Neste artigo abordaremos a história da elaboração e da tramitação do Código Penal de 1969, objeto em torno do qual se desenvolveu grande parte das discussões travadas entre os penalistas notáveis no período da ditadura civil-militar brasileira. Investigaremos o processo de vida e morte do Código: a elaboração do anteprojeto e o advento do golpe de 1964, a atuação da Comissão revisora, os impasses decorrentes do contexto político, os anteprojetos alternativos, a promulgação do código, os adiamentos da entrada em vigor, os debates parlamentares, as alterações legislativas e a revogação definitiva. In this paper we will discuss the history of the elaboration and processing of the Penal Code of 1969, object of the discussions developed between penal law experts during the period of the brazilian civil-military dictatorship. We will investigate the life and death process of the Code: the preparation of the law draft and the advent of the 1964 coup, the performance of the review Commission, the impasses arising from the political context, the alternatives law drafts, the promulgation of the code, the postponement of entry into force, the parliamentary debates, the legislative changes and the definitive repeal.

No presente estudo discutiremos as relações entre criminologia, ordem, dominação, violência e transformação social, buscando respostas desde o criticismo criminológico. Inicialmente, refletiremos sobre as diferentes perspectivas das quais partem a criminologia (crítica) e a segurança pública, argumentando que tais saberes possuem premissas distintas e que é imprescindível não perder de vista tais diferenças. Na sequência, vamos investigar a atual relação das classes sociais da sociedade brasileira com o sistema penal, principalmente da classe trabalhadora e do subproletariado, de maneira a retomar a discussão acerca desse tema. In the present study we discuss the relations between criminology, order, social domination and violence in search of answers through the prism of criminological criticism. Firstly, we reflect on the different perspectives of critical criminology and criminal policy, arguing that such knowledge has different assumptions and that it is essential not to lose sight of such differences. In the sequence, we investigate the current relationship of social classes in the Brazilian society with criminal justice, especially the working-class and the sub-proletariat, in order to resume the discussion on this topic.

No presente artigo buscaremos compreender os pressupostos profundos da cidadania moderna, desde sua matriz liberal construída na Europa. Na segunda parte, tentaremos verificar os efeitos de tal concepção de cidadania no contexto de um país de modernidade periférica como o Brasil. In this paper, we intend to understand the concept of modern citizenship, from your liberal standard built in Europe. In the second part, we will try to analyze the effects of this concept in the context of Brazil.

Partindo do referencial teórico da criminologia crítica, o presente artigo pretende retomar a crítica radical ao controle penal, superando os reformismos em busca da utopia anticarcerária. Based on the theoretical framework of critical criminology, this paper intends to resume the radical critique of punishment, overcoming reformisms on behalf of the utopia of the abolition of prison.

O estudo descreve as formas de gestão penal do crime de porte de droga para consumo pessoal nos Juizados Especiais Criminais da cidade de Porto Alegre. A pesquisa constituiu na análise de 105 processos, no ano de 2009, na capital gaúcha. Em paralelo, foram utilizados procedimentos metodológicos, como a observação de audiências, entrevistas e algumas incursões etnográficas. A pesquisa possibilitou perceber a ingerência inadequada do sistema penal nos casos de consumos problemáticos e não problemáticos. O artigo intenta, portanto, apresentar argumentos antiproibicionistas que sensibilizem o Judiciário na efetivação do processo (judicial) de descriminalização, sobretudo em decorrência do reconhecimento de repercussão geral sobre a matéria pelo Supremo Tribunal Federal. The study describes how crimes of drug possession for personal consumption are managed by the Special Criminal Courts in the city of Porto Alegre. The research comprises the analysis of 105 lawsuits throughout the year of 2009 in the state capital. The methodological procedures adopted included the attendance to court hearings, interviews and some ethnographic incursions. Inadequate management in cases of problematic and non-problematic consumption was observed. The article attempts, thus, to present anti-prohibition arguments that are able to sensitize the Judiciary in the implementation of the (judicial) descriminalization process, mainly due to the fact that this issue was granted the status of general repercussion by the Supreme Court.
