This is Part II of the reporting of FAIRCOM, a collaboration of partners, both academics and NGO's, in several member states of the European Union. This Report part II presents the results of an investigative study on State Compensation and Offender Compensation in the current five partner countries: Greece, Italy, Latvia, the Netherlands and Spain. It identifies good practices en offers recommendations. It is the follow-up of the first FAIRCOM Report ('Fair and Appropriate? Part I'). There will also be a Final Report. La ricerca che presentiamo è stata condotta dall’équipe della cattedra di Psicologia sociale e giuridica dell’Università degli Studi di Sassari. La sua finalità è quella di contribuire alla riflessione sui Restorative Approaches, attraverso due specifici focus di indagine che riguardano la rilevazione dei modelli di giustizia riparativa utilizzati: a) nelle scuole per la progettazione di interventi nei casi di bullismo; b) nei servizi della giustizia minorile per la programmazione e realizzazione di progetti rivolti ad adolescenti che hanno commesso reato.

Lo studio esamina il reato di molestia o disturbo alle persone, le sue dinamiche, la distribuzione territoriale, il profilo della vittima e del molestatore.

The concerned research had the aim to deeply examine the current state of the general theory of family law, according to an approach which sees it belonging to the category of social rights, by means of the study of the protection of the main family rights, considered in conjunction with the adult person in custody, and of the way this discipline has been modified over time, due to social changes and thanks to the science of legal psychology. This paper highlights the theories which recognize the private law as a legal matter more and more mindful of social relationships and more and more looking after the consequences that different private-law institutes unavoidably produce inside the relationships established among the associates. The family law is no longer on the border between private and public law, but rather in the social law category, understood as a third genus and as a new shared legal tool between private and public law. The issue of the general theory of family law applied to prison law has been dealt purely with psycho-legal tools. Indeed, the focal point of this work is precisely the analysis of the relationships which tie all the individuals involved inside the detention context and all different profiles, to protect the same relationships according to the references placed before by the general theory of family law.

The research project focuses on early school-leaving and well-being promotion in school environment through peer intervention training. It provides a theoretical framework of early school-leaving by showing the difficulties encountered in the literature (Morrow, 1986; Besozzi, 1993; Morgagni, 1998; Liverta Sempio, 1999; Colombo, 2010) to attribute unambiguous definitions. Through a historical overview from the nineties up to now, we retrace the main steps that have led to the evolution of the issue and the policies adopted, nationally and internationally, to face it. The work takes the form of an action-research carried out in the school year 2014/2015 in the middle school’s first grade classes at the Comprehensive Institut Li Punti in Sassari (Italy). Starting from the representations of teachers, parents and students, we try to create, facilitate and observe a process of improvement through a training program, addressed to teachers and pupils. It is inspired by the model of the Life skills (WHO, 1993; Boda, 2001; Boda, Mosiello, 2005; Patrizi Bussu, 2010; Bussu, 2011) through the use of peer education (Boda, 2001; D'Angiò, Recco, Cinquegrana, 2006; Franzese, 2009) and the peace circle (Boyes-Watson, 2005; Pranis,2005; Boyes-Watson, Pranis, 2015), as a restorative practice aimed at creating a positive environment. The research methodology is mix-method. The instruments used are: interviews, focus groups, observation and questionnaires.

This project aims to assist the public in an “Socratic” action that will lead them to discover and support the social, relational and affective potential they already own, helping them to discover and enhance their “Relational Goods”. The project is characterized by elements of originality, for the absence of similar experiences in this field. This fact has led the project team to anticipate the future, abandoning the desire and / or the willingness to apply “reassuring schemes” (Formez-Strumenti 38, 2007). Within this conceptual framework was born on the research project that is facing uncertainty and to leave the safety of projects structured by the desire to leverage intangible instances and not just on those measurable. The goal is to use the building as a “unit” for a trial of interpersonal relationships based on the economic and social theory of “Relational Goods”, which sees modern man becoming more and more unhappy because reduced to an isolated consumer monad.

The research project focuses on the role of communication in the context of educational and vocational guidance. Recent studies (Sibel Akel, 2005; Balmer, Liao, 2007) have supported the role of in university settings, reporting best practice’s policies implemented in the case-studies. This perspective offers a wide insight into communication among universities despite it doesn’t take in consideration the field of guidance and its implications for communication that manages all decision-making and production processes. In order to fulfill the purpose of this research it was carried out a study of: the corporate culture, the self and perceived collective efficacy, the reflective learning, the empowering approach, the organizational communication, the strategic and relational marketing, the model of the university as a business-network professional. These models were analyzed in their applications in the guidance services in national and international field (Rome and Barcelona). This work is an action research which aims to investigate in depth the context of the case study (“Centro Orientamento” - University of Sassari) to speculate and propose an organizational change, marked by the quality of services through the improvement of communication processes. The research method is mainly qualitative and instruments that were used are interviews, focus groups and questionnaires.
