As domestic affluence increases, nations advocate for conservation policies to protect domestic biodiversity that often curtail natural resource production activities such as fishing. If concomitant consumption patterns remain unchanged, environmentally conscious nations with high consumption rates such as the U.S. may only be distancing themselves from the negative environmental impacts associated with consuming resources and commodities produced elsewhere. This unintended displacement of ecosystem impacts, or leakage, associated with conservation policies has not been studied extensively in marine fisheries. This paper examines this topic, drawing on case studies to illustrate the ways in which unilateral marine conservation actions can shift ecosystem impacts elsewhere, as has been documented in land use interventions. The authors argue that the U.S. should recognize these distant ecological consequences and move toward greater self-sufficiency to protect its seafood security and minimize leakage as well as undertake efforts to reduce ecosystem impacts of foreign fisheries on which it relies. Six solutions are suggested for broadening the marine conservation and seafood consumption discussion to address leakage induced by U.S. policy.

Effort rights-based fisheries management (RBM) is less widely used than catch rights, whether for groups or individuals. Because RBM on catch or effort necessarily requires a total allowable catch (TAC) or total allowable effort (TAE), RBM is discussed in conjunction with issues in assessing fish populations and providing TACs or TAEs. Both approaches have advantages and disadvantages, and there are trade-offs between the two approaches. In a narrow economic sense, catch rights are superior because of the type of incentives created, but once the costs of research to improve stock assessments and the associated risks of determining the TAC and costs of monitoring, control, surveillance and enforcement are taken into consideration, the choice between catch or effort RBM becomes more complex and less clear. The results will be case specific. Hybrid systems based on both catch and effort are increasingly employed to manage marine fisheries to capture the advantages of both approaches. In hybrid systems, catch or effort RBM dominates and controls on the other supplements. RBM using either catch or effort by itself addresses only the target species stock externality and not the remaining externalities associated with by-catch and the ecosystem.

A community group was formed to consider establishing marine reserves within the Channel Islands National Marine Sanctuary in southern California. Membership included representatives from resource agencies, environmental organizations, commercial and recreational fishing interests, and the general public. While the group agreed on several areas for fishing closures, members could not reach consensus on a specific network design. Several factors interfered with the group’s effort in attaining agreement resulting in the endeavor subsequently being replaced by a “topdown” approach that lacks the support of the fishing community. Lessons learned from the project emphasize the need by marine protected area participants to recognize irreconcilable impasses early in the process and to seek solutions to maneuver around them. The importance of keeping the fishing community fully engaged is discussed.

US federal agencies must consult with the National Marine Fisheries Service on actions that may adversely affect “essential fish habitat” (EFH). This EFH mandate coincides with recent discussions on proposed decommissioning of oil and gas platforms in southern California. While many species falling under the Pacific Groundfish Fishery Management Plan (e.g. rockfish, genus Sebastes) inhabit platforms, available information is insufficient for determining whether the structures are necessary to support a sustainable fishery or contribute to a healthy ecosystem, the two basic tenets of EFH. The occurrence of juvenile and large adult rockfish at some platforms suggests that they may support important ecological functions. Because rockfish show long-term population declines, further evaluation of platform ecological structure and function is warranted and should be integrated into the environmental review process. Normally this would be viewed as competition for a common resource. With the passage of the Marine Mammal Protection Act (MMPA) in 1972, marine mammals are protected which has aided in the recovery of numerous species. Along the West Coast, the MMPA has been highly successful in the recovery of most stocks of California sea lions and Pacific harbor seals, and it has resulted in more frequent interactions with commercial and recreational fishermen, causing damage to fishing gear and loss of catch. Non-lethal methods to eliminate or reduce pinniped predation have been unsuccessful. This paper summarizes the issue of marine mammal depredation in general, examines some of the economic damages, and discusses efforts to minimize these interactions.

The courtship behavior of the blue rockfish, Sebastes mystinus, is described from underwater observations off southern California. Courtship activity corresponded with male gonadal recrudescence, beginning in late summer-early fall, and extending until early winter. Courtship occurred just above the substratum at reefs deeper than 15 m. Males were the active participants during courtship while females were relatively inactive. Males performed a sequence of stereotyped movements to the motionless females that included a "front position," "lateral pass," "tail fan" and "turn." Females attracted varying sized entourages of males, but only a few males actually courted the female. Females were frequently courted within short periods of time but never appeared aroused. Arguments are presented that courtship behavior in blue rockfish functions in persuasion leading to mate selection.
