Abstract

The article explores challenges in the application of the jus in bello principle to clandestine and unconventional warfare activities. Topics discussed include modern U.S. unconventional warfare doctrine and the legal issues raised by clandestine and unconventional warfare activities. The status of surrogates in non-intentional armed conflict and in conducting clandestine activities is also discussed.
