When it was created in 1965, condominium’s status was applicable to all built-up buildings or groups of built-up buildings whose property is divided into lots by several persons. After fifty-five years of existence, this principle is relaxed and the scope no longer concerns, since June 1st 2020, buildings or groups of buildings built for the total or partial use of dwellings, the ownership of which is divided into lots among several persons. This imperative field’s reduction comes within the framework of the entry into force of the provisions of the ordinance to the ELAN law of October 30th 2019. This development creates new prospects for the businesses or offices oriented buildings management. It is necessary to analyze all the ins and outs of this change in order to be able to propose secure and lasting legal arrangements.; Lors de sa création en 1965, le statut de la copropriété était applicable à tous les immeubles bâtis ou groupes d'immeubles bâtis dont la propriété est répartie par lots entre plusieurs personnes. Après cinquante-cinq ans d’existence, ce principe est assoupli et le champ d’application ne concerne plus, depuis le 1er juin 2020, que les immeubles bâtis ou groupes d'immeubles bâtis à usage total ou partiel d'habitation dont la propriété est répartie par lots entre plusieurs personnes. Cette réduction du champ impératif intervient dans le cadre de l’entrée en vigueur des dispositions de l’ordonnance à la loi ELAN du 30 octobre 2019. Cette évolution crée de nouvelles perspectives quant à la gestion des immeubles à destination exclusivement de commerces ou de bureaux. Il convient d’analyser tous les tenants et aboutissants de ce changement pour, in fine, être en mesure de proposer des montages juridiques sécuritaires et pérennes.

Дисертаційна робота присвячена дослідженню питань вдосконалення механізму фінансового забезпечення приватизації та постприватизаційної підтримки підприємств агропромислового комплексу. У роботі обгрунтовані та систематизовані економічні та соціальні фактори, які впливають на приватизацію агропромислових підприємств. Проаналізовано стан фінансового забезпечення приватизації підприємств агропромислового комплексу. Запропоновані рекомендації щодо вдосконалення фінансових відносин процесу приватизації і залучення інвестицій. Розроблено методику оцінки вартості майнового комплексу, що приватизується, на основі прогнозування майбутніх фінансових результатів функціонування підприємства. The thesis is devoted to the investigation of finansial ensuring mechanisms improvement of privatization and post-privatization support of agribusiness enterprises. The economic and social factors are systematized and grounded influencing the agribusiness enterprises privatization. The state of finansial ensuring of agribusiness enterprises privatization is analysed. The recommendations for finansial relations improvement of privatization process are given and investments involvements are suggested. The estimation methods of real estate being privatized are developed on the basis of the future finansial results prognosis of enterprises functioning.
