VARIETIES OF RESISTANCE 1425 INTRODUCTION In his [...], Walter Dellinger's 1994 Memorandum Opinion for the Office of Legal Counsel ("OLC") defining when the President may decline to enforce a law of Congress remains one of his lasting contributions to the theory and practice of the separation of powers. Despite articulating a departmentalist vision for relations between the political branches, however, the Memo accepts judicial supremacy as a given. It emphasizes that the Supreme Court has the final word on contested constitutional questions and that enforcement judgments must hew to judicial doctrine. For decades, scholars, officials, and advocates of various ideological stripes have challenged judicial supremacy, even as it has remained central to executive branch practice. Typically, these challenges underscore the authority and even primacy of Congress, the representative legislature, over constitutional meaning. But some critics have called on the President to reject judicial dominance, too. In this tribute to Dellinger's storied life and career, I offer a hypothetical follow-up opinion to his 1994 Memo, entitled Presidential Authority to Decline to Follow Supreme Court Opinions. I suggest how OLC might define the circumstances under which it would be permissible for the Executive to continue enforcing a law that the Supreme Court has declared unconstitutional on the ground that the Court got it wrong. Even for those who would regard such a call as implausible or dangerous, the varieties of resistance available to the President and the Executive Branch warrant attention as part of the larger debate over whose province and duty it is to say what the law means.

Abstract

TP53 mutation is the most frequent genetic event in head and neck squamous cell carcinoma (HNSCC), found in more than 80% of patients with human papillomavirus-negative disease. As mutations in the TP53 gene are associated with worse outcomes in HNSCC, novel therapeutic approaches are needed for patients with TP53-mutated tumors. The National Cancer Institute sponsored a Clinical Trials Planning Meeting to address the issues of identifying and developing clinical trials for patients with TP53 mutations. Subcommittees, or breakout groups, were tasked with developing clinical studies in both the locally advanced and recurrent and/or metastatic (R/M) disease settings as well as considering signal-seeking trial designs. A fourth breakout group was focused on identifying and standardizing biomarker integration into trial design; this information was provided to the other breakout groups prior to the meeting to aid in study development. A total of 4 concepts were prioritized to move forward for further development and implementation. This article summarizes the proceedings of the Clinical Trials Planning Meeting with the goal of developing clinical trials for patients with TP53-mutant HNSCC that can be conducted within the National Clinical Trials Network.

Abstract

Organic chemistry is one of the most feared and failed courses due to its complex and fast-paced nature. Investigating affective metrics that relate to achievement in these courses can be worthwhile, particularly when these metrics show predictive relationships to achievement. Attitude toward chemistry has been investigated utilizing a variety of instruments. We present herein an instrument related to the well-established Attitude toward the Subject of Chemistry Inventory (ASCIv2). This new instrument was developed utilizing The Standards of Psychological and Educational Measurement, which describe five aspects of validity evidence that should be gathered when using instruments in research. Content validity was gathered through consultation with experts. Response process validity was gathered through student interviews. Internal structural validity was collected through confirmatory factor analysis. Relations to other variables were investigated through correlation analysis and structural equation modeling. Consequential validity was studied through measurement invariance testing before comparing scores for subgroups (high- and low-achieving students). Additionally, reliability evidence was tested with Omega coefficients for each of the factors. We showed that all tests and analyses were done with high rigor, and that this new instrument, ASCI-UE, measuring utility and emotional satisfaction, can provide interesting results and implications for research and practice.
