Svrha je ovoga rada utvrditi provedbu Planerske zone u komasaciji građevinskog zemljišta za teorijsku i praktičnu primjenu. Cilj je prikazati aktivnosti i posredovanja pravnih osoba i osoba tehničke struke za okupljanje katastarskih čestica građevinskog zemljišta iz različitog stanja vlasništva u suvlasništvo jedinstvene parcele. Rezultati istraživanja obrađuju uvjete postupnog rada za komasaciju zemljišta, počevši od vlasnika nekretnina bilo fizičke bilo pravne osobe do pravnih akata i elaborata, te pregledno i svrhovito razrađuju formule za okupljanje komasacijske mase, uključujući i njezinu uknjižbu.

Rad obrađuje problematiku primjene pojedinih skupina pravnih izvora na ugovore o hotelskim uslugama, poglavito problematiku hijerarhije primjene pojedinih skupina izvora prava. Prema općim pravilima ZOO-a na trgovačke ugovore praksa uspostavljena između strana i trgovački običaji primjenjuju se i kad nisu ugovoreni i to prije dispozitivnih odredbi ZOO-a, dok se na ugovore građanskopravnog karaktera običaji primjenjuju samo ako je njihova primjena ugovorena ili određena zakonom. Stoga je bilo potrebno odrediti pojam i relevantne značajke ugovora o hotelskim uslugama, gdje se uočava kako neki u pravilu imaju trgovački karakter, a neki građanskopravni. Također je uočeno kako su ugovori o hotelskim uslugama podrobnije uređeni uzancama nego ZOO-om, što dovodi do više otvorenih pitanja u situacijama u kojima ugovor o hotelskim uslugama ima građanskopravni karakter. Nasuprot tome, kad ugovor ima trgovački karakter ista pitanja se ne postavljaju jer se na nj prvenstveno primjenjuju trgovački običaji odnosno uzance, koje iscrpno uređuju ugovore o hotelskim uslugama. Ista pitanja obrađena su iz perspektive primjene hrvatskog prava kao mjerodavnog, ali također i iz perspektive primjene francuskog, njemačkog i talijanskog prava i prava Ujedinjenog Kraljevstva.

Ugovori o hotelskim uslugama dijele se na tri osnovne vrste: izravni, agencijski i alotmanski. Izravni ugovor o hotelskim uslugama sklapaju ugostitelj i gost, a agencijski i alotmanski ugovor ugostitelj i turistička agencija. Istim se ugovorima pružaju hotelske usluge za određenu naknadu uz eventualno plaćanje provizije. Predmet doktorskog rada jest obrada ugovorne odgovornosti kontrahenata (ugostitelja, gosta i turističke agencije) za štetu zbog povrede obveza iz ugovora o hotelskim uslugama u hrvatskom i usporednom (francuskom, njemačkom, talijanskom, UK, SAD, europskom i međunarodnom) pravu. Doktorski je rad sastavljen od deset glava i sastoji se od općeg i posebnog dijela. U općem dijelu rada, u drugoj i trećoj glavi rada, obrađeni su pojam, vrste i izvori prava o ugovorima o hotelskim uslugama kao i općenita odgovornost dužnika za imovinsku i neimovinsku štetu zbog povrede ugovora. Posebni dio rada, od četvrte do devete glave rada, bavi se ugovornom odgovornošću kontrahenata (ugostitelja, gosta i turističke agencije) za imovinsku i neimovinsku štetu zbog povrede izravnog, agencijskog i alotmanskog ugovora o hotelskim uslugama u hrvatskom i usporednom pravu. Zbog povrede ugovora o hotelskim uslugama može se naknaditi imovinska (obična šteta i izmakla korist) i neimovinska šteta (povreda ugleda, upropaštavanje godišnjeg odmora, propuštanje ciljeva boravka, nemir, nelagoda, nezadovoljstvo, fizičke i duševne boli, itd.). U hrvatskom i usporednom pravu, izravni i agencijski ugovor o hotelskim uslugama kao neimenovani ugovori moraju naći svoje legislativno mjesto, a na razini usporednog prava potrebna je unifikacija ugovora o hotelskim uslugama ; pritom bi nacrt UNIDROIT Konvencije, ECTAA-HOTREC Kodeks i IH&RA-UFTAA Kodeks morali biti temelj međunarodne konvencije o ugovorima o hotelskim uslugama.

Nautical tourism is, in the Croatian law, regulated by legislation largely from the administrative aspects. In addition, given its importance in the Croatian tourism, it is the most widely covered of all special forms of tourism in the scientific literature. However, the practice of nautical tourism in Croatia has developed much faster than the adoption of legislative norms that supposed to follow it. The paper deals with the analysis of existing solutions of nautical tourism in the Croatian law through the: 1) sources of law that regulate it (from the Provision of Tourism Services Act (2007) to the sub-legislative acts), 2) the advantages and disadvantages of existing legislation and judicial practice (through analysis of theoretical and practical problems) and 3) suggestions for future solutions. The paper's results are the synthesis of answers to the analysis of theoretical (narrow legislation, the fragmentation of the sources of law, the legal definition, the principle of proportionality) and practical (nautical tourism ports planning, linking other tourism resources with nautical tourism, paying nautical vignettes, limiting stay of foreign boaters) questions set in the paper. The paper's conclusion is that nautical tourism in the Croatian law, despite the positive points of the legislation, is under-regulated. Future solutions of the nautical tourism in the Croatian law should especially integrate the existing fragmented legal norms into one unified legislative corpus and regulate relations (contracts, rights and duties) between nautical tourism subjects.

The hotel-keeper is liable for any damage due to breach of the allotment contract. His liability is divided into two types: 1. general liability - that derives from the agency hotel-keeper's contract and 2. special liability - characteristic only for the allotment contract. His most important general liability is the liability for non-payment of the commission and his most common special liability is the liability for non- providing the allotment accommodation. The purpose of the paper is to analyze the hotel-keeper's contractual liability for non-payment of the commission and non-providing the allotment accommodation to the agency and its guests through the solutions of the comparative laws (of Croatia, France, Germany, Italy, UK and USA) and at the EU and international law level. The results of the paper are answers to given theoretical questions (damage to a double subjectivity, the types of damage and liabilities, the comparative solutions) and the sinthesy of the hotel-keeper's liability in the allotment contract analysis. The conclusion is the need of adoption of an international convention that would regulate the allotment contract content, especially regarding the liabilities of the parties.

The article analyzes recent tendencies in the Croatian and comparative laws according to which the contractual liability of the guest for proprietary and non-proprietary hotel-keeper’s damage is acknowledged. Through analysis of the same institute in Croatian and comparative law it is demonstrated that contractual liability of the guest, in addition to specific duties from various legal systems, determines the breach of the two main obligations of the guest: payment the price of the services and behavior in the hotel premises in accordance with the same purpose. Contractual liability of the guest for proprietary and non-proprietary damage reinforces the contractual hotel-keeper’s position and reputation, as well as the protection of his property. Guest will be liable for hotel-keeper’s proprietary damage, which includes all the regular damages and lost hotel-keeper’s profit. The most common causes of contractual liabilities of the guest for non-proprietary hotelkeeper’s damage are: 1) injury of the hotelkeeper’s reputation and 2) various types of hotelkeeper’s anxiety, dissatisfaction or discomfort., Rad analizira novije tendencije hrvatskog i usporednog prava kojima se spoznaje ugovorna odgovornost gosta za imovinsku i neimovinsku štetu ugostitelja. Kroz analizu istog instituta u hrvatskom i usporednom pravu, vidljivo je da ugovornu odgovornost gosta, povrh posebnih obveza iz pojedinih pravnih sustava, determiniraju povrede dviju glavnih obveza gosta: plaćanja cijene usluga i ponašanja u hotelskom objektu u skladu s namjenom istog. Ugovorna odgovornost gosta za imovinsku i neimovinsku štetu ojačava ugovorni položaj i ugled ugostitelja, te zaštitu njegove imovine. Gost će odgovarati ugostitelju za imovinsku štetu, što uključuje svaku običnu štetu i izmaklu dobit ugostitelja. Najčešći razlozi ugovorne odgovornosti gosta za neimovinsku štetu ugostitelja jesu: 1) povreda ugleda ugostitelja i 2) razni tipovi nemira, nezadovoljstva ili nelagode ugostitelja.

The subject of the paper is comparative analysis of the hotel guest’s contractual liability for breaching the obligation for non-payment of hotel services in the hotel-keeper’s contract. The paper is methodologically conceived of six chapters (1. introduction, 2. comparative law sources of the hotel-keeper’s contract, 3. the guest’s obligation for payment of hotel services, 4. hotel guest's liability for non-payment, 5. the hotel-keeper’s rights due to non-payment and 6. conclusion), which analyzes the guest’s liability for non- payment of hotel services through the international law, European law, euro-continental national laws (France, Germany, Italy, Croatia) and Anglo-American national laws (UK, USA). The paper’s results are the synthesis of answers to the set hypothesis and comparative review of hotel guest’s contractual liability for non-payment of hotel services provided. In conclusion, it is necessary to adopt an international convention on the hotel-keeper’s contract, which would unify the institute of the hotel guest’s contractual liability for non-payment of hotel services at the international level.

Film tourism as a modern tourist trend expands rapidly summarizing cultural, fair and visual appearance. The paper’s purpose is a multidisciplinary analysis of film tourism from economic, socio-cultural and legal aspects referring to the Istrian region. Film tourism is manifested through three forms of appearance: 1) as cultural tourism of film festivals, 2) as fair tourism of promotive films and 3) as film induced tourism featuring films’ scenes. Recognizing the division, the most common form of Istria's film tourism is fair tourism. Istria has been positioning itself as a destination of film festivals, while film induced tourism, due to objective factors, is not so developed. Regarding the forms of a film tourism appearance, there are three kinds of legal relations: 1) in festival tourism there is a contract on “film viewing” with the provision of additional services, 2) in fair tourism hotel-keepers conclude a contract with travel agencies on the sample basis (promotive film), and 3) in film induced tourism there is no specific relation between the provider and the guest. The final remark is that the film tourism in Istria should be developed and planned systematically regulating the relations between providers and guests in all forms of appearance of film tourism, as well as regulating the same in the Croatian legislation.

Agencijski ugovor o hotelskim uslugama jest sui generis ugovor, u pravilu uređen poslovnom praksom (lex mercatoria): 1) u hrvatskom pravu - Posebnim uzancama u ugostiteljstvu (1995), 2) u europskom pravu - Kodeksom ponašanja ECTAA-HOTREC (1996) i 3) u međunarodnom pravu - Kodeksom poslovanja IH&RA-UFTAA (1999). Predmet rada jest analiza ugovorne odgovornosti ugostitelja zbog povrede agencijskog ugovora o hotelskim uslugama u hrvatskoj, europskoj i međunarodnoj poslovnoj praksi. Ugostitelj odgovara za imovinsku i neimovinsku štetu zbog povrede ugovornih obveza dvostrukom subjektivitetu - i turističkoj agenciji i njenim gostima (individualnim ili skupini). Rezultati rada jesu odgovori na postavljene teorijske i praktične probleme, kao i sinteza rješenja o svakoj odgovornosti ugostitelja posebno kroz analizu kodifikacija hrvatske, europske i međunarodne poslovne prakse. Zaključno, hrvatska je poslovna praksa utjelovila sva bitna rješenja europske i međunarodne poslovne prakse glede ugovorne odgovornosti ugostitelja u agencijskom ugovoru o hotelskim uslugama, dodajući i poneku specifičnost.

In the tourism business law, especially in the hotel-keeper's contract (direct, agency, allotment), the hotel-keeper assumes certain obligations to the guests, among which, in the last twenty years, the protection of the guest's privacy is particularly emphasized. The subject of the paper is hotel guest's privacy protection in the Croatian and comparative tourism business law. The paper is structured in a way that it analyzes, through the laws of Croatia, France, Italy, Germany, UK and USA, the hotel-keeper's: 1) duties on guest's privacy protection (1. respect of the guest room privacy, 2. registration of the guest under the false name, 3. non-receiving certain guests or persons, 4. discretion of the hotel staff) and 2) contractual liability for non- proprietary damage to violation of guest's privacy (a. the intrusion of staff in the guest room, b. the release of persons in the guest room, c. recording, wiretapping or spying and d. giving third parties information about the guest). Croatian law does not yet recognize the institute of guest's privacy protection as the comparative law of Euro-Continental and Anglo-American legal system (between which there are differences in relation to the institute). The conclusion is the need of adopting unified source at the international law and the European Union's law level, about hotel-keeper's obligation to protect the guest's privacy.

The paper deals with multidisciplinary (economic, socio-cultural and legal) analysis of tourism sustainability in national parks through the conclusion of the timesharing contract with special (all inclusive) services provided by national parks. National parks might apply the timesharing contract model for achieving tourism sustainability by building tourist objects (villas and apartments) on the outskirts of national parks (areas outside the protected zone) providing timesharing service users with services that national parks offer through their natural resources. Such a timesharing contract with “all inclusive” services should be primarily concluded by means of the right to use system, in which the owner or the proprietor would be a person in charge of the national park management and the user a person who takes advantage of the entire service package once in a year (from the timesharing accommodation to services such as photo-saphari, boat excursions, cycling trails…) or sub-leases his own facility and pertaining package of services. In such a process it is very important that the mentioned model pays attention to maintain the number of such guests on the annual level in a national park, while ad hoc guests remain, from the point of view of tourism sustainability, a variable, that is, an unstable factor. In certain situations even the fee simple system of timesharing could be an adequate model of national park management in terms of tourism sustainability. The results of the paper are replies to set working hypotheses from the economic, socio-cultural and legal aspects. The conclusion is that national parks at the global level need a model which will guarantee financial and tourism sustainability, while from the legal point of view, the timesharing contract in interaction with the special all inclusive service model is hypothetically an excellent variant of tourism sustainability in national parks, which is considered in greater detail in the paper.

The paper deals with the notion of golf-tourism from the multidisciplinary point of view: as an economic factor of innovation and development of the Istrian region as well as a legal problem of the Croatian law. Golf-tourism in Istria leads to diversification and enhancement of a destination’s aggregate tourist offer. Negative effects are evident in relation to numerous planned golf courses, what may create the risk that golf-tourism becomes, contrary to the principles of sustainability and indigenousness of the destination, the explicit form of tourism in Istria. Golf-tourism is a twofold legal problem in the Croatian law: 1) Croatian legislation does not deal with golf-tourism at all, 2) due to ''public interest'' and the development of golf-tourism, the controversial Golf Courses Act was adopted (in force since 02.01.2009), it even permits the expropriation of private land in favour of a third party. The conclusion is that it is necessary to perform an optimal combination of different forms of tourism in Istria today, whilst Croatian law requires a higher degree of golf-tourism legal regulation and a revision of dubious provisions from the Golf Courses Act.

Donošenjem novog Zakona o obveznim odnosima 2005. godine, hrvatsko je odštetno pravo doživjelo revolucionarni preokret. Uz već postojeća legislativna rješenja, iz starog Zakona o obveznim odnosima (iz 1978. godine), o izvanugovornoj odgovornost za imovinsku i neimovinsku štetu te ugovornoj odgovornosti samo za imovinsku štetu, prvi je put uveden i institut odgovornosti za neimovinsku štetu povredom ugovora. Takvo rješenje iskaz je napretka shvaćanja načela ispunjavanja ugovornih obveza i suvremenog mišljenja o dostojanstvu i poštivanju ličnosti kontrahenata. Usporedna zakonodavstva različito gledaju na institut ugovorne odgovornosti za neimovinsku štetu, ali čak i u onim državama koje nisu uvele taj institut u svoja zakonodavstva, sudska praksa počinje bitno drukčije tumačiti norme ugovorne odgovornosti za štetu, uvelike priznajući pravo vjerovniku na naknadu neimovinske štete. Izravni ugovor o hotelskim uslugama jedan je od najvažnijih ugovora iz oblasti hrvatskog i usporednog prava u turizmu. Uza svu važnost za hrvatsko pravo u turizmu, isti nije bio reguliran ni u starom Zakonu o obveznim odnosima, a nije našao mjesto ni među normama novog Zakona o obveznim odnosima. Dok je stari ZOO iz 1978. godine to čak i bilo razumljivo (kako su svi veliki ugostitelji tada bili društvena privredna poduzeća u društvenom vlasništvu, smatralo se da će nositelji turizma biti agencije), za novi ZOO iz 2005. godine to je neshvatljivo (novi ZOO kao i stari uređuje četiri ista imenovana ugovora kao i stari ZOO, ponovno zanemarujući činjenicu da samo krajnji pružatelj usluga (ugostitelj) može biti nositelj turizma). Usprkos navedenim činjenicama, rješenja novog ZOO-a ipak uvelike utječu na primjenu izravnog ugovora o hotelskim uslugama i tumačenju odgovornosti njegovih stranaka. Dijelovi ZOO-a općenito o ugovorima i odgovornosti za štetu, kao i norme ugovora o ugostiteljskoj ostavi (koji je faktički posebni ugovor nastao iz ugovora o hotelskim uslugama) u potpunosti se odnose i na izravni ugovor o hotelskim uslugama. Posebno mjesto u kontekstu ugovorne odgovornosti za štetu ima ugostitelj (hotelijer) kao glavni subjekt i najveći pružatelj usluga u turizmu ; njegova se odgovornost povećava u smislu dostojanstvenijeg odnosa prema gostu i čuvanja i poštivanja osobe gosta. Usporedna prava, temeljem novih odštetnih rješenja, slijede koncept odgovornosti ugostitelja i za neimovinsku štetu. Temeljem svega navedenog, razumljivo je da ugostitelj odgovara zbog povrede ugovora i za imovinsku i za neimovinsku štetu.

Conceptualising tourism as a social phenomenon, that is, as a group of relations and occurrences, means to define its multifunctionality. Within this framework nautical tourism may be regarded as a multifunctional tourist phenomenon manifested through physical consumption of natural and social resources. Although nautical tourism with its ports of nautical tourism, charter and cruising has been recognized as a generator of economic development of a particular area, quite often it gives rise to negative repercussions of social benefits. Therefore, it is necessary to turn to the legal regulation, which specifies the aforementioned field, for the purpose of profit maximisation. The purpose of this paper is to explain more closely the mere notion of nautical tourism and its manifestations and benefits reflected in the economic, socio-cultural and legal frameworks. The article focuses on the achievement of benefits through the multiplicative tourism effects accompanied by the qualitative detachment from standard elements of tourism offer characteristic for nautical tourism through the inclusion of new contents, demanding boaters’ active participation and associated with cultural and historical heritage.

Predmet i ciljevi ovog magistarskog rada su: uvođenje termina pravo vrijednosnica kao izraz instituta koji u realnosti egzistira u europskoj i hrvatskoj teoriji i praksi, sistematika izvora prava vrijednosnica u Europskoj Uniji i Hrvatskoj, pokušaj unifikacije danas pretežno razjedinjenih instituta prava vrijednosnica, prikazati što je i kako funkcionira europsko pravo uopće, a unutar njega i europsko pravo vrijednosnica, podrobnija analiza temelja odnosno vrsti, pojmova, izvora, prijenosa i ostalih glavnih karakteristika koje se odnose na vrijednosnice u europskom i hrvatskom pravu, a naročito njihov transakcijski značaj i modernizaciju, utvrditi stupanj prilagodbe hrvatskog prava vrijednosnica europskome i ukratko prikazati odnos europskog i hrvatskog prava vrijednosnica odnosno njihovih sličnih izvora.

Izum je novo i inventivno rješenje tehničkog problema. Kako bi se zaštitio izum postoje pravni mehanizmi zaštite, odnosno prava intelektualnog vlasništva pogodna za zaštitu proizvoda. Patent je jedan od njih. Patent je isključivo pravo priznato za izum koji nudi novo rješenje nekog tehničkog problema. Dugotrajna zaštita koja pruža nositelju prava sigurnost i mogućnost za naknadu štete. Uporabni model je mali patent kojim se pruža kraća zaštita većinom za poboljšanja izuma ili mala usavršavanja. Poslovna tajna ima trenutačni učinak i ne podrazumijeva nikakve troškove registracije. Ukoliko se javno otkrije moći će je koristiti svi koji imaju pristup, njena razina zaštite puno je slabija nego kod patenata, te ju je teško zaštititi. Ovaj rad nastoji pokazati prednosti i nedostatke svakog od navedenih modela zaštite, koje su specifičnosti svakoga od njih te koji model zaštite bi bio najprikladniji za pojedini izum.

Kreditna kartica je sredstvo plaćanja koje u pravilu izdaje banka, no može biti izdana i od strane nebankovne organizacije, a njihovo korištenje uređeno je Zakonom o platnom prometu. Cilj kreditne kartice je omogućavanje bezgotovinskog plaćanja i kratkoročnog kredita koji će korisniku osigurati da plati sve željene proizvode i usluge. Ona predstavlja jedan od najjednostavnijih, ali ujedno i najsigurnijih načina plaćanja koji je prihvaćen na globalnoj razini, a u turizmu je, odnosno u hotelskim i ugostiteljskim poduzećima, najčešće ponuđen oblik plaćanja. Potražnja za kreditnim karticama u konstantnom je porastu, pa tako kreditne kartice zamjenjuju gotovinsko plaćanje kao primarni način plaćanja. Ovaj rad nastoji objasniti ulogu kreditne kartice kao globalnog sredstva plaćanja u turizmu, sve karakteristike koje jedna kreditna kartica ima, te pogodnosti koje njezino korištenje donosi turistima, ali i svim ostalim korisnicima. Credit card is a means of payment that is usually issued by a bank, but it can also be issued by a non-bank organization, and their use is regulated by the Act on Payment Transactions. The purpose of the credit card is to enable cashless payment and short-term credit that will ensure the user pays for all desired products and services. It represents one of the simplest, but at the same time the most secure payment method that is accepted on a global level, and in tourism, that is, in hotel and hospitality companies, it is the most often offered form of payment. Demand for credit cards is constantly increasing, therefore the credit cards are replacing cash payments as the primary payment method. This paper tries to explain the role of the credit card as a global means of payment in tourism, all the characteristics that a credit card has, and the benefits that its use brings to tourists, as well as to all other users.

U Republici Hrvatskoj pravila vezana uz tržišno natjecanje uređena su Zakonom o zaštiti tržišnog natjecanja, koji definira ovlasti, zadaće i ustrojstvo tijela za zaštitu tržišnog natjecanja. Agencija za zaštitu tržišnog natjecanja je opće nacionalno regulatorno tijelo koje je nadležno za zaštitu tržišnog natjecanja na svim tržištima u okviru djelokruga i nadležnosti utvrđenih Zakonom o zaštiti tržišnog natjecanja. Horizontalni sporazumi su sporazumi između poduzetnika koji djeluju na istoj razini, a kojima su uređeni uvjeti pod kojima sudionici sporazuma mogu kupovati, prodavati ili preprodavati određenu robu i/ili uslugu, odnosno djelovati na mjerodavnom tržištu. Sporazumi u kojima se poduzetnici dogovaraju o cijenama, količinama ili podjeli tržišta smatraju se osobito štetnima te se nazivaju kartelima. Kada se poduzetnici međusobno dogovaraju, odnosno kada svoje poslovne odluke ne donose samostalno, tržišno natjecanje trpi teške povrede koje će se u konačnici odraziti na kupce kroz povećanje cijena, manjak izbora i sl. Kartelski sporazumi su vrsta horizontalnih sporazuma kojima se nastoji potpuno ukloniti tržišno natjecanje između tržišnih takmaca kako bi se kroz povećanja cijena ostvario veći profit, čime se djeluje na štetu kupaca i gospodarstvu u cjelini. Karteli se na tržištu mogu pojaviti kao dogovori o cijenama, diskriminacija u cijenama, podjela tržišta, ograničavanje ili kontrola proizvodnje, razmjena informacija i sl. U radu su prikazana dva veoma značajna predmeta o kojima je odlučivao Europski sud: slučaj Bojila i slučaj Celuloza II. U slučaju Bojila Europski je sud zauzeo stav kako se svjesnim zamjenjivanjem rizika praktičnom suradnjom poduzetnika može ostvariti tzv. usklađivano djelovanje poduzetnika (što također spada u tzv. zabranjene horizontalne sporazume), a da se o tome izričito ne sklopi sporazum. U slučaju Celuloza II Europski sud je zauzeo stav da se paralelno ponašanje poduzetnika (npr. istovjetno povećanje cijena u kratkom vremenskom proizvodu) treba smatrati usklađenim djelovanjem (odnosno zabranjenim horizontalnim sporazumom), jedino u onim situacijama u kojima za takvo paralelno ponašanje ne postoji drugi argument koji proizlazi iz strukture mjerodavnog tržišta i ekonomskih kretanja na navedenom tržištu. Agencija za zaštitu tržišnog natjecanja posluje s ciljem promicanja i osnaživanja kulture tržišnog natjecanja te s ciljem provođenja sustava mjera zaštite tržišnog natjecanja na domaćem tržištu. U radu su analizirane relevantne odluke AZTN-a o kartelskim sporazumima s područja Republike Hrvatske.

Pravni okvir za djelovanje institucija u turizmu i kulturi Republike Hrvatske određeni su zakonima, uredbama i propisima. Na vrhu tih institucija nalaze se ministarstvo kulture i ministarstvo turizma. Ministarstvima su podređene druge institucije i organizacije koje su organizirane na regionalnom i lokalnom nivou. Te institucije su turističke zajednice županija, gradova, općina i mjesta u turizmu, a u kulturi to su knjižnice muzeji i kazališta. Ovim radom prikazan je njihov ustroj, zadaci i ciljevi djelovanja te pravna regulativa. The legal framework for the operation of institutions in tourism and culture of the Republic of Croatia is determined by laws, decrees and regulations. At the top of these institutions are the Ministry of Culture and the Ministry of Tourism. Other institutions and organizations organized at the regional and local level are subordinated to the ministries. These institutions are the tourist boards of counties, cities, municipalities and places in tourism, and in culture they are libraries, museums and theaters. This paper presents their structure, tasks and goals of operation, as well as legal regulations.

Zaštita privatnosti turističkih subjekata nije dovoljno medijski eksponirana kako bi se društvo zainteresiralo na promjene koje najnovije izmjene i dopune donose, stoga se napravio rezime odnosno kronološki razvoj događaj od 1995. godine, do najnovijih izmjena u hrvatskom pravnom sustavu i zakonodavstvu. GDPR, odnosno Opća uredba o zaštiti podataka, dobila je veću medijsku pozornost 2018. kada ju je većina članica Europske unije uvela u nacionalno zakonodavstvo. Hipoteza kojom se vodila tema rada bila je: Zaštita privatnosti turističkih subjekata u hrvatskom pravu potrebno je uskladiti sa svim pravnim aspektima članica Europske unije. Cilj rada bio je prikazati i objasniti kako je Opća uredba o zaštiti podataka utjecala na pravni aspekt zaštite fizičkih i pravnih osoba u Hrvatskoj te mogućnostima poboljšanja iste. Iako je termin zaštite privatnosti u današnje vrijeme prilično složen, ulažu se veliki napori u osiguranje što većeg broja mogućih problematičnih situacija i nesporazuma, odnosno njihovih rješenja kako nijedna strana ne bi bila oštećena, te kako bi bili zadovoljeni svi pravni aspekti zaštite privatnosti. U radu su korištene metode sinteze i analize, metoda kompilacije te deskriptivna metoda. The protection of the privacy of tourist entities is not sufficiently exposed in the media for the society to be interested in the changes brought about by the latest amendments, so a summary or chronological development of the event from 1995 to the latest changes in the Croatian legal system and legislation. The GDPR, or the General Data Protection Regulation, received more media attention in 2018 when most EU member states introduced it into national legislation. The hypothesis that guided the topic of the paper was: The protection of the privacy of tourist entities in Croatian law needs to be harmonized with all legal aspects of the European Union. The aim of this paper was to present and explain how the General Data Protection Regulation has affected the legal aspect of the protection of natural and legal persons in Croatia and the possibilities for improving it. Although the term of privacy protection is quite complex nowadays, great efforts are made to ensure as many possible problematic situations and misunderstandings, ie their solutions so that neither side would be harmed, and so that all legal aspects of privacy protection would be satisfied. Methods of synthesis and analysis, compilation method and descriptive method were used in the paper.

Suvremena je turistička praksa prožeta razvojem brojnih etabliranih odnosa te sklapanjem ugovora između nositelja turističkih ponuda i krajnjih potrošača, odnosno putnika. S toga, ugovor o organiziranju putovanja postaje najčešći pravni posao koji se ugovara između organizatora putovanja, odnosno putničkih agencija i putnika kao subjekata obveznopravnog odnosa dok je objekt ugovora putovanje u sklopu paket - aranžmana. Predmet rada je analiziranje obveza ugovornih strana i ostalih bitnih sastojaka ugovora sukladno Zakonu o obveznim odnosima, Zakonu o pružanju usluga u turizmu te ostalim povezanim zakonima, direktivama i uredbama koje ga svojevrsno legislativno uređuju. Kroz rad se nastoji pružiti sveobuhvatna analiza ugovora te se prilaže vlastiti primjerak istoga u cilju povezivanja zakonom propisanih odredaba sa strukturom ugovora u praksi. Zaključuje se da je putovanje multidimenzionalna pojava koja može rezultirati još neviđenim događajima te se u vezi s time ističe nemogućnost stopostotnog pravnog uređenja ugovora o organiziranju putovanja. Modern tourist practice is permeated by the development of numerous established relationships and the conclusion of contracts between the holders of tourist offers and end consumers, i.e. travelers. Therefore, the agent-organized tour contract becomes the most common legal transaction that is contracted between the travel organizer, i.e. travel agencies and passengers as subjects of a legal relationship, while the object of the contract is the tour as part of a package travel. The subject of this paper is to analyze the obligations of the contracting parties and other essential components of the contract in accordance with the Civil Obligations Act, Act on the Provision of Tourism Services and other related laws, directives and regulations. The paper seeks to provide a comprehensive analysis of the contract and encloses its own copy in order to link the statutory provisions with the structure of the contract in practice. It is concluded that a tour is a multidimensional phenomenon that can result in unprecedented events, and in regard with this the impossibility of complete legal regulation of the agent-organized tour contract is emphasized.

Turistička zajednica u Republici Hrvatskoj predstavlja temeljnu osnovu u sustavu turističkog organiziranja. Cilj turističkih zajednica je stvaranje, promicanje i koordiniranje aktivnosti vezanih za identitet, sadržaj i kvalitetu turističke ponude same destinacije. Sve turističke zajednice, od lokalne do državne razine, rade na razvoju i marketingu destinacije kroz koordiniranje ključnih aktivnosti turističkog razvoja, pritom se pridržavajući zakona i pravilnika, te statuta i ostalih dokumenata kojima se definira nacionalna strategija razvoja turizma te osiguravanje cjelovitije zastupljenosti specifičnih interesa svih sudionika u turizmu od lokalne do nacionalne razine. Sve je to u svrhu poboljšanje uvjeta boravka turista u republici Hrvatskoj, kao i razvijanje svijesti o važnosti i gospodarskim, društvenim i drugim učincima turizma, te svakako potrebi i važnosti očuvanja i unaprjeđenja svih elemenata turističke resursne osnove određene destinacije, a osobito zaštite okoliša, prirodne i kulturne baštine. The tourist board represents a fundamental basis in the system of tourist organization in the Republic of Croatia. The goal of tourist boards is the creation, promotion and coordination of activities related to the identity, content and quality of the offer a destination provides. All tourist boards, from the local level to the state level, work on the development and marketing of a destination through coordination of key activities of tourism development, while adhering to laws, regulations, statutes and other documents that define the national strategy of tourism development and ensuring a more complete representation of the specific interests of all the participants in tourism, from the local to the national level. All this is for the purpose of improving the conditions of tourists staying in Croatia, as well as raising awareness to the importance of the economic, social and other effects of tourism, and importance of preserving and improving all of the elements of the tourism resources of a certain destination, particularly the protection of the environment, as well as the natural and cultural heritage.

Ovaj završni rad bavi se pravima i obvezama gosta u izravnom ugovoru o hotelskim uslugama. Turistički ugovori nastali su kako bi se uredili pravni poslovi između sugovaratelja usluga u turizmu. Izravni ugovor o hotelskim uslugama uređen je poslovnim običajima i uzancama. Kako bi se smatrao sklopljenim hotelijer i gost moraju se složiti oko vrste i opsega usluge, cijeni, vremenu korištenja usluge i smještaja to jest pansiona ili polupansiona. Unutar ugovora hotelijer ima dužnosti koje se obvezuje ispuniti, te mora štititi privatnost gosta. Ako ne ispunjava obveze odgovoran je za imovinsku i neimovinsku štetu nastalu gostu. Gost unutar ugovora stječe prava, ali i obveze koje je dužan ispuniti, no odgovoran za imovinsku i neimovinsku štetu koju učini hotelijeru prilikom kršenja istih. This paper deals with the rights and obligations of the guest in a direct hotel-keeper’s contract services. Tourism contracts were created to regulate legal transactions between the contractors of services in tourism. The direct hotel-keeper’s contract is governed by business customs and special customs. In order to be considered concluded, the hotelier and the guest must agree on the type and scope of the service, the price, the time of using the service and the accommodation. Within the contract, the hotelier has duties that he undertakes to fulfill, and also he must protect the privacy of the guest. If he does not fulfill his obligations, he is responsible for property and non-property damage caused to the guest. Within the contract, the guest acquires rights but also obligations that he is obliged to fulfill and is responsible for property and non-property damage that he does to the hotelier in violation of the same.

Tema ovog završnog rada su „Posebne uzance u ugostiteljstvu (1995.) i njihov značaj u hrvatskom pravu“. Posebne uzance u ugostiteljstvu su kodificirani trgovački običaji za poslove ugostiteljskih usluga. One su objavljene u Narodnim novinama Republike Hrvatske od 8.3.1995. godine, br. 16/95 i 108/96. Svrha ovog rada je upoznavanje sa pojmom uzanci i statusom uzanci te Posebnim uzancama u ugostiteljstvu i ugovorima koji su uređeni po njima. U Posebnim uzancama je uređeno šest turističkih ugovora. To su izravni ugovor o hotelskim uslugama, agencijski ugovor o hotelskim uslugama, ugovor o alotmanu, ugovor o smještaju u turističkim apartmanima, ugovor o uslugama kampiranja i ugovor o uslugama prehrane i točenja pića. Cilj ovog rada je prikazati ugovore koje Posebne uzance u ugostiteljstvu uređuju i ukazati na njihov značaj. U radu je korištena induktivna i deduktivna metoda, metoda analize i sinteze i metoda deskripcije. Ovaj rad sadrži uvod, šest poglavlja, zaključak i sažetak. U prvom poglavlju „Uzance“ definiran je pojam uzanci i status uzanci. Dalje se navodi pojam posebne uzance u ugostiteljstvu, njihov sadržaj te opće odredbe. U drugom poglavlju sa naslovom „Ugovor o hotelskim uslugama“ obrađuju se ugovori koji spadaju pod ugovor o hotelskim uslugama, a to su: izravni ugovor o hotelskim uslugama, agencijski ugovor o hotelskim uslugama i ugovor o alotmanu. U cijelom poglavlju se navode i objašnjavaju uzance od 8. do 102. U trećem poglavlju se govori o smještaju u turističkim apartmanima. U ovom dijelu su obrađene uzance od 103. do 116. koje uređuju ovaj ugovor. U tim uzancama je propisana primjena uzanci, oblik ugovora, rezervacija smještaja, predujam, odustanak od rezervacije, trajanje ugovora, lista inventara, zabrane gostu, cijena, jamčevina, raskid ugovora i najam kuća i stanova za odmor. U četvrtom poglavlju je obrađen ugovor o uslugama kampiranja koji sadrže uzance od 117. do 129.. Te uzance se odnose na sklapanje ugovora o uslugama kampiranja, prava i obveze ugovornih strana, uporabu kampa, red u kampu, stvari gosta, raskid ugovora i primjenu uzanci. U šestom i zadnjem poglavlju glavnog dijela se nalazi ugovor o uslugama prehrane i točenja pića. U tom ugovoru su sadržane uzance od 130. do 151., a one se odnose na sklapanje ugovora, predmet ugovora, cijenu usluge, rezervaciju, pružanje usluga, plaćanje usluga, korištenje usluga, pravo ugostitelja, stvari gosta, otkaz usluge i proviziju. Na samom kraju rada je zaključak. Posebne uzance u ugostiteljstvu su nastale zbog velikog broja subjekata koji su se susretali na turističkom tržištu. Među njima je bilo nemoguće u potpunosti urediti sve odnose propisima i ugovorima između davatelja i korisnika ugostiteljskih usluga. Zbog toga je praksa razvila veliki broj trgovačkih običaja u ugostiteljstvu, čijim su kodificiranjem nastale Posebne uzance u ugostiteljstvu. Značaj Posebnih uzanci u ugostiteljstvu, osim u svakodnevnoj i poslovnoj primjeni, očituje se u tome što su poslije Zakona o obveznim odnosima izvor poslovnog prava u turizmu. Posebne uzance u Ugostiteljstvu olakšavaju poslovanje, smanjuju nesporazume, omogućuju njihovo djelotvorno rješavanje i pridonose unaprjeđenju kvalitete pružanja ugostiteljskih usluga i poslovanja. The topic of this thesis is „Customary Practices in the Hospitality Industry (1995) and Their Relevance in Croatian Law“. Customary Practices in the Hospitality Industry are codified trade customs observed in the hospitality sector. They were published on 8 March 1995 in the Official Gazette of the Republic of Croatia, No. 16/95 and 108/96. The purpose of this thesis is to provide deeper understanding of the term customary practices i.e. customs and their status, as well as the Customary Practices in the Hospitality Industry and the contracts governed by such customs. The provisions of the Customary Practices in the Hospitality Industry govern six tourism-related contracts. These are the hotel services direct agreement, the hotel services agency agreement, the allotment contract, the holiday apartment accommodation contract, the campsite service agreement, and the food and beverage services agreement. This thesis aims at providing an overview of the contracts governed by the Customary Practices in the Hospitality Industry and identifying their relevance. The research methods used in the thesis were the inductive and deductive method, the analysis and synthesis method, and the descriptive method. The thesis is organized in several sections; the introduction, six chapters, the conclusion, and the abstract. The first chapter „Customs“ provides a definition of the term customs and their status. Moreover, it introduces the term Customary Practices in the Hospitality Industry, their content and general provisions. The second chapter, entitled „Hotel Services Agreement“, explores the hotel-related contracts such as the hotel services direct agreement, the hotel services agency agreement, and the allotment contract. The chapter outlines and explains the customary practices under items 8 to 102. The third chapter elaborates on the contract for accommodation in holiday apartments. This chapter analyzes the customary practices under items 103 to 116, which govern said contract. The above customary practices provide for their application, form of the contract, booking of the accommodation unit, down payment, cancellation of booking, term of the contract, inventory list, rules for guests, price, deposit, cancellation of the contract, and rental of holiday homes and apartments. The fourth chapter outlines the campsite service agreement which includes the customary practices under items 117 to 129. These common practices relate to the conclusion of the campsite service agreement, the rights and duties of the parties, usage of the campsite, the camping rules, personal belongings of guests, cancellation of the contract, and application of the customary practices. The sixth and last chapter of the main section presents the F&B services agreement. Said agreement includes the customary practices under items 130 to 151, which relate to the conclusion of the agreement, subject of the agreement, price, booking, provision of services, payment of services, utilization of services, rights of the service provider, personal belongings of guests, cancellation of the services, and commission. The thesis is rounded up with a conclusion section. The Customary Practices in the Hospitality Industry have been established due to the large number of parties involved and interacting with one another in the tourism and hospitality sector. It was impossible to fully regulate all the relations among the various stakeholders by regulatory provisions and contracts between providers and users of hospitality services. For this reason, the practice has developed a large number of trade customs commonly used in the hospitality industry, whose codification resulted in the Customary Practices in the Hospitality Industry. Apart from their application in the everyday and business practice, the relevance of the Customary Practices in the Hospitality Industry is demonstrated by the fact that, right after the Civil Obligations Act, they are the source of tourism business law. The Customary Practices in the Hospitality Industry facilitate the business operations, reduce misunderstandings, enable their effective resolution, and contribute to the improvement of the hospitality services quality and the ease of doing business in the hospitality sector.

Turizam je globalna pojava, i kao takav je djelomično reguliran od strane državnih ministarstava, regionalnih i međunarodnih organizacija, a kojima je krovna organizacija Svjetska turistička organizacija. Tema završnog rada je Pravo Svjetske turističke organizacije. Svrha ovoga rada je više i detaljnije naučiti i razumjeti pojmove Svjetske turističke organizacije, prava u turizmu i Globalni etički kodeks. Svjetska turistička organizacija (UNWTO) agencija je Ujedinjenih naroda specijalizirana za promicanje odgovornog, održivog i univerzalno dostupnog turizma. implemetira se kroz načela Globalnog etičkog kodeksa definiran kao cjelovit skup načela namijenjenih vodećim dionicima u razvoju turizma. Upućen je vladama, privatnom sektoru, zajednicama i turistima, cilj mu je pomoći povećati korist od turizma, a umanjiti njegov potencijalno negativan utjecaj na okoliš, kulturnu baštinu i društva širom svijeta. Deset načela kodeksa pokrivaju ekonomske, socijalne, kulturne i ekološke komponente turizma. As a global phenomenon, tourism is partly regulated by state ministries, regional and international organizations, at the top of which is World Tourism Organization. The topic of this thesis is Law of World Tourism Organization. The purpose of this thesis is to provide deeper understanding of the term TheWorld Tourism Organization, Law in Tourism and the Global Code of Ethics for Tourism. The World Tourism Organization (UNWTO) is the United Nations agency responsible for the promotion of responsible, sustainable and universally accessible tourism. UNWTO encourages the implementation of the Global Code of Ethics for Tourism which has defined as a complete set of principles intended for the leading stakeholders in the development of tourism. It is addressed to governments, the private sector, communities and tourists, and its goal is to help enlarge the benefits of tourism, while diminishing its potentially negative effects on the environment, cultural heritage and societies around the world. The ten principles of the Code cover economic, social, cultural and environmental components of tourism.

Potreba za turizmom i kvalitetnim odmorom je, u današnje suvremeno doba, sve veća. Upravo zbog te potrebe ugostiteljski objekti moraju pružati turistu sigurnost u turističkoj destinaciji kako bi se isti vratili. Briga o gostu, njegova zaštita privatnosti te sigurnost zahtjeva osposobljeno i motivirano osoblje koje zna učinkovito komunicirati i poštuje zadane procedure. Obveze vođenja brige obuhvaća udobnost, poštivanje i sigurnost prava privatnosti gosta. Također hoteli moraju biti spremni preuzeti odgovornost u slučaju da je kriv za neku određenu povredu hotelskog gosta, bila ta odgovornost imovinska ili neimovinska. Privatnost gosta proizlazi iz izravnog ugovora s hotelijerom i gosta. The need for tourism and quality vacations is increasing in the modern times. For this reason, catering establishments must provide security to the tourist in the tourist destination in order to return. Customer care, privacy and security require skilled and motivated staff who are able to communicate effectively and follow the procedures in place. The duty of care includes comfort, respect and security of the guest's privacy rights. Also, hotels must be prepared to take responsibility in the event that they are guilty of a specific violation of a hotel guest, whether that liability is property or non-property. The privacy of the guest comes from a direct contract with the hotelier and the guest.

Turističko tržište karakterizira odvojenost ponude od potražnje, a sve većim razvojem turizma javlja se i veća potreba posredovanja između turista i davatelja usluga. Ugovor o alotmanu, odnosno ugovor o raspolaganju ugostiteljskim smještajem, smatra se jednim od najčešćih ugovora između putničke agencije i davatelja usluga u današnje vrijeme, a sama činjenica kako se bilježi sve veći porast turizma u svijetu, također se pridaje sve veći značaj i važnost ugovoru. Alotmanski ugovor reguliran je Zakonom o obveznim odnosima, a ugovorne strane jesu turistička agencija i ugostitelj, pri kojem ugostitelj stavlja određeni broj smještajnih kapaciteta na raspolaganje turističkoj agenciji, te ona nastoji popuniti te kapacitete uz ugovorenu proviziju. Ugostitelji sklapaju poslovanje s agencijama upravo kako bi pribavili što veći broj korisnika smještajnih kapaciteta. S druge strane, turističke agencije pružaju gostima koordinirano i organizirano putovanje uz pristupačne cijene, pouzdanost i fleksibilnost, kao i široko poznavanje turističke ponude. Potrošači se stoga najčešće obraćaju turističkoj agenciji prilikom planiranja svog putovanja. Cilj ugovora o alotmanu je popunjavanje ugovorenih smještajnih kapaciteta pri čemu ugostitelj umanjuje rizik neispunjenja ležajeva, dok agencija kroz proviziju ostvaruje svoj profit koji dobiva od strane ugostitelja. Svrha rada je objasniti karakteristike ugovora o alotmanu s naglaskom na odgovornost turističke agencije kao ugovorne strane, istaknuti njegovu važnost u turističkom poslovanju te međusobnu korist i doprinos uspješnom poslovanju za obje ugovorne strane. The tourist market is characterized by the separation of supply from demand, and the growing tourism development is accompanied by the greater need for mediation between tourists and service providers. The allotment contract is considered to be one of the most common contracts between travel agencies and service providers today, and the fact that tourism is growing in the world also attaches even greater importance to the contract. In this agreement there are two parties, a travel agency and a hotel-keeper. The hotel-keeper gives a certain number of accommodation capacities at the disposal of the travel agency, and the agency strives to fill these capacities with the agreed commission. Hotel-keepers enter into business with agencies in order to provide themselves as many customers as possible. On the other hand, tourist agencies provide their guests a coordinated and organized travel with affordable prices, reliability and flexibility, as well as knowledge about the tourist offer. Therefore the customers usually contact the travel agency when planning their trip. The purpose of the allotment contract is to fill the agreed accommodation capacity, which will reduce the risk of empty rooms for the hotel-keeper, while the agency through the commission realizes its profit received by the hotel-keeper. The aim of this bachelor is to explain the characteristics of the allotment contract, with emphasis on the responsibility of the travel agency as a contracting party, to emphasize its importance in tourism business, mutual benefit and contribution to successful business for both parties.

Tema ovog rada je briga o gostu koja predstavlja kvalitetu usluge i ostavlja impozantan utisak na goste. Polazna hipoteza ovog rada usmjerena je na brigu o gostu koja ima određen koncept profesionalnosti i način sublimacije zaposlenika kako bi se pravovremeno reagiralo na potrebe i želje gosta. Ističe se važnost gostoprimstva koji je temelj uspješnog odnosa između osoblja i gosta, te kultura i poslovnost gdje ljudi predstavljaju presudni faktor u odlučivanju za turistička kretanja i boravak u nekoj određenoj destinaciji ili ugostiteljskom objektu. U ovom završnom radu bit će prikazane potrebe koje je potrebno prepoznati kako bi se moglo kvalitetno brinuti o gostu i njegovim željama. Imajući u vidu potrebe, cilj je upoznati se sa zahtjevima suvremenih gostiju, te nastojati prikupljati informacije o njihovim željama i očekivanjima. Gost daje konačnu ocjenu poslovanja hotelu, zbog toga je važno da hoteli ulažu svoje vrijeme i napor u provođenje anketa kako bi uvidjeli svoju kvalitetu i zadovoljstvo gostiju, što će se moći uvidjeti u daljnjem radu. Razradit će se i komunikacijski proces, te kolika je njegova važnost u vrednovanju kvalitete usluga. Moći će se uvidjeti koliko utječe vještina uljudnog i učinkovitog telefoniranja, te neverbalna komunikacija na kvalitetu usluge. Fokus u radu je na ugovorima između davatelja turističkih usluga i izravnih korisnika. Obuhvatit će sve bitne karakteristike, od pojma i sklapanja ugovora, prava i obveza koji se odnose na suugovaratelja, obveza ugostitelja i gosta do prestanka ugovora. Kraj rada bit će usmjeren na zaštitu privatnosti hotelskog gosta. Bitno obrađena bit će odgovornost ugostitelja za štetu počinjenu povredom izravnog ugovora o hotelskim uslugama, povreda obveze pružanja smještaja i akcesornih usluga, povreda obveze kod vođenja brige o gostu i povreda obveze vođenja brige o stvarima gosta. Izrazito veliku odgovornost imaju ugostitelji i njihovi zaposlenici, te načinom pridržavanja ugovorenih stavki iskazuju brigu o svojim gostima. The topic of this final work is customer care that represents the quality of service and leaves an impressive impression on the guest. The underlying hypothesis of this final work is focused on the care for a guest who has a certain concept of professionalism and sublimation of employees in order to react timely to the needs and wishes of the guest. It emphasizes the importance of hospitality, which is the basis of a successful relationship between the hotel staff and guest, and culture and professionalism where people represent a decisive factor in deciding on tourist movements and staying in a particular destination or some hospitality facility. In this final work will be presented the needs that need to be identified in order to make the best care for the guest and his wishes before and during his stay. Keeping in mind the needs, the goal is to get acquainted with the demands of modern guests and to seek information in the uncompromising and professional way on their wishes and expectations. The guest gives the hotel a definitive rating, famous in modern language- review, so it is important for hotels to invest their time and effort in conducting the survey to see their quality and customer satisfaction, which they will be able to see in further work. The communication process will be elaborated and its importance in evaluating the quality of services. It will be able to see how much the skills of courteous and efficient verbal and nonverbal communication affect the quality of service. The focus is on contracts between providers of tourist services and direct users. It will be constituted by the all essential features, from concept and contract signing, rights, and obligations relating to the contractor, the obligations of the caterer and the guest until termination of the contract. The end of the work will be aimed at protecting the privacy of a hotel guest. Essentially processed will be the responsibility of the caterer for the violation of the direct contract on hotel services, to provide accommodation and ancillary services, care for the guest and for the things of the guest. Caterers and their employees are extremely responsible, they express care about its guests in the manner in which they attended the contracted items.

Završni rad govori o turističkim agencijama i njihovom statusu i ugovorima u hrvatskom pravu. Turističke agencije su subjekti trgovačkog prava čija se temeljna djelatnost sastoji u organiziranju i sklapanju ugovora, ugovora vezanih uz boravak turista u nekom kraju te pružanju drugih usluga svojim klijentima. Funkcije turističkih agencija su informativno – savjetodavni poslovi, posrednički poslovi, poslovi u ulozi organizatora putovanja i ostali različiti poslovi poput mijenjanja valute. Postoji više vrsta turističkih agencija, među kojima su detaljističke one koje posluju kao trgovci na malo, grosističke koje su trgovci na veliko, samostalne i zavisne. Bitno ime za turističke agencije je Thomas Cook, koji je organizirao prvo putovanje u 19. stoljeću. Da bi turističke agencije lakše štitile svoje interese i unaprjeđivale poslovanje, postoje udruge poput UHPA-e (Udruga hrvatskih putničkih agencija), koje im to olakšavaju. Na međunarodnoj razini djeluju udruge UFTAA, WATA, ASTA, IATA i ostale. U turističkim ugovorima turističke su usluge glavni sadržaj, bez obzira na subjekte koji ih sklapaju. Zakoni, koji štite turiste koji borave na području Republike Hrvatske, su Zakon o zaštiti potrošača i Zakon o turističkoj djelatnosti, pomoću kojih se osigurava zaštita turista. Ugovori koje sklapaju agencije dijele se na ugovore koje sklapaju s korisnikom usluga i na ugovore koje agencije sklapaju s davateljem usluga. Ugovori koje sklapaju agencije s korisnikom usluga dijele se na ugovore o organiziranju putovanja i posredničke ugovore o putovanju. The thesis discusses tourist agencies and their status and contracts related to Croatian legislation. Tourist agencies are commercial law entities whose principal activity consists of organizing and entering into agreements, agreements related to tourist accommodation at a certain destination, and offering other services to their clients. The activities of tourist agencies include informative - consulting, mediating, the role of tour operators, and other various tasks such as exchanging currencies. There are several types of tourist agencies including specialized agencies such as those operating as retailers, those operating as wholesalers, independent, and dependent. An important name among tourist agencies is that of Thomas Cook, who organized the first trip in the 19th century. Associations such as UHPA (Udruga hrvatskih putničkih agencija; Association of Croatian Travel Agencies) exist in order for tourist agencies to protect their interests and improve their business. Associations that operate on an international level are UFTAA, WATA, ASTA, IATA, and others. The main contents of tourism agreements are tourism services regardless of the parties entering into agreement. Laws that protect tourists staying in Croatia are the Consumer Protection Act and the Law on Tourism, which ensure the protection of tourists. Agreements which agencies enter into are divided into those entered into with service users and those entered into with service providers. Agreements between agencies and service users are divided into agreements on travel organisation and intermediary travel agreements. Agreements between travel agencies and service providers are divided into agency agreements on hotel services, agreements on engaging catering facilities, agreements on leasing catering facilities, and agency agreements between the hotel representatives and hoteliers. Tourism agencies must maintain their liquidity by achieving clients’ trust and through effective and high quality travel organisation.

Turističko tržište je specifično po tome što su ponuda i potražnja prostorno udaljeni i što korisnici određenih usluga moraju napustiti svoje mjesto boravka kako bi iskoristili plaćene usluge, odnosno karakteristično je kretanje turističke potražnje prema turističkoj ponudi. U turizmu postoji velika međuovisnost između turističkih agencija i ugostitelja. Činjenica da turističke agencije dobro poznaju turističku ponudu i potraţnju ukazuje na njihovu mogućnost posredovanja između istih. Ugovor o alotmanu jedan je od glavnih ugovora u turizmu koji regulira poslovne odnose te vrste. U ovom ugovoru javljaju se dvije ugovorne strane, turistička agencija i ugostitelj. Ugovori koji su sklopljeni između turističke agencije i ugostitelja su uvijek sklopljeni za gosta koji će te usluge koristiti. Agencija posredništvom između gosta i ugostitelja ostvaruje dobit, odnosno ugostitelj joj isplaćuje proviziju. Gosti biraju turističke agencije kao posrednike zbog velikog izvora informacija koje nude, radi brzine, jednostavnosti, sigurnosti i pouzdanosti, a nerijetko i jeftinijih cijena kod paket aranžmana u usporedbi sa zbirom cijena pojedinačnih usluga. Gost, koji je korisnik ugovorenih usluga, klijent je agencije s kojom sklapa ugovor o organiziranju putovanja, dok kod ugostitelja ima status treće osobe. Cilj ugovora o alotmanu je popunjavanje ugovorenih smještajnih kapaciteta, u kojem se kod ugostitelja smanjuje rizik od neispunjenja leţajeva, a agencija ostvaruje profit kroz proviziju koju dobiva od strane ugostitelja. Svrha rada je prikazati na koji način funkcionira ugovor o alotmanu, prava i obveze suugovaratelja, pozitivne učinke sklapanja ugovora o alotmanu i kriterije za uspješne dugoročne poslovne odnose između ugovornih strana. The tourist market is specific since the supply and demand are geographically distant and as users of certain services must leave their place of residence in order to take advantage of paid services, or the characteristic movement of tourist demand to the tourist supply. In tourism, there is a strong interdependence between travel agencies and hotel-keepers. The fact that travel agencies are well acquainted with the tourist supply and demand led to their possibility of mediation between those two. The allotment contract is one of the main contracts in the tourism industry, which regulates business relationships of that kind. In this agreement there are two parties, a travel agency and a hotel-keeper. Guests choose travel agencies as intermediaries between them and hotel-keepers because of the great sources of information that are offered by them, because of the simplicity, safety and reliability, and often cheaper prices. Guests, which are the users of the contracted services, are direct clients of agency's, while for the hotel-keepers they have the status of a third party. The purpose of the allotment contract is to fill the agreed accommodation units with guests by agencies, which will reduce the risk of empty rooms for the hotel-keeper, and the agencies make a profit through the commission they receive from the hotel-keepers. The aim of this bachelor thesis is to show how the allotment contract works, the rights and obligations of the contracting parties, the positive effects of the allotment contract and the criteria for successful long-term business relations between the parties.
