The rapidly increasing digitalisation of financial markets also has an impact on the requirements relating to their supervision and regulation. The first issue of the new series of publications by the German regulator, the Federal Financial Supervisory Authority (BaFin) "BaFin Perspektives ",' set to be published twice a year, addresses a whole range of issues relating to digitalisation in the financial sector. While the statements made by the regulator in these publications are by no means of a legally binding nature, they do refect a practice-relevant attitude expressed by BaFin which market participants should regard as general tendencies of financial supervisory culture and attitudes which may' ultimately crystallise in legally binding acts. The following legal analysis aims to provide a summary of selected issues relating to digitalisation in the financial sector from a regulatory perspective which are addressed by BaFin in Issue l of the new series. It focuses on how supervisory and regulatory authorities treat big data and artificial intelligence (BDAI) and on the security and regulation of blockchain technology, including how tokens are categorised in the context of regulation.
