípios universais, princípios civilizacionais e princípios de direito-família e possibilidades de separação de princípios do ordenamento jurídico nacional.

The scientific article is devoted to the characteristics of the procedure of providing administrative services in the field of taxation and fees. In Ukraine, the procedure for providing administrative services in the field of tax and levying needs to be improved. After all, in the Law of Ukraine “On Administrative Services”, the characterization of the mechanism of the procedure of providing administrative services in the field of taxation and collection contains only formal aspects and is reflective of other normative legal acts, which, in turn, leads to its own and quite opposite interpretation of norms by subjects of public administration.Regarding the directions of improvement of the procedure of providing administrative services in the field of taxation and collection there are: development and adoption of the Law of Ukraine "On Administrative Procedures"; the amount of payment for types of electronic services should be determined solely by laws, not by-laws; development and adoption of the Law of Ukraine “On Administrative Fee”, which should unify the name of the fee for administrative services; it is necessary to define uniform rates of administrative fees for all types of administrative services.The stages of the procedure of providing administrative services in the field of taxes and fees are established: 1) acceptance of documents and applications, their registration in accordance with the Model Instruction in the Central Executive Bodies, the Council of Ministers of the Autonomous Republic of Crimea, local executive bodies, approved by resolution Ministers of Ukraine dated November 30, 2011 No. 1242; 2) check of the completeness of the documents, the accuracy of the information provided, which can be carried out by inspecting and photographing the storage facilities, the surrounding area, checking the compliance of the storage facilities with the information, specified in the documents, attached to the application for authorization. According to the results of the “actual” inspection, an act is drawn up. The term of verification of both documents and compliance of future objects of conducting permitting activity is general and should not exceed 10 working days on the day of registration of the application; 3) making a decision on granting a permit or refusing to grant a permit, issuing a relevant decision by an order occurring within no more than 3 working days from the date of drafting the act; 4) registration of the object of permitting activity in the respective Register; 5) sending to the applicant an extract from the Register, Научная статья посвящена характеристике процедуры предоставления административных услуг в сфере взимания налогов и сборов. В Украине на сегодняшний время процедуры предоставления административных услуг в сфере взимания налогов и сборов требует усовершенствования. Ведь в Законе Украины «Об административных услугах» характеристика механизма процедуры предоставления административных услуг в сфере взимания налогов и сборов содержит только формальные аспекты и имеет отсылочный характер к другим нормативно-правовых актов, что, в свою очередь, приводит к собственному и довольно противоположного толкования норм субъектами публичной администрации.По направлениям совершенствования процедуры предоставления административных услуг в сфере взимания налогов и сборов являются: разработка и принятие Закона Украины «Об административных процедурах»; размер оплаты за виды электронных услуг должны определяться исключительно в законах, а не в подзаконных нормативно-правовых актах; разработать и принять Закон Украины «Об административном сборе», в котором должно быть унифицировано название платы за административные услуги; необходимо определить единые размеры административных сборов для всех видов административных услуг.Установлено стадии процедуры предоставления административных услуг в сфере взимания налогов и сборов: 1) принятие документов и заявления, его регистрация в установленном в соответствии с Типовой инструкции по делопроизводству в центральных органах исполнительной власти, Совету министров Автономной Республики Крым, местных органах исполнительной власти, утвержденной постановлением Кабинета Министров Украины от 30 ноября 2011 года № 1242; 2) проверка полноты, комплектности документов, достоверности предоставленных сведений, может проводиться и путем осмотра и фотографирования складских объектов, прилегающей территории, проверки соответствия складских объектов сведениям, указанным в приложенных к заявлению о предоставлении разрешения документах. По результатам «фактической» проверки составляется акт. Срок проверки как документов, так и соответствия будущих объектов производства разрешительной деятельности является общим и не должен превышать 10 рабочих дней дня регистрации заявления; 3) принятие решения о предоставлении разрешения или отказе в выдаче разрешения, оформление соответствующего решения приказом, что происходит в срок не более 3 рабочих дней со дня составления акта; 4) регистрация объекта разрешительной деятельности в соответствующем Реестре; 5) направление заявителю выписки из Реестра, Наукова стаття присвячена характеристиці процедури надання адміністративних послуг у сфері справляння податків і зборів. В Україні на сьогоднішній час процедури надання адміністративних послуг у сфері справляння податків і зборів потребує удосконалення. Адже в Законі Україні «Про адміністративні послуги» характеристика механізму процедури надання адміністративних послуг у сфері справляння податків і зборів містить тільки формальні аспекти та має відсильний характер щодо інших нормативно-правових актів, що, у свою чергу, призводить до власного і доволі протилежного тлумачення норм суб’єктами публічної адміністрації.Щодо напрямів удосконалення процедури надання адміністративних послуг у сфері справляння податків і зборів є: розроблення та прийняття Закону України «Про адміністративні процедури»; розмір оплати за види електронних послуг мають визначатись виключно у законах, а не у підзаконних нормативно-правових актах; розробити та прийняти Закон України «Про адміністративний збір», у якому має бути уніфіковано назву плати за адміністративні послуги; необхідно визначити єдині розміри адміністративних зборів для всіх видів адміністративних послуг.Встановлено стадії процедури надання адміністративних послуг у сфері справляння податків і зборів: 1) прийняття документів та заяви, її реєстрація у встановленому відповідно до Типової інструкції з діловодства у центральних органах виконавчої влади, Раді міністрів Автономної Республіки Крим, місцевих органах виконавчої влади, затвердженої постановою Кабінету Міністрів України від 30 листопада 2011 року № 1242; 2) перевірка повноти, комплектності документів, достовірності наданих відомостей, що може проводитися і шляхом огляду та фотографування складських об’єктів, прилеглої території, перевірки відповідності складських об’єктів відомостям, зазначеним у доданих до заяви про надання дозволу документах. За результатами «фактичної» перевірки складається акт. Строк перевірки як документів, так і відповідності майбутніх об’єктів провадження дозвільної діяльності є загальним та не повинен перевищувати 10 робочих днів дня реєстрації заяви; 3) прийняття рішення про надання дозволу або відмову у видачі дозволу, оформлення відповідного рішення наказом, що відбувається у строк не більше 3 робочих днів з дня складання акта; 4) реєстрація об’єкта дозвільної діяльності у відповідному Реєстрі; 5) надсилання заявнику витягу з Реєстру
