Abstract

Mineral-associated organic carbon (MAOC) constitutes a major fraction of global soil carbon and is assumed less sensitive to climate than particulate organic carbon (POC) due to protection by minerals. Despite its importance for long-term carbon storage, the response of MAOC to changing climates in drylands, which cover more than 40% of the global land area, remains unexplored. Here we assess topsoil organic carbon fractions across global drylands using a standardized field survey in 326 plots from 25 countries and 6 continents. We find that soil biogeochemistry explained the majority of variation in both MAOC and POC. Both carbon fractions decreased with increases in mean annual temperature and reductions in precipitation, with MAOC responding similarly to POC. Therefore, our results suggest that ongoing climate warming and aridification may result in unforeseen carbon losses across global drylands, and that the protective role of minerals may not dampen these effects.

Abstract

Perennial plants create productive and biodiverse hotspots, known as fertile islands, beneath their canopies. These hotspots largely determine the structure and functioning of drylands worldwide. Despite their ubiquity, the factors controlling fertile islands under conditions of contrasting grazing by livestock, the most prevalent land use in drylands, remain virtually unknown. Here we evaluated the relative importance of grazing pressure and herbivore type, climate and plant functional traits on 24 soil physical and chemical attributes that represent proxies of key ecosystem services related to decomposition, soil fertility, and soil and water conservation. To do this, we conducted a standardized global survey of 288 plots at 88 sites in 25 countries worldwide. We show that aridity and plant traits are the major factors associated with the magnitude of plant effects on fertile islands in grazed drylands worldwide. Grazing pressure had little influence on the capacity of plants to support fertile islands. Taller and wider shrubs and grasses supported stronger island effects. Stable and functional soils tended to be linked to species-rich sites with taller plants. Together, our findings dispel the notion that grazing pressure or herbivore type are linked to the formation or intensification of fertile islands in drylands. Rather, our study suggests that changes in aridity, and processes that alter island identity and therefore plant traits, will have marked effects on how perennial plants support and maintain the functioning of drylands in a more arid and grazed world.

Abstract

The biggest challenge that micro-, small- and medium-sized enterprises (MSMEs) face in order to become successful is access to microfinance, particularly microcredit. However, that is not the only challenge they face. The article looks at the current landscape of MSMEs in South Africa and some of the challenges they face preventing their success. It considers current consumer-credit legislation and points out that it is not sufficiently supportive of improving the microcredit environment. It highlights the need to reform current credit legislation and other relevant legislation. It argues that better coordination between various South African government agencies is required. It also briefly considers whether the solution is to simply amend existing consumer-credit legislation and accompanying legislation or to rather create a single microcredit-specific statute. The article in essence examines the advantages and disadvantages of a single statute versus a concerted effort applying the statutory provisions in harmony. [ABSTRACT FROM AUTHOR]

17. Beneficiary Fraud and Demand Guarantees

Abstract

It is settled in South African and English law that for the fraud exception to apply to demand guarantees or letters of credit the fraud must have been committed by the beneficiary (or his agent with the beneficiary's knowledge) and not by a third party. Even where the fraud relates to a forgery or materially fraudulent document, the fraud must have been committed by the beneficiary for the exception to apply. This is in contrast with American law, where the fraud relating to forgeries and materially fraudulent documents does not necessarily have to be committed by the beneficiary. This contribution considers the law in this regard in these three jurisdictions.

Abstract

Grazing represents the most extensive use of land worldwide. Yet its impacts on ecosystem services remain uncertain because pervasive interactions between grazing pressure, climate, soil properties, and biodiversity may occur but have never been addressed simultaneously. Using a standardized survey at 98 sites across six continents, we show that interactions between grazing pressure, climate, soil, and biodiversity are critical to explain the delivery of fundamental ecosystem services across drylands worldwide. Increasing grazing pressure reduced ecosystem service delivery in warmer and species-poor drylands, whereas positive effects of grazing were observed in colder and species-rich areas. Considering interactions between grazing and local abiotic and biotic factors is key for understanding the fate of dryland ecosystems under climate change and increasing human pressure.

Section 126B is specifically analysed, and the question whether section 126B absolutely prohibits certain abusive practices related to the prescription of consumer debts is answered. Several shortcomings of the current legislation are also pointed out. In this article some aspects of the draft Prescription Bill proposed by the South African Law Reform Commission are also considered. In particular, we focus on the impact the Bill may have on the consumer-credit industry.

Abstract

The jurisdiction or competence of the Equality Court to hear a dispute concerning alleged hate speech is affected by various jurisdictional factors. The decision in South African Human Rights Commission v Khumalo 2019 1 All SA 254 (GJ) reveals several shortcomings in the provisions regulating jurisdiction in the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000 which must be attended to in order to provide clarity and legitimacy in regard to the application of the protection against hate speech.

30. The 2014 credit-information amnesty regulations: What do they really entail?

Abstract

Op 1 April 2014 het regulasies ingetree wat behels dat sekere nadelige verbruikerskredietinligting en inligting aangaande volopbetaalde siviele vonnisse van alle kredietrekords van verbruikers wat gehou word deur alle geregistreerde kredietburos verwyder moet word. Die regulasies maak voorsiening vir 'n proses ten aansien van die eenmalige verwydering van sodanige inligting sowel as om inligting aangaande volopbetaalde vonnisse op 'n voortdurende basis te verwyder. Die Nasionale Krediet Wysingswet 19 van 2014 maak ook voorsiening vir die deurentydse verwydering van sodanige inligting. Alhoewel die regulasies redelik eenvoudig is, is daar tog 'n paar fasette wat onduidelikheid veroorsaak. Grotendeels het dit te make met die korrekte interpretasie van sekere woorde en uitdrukkings wat in party subregulasies gebruik word. Dit is byvoorbeeld onduidelik of die regulasies ook van toepassing kan wees op sekere regspersone. Daar is ook nie sekerheid oor welke inligting steeds in verbruikers se betalingsprofiel mag verskyn en hoe sodanige regulasies die betalingsprofiele beïnvloed nie. Die regulasies bepaal duidelik dat die inligting wat verwyder is van die kredietrekords van verbruikers ingevolge die regulasies nie deur kredietgewers gebruik mag word tydens die assessering of 'n verbruiker kwalifiseer vir enige krediet nie. Wat die regulasie egter nie bepaal nie is of sodanige kredietgewer sodanige inligting mag gebruik waar hy dit bekom het deur nie na 'n kredietburoverslag te kyk nie, maar deur sy eie interne rekords na te gaan, byvoorbeeld in die geval waar hy met 'n bestaande kliënt te doen het nie. Hierdie aspekte, sowel as 'n paar ander, word in diepte in hierdie artikel bestudeer. Die impak wat die regulasies op die verbruikerskrediet mark tot dusver gehad het, sowel as 'n paar voordele en nadele van die regulasies word ook kortweg bespreek.

35. Prevention of Overindebtedness and Mechanisms for Resolving Overindebtedness of South African Consumers.

Abstract

Before, the National Credit Act of 2005 there was only one process, besides formal insolvency that overindebted consumers could make use of to alleviate their position. In terms of the Magistrates' Courts Act of 1944 a debtor who is unable to pay his debts may apply for an administration order provided that his debts do not exceed an amount of R50 000. An administration order is a debt relief measure available to some debtors that find themselves in financial distress and that afford them the opportunity to obtain a statutory rescheduling of debt sanctioned by a court order. In 2005 approximately 650 000 persons' affairs were being handled by administrators and there were about 1 200 such administrators in operation. Based on the limit on the amount of the debt, the debtors involved are usually from the lower income group and ignorant of their rights and the obligations of the administrator. In practice, an administration order is in many instances a failure. The procedure also does not provide for a discharge of debts and therefore many debtors remain in a debt-trap. The National Credit Act now creates another alternative to formal insolvency that will be available to all consumers. The Act provides for debt review and debt counselling in cases of overindebtedness. However, debt restructuring orders will only be effective if all the pitfalls and problems experienced with administration orders are properly addressed.
