O presente trabalho tem por objetivo examinar a efetividade do “Simples Nacional”, enquanto principal gasto tributario brasileiro. Para tanto, sera feita uma analise das justificativas para o tratamento diferenciado das pequenas e medias empresas (PME), assim como uma comparacao do regime brasileiro com a tributacao de PMEs de outros paises.

The objective of this work is to demonstrate the organizational integration achieved through the implementation of a project management office (PMO), created to combat the loss of water distribution in one of the business units of Basic Sanitation Company of the State of São Paulo – Sabesp. The methodology used to achieve this goal was the study of a single case in which the information was obtained through documentary research and semi-structured interviews. The results showed how this integration was achieved with the adoption of a standard methodology in project management, control based on information technology and the spread of the organization's strategy in the sectors below. This work concluded that with this implantation of the project management office it was possible to improve the planning and the control of the activities of the projects through a pattern methodology in managing projects that gave possibilities to create a new culture focusing in solving problems.

Resumo A partir dos anos 1970, a importância das micro e pequenas empresas (MPE) para a economia passou, cada vez mais, a ser reconhecida, principalmente em função do seu papel na geração de empregos. Entre as medidas tomadas pelo governo brasileiro para incentivar e promover as MPE destaca-se a Lei do Simples Nacional, que passou a incluir entre os tributos abrangidos pelo regime tributário diferenciado o ICMS e o ISS. No entanto, muitas empresas que possuem condições de fazer a opção pelo Simples Nacional não optam por esse sistema, pois essa opção traria problemas relacionados à apropriação e à transferência de créditos de ICMS. O objetivo do presente trabalho é identificar e analisar os fatores que levam essas empresas a optar por um sistema de pagamento de tributos que lhes seria, em princípio, desfavorável para, a partir disso, contribuir com a discussão sobre o Simples Nacional como política pública de incentivo às MPE. Trata-se de uma pesquisa exploratória de natureza qualitativa em que foi utilizado o método de estudo de caso. Os resultados mostram que o Simples Nacional não funciona para empresas que têm como clientes grandes redes de varejo, pois elas são forçadas pelo mercado a não fazer a opção pelo Simples. Conclui-se assim que, para determinados setores como o da empresa estudada, o Simples Nacional não resultou em vantagem alguma e, além disso, acarretou uma grande desvantagem: a lei que o instituiu revogou o Simples Federal e essas MPE deixaram de poder pagar os tributos federais de forma unificada. Abstract From the 1970s, the importance of small business – SB – started to be increasingly recognized, mainly because of its role in generating employment. Among the measures taken by the Brazilian government to encourage and promote the SB, stands out the Simples Nacional law which included ICMS and ISS between taxes covered by the special tax regime. There are, however, many companies in condition to be in the Simples Nacional, but do not opt for this system, since this option would bring problems related to ICMS credits. The objective of this study is to identify and analyze the factors that lead these companies to opt for a system of paying taxes that would not be, in principle, favorable to them, in order to contribute to the discussion on the Simples Nacional and public policy incentives to SB. This is an exploratory qualitative research that used the method of case study. The results show that the Simples Nacional simply does not work for companies whose customers are large retail companies, because they are forced by the market not to make the option for the Simples system. Thus, the study concluded that, for certain sectors such as that of the company studied, the Simples Nacional did not result in any advantage for the SB and caused a disadvantage: the law that instituted it revoked the Simples Federal and the SB can no longer pay federal taxes in an unified way.

This Technical Report deals with the classification of projects, a process that allows the portfolio management of the project portfolio of the organization. Brings the analysis of an established classification models, the method Analytic Hierarchy Process (AHP), studied from a problem encountered in a real case. The unit of analysis chosen was the innovation department of a public institution of higher education because of the need to employ an organizational tool in the classification of research projects, using objective criteria. The work was aimed at pointing out a solution to this problem commonly faced by organizations. And with that, you want to answer the research problem: "How the AHP contributes to prioritization of projects in an objective way?". As search strategies were used bibliographical research and action research., O presente Relato Técnico trata da classificação de projetos, processo que possibilita o gerenciamento do portfólio da carteira de projetos da organização. Traz a analise de um dos modelos consagrados de classificação, o método Analytic Hierarchy Process (AHP), estudado a partir de um problema encontrado em um caso real. A unidade de análise escolhida foi o departamento de inovação de uma instituição pública de ensino superior, devido à necessidade organizacional em empregar uma ferramenta no processo de classificação de projetos de pesquisa, que utilize critérios objetivos. O trabalho tem como objetivo central apontar uma solução para este problema comumente enfrentado pelas organizações. E, com isso, pretende responder ao problema de pesquisa: “Como o método AHP contribui para priorização de projetos de forma objetiva?”. This article discusses the impact on the profitability of firms under Complementary Law 102/2000 (which abrogated the Law 89/96 – Kandir Law) allowing the appropriation of ICMS credits, due to investment in fixed assets goods, at a ratio of 1 / 48 per month. The paper seeks to demonstrate how this new system - which resulted in the transformation of the ICMS as a value added tax (VAT) consumption-type to an income-type - leads to a loss of approximately 30% of the value of credits to be recovered and the effect it generates on the cost of investment and the profits for small, medium and large firms. From the methodological point of view, it is a descriptive and quantitative research, which proceeded in three stages. Initially, we have obtained estimated value of net sales and volume of investments, based on report Painel de Competitividade prepared by the Federacao das Industrias do Estado de Sao Paulo (Fiesp/Serasa). Based on this information, it was possible to obtain estimates of the factors of generation of debits and credits for ICMS, using the model Credit Control of Fixed Assets (CIAP). Finally, we have calculated three indicators: (i) present value of debt recovery/value of credits, (ii) present value of debt recovery / investment value, (iii) present value of debt recovery / sales profitability. We have conclude that the system introduced by Complementary Law 102/2000 implicates great opportunity cost for firms and that legislation should be reviewed from this perspective, aiming to ensure lower costs associated with investment projects. Resumo O objetivo deste artigo e identificar e analisar os principais problemas na tributacao -tanto com relacao aos tributos quanto aos custos de conformidade a tributacao- das organizacoes da sociedade civil no Brasil. Trata-se de um estudo qualitativo de natureza descritiva. Foi realizado um estudo de casos em que foram coletadas informacoes de 26 organizacoes. Os resultados indicam que os problemas afetam principalmente as organizacoes com menor receita e que nao atuam nas areas de educacao, saude e assistencia social. Os principais problemas sao a tributacao da folha de pagamentos e dificuldades relacionadas a obtencao e manutencao das certificacoes. O estudo conclui com sugestoes para o aprimoramento do arcabouco regulatorio.

As tecnologias de Agricultura de Precisão (AP) já são adotadas nas lavouras do Brasil com técnicas cada vez mais produtivas, importantes para garantir a liderança do país na produção agrícola. No entanto, no Brasil não existem ainda estudos sobre a intensidade do uso de tecnologias de AP. O desafio central deste trabalho foi, então, investigar o processo de adoção e uso dessas técnicas alcançado pela indústria sucroalcooleira no Estado de São Paulo, região que concentra 60% da produção nacional de cana-de-açúcar. Para tanto, foram utilizados dados primários, a partir do encaminhamento de questionário a todas as empresas do setor sucroalcooleiro da região, com o objetivo de se conhecer, não só o grau de adoção e uso de tecnologias de AP, mas, também, aprofundar a discussão sobre o tema na indústria sucroalcooleira. Assim, foram obtidas informações sobre as características das empresas, as fontes de informação para adoção, os impactos nas empresas e os obstáculos encontrados às práticas das referidas tecnologias. As principais conclusões deste trabalho sugerem que a adoção e uso de práticas de AP trazem resultados positivos para as empresas, como por exemplo, a melhoria no gerenciamento, o aumento da produtividade, a redução dos custos, a minimização dos impactos ambientais e a melhoria da qualidade da cana-de-açúcar. Technologies of Precision Agriculture (PA) have already been implemented in Brazilian plantations, generating an increase of productive techniques, crucial to guarantying the country’s supremacy in agricultural production. However, there remain no studies concerning the intensity of PA technology use in Brazil. Thus, the principal challenge of this study was to investigate the process of adopting and using such techniques by the sugarcane industry in the state of Sao Paulo, an area that cultivates 60% of national sugarcane production. Hence, we used primary data, through a questionnaire submitted to all sugarcane companies within the area, aiming to ascertain not only the degree of adoption and use of such techniques, but to also elaborate on the debate concerned with the sugarcane industry. Therefore, information on the industries’ characteristics, sources of information for adopting the technology, and the impact and obstacles encountered for implementing the technology were gathered. The study’s prime results suggest that the adoption and use of PA techniques garner positive results for companies, such as: improvement in management; increase in productivity; cost reduction; minimizing environmental impacts and improvement of sugarcane quality.

This study uses a risk management perspective to analyze compliance costs arising from overlapping service tax (ST) jurisdictions. We study the case of an engineering company providing services to the Companhia de Saneamento Básico do Estado de São Paulo [São Paulo State Sanitation Company] – SABESP, a public entity. The engineering company was contracted under public law 8.666/93, to provide engineering service in several townships in São Paulo’s metropolitan area. Because the laws governing bidding do not permit later modification in price or provider, subsequent double taxation by one municipality cut into the firm’s margins, and should other local governments follow suit, multiple taxation would render the contract untenable for the provider. Our paper models the impact of conflicting jurisdictions on administrative burden, psychological costs and profit constriction and discusses project management techniques for decision making and management in similar situations., O presente estudo aborda a ocorrência da guerra fiscal envolvendo o Imposto Sobre Serviços – ISS, o custo de conformidade à tributação e a interação com a gestão do risco em projetos. Será analisado o caso de um prestador de serviços para a Companhia de Saneamento do Estado de São Paulo - SABESP, contratado por meio de complexo processo público de licitação, regido pela Lei 8.666/93, para prestação de serviço de engenharia em vários municípios da região metropolitana de São Paulo. Como, nesse tipo de contratação, o preço final ofertado e vencedor do certame não pode ser alterado, o impacto da bitributação e dos custos de conformidade em que a empresa incorreu em um desses municípios afetaram sua lucratividade e, se o mesmo problema tivesse ocorrido com a legislação dos demais municípios, poderia ter inviabilizada a prestação do serviço. Trata-se de demonstrar como o impacto sobre o custo relacionado ao imposto sobre serviço cobrado, ao tempo perdido e ao custo psicológico de lidar com a situação teria sido evitado, se uma metodologia de gestão de projetos que considerasse a gestão do risco tivesse sido utilizada. E de discutir as ferramentas da gestão de projetos para equacionar tal situação.

In this article, it is examined, from the perspective of the new institutional economy, the controversies involving the recent decision of the Brazilian Supreme Court that defends the distraining quality of the co-signer’s family assets.

O presente texto pretende mostrar como a distinção elaborada por Theodor Viehweg entre as perspectivas zetética e dogmática ainda pode contribuir para o diagnóstico e análise da crise do saber jurídico e da produção de textos jurídicos no Brasil.

The objective of this paper is to analyze the application of the ‘ability to pay’ principle to decisions of the Brazilian Supreme Court. In research carried out on the court website, the term ‘ability to pay’ appeared 70 times in court decisions, until November, 2008. To analyze the decisions, texts from Italian jurists were first used, especially Pietro Boria, who sought to demonstrate that the ability to pay principle in Italy is applied both in the protection of taxpayer interests and in the protection of the state. Decisions were divided into five groups, according to the interest protected and the subject involved. It was concluded that, although some times the principle was applied in the protection of the taxpayer interests, it was almost always applied in the protection of the state interests.

Since the 1970s, the importance of small business - SB - has increasingly been recognized in the world and in Brazil. Among the measures taken by the Brazilian government to encourage and promote SB, the National Simplified Taxation System - NSTS - stands out.§ There are, however, many companies that meet the requirements to be in the NSTS, but they do not opt for this system. The objective of this study is to identify and analyze the reasons for this decision. This is an exploratory qualitative investigation based on a case study. The results show that the NSTS simply does not work for companies whose customers are large retail companies. Thus, the study concludes that, for certain sectors, SBs face a drawback: SBs can no longer pay federal taxes in a unified way.

The objective of this paper is to identify and analyze the main problems in the taxation — regarding both taxes themselves and compliance costs of taxation — of civil society organizations in Brazil. This study is qualitative descriptive research. A multiple case study with 26 organizations was performed. The results show that the problems mainly affect organizations with lower revenue and that do not work in the areas of education, health or social care. The main problems involve the taxation of the payroll and the difficulties related to obtaining and maintaining certifications. The study concludes with suggestions for the improvement of the regulatory framework.

O objetivo deste trabalho é demonstrar a integração organizacional alcançada por meio da implantação de um escritório de gerenciamento de projetos (PMO), criado para o combate às perdas de água na distribuição em uma das Unidades de Negócios da Companhia de Saneamento Básico do Estado de São Paulo - Sabesp. A metodologia utilizada para alcançar este objetivo foi o estudo de caso único em que as informações foram obtidas através de pesquisa documental e entrevistas semi-estruturadas. Os resultados mostram como essa integração foi alcançada com a adoção de uma metodologia padrão em gerenciamento de projetos, o controle baseado na tecnologia da informação e a difusão da estratégia da organização nos setores inferiores. Concluiu-se que, com a implantação do escritório de gerenciamento, foi possível melhorar o planejamento e o controle das atividades de projetos, por meio de uma metodologia padrão para gerenciamento criando-se uma cultura com foco na solução dos problemas. Innovation, especially the revolution in innovation, is linked to the creation of a favorable enabling environment. According to Sabato and Botana (1968), innovations are the result of multiple and coordinated actions between three elements: government, structure of production, and scientific-technological infrastructure. Technology parks are the institutions which, par excellence, combine these three elements. In Brazil, they take many different legal forms, the spectrum ranging from private to public. There are examples of parks established as joint stock companies, social organizations, foundations, OSCIPS (civil society organization of public interest), and also are directly linked to the administration itself. The difference in legal structure is reflected directly in legal regimes and different management models. Differences in management and legal form may play a role in the ability of the park to offer suitable conditions for innovation. Of all the existing models, three presented themselves as the main foundations, joint stock companies, and social organizations. This is due to both the number of parks that follow these models and their importance of its relevance, since currently the parks have been created based on these three different structures. The objective of this study is to analyze seven technology parks Brazilians made according to these three models, in order to identify the advantages and disadvantages of the legal form chosen, and thus the conditions of each to foster innovation.

Para analisar as decisões, partiu-se dos trabalhos de alguns juristas italianos, em especial de Pietro Boria, que procuraram mostrar como, na itália, o princípio da capacidade contributiva foi aplicado tanto na proteção do interesse do contribuinte, como na proteção do interesse do fisco. Os acórdãos foram divididos em cinco grupos de acordo com o interesse protegido e a matéria envolvida. Concluiu-se que, no Brasil, ainda que, às vezes, o princípio tenha sido utilizado na proteção do interesse do contribuinte, foi quase sempre aplicado para a proteção do interesse do fisco. O tema desta dissertação é a apresentação e compreensão da teoria da interpretação do jurista norte-americano Dennis Patterson defendida em sua obra Law and Truth (1996) e artigos publicados entre o final dos anos 1990 e 2010, argumentando-se nesta pesquisa que a obra de Patterson contribui para o tema da interpretação jurídica, dentro da teoria contemporânea do direito desenvolvida no contexto da tradição analítica, com duas teses: (i) a defesa de que verdade de uma proposição jurídica é demonstrada pelo uso das formas de argumentação - tese epistemológica; (ii) uma proposta de critérios para a solução de desacordos argumentativos, para os quais a interpretação se faz necessária - tese metodológica. Com isso, a dissertação defende que a teoria de Patterson apresenta um conceito de interpretação mais adequado do que aquele oferecido pelas teorias da interpretação de Ronald Dworkin e de Stanley Fish, seus principais interlocutores. Por fim, a dissertação analisa a possibilidade de interpretação de casos claros através da teoria de Patterson, argumentando que em tais hipóteses há uma situação de compreensão, e não de interpretação. This dissertation\'s theme is the presentation and understanding of the theory of interpretation defended by the North-American jurist Dennis Patterson in his book Law and Truth (1996) and articles published between the end of 1990s and 2010s, arguing this research that Patterson\'s work contributes to the legal interpretation topic discussed within the contemporary jurisprudence with two theses: (i) the defense that the truth of a legal proposition is manifest by the use of legal forms of argument - epistemological thesis; (ii) a proposal of criteria for the solution of argumentative disagreements, for which interpretation becomes necessary - methodological thesis. Thus, the dissertation defends that Patterson\'s theory offers a more adequate concept of interpretation than Ronald Dworkin\'s or Stanley Fish\'s theories of interpretation, notably in the matter of decision criteria for argumentative disagreements. Finally, the dissertation analyzes the possibility of interpretation of clear cases through Patterson\'s theory, arguing that in such hypotheses there is a situation of understanding, not of interpretation.

Esta é uma pesquisa sobre a identificação de divergências inconciliáveis. Joseph Raz é um dos principais expositores contemporâneos do positivismo jurídico, porém sua tese não apenas é controversa, como também mal compreendida. Nesta pesquisa, defendo o argumento de que a má compreensão deve-se ao fato de ser ignorada uma premissa ontológica adotada por Raz. O filósofo supõe que práticas sociais não se referem a nada mais do que fatos socialmente praticados e, portanto, não as reconhece como fonte de normatividade. Com base nesse pressuposto, a natureza do direito não poderia ser investigada do mesmo modo como se investigaria a natureza de um jogo lúdico: aos olhos de Raz, ambos possuem estruturas lógicas e normativas completamente distintas. Com isso em vista, sustento que a divergência a respeito dessa questão de ordem ontológica gera um impasse insolúvel no debate a respeito da normatividade do direito. Para testar o argumento, examino as críticas que Dennis Patterson, Gerald Postema, Kenneth E. Himma, Nicos Stavropoulos, Ronald Dworkin e Stephen Perry fazem à teoria do direito de Joseph Raz. This is a research on the grounds of irreconcilable disagreements. Joseph Raz is one of the leading authors of legal positivism, whose theory generated a lot of controversy, matched only by the same degree of misapprehension. This research argues that this is due to the fact that an ontological premise held by Raz has been largely ignored. The philosopher considers that social practices are nothing more than socially practiced facts and, therefore, do not acknowledge them as a source of normativity. Furthermore, on that token, laws nature cannot be known and investigated in the same way games are known: according to Raz, both have completely different logical and normative structures. I sustain that there cannot be any fruitful debate regarding the normativity of law, until this ontological matter is not approached. This thesis was tested on the criticism made to the razian theory by Patterson, Gerald Postema, Kenneth E. Himma, Nicos Stavropoulos, Ronald Dworkin and Stephen Perry.

A tese tem por objetivo investigar como se forma o juízo sobre os fatos na decisão judicial. Parte-se do pressuposto de que um juízo verdadeiro sobre os fatos é condição necessária, ainda que não suficiente por si só, para a justiça da decisão. A estratégia adotada é estudar o processo de conhecimento ao longo do qual se forma o juízo sobre os fatos. Inicia-se a exposição afirmando-se que são objeto de julgamento, e, portanto, do processo de conhecimento, ações humanas, as quais são sempre singulares, irrepetíveis e praticadas no passado. Sustenta-se que as ações só podem ser apreendidas adequadamente quando se consideram todos os aspectos que a caracterizam, a saber: que a ação tem como causa um agente, que é praticada com base em motivos e com determinada intenção e que é praticada em circunstâncias que, em sua totalidade, só dizem respeito a cada ação particular. Definido o objeto, passa-se ao primeiro aspecto relativo ao sujeito do conhecimento: a análise da repercussão dos dois tipos clássicos de raciocínio decisório judicial sobre a apreensão das ações particulares do caso. Conclui-se que o raciocínio analógico favorece uma apreensão das ações ampliada em relação ao raciocínio subsuntivo. O raciocínio subsuntivo, por sua vez, inibe, mas não é incompatível, com essa apreensão ampla. O trabalho retorna ao objeto de conhecimento, desta feita para analisar o que se oferece ao conhecimento do juiz para obter informações sobre as ações humanas que serão julgadas. Conclui-se que esses elementos ou são evidências, sobre as quais o juiz realiza inferências, ou presunções, que ele aplica. Evidências e presunções contribuem de forma variada para a satisfação de critérios de verdade. A tese se encerra com um retorno ao sujeito do conhecimento judicial: a análise dos dois modos de ajuizar as informações obtidas mediante inferências obtidas das evidências e os resultados das aplicações de presunções. Pelo método de resposta a questões feitas com base na regra de Direito que se supõe aplicável é possível resolver o caso nos termos dessa mesma regra de Direito, mas com um possível déficit de verdade, pois ficam de fora do juízo os aspectos das ações não contemplados pelas questões formuladas. Pelo método narrativo, os fatos são expostos em toda sua amplitude, o que atende mais satisfatoriamente à pretensão de verdade que lhe é inerente. O método narrativo não é incompatível com o método de questões, mas o completa e serve de teste à verdade das respostas. The thesis aims to investigate how the judges opinion about the facts is built. Its basic assumption is that a true statement of the facts is a necessary condition to the justice of the decision, although insufficient by itself. The strategy adopted is to study the process of knowledge production which ends with the ascertainment of the facts. The study begins by saying that the object of trial, and therefore of the process of knowledge, are human actions, which are always unique, unrepeatable and practiced in the past. It is argued that actions can only be grasped properly when you consider all the aspects that characterize them, namely that the action is caused by an agent, it is practiced on the basis of reasons, with specific intention and that is practiced in circumstances that, in its entirety, only relate to each particular action. Set the object we pass to the first aspect of the subject of knowledge: the analysis of the impact of the two classical types of judicial reasoning on the task of knowing the particular actions of the case. It is concluded that analogical reasoning favours an expanded understanding of actions in relation to subsumption reasoning. Subsumption reasoning, in turn, inhibits, but is not inconsistent with, a broad approach to the facts. The work returns to the object of knowledge, this time to analyze what is offered to the attention of the judge to give him information about human actions that will be judged. We conclude that these elements are either evidence on which the judge makes inferences or presumptions that he applies. Evidence and presumptions contribute in different ways to the satisfaction of criteria of truth. The thesis concludes with a return to the subject of legal knowledge: the analysis of the two ways of ascertaining the information obtained through the inferences made on the basis of evidences and by application of presumptions. By the method of answering questions based on the rule of law that is supposed to apply it is possible to solve the case under that same rule of law, but with a possible deficit of truth, for the court doesnt take into account any information that is not an answer to the questions formulated. By the narrative method, the facts are exposed in all their diversity, which serves more satisfactorily to the claim to truth that must guide the judge. Moreover, the narrative method is not inconsistent with the method of questions, but functions as a complement and to test the truth of the answers.
