What does non-hierarchical governance mean? Under what conditions are actors likely to engage in it? Which trajectory best captures its long-term evolution? Through which mechanisms does it overcome gridlock? To respond to these questions at the heart of regulatory governance, Experimentalist Governance develops an analytical framework that draws on contemporary debates but seeks to overcome their limitations. Notably, it offers a definition of non-hierarchical (experimentalist) governance that goes beyond institutional structures, focusing attention on actors'choices and strategies. It shows that, contrary to expectations, functional and political pressures were more influential than distributions of legal power, and bolstered one another. Strong functional demands and political opposition influence actors'capacity of using powers which, de jure, might be concentrated in their own hands. Indeed, actors can use non-hierarchical governance to aid learning and mould political support. Conversely, they may override legal constraints and impose their views on others, insofar as they are equipped with confidence and powerful coalitions beforehand. This book also challenges conservative views that non-hierarchical governance is doomed to wither away, showing that, on the contrary, it is often resilient. Finally, it demonstrates that, far from being alternatives, positive (shadow-of-hierarchy) and negative (penalty-default) mechanisms to avoid gridlock are frequently complementary. By analysing five crucial domains (electricity, gas, communications, finance, and pharmaceuticals) in the European Union, an examination is made of when, how, and why non-hierarchical institutions affect policy processes and outcomes. Combining temporal, cross-sectoral, and within-case comparisons with process-tracing, this book ultimately illustrates the conditions, trajectories, and mechanisms of non-hierarchical governance.

This book examines the position and role of expertise in European policy-making and governance. At a time when the very notion of expertise and expert advice is increasingly losing authority, the book addresses these challenges by empirically examining specific administrative processes and institutional designs in the European Union. The first part of the volume theorizes expertise and its contestation by examining accounts of the legitimate institutional design of knowledge production processes and exploring the theoretical links of Europeanisation and expertise. The second part of the book delves into empirical institutionalist accounts of expertise and maps the role of experts in a variety of EU institutions but also explains the implications when EU bodies themselves are in an ‘expert'position, such as agencies. The book offers insights into how individual experts deal with the challenge of producing reports that will be heard by policy-makers, while at the same time preserving their independence. Broadening its scope, the book then expands the analysis to the role of advisory committees in light of the shift from a reliance primarily on in-house expertise to including more external experts in advisory groups in the European Commission and European Parliament as well as at the European External Action. This book analyses how the European Union should react to the threats and challenges it faces today. Europe's external problems concern first of all the geopolitical threats at its external borders, such as the Russia/Ukraine crisis, the ongoing conflicts in the Middle East, the anti-democratic developments in Turkey and the unrest in Northern Africa; and secondly the challenges of refugee flows, terrorism, climate change and the changing relationship with the United States. Internally, the Union has to deal with the aftereffects of the economic crisis, the impact of migration on national societies, the rise of populism and ‘Brexit'. These threats and challenges can only be countered effectively through concerted action by the Member States. However, EU cooperation is essentially a voluntary process, while the abovementioned problems are politically highly sensitive issues. Moreover, for every step forward in the integration process consensus is required between all Member States. Yet such a consensus becomes more and more difficult to attain, due to the growing number of Member States and their increased heterogeneity. The author therefore presents several concrete proposals for more flexible and differentiated EU integration, such as new models of enhanced cooperation, the establishment of an EU Security Council, and the simplification of the ordinary treaty amendment procedure.

This book furthers the ongoing theoretical development of the multiple streams framework, assessing its applicability to European Union (EU) policy-making processes. It systematically defines and identifies functional equivalents for all of the framework's core concepts at the EU level and extends the framework in order to explain agenda-setting and decision-making. Furthermore, the book derives a set of explicit hypotheses to empirically assess the extent to which the (modified) framework is able to explain timing, agenda prominence, and policy change (or a lack thereof) for the EU natural gas directives passed in 1998, 2003, and 2009. The analysis documents that the framework is well-suited to explain the EU policy process in general and reveals where additional theoretical refinements are required.

In the 21st century, think tanks have become more than a buzzword in European public discourse. They now play important roles in the policy-making process by providing applied research, building networks and advocating policies. The book studies the development of think tanks and contemporary consequences in the United Kingdom, Germany, Denmark and at the EU-level. A Continental think tank tradition in which the state plays a pivotal role and an Anglo-American tradition which facilitates interaction in public policy on market-like terms have shaped the development of think tanks. On the basis of a typology of think tanks, quantitative data and interviews with think tank practitioners, the interplay between state and market dynamics and the development of different types of think tanks is analysed. The European Union (EU) has a compliance problem: there are persistent failures in the implementation of EU rules and policies by the member states. This book examines how policy implementation may be improved. Public administration has traditionally been characterised with such bureaucratic features as hierarchical and formalised organisational structure, clear and rigid career paths, lifetime tenure, full-time employment, principle of seniority, advantageous pension schemes and rigid remuneration systems. These features were introduced in late 19th century to reduce the risk of excessive political influence, corruption, misconduct and instability of government. Today, however, numerous administrative and managerial reforms are affecting these longstanding aspects of public employment. Size and composition of workforce, its working and employment conditions, nature of work, and values and legal status are all undergoing a process of change. The various reforms are also gradually shrinking the size of central public administrations of the EU-27 Member States. They are becoming more decentralised and fragmented, more diversified, more aligned and less specific. The on-going financial crisis and the introduction of hasty austerity measures have a strong impact on the public workforce in most EU Member States. So far, restructuring programmes and effects of austerity measures have not been a subject of rigorous scrutiny. Similarly, the effects of public management reforms have not been studied either and have resulted in national administrations having no longer a single coherent framework. Filling this important gap, this comparative study attempts to assess the effects of these developments in public employment in the central public administrations of the EU Member States offering insight into the future of public employment.

Constructing a Policy-Making State? sets out to examine the processes by which Europeanization takes place. Europeanization is defined as the process by which the key decisions about public policies are gradually transferred to the European level (or for new policy areas, emerge at the European level). This is in contrast to definitions of Europeanization which focus on the adaption of member states to European public policies. Thus, the main focus is whether a European Union'policy-making state'is being created via changes in the distribution of power between member states and the European level institutions over time. In addition to several overview chapters (such as on agenda setting in the EU), there are twelve sectoral studies which analyse the differing trajectories and outcomes of the Europeanization process and the extent to which the European Union can make'authoritative allocations'. The case studies have been selected in order to illustrate the degree of cross-sectoral variation in the process of Europeanization, from sectors which have yet to see very much Europeanization, such as health, to sectors such as competition policy which are almost fully Europeanized. The book is consciously multi-theoretic in its approach, drawing on a range of theories and concepts, from theories of European integration, to theories of public policy processes.

This volume assesses the implementation of the EU's cohesion policy and the role that the policy has in stimulating ten new member states from eastern and southern European countries to join the EU in 2004 and another three to four countries that will join in the near future.

Efforts to tackle the trade impeding effects of divergent standards and regulations are at the core of European economic relations. This volume draws on literature from several disciplines to develop a comprehensive account of the regulatory strategies and institutional arrangements adopted by the EU in promoting the single market in goods. It provides a historical overview and detailed cases studies of the various policy initiatives that have altered the boundaries between the public and private sector in fostering market integration. Tackling interstate barriers to trade has relied heavily on European law to shape the framework of relations between states, and trade liberalization has been facilitated by legal rulings resolving territorial conflicts over regulatory jurisdiction and authority. The European Court of Justice has actively shaped markets, acting as a'free trade umpire'in balancing the goals of market liberalization and market regulation while fostering market compliance. Although markets are absolutely dependent on public authority, the institutional innovation of the EU has been to use the private sector in an ancillary role to the state. By delegating responsibility to set standards for market access, the EU has chosen to draw on the resources of private actors, resulting in a system of governance that is a distinctive, hybrid model of regulation composed of state and non-state actors. Though the'outsourcing'of public sector regulatory activity was expected to be more effective than the process of regulatory harmonization, progress has been difficult. The current deficit in setting standards for European-wide market access raises concerns about the efficiency and effectiveness of such a regulatory regime. Egan provides a detailed evaluation of that process, highlighting regulatory gaps in the single market and the need to focus not only on the process of market integration, but also its outcome and impact on European business. Comparisons with American efforts to create a national market are made throughout to demonstrate the difficulties of constructing and maintaining a single market. American and European efforts to devise a uniform market for commerce and trade have involved both public and private authorities, though with different degrees of coordination and centralization, as many of the strategies undertaken by the EU echo earlier American market-building efforts.

This book is the second of two volumes that examine how EU member states co-ordinate their European policies. In this second volume, the focus is on the European level. The book investigates the strategies deployed by eleven member states — Austria, Belgium, France, Germany, Greece, Ireland, Italy, the Netherlands, Portugal, Sweden, and the United Kingdom - and examines the role played by the permanent representation, and the structures and processes that link national officials in Brussels and at home. From a comparative perspective, the book identifies and assesses the organisation, functions and effectiveness of the permanent representation, and the part that it plays in the national system of co-ordination. It considers the influences that have shaped systems of national co-ordination — the demands exerted by Union membership, the institutional structure of the national polity, the pre-existing balance between domestic institutions, administrative norms and values, and attitudes, both popular and elite, to European integration. It assesses the extent to which there has been a convergent response to the administrative challenges posed by membership on the part of the member states or whether a pattern of divergence endures. The question of effectiveness is also addressed. The companion volume explores co-ordination institutions, structures and procedures at the domestic level. Looking at ten member states, it offers a comprehensive comparative analysis of the way in national governments organise European policy making.

Policy-Making and Diversity in Europe examines the European polity and its policy-making processes. In particular, it asks how an institution which is so riddled with veto points manages to be such an active and aggressive policy maker. Héritier argues that the diversity of actors'interests and the consensus-forcing nature of European institutions would almost inevitably stall the decision-making process, were it not for the existence of creative informal strategies and policy-making patterns. Termed by the author'subterfuge', these strategies prevent political impasses and'make Europe work'. The book examines the presence of subterfuge in the policy domains of market-making, the provision of collective goods, redistribution and distribution. Subterfuge is seen to reinforce the primary functions of the European polity: the accommodation of diversity, policy innovation and democratic legitimation. Professor Héritier concludes that the use of subterfuge to reconcile unity with diversity and competition with co-operation is the greatest challenge facing European policy-making.

The book presents a theoretically informed typology of modes of governance which is tested in a careful selection of comparative country and policy studies.
