The Twenty-Fifth Amendment of the United States Constitution contains a mechanism that enables the Vice President, with the support of a majority of the Cabinet, to temporarily relieve the President of the powers and duties of the Presidency. The provision has never been invoked, but was actively discussed by multiple Cabinet Secretaries in response to President Trump's actions on January 6, 2021. News reports indicate that at least two Cabinet Secretaries-Secretary of State Mike Pompeo and Treasury Secretary Steve Mnuchin-tabled these discussions in part due to uncertainties about how to operationalize the Amendment. Specifically, the Secretaries were concerned that the text of the Amendment did not specify whether Acting Cabinet Secretaries (of which there were three at the time) should be included in the vote. This Article considers that question in light of both the common law and Supreme Court of the United States precedent, concluding that Acting Secretaries should indeed be counted. Doing business and investing both require mindfulness about risk, and market regulatory systems aim to ensure risk is appropriately disclosed. Recent discussions of today's international system of Great Power Competition by U.S. Secretary of State Mike Pompeo mention risk from China's Military- Civil Fusion ("MCF"). For U.S. and U.K individuals and business firms looking to invest in and do business with China, MCF awareness requires consideration of the ways in which all individuals and institutions in China are called to a duty that transcends their personal and civilian identities in their observable roles. As courts and regulators in China continue to demonstrate everimproving professional procedures for dispute resolutions and regulatory investigations, including fairness in avoiding bias towards either litigating party when both parties are ordinary commercial entities, connecting the dots to MCF reveals a distinct category of embedded risk. MCF imposes obligations flowing in multiple directions among personnel in Chinese courts and agencies, national leadership, national security apparatus, and state-owned or statechampioned commercial firms. This risk fits well with familiar tool kits used by U.S. and U.K. investors, business firms, and related commercial parties to make their own best-informed business decisions, as well as the familiar toolkits used within the broader ecosystem of financial regulators and private parties who bring civil litigation, investigation, and whistleblower claims for material misstatements and the like. In July 2019, Secretary of State Mike Pompeo launched a Commission on Unalienable Rights, charged with a reexamination of the scope and nature of human rights–based claims. From his statements, it seems that Pompeo hopes the commission will substantiate—by appeal to the U.S. Declaration of Independence and to natural law theory—three key conservative ideas: (1) that there is too much human rights proliferation, and once we get things right, social and economic rights as well as gender emancipation and reproductive rights will no longer register as human rights; (2) that religious liberties should be strengthened under the human rights umbrella; and (3) that the unalienable rights that should guide American foreign policy neither need nor benefit from any international oversight. I aim to show that despite Pompeo's framing, the Declaration of Independence, per se, is of no help with any of this, whereas evoking natural law is only helpful in ways that reveal its own limitations as a foundation for both human rights and foreign policy in our interconnected age.
