Abstract

The article discusses the aim of the Transatlantic Reflection Group on Democracy and the Rule of Law in the Age of Artificial Intelligence (AI) to address challenges facing democracy caused by monopolies and centralized governance of AI. It describes the formation of the interdisciplinary group, its concerns regarding AI systems and the importance of reforming laws governing such technologies. It presents the group's manifesto outlining the principles to follow in addressing the challenges.

13. Transparency and Accountability of EU Decentralised Agencies and Agencification in Light of the Common Approach on EU Decentralised Agencies

Abstract

Since transparency and accountability are core values of good governance, they also determine to a large degree the legitimacy of the EU decentralized agencies and the process of agencification itself. This chapter argues that there are three levels (macro, meso and micro) at which good governance can be assessed, focusing on (i) the process of agencification itself, (ii) the establishing instrument of an individual agency and (iii) the actual functioning of the agency. As regards the macro level, the chapter analyses the 2012 Common Approach on EU Decentralized agencies to conclude that the CA has not improved the accountability of agencification and has only slightly improved the transparency of the process. Turning to the meso level, the analysis of the CA shows that the EU institutions have imposed an incomplete and partial form of accountability on EU agencies, mainly because there was no agreement between themselves on the role and place of EU agencies in the EU's institutional setup. This problematic conceptualization of accountability results in knock on effects for transparency as conceptualized in the CA, given that transparency is a necessary but insufficient condition for accountability.

Abstract

There is no doubt that technology has shaped democracy. However, it is also the legal rules concerning technology which have shaped and have been shaped by democracy. Developing and using technologies according to democratic rules is what we need. There are libertarians today who deliberately design technological systems in a way that makes control by democratic states increasingly difficult. However, there is sufficient counter power and engagement, at least in Europe, to ensure that democracy functions and we work together to produce rules that are sensible for the future of democracy and confirm the supremacy of democracy over technology and business interests. 19. Constitutional democracy and technology in the age of artificial intelligence.

Abstract

Given the foreseeable pervasiveness of artificial intelligence (AI) in modern societies, it is legitimate and necessary to ask the question how this new technology must be shaped to support the maintenance and strengthening of constitutional democracy. This paper first describes the four core elements of today's digital power concentration, which need to be seen in cumulation and which, seen together, are both a threat to democracy and to functioning markets. It then recalls the experience with the lawless Internet and the relationship between technology and the law as it has developed in the Internet economy and the experience with GDPR before it moves on to the key question for AI in democracy, namely which of the challenges of AI can be safely and with good conscience left to ethics, and which challenges of AI need to be addressed by rules which are enforceable and encompass the legitimacy of democratic process, thus laws. The paper closes with a call for a new culture of incorporating the principles of democracy, rule of law and human rights by design in AI and a three-level technological impact assessment for new technologies like AI as a practical way forward for this purpose.This article is part of a theme issue 'Governing artificial intelligence: ethical, legal, and technical opportunities and challenges'., (© 2018 The Author(s).)
