The historical aspects of the development of leasing have been thoroughly researched in the economic literature, however, scientists have divergent views on the interpretation of some positions on these issues. Insufficient definition of the concept of leasing and blurring of its classification adversely affects the participants of the leasing relations that interact with each other, so the specified direction of the study requires clear specification to avoid duplication of concepts, which confirms the relevance and purpose of the topic. The article analyzes the historical aspects of the development of leasing, the content, value and objective causes of the leasing relationship. The scientific substantiation of modern approaches to the interpretation of the term "leasing" has been formed. The scientific views and approaches to the classification of types of leasing according to different characteristics are investigated, as well as its features and disadvantages. The prospects for a well-functioning financial intermediation in the form of leasing are related to a number of problems. In particular, the research requires the definition of leasing, as well as the formulation of a clear classification based on the fundamental differences and features of each type of leasing

Despite the global popularity of restorative justice that has emerged in recent decades, limited attention has been paid to restorative justice conferencing used with offending girls. This article critically analyses restorative justice practitioners’ views concerning gender-specific practice and outcomes in restorative justice conferencing used with girls who offend. It is argued that restorative justice policy and practice has developed in a gender-blind framework, which fails to recognise or respond to the gender-specific needs and experiences of girls who offend. Drawing upon empirical findings, the article conceptualises, through a feminist-informed framework, the practical and policy implications arising from the gender-blind approaches of restorative justice conferencing.

The article considers the issue of creation, rise and development of the political term system in Ivan Franko’s research. It defi nes the innovative character of the thinker’s term practice, the historical impact on modernization of the Ukrainian political thought. The study deals with the rise and development of the national term system at the end of XIX – beginning of XX century. The task was determined by the necessity to solve two problems: a) to establish the only literary language; b) to create the national scientifi c language with the core formed by terms. The solution of those urgent problems required innovative methodological approaches. The research highlights the historical importance of Ivan Franko’s activity aimed at the development of the political scientifi c language particularly the political terminology, his contribution to the modernization of the Ukrainian political thought. The author’s resources served to be the main source of the term enrichment in Franko’s lexicon. The most productive way of word building is assumed to be the morphological one where the affi xation turns out to be dominant. The majority of the morphological derivatives are adjectival and verbal nouns. The conclusion is that the relevance and importance of Ivan Franko’s terminology go far beyond the scope of linguistics. The multiimensional activity of the researcher-terminologist and term-creator promoted not only the enrichment of the Ukrainian political lexicon by means of oneword original terms but also the intellectualization, presentation of new natiosophic notions. Ivan Franko modernized the Ukrainian political thought, enriched it with new knowledge of state formation.

Contributions on localisation often focus on interactions between local organisations and the international community, with limited attention for dynamics within the locally led part of the response themselves. The humanitarian response in the non-government-held areas of Syria is considered a key example of localisation, in which the health sector has taken a leading role. Drawing on fieldwork among Syrian medical-humanitarian organisations conducted in southern Turkey, this paper offers a view from below on the localisation debate. It provides a nuanced perspective on 'the local', showcasing how localisation is interpreted and expressed among Syrian NGOs themselves, and within their interaction with each other. It shows how most organisations have moved to a hybrid model emphasising their local and international character, resisting simplistic classifications. However, despite the sometimes strategic nature of its invocation, localisation does not lose its relevance as a lived experience, especially for local field staff. Background Announced in March 2016 and implemented in April 2018, the UK Soft Drinks Industry Levy (SDIL) aims to incentivise the reformulation of soft drinks. The SDIL has successfully decreased the amount of sugar in UK soft drinks, and purchased in soft drinks. Consequently, the SDIL has been widely applauded as a policy success. SSB taxation in other countries, however, has not been as successful and in some cases the policy was retracted. We aimed to develop an understanding of why the SDIL was deemed successful by analysing parliamentary debate two years before its announcement until two years post-implementation (2014–2020). Methods Searches of Hansard were conducted for parliamentary debate transcripts discussing the SDIL across three key time periods: Pre-Announcement (01/01/14–15/03/16), Announcement – Implementation (16/03/16–5/04/18), and Post-Implementation (6/04/18–16/03/20). 218 transcripts containing eligible search terms were identified, and 179 included in the analysis after screening for relevance. Applied thematic analysis was conducted in 5 stages: familiarisation and creation of initial codebooks, independent second coding, codebook finalisation through team consensus, final coding of the dataset to the complete codebook and theme finalisation through team consensus. Results Common issues raised in discussions across the timeline were: the ring-fencing of SDIL funds for pro-social causes, the scale of the health problems associated with excess sugar consumption, and the role of celebrities in making the SDIL a high profile issue. MPs acknowledged that the SDIL is not a ‘silver bullet’ for obesity prevention: it was positioned as either a ‘good start’ with other interventions required or that other interventions were needed instead. Distinct themes were that, due to early reformulation, the SDIL was discussed as ‘having worked’ one year prior to implementation. This notion persisted until the end of the timeline. These themes will be further refined to identify temporal patterns and trends. Additional results will be submitted before the June 28th deadline. Population Health Relevance The SDIL is unique: it is a flagship policy for the UK Childhood Obesity Strategy and has cross-party support. Understanding why and how the SDIL made it onto the statutes, and why it was politically successful is vital for using policy instruments to improve population health in future. This work will aid understanding of the parliamentary process surrounding the SDIL, and could provide insight for those wishing to extend the SDIL to other products or implement SSB taxes elsewhere.

This article explores the process of grammaticalization that has lead to the innovation of a distinct form of negation in Arizona Tewa, a Kiowa-Tanoan language spoken in the U. S. southwest. After reviewing comparative linguistic evidence that clearly establishes the innovative form of the Arizona Tewa negative, the analysis proceeds to examine ethnographic data as a means of understanding an apparent reanalysis of a subordinate clause marker as an obligatory part of negative constructions. Such data provide strong evidence for viewing the powerful role of discourse and language ideological factors in accounting for how this grammatical reanalysis both emerged and ultimately came to be the “preferred” form. Comparative data from Australian languages provides additional evidence for viewing larger discourses as highly influential contexts for grammatical change.

During the 2012 U.S. Presidential campaign, President Obama turned some heads by stating “If you’ve got a business – you didn’t build that”. His opponents argued that this was an attack on private enterprise (with “that” referring to business), while his supporters and fact-checking organizations maintained that “that” referred to what Obama was talking about previously (U.S. infrastructure) and represented his political-economic plan of an increased interlacing of private business with government investment. I argue, from a relevance-theoretic perspective, that both interpretations follow from differing contextual assumptions on the part of the audience. In this sense, the role of contextual assumptions in utterance interpretation is highlighted – different contextual assumptions lead to different cognitive effects if the utterance leaves room for more than one interpretation. Combined with a highly polarized U.S. political arena, where participants pounce on their opponent’s every possible miscue, all the ingredients for misunderstanding are present.

The notion of implicature was first introduced by Grice (1967, 1989), who defined it essentially as what is communicated less what is said. This definition contributed in part to the proliferation of a large number of different species of implicature by neo-Griceans. Relevance theorists have responded to this by proposing a shift back to the distinction between explicit and implicit meaning (corresponding to explicature and implicature respectively). However, they appear to have pared down the concept of implicature too much, ignoring phenomena which may be better treated as implicatures in their over-generalisation of the concept of explicature. These problems have their roots in the fact that explicit and implicit meaning intuitively overlap, and thus do not provide a suitable basis for distinguishing implicature from other types of pragmatic phenomena. An alternative conceptualisation of implicature based on the concept of implying with which Grice originally associated his notion of implicature is thus proposed. From this definition it emerges that implicature constitutes something else inferred by the addressee that is not literally said by the speaker. Instead, it is meant in addition to what the literally speaker says, and consequently, it is defeasible like all other types of pragmatic phenomena.

In its modern form, textualism promised careful attention to interpretive context. Such attention would allow textualism to be less ‘wooden’ than its earlier manifestations and so to avoid the embarrassing ‘contradictions’ of the sort highlighted by Karl Llewellyn’s table of ‘dueling’ interpretive canons. Avoiding that sort of embarrassment, though, required that textualists be more modest about the determinacy of statutory meaning. To make their method of interpretation less wooden, after all, was to make it more nuanced and, accordingly, to make it more vulnerable to reasonable disagreement about its application in individual cases. To back away from the ‘foolish pretense’ of statutory determinacy was awkward in a legal environment disfavoring the open exercise of judicial discretion, and all the more so for proponents of an interpretive methodology grounded so explicitly in a commitment to democratic self-rule. To the extent that it did, modern textualism was able to incorporate a more Realist understanding of legal determinacy because it also contained a (concededly modest) commitment to judicial non-intervention. That commitment is, however, now mostly gone. Seemingly motivated by a desire to accumulate power to a now firmly conservative judiciary, a combination of interpretive methodological conversions and new judicial appointments has yielded a federal judiciary committed not only to textualism but also to deciding the cases before them on the basis of 'independent' judicial judgment. And because the legal environment continues to disfavor the open exercise of judicial discretion -- and understandably so, given judges’ comparative lack of democratic legitimacy -- the result has been increasingly wooden analysis, giving new and unfortunate relevance to Llewellyn’s near-century old critique.

Consideration of a learners’ biography is deemed to impact on their engagement with formal education and their connection with, and perceived relevance of, educational course content. It is considered equally important to understand coaches who enrol on formal coach learning in sport—their motivations, beliefs, values, existing knowledge, and previous life experiences. This research explored the individual biographies of eight neophyte cycling coaches over an 18-month period following the successful completion of a national governing body coach award. Following 23 formal semistructured interviews and 26 unstructured interviews, deductive thematic narrative analysis revealed three different typologies of coach: the “performance coach”; the “parent-coach”; and the “community coach.” Although the subjective details of the life stories varied according to their idiosyncratic perspective, all participants’ stories broadly followed one of these three identifiable narratives. Identifying different “typologies” of cycling coaches’ answers calls from coach developers to account for the specific backgrounds of coaches’ practices. It is hoped this research will begin the process of developing more personalised approaches to coach education.

Youth with anxiety often experience significant impairment in the school setting. Despite the relevance and promise of addressing anxiety in schools, traditional treatment approaches to school-based anxiety often do not adequately address generalization to the school setting, or they require removing the student from the classroom to deliver time- and staff-intensive programs. Such programs often leave teachers and caregivers feeling ill-equipped to support the student with anxiety throughout the natural course of the school day. Given the heavy demands placed on teachers and documented burnout among school professionals, providing effective school supports requires collaborative partnerships among outpatient therapists/specialists, school personnel, and caregivers. Drawing from literature on collaborative models for externalizing problems, we offer recommendations for outpatient therapists and specialists working to implement evidence-based supports in school settings and promote home-school partnerships to benefit youth with anxiety in the school setting. Our recommendations touch upon several components of such school consultation, including (a) identification of key parties involved, (b) conducting a needs assessment, (c) collaborative goal setting and development of a fear hierarchy, (d) plan development and implementation (e.g., facilitating a school-based exposure mindset, promoting home-school communication, enhancing school relationships), and (e) progress monitoring and ongoing support. We conclude with a case example to bring these recommendations to life.

Many applied economic settings involve trade-offs between in-group members and strangers. To better understand decision making in these contexts, this paper measures and investigates the economic relevance of heterogeneity in moral universalism: the extent to which people exhibit the same level of altruism and trust toward strangers as toward in-group members. We first introduce a new experimentally validated, survey-based measure of moral universalism that is simple and easily scalable. We then deploy this tool in a large, representative sample of the U.S. population to study heterogeneity and economic relevance. We find that universalism is a relatively stable trait at the individual level. In exploratory analyses, heterogeneity in universalism is significantly related to observables: Older people, men, the rich, the rural, and the religious exhibit less universalist preferences and beliefs. Linking variation in universalism to self-reports of economic and social behaviors, we document the following correlations. Universalists donate less money locally, but more globally, and are less likely to exhibit home bias in equity and educational investments. In terms of social networks, universalists have fewer friends, spend less time with them, and feel more lonely. These results provide a blueprint for measuring moral universalism in applied settings and suggest that variation in universalism is relevant for understanding a myriad of economic behaviors. Objective Research has shown that complicated grief has the potential to adversely affect bereaved individuals, and in this context, understanding how mental health professionals engage with it in practice is of relevance. Gaining an understanding of professionals’ knowledge, attitudes, skills and training in relation to complicated grief could provide insights that will inform their training and professional development. The aim of this study was to consider professionals’ engagement with complicated grief, as represented by self-reported knowledge, attitudes, skills and training. Methods The study used a three-phase mixed methods design (systematic review, qualitative interviews, and a quantitative survey) with empirical data being collected from psychologists, psychiatrists and counselor/psychotherapists. Results Analysis yielded 15 integrated findings across the three phases, which were grouped into two clusters: the first highlighted tension between professionals’ reported confidence and competence and the second explored the parameters and contribution of research and training in this area. Conclusion Professionals’ perception of their competence to work with complicated grief seems overstated and research and professional practice are not aligned. Practice implications These findings are positioned to inform empirically supported training that addresses identified deficits in professionals’ knowledge, attitudes and skills. It is important therefore that training is reflective of the needs of different professional groups.

A key question confronting policy makers during economic crises is how they can support firms to maintain their performance levels until the economic storm has passed. The present study bridges insights from the ambidexterity and public policy literatures to examine how firm-internal responses (that is, ambidexterity) and external public policy incentives (that is, demand-pull policies) affect the stability of firms’ performance in a recessionary economic context. Using data from private German renewable energy firms at a time following the global financial crisis, we find that only firms with low ambidexterity achieve performance stability in light of demand-pull policies. This research draws attention to the relevance of stability as a policy-relevant performance measure during times of economic crises. Further, we suggest that greater insight into the interplay of managerial and political factors is necessary to enable policy makers to support the stability of certain industries during crises.

The present editorial provides a series of perspectives on the future of burnout in sport. Specifically, for the first time, seven burnout researchers have offered their opinions and suggestions for how, as a field, we can progress our understanding of this important topic. A broad range of ideas are discussed, including the relevance of the social context, the value of theory and collaboration, and the use of public health frameworks in future work. It is hoped that these perspectives will help stimulate debate, reinforce and renew priorities, and guide research in this area over the coming years.

Many family firms hire and rely on non-family employees; therefore, the mutual benefits provided to both family and non-family members are important. Yet, the perspectives of non-family employees have been under researched. Drawing upon organizational identity and justice theories and the extant literature on family influence, this study examines non-family employees’ perceived family influence, family firm identification, family firm justice, and turnover intentions in a sample of 301 family business non-family employees. Path analysis results show that non-family employees’ perceived family influence can lead to family firm identification, in turn diminishing their turnover intentions. We also find that non-family employees’ perceptions of family firm justice moderate the relationship between non-family employees’ perceived family influence and family firm identification. We conclude by discussing implications.

Leveraging China’s 2013 anti-corruption campaign (the Campaign) as a quasi-natural experiment and a difference-in-differences (DID) research design, we examine which of the three motives (value relevancy, risk management, or altruism) better explain a firm’s corporate social responsibility (CSR) activities. Our findings suggest that, after the Campaign and conditional on the level of firm corruption-related expenses, firms generally engage in more CSR, which supports the value relevance motive of CSR. Additional analyses suggest that the positive impact of the Campaign on CSR is more salient when: 1) the Campaign is effective in the province in which a firm is located; 2) the financialization level of a province in which a firm is located is high; 3) firms have more political connections interruption in the Campaign; 4) firms have high operating risk; 5) firms are more capable of conducting CSR activities; or 6) the extent of firms’ corporate governance is excellent.

The relevance of screening is discussed in the review in indissoluble connection with World Health Organization position on the need to eliminate hepatitis С viral infection by 2030 in Europe and the US. It was quoted the definition of screening and the criteria that make screening appropriate. The indications for screening, given in the National Guidelines, and the need for their clarification in accordance with the epidemiological situation in Ukraine are discussed. Based on an analysis of 55 literature sources, the authors conclude that screening is an important tool that opens a way to antiviral treatment for the patients with hepatitis. Screening should be properly organized, because otherwise it will be inefficient or extremely expensive. Generally accepted criteria for the screening should be adapted to the epidemiological situation in the region, taking into account the prevailing routs of transmission. Patients can be recruited for screening through the media, but the most effective is selection that conducted by health professionals. It is necessary to constantly adapt the criteria for selecting patients for screening in accordance with the changing epidemiological situation over time.

The hustle and bustle of the modern era, marked by an easy life, is relatively only able to provide physical pleasure, but is unable to provide physical and spiritual happiness. The phenomenon of life that is not balanced with this level of happiness, causes a void. The purpose of this study was to determine the meaning and ways of obtaining happiness according to Syeikh Ibnu Atha’illah as-Sakandari, as well as its relevance to human life in the modern era. This research is a qualitative research that uses a library research approach. The analytical method used is a content analysis technique. The conclusion of this study, shows that the happiness referred to by Syeikh Ibnu Atha’illah as-Sakandari divided happiness in two dimensions, namely happiness in the World and happiness in the hereafter. Happiness actually exists in human. Happiness will be realized when humans are able to optimize the potential of the mind and the potential of the heart. The path to happiness can be attained by knowing the characteristics of the wordly life and suffering and reducing pleasures. Moral perfections will lead humans to true happiness, namely meeting Allah SWT in a state of faith.

This article compares case studies to better understand how third grade teachers, serving low-income (including Title I) schools, adapted their instruction in the midst of a global pandemic to better support their students’ learning about locally-relevant civic issues. Civic perspective-taking components were embedded in the unit design with the aim of building deliberative, inclusive classrooms. The team designed lessons drawing from theories of culturally sustaining pedagogy. Using semi-structured interview data, we examined teachers’ reported thinking and perceptions about students’ needs and their own struggles to deliver purposeful, equitable instruction. Findings indicate that as teachers collaboratively designed the lessons they discussed how to balance relevance and sensitivity in relation to content that mirrored students lived realities. This study advances our understanding of what challenges teachers overcome to integrate culturally-sustaining practices in their social studies instruction.

Although, sustainable consumption is gaining in relevance for consumers and retailers in Germany, pro-social consumption is still often neglected. Therefore, this study investigates factors influencing the purchase intention of German flower buyers in relation to Fairtrade-cut roses based on an online survey of 1,201 flower buyers in retail shops in 2017. As a basic theoretical framework, the Theory of Planned Behavior (TPB) was utilized and extended with two additional constructs. The addition of emotions and perceived consumer effectiveness reveals a strong explanatory power of the model proposed. Data analysis via partial least square structural equation modeling (PLS-SEM) suggests that emotions and subjective norm are the two most influential determinants of intention to purchase Fairtrade roses. However, emotions also significantly influence all determinants of behavioral intention introduced to the extended model. The findings of this study can be used to fine-tune marketing and communication activities related to pro-social and Fairtrade products.

The influence of early childhood teachers’ beliefs on different aspects of their professional competencies has become a topic of growing importance in early childhood education and care. The presented study investigated pedagogical content beliefs of 120 early childhood teachers in German kindergartens. The relations between their beliefs and the assessed quality of interaction with children, the competency of professional vision, theoretical knowledge, and educational background were examined. The study focused on the domain of Instructional Support because of its relevance for children's cognitive development. Five distinct profiles of teachers’ beliefs were identified from a person-centered approach of latent profile analysis. The analyses of profile-differences showed that profiles of teachers with similar beliefs significantly differed in their theoretical knowledge and educational background. This paper concludes by outlining analogies of the resulting profiles with the concurrent evidence in the field of ECEC, discussing study-specific limitations and suggesting potential implementation for teachers’ educations as well as starting points for further research investigations.

The Internet of Things (IoT), a worldwide network of interconnected objects uniquely addressable, based on standard communication protocols, has become a disruptive technology, even for decision-makers who develop products based on them. It was reported in 2015 and 2018 that decision-makers associated with the Fortune 1000 firms stated that they were hesitant to use IoT-based value propositions, primarily due to privacy and security concerns. In this article, we view decision-maker willingness to develop IoT-based products through the lens of the social construction of technology (SCOT) theory. We utilize SCOT-based generational cohorts of firm decision-makers to investigate whether generational cohorts of decision-makers are relevant in a firm's decision to launch an IoT value proposition. We argue that it is pertinent to consider age-based generations as stakeholders for IoT, which currently constitutes a gap in the literature on IoT and SCOT. We employ an exploratory survey analysis that supports the relevance of generational decision-making cohorts. We focus on age to the exclusion of other potential decision-maker cohort possibilities and discuss this as a limitation in our conclusion.

Pediatric populations are expected to bear most of the climate change impacts, with racial minorities and children living in poorer countries being particularly vulnerable. Given their relevance to cutaneous disease, dermatologists should be aware of these climate-sensitive health impacts and the ways in which they intersect with social factors. Strategies including targeted risk communication, motivational interviewing, and storytelling can help facilitate climate discussions during the patient encounter. In this article the authors summarize common dermatologic health impacts related to environmental exposures and provide sample scripts for climate messaging.

We study a model of the rise and fall of illiberal democracies. Voters value both liberty and economic security. In times of crisis, voters may prefer to elect an illiberal government that, by violating constitutional constraints, offers greater economic security but less liberty. However, violating these constraints allows the government to manipulate information, in turn reducing electoral accountability. We show how elements of liberal constitutions induce voters to elect illiberal governments that remain in power for inefficiently long—including forever. We derive insights into what makes constitutions stable against the rise of illiberal governments. We extend the model to allow for illiberal governments to overcome checks and balances and become autocracies. We show that stronger checks and balances are a double-edged sword: they slow down autocratization but may make it more likely. We discuss the empirical relevance of our theoretical framework and its connection to real world examples.

Managers and corporate directors need to recognize two key behavioral impediments that obstruct the process of value maximization, one internal to the firm and the other external. I call the first obstruction behavioral costs. Behavioral costs, like agency costs, tend to prevent value creation. Behavioral costs are the costs associated with errors that people make because of cognitive imperfections and emotional influences. The second obstruction stems from behavioral errors on the part of analysts and investors. These errors can create gaps between fundamental values and market prices. When they do, managers may find themselves conflicted, unsure of how to factor the errors of analysts and investors into their own decisions. Proponents of value based management emphasize that with properly designed incentives, managers will maximize the value of the firms for which they work. As such, either they treat behavioral costs as simply another form of agency costs, or they deny the relevance of cognitive errors. In contrast, proponents of behavioral finance argue that behavioral costs are typically large, and cannot be addressed though incentives alone. This is not to say that incentives are immaterial. On the contrary, incentives are of critical importance. The point, however, is that there are limits to incentives. If employees have a distorted view of what is in their own self-interest, or if they have a mistaken view of what actions they need to take in order to maximize their self-interest, then incentive compatibility, although necessary for value maximization, will not be sufficient.

Background Falls efficacy is a widely-studied latent construct in community-dwelling older adults. Various self-reported instruments have been used to measure falls efficacy. In order to be informed of the choice of the best measurement instrument for a specific purpose, empirical evidence of the development and measurement properties of falls efficacy related instruments is needed. Methods The Consensus-based Standards for the Selection of Health Measurement Intruments (COSMIN) checklist was used to summarise evidence on the development, content validity, and structural validity of instruments measuring falls efficacy in community-dwelling older adults. Databases including MEDLINE, Web of Science, PsychINFO, SCOPUS, CINAHL were searched (May 2019). Records on the development of instruments and studies assessing content validity or structural validity of falls efficacy related scales were included. COSMIN methodology was used to guide the review of eligible studies and in the assessment of their methodological quality. Evidence of content validity: relevance, comprehensiveness and comprehensibility and unidimensionality for structural validity were synthesised. A modified GRADE approach was applied to evidence synthesis. Results Thirty-five studies, of which 18 instruments had been identified, were included in the review. High-quality evidence showed that the Modified Falls Efficacy Scale (FES)-13 items (MFES-13) has sufficient relevance, yet insufficient comprehensiveness for measuring falls efficacy. Moderate quality evidence supported that the FES-10 has sufficient relevance, and MFES-14 has sufficient comprehensibility. Activities-specific Balance Confidence (ABC) Scale–Simplified (ABC-15) has sufficient relevance in measuring balance confidence supported by moderate-quality evidence. Low to very low-quality evidence underpinned the content validity of other instruments. High-quality evidence supported sufficient unidimensionality for eight instruments (FES-10, MFES-14, ABC-6, ABC-15, ABC-16, Iconographical FES (Icon-FES), FES–International (FES-I) and Perceived Ability to Prevent and Manage Fall Risks (PAPMFR)). Conclusion Content validity of instruments to measure falls efficacy is understudied. Structural validity is sufficient for a number of widely-used instruments. Measuring balance confidence is a subset of falls efficacy. Further work is needed to investigate a broader construct for falls efficacy.

In this short paper, I shall argue that legal philosophers ought to focus more than they have done so far on problems of legal reasoning. Not only is this a field with many philosophically interesting questions to consider, but it is also, in my estimation, the field in which legal philosophers can contribute the most to both the practice and the study of law. The practice of law is, after all, an argumentative practice. Lawyers and judges aim to provide solutions to concrete legal problems but rarely try to say anything of general application. And although legal scholars take a more general view of things and typically discuss types of legal problems, they, too, tend to prefer a rather piecemeal approach to legal problem-solving, and usually abstain from defending general theories or otherwise speaking in general terms. But even though reasoning and interpretation are at the center of what legal practitioners and legal scholars do, and even though there are many highly talented persons in the above-mentioned groups, neither legal practitioners nor legal scholars reason with the same care and precision as philosophers do. Perhaps the most important difference is that whereas legal practitioners and legal scholars typically approach reasoning and interpretation in an intuitive way, emphasizing rules of thumb, common sense, and the value of workable legal solutions to problematic cases, philosophers, although they may also reason intuitively and emphasize common sense, often take care to make the logical structure of the relevant argument explicit by formulating as precisely as possible both the conclusion and the premises, and by subjecting the argument thus formulated to close logical as well as substantive scrutiny, where such scrutiny typically involves paying close attention to the content, structure, and function of any relevant concepts. Against this background, I consider the following three types of questions regarding legal reasoning especially worthy of serious consideration. The first question is that of the relevance of the theory of reasons holism to legal reasoning in general. The second is the question of how to analyze (first-order) legal statements in a way that does not undermine the rationality of legal reasoning. And the third is the question of whether legal arguments or inferences are to be understood as deductive or as inductive inferences, or both, and if so how.

This study examines the impact of the enhanced auditor’s report (ISA 701) in New Zealand on audit effort (audit fees and audit delay); audit quality (absolute abnormal accruals); client disclosures (inventory) and investors (value relevance). ISA 701 requiries an enhanced auditor’s report. A notable feature of the report is a section termed Key Audit Matters (KAMs). The purpose of a KAM is to disclose financial reporting risks, thereby enhancing the communication value of the audit report. We find no incremental affect related to the introduction of KAM disclosures. We find that both auditors and investors price the information in KAMs (audit fees and share prices) in both in the first year of KAM reporting and in the prior year. We note that client disclosure related to inventory KAMs are greater than non-inventory KAMs firms in both the year of KAM reporting and in the prior year.

The current paper discusses possibilities for school students to successfully pass TORFL-I/B1, TORFL-II/B2 and TORFL-III/C1. The relevance of this article is determined by the fact that despite Russian as a foreign (second) language has been taught within the framework of the TORFL system for more than two decades, there is a shortage of methodological material aimed at preparing school students for TORFL. In addition, the issue of choosing the level of testing in accordance with the level of Russian language proficiency and taking into account age specifics is not sufficiently covered in Russian academic literature. The aim of this paper is to define age reference marks for school students who plan to pass TORFL. The materials to review and analyse were the works of Russian and foreign researchers in the field of foreign (second) language proficiency, language development of children and adolescents, assessment of school students communicative competence, language assessment, and correlation of these data with the requirements for completing tasks of the TORFL-I/B1, TORFL-II/B2, TORFL-III/C1 Writing subtests selected as an example. The paper has resulted in providing recommendations on the choice of examination level for senior and junior school students, within the framework of TORFL-I/B1, TORFL-II/B2, TORFL-III/C1, which can also be used in the development of training courses in Russian as a foreign language for schools. The authors concluded that there is need to develop a new methodological area in testing of Russian as a foreign language system capable to provide guidelines and recommendations for preparing school students for examinations, and designing TORFL training courses and teaching materials according to the school students age.

The relevance of the article is due to the authors attempt to apply some of the philosophical concepts of F.M. Dostoevsky to the comprehension of contemporary sociocultural reality. The purpose of this study is to clarify the reasons for the historically unfriendly attitude of Europe towards Russia by analyzing the works of F.M. Dostoevsky dedicated to this problem. In the process of writing the article, the published Diaries of the writer were used; diary entries unpublished during the writer's life; philosophical reflections contained in works of art, as well as applied modern scientific and popular science literature dedicated to the work of F.M. Dostoevsky. In the course of the analysis, it was found that the writer considered historical, confessional and moral reasons to be the main factors in the rejection of Russia by Europe, while he especially singled out disinterestedness incomprehensible to Europe as a characteristic of the Russian people. The authors draws attention to the fact that all the reasons for Europe's "remarkable dislike" for Russia, about which F.M. Dostoevsky, directly or indirectly associated with the Orthodox faith. Therefore, an attempt to actualize the worldview heritage of the great writer will certainly lead us to a dilemma: either to move from thoughts and words to actions, to religiously enlighten both ourselves and Europe; or to enclose our Orthodox heritage in a historical and cultural framework, eliminating the source of the reasons for our rejection by the European public, with all the ensuing consequences.

The article presents the results of a pilot experiment carried out within the framework of psycholinguistics and aimed identify the structure and content of the value system and the image of the future of generation Z. The relevance of such studies is substantiated; a complex of methods is described that allows: 1) reveal the specifics of the value system and the image of the future as its subsystem; 2) highlight the most significant signs of the studied phenomena in the group consciousness; 3) draw conclusions on the motives determining the hierarchy of values. The results of the analysis allow us conclude that at present there is a change in the connections between the elements of the structure of values, the core of which is the desire for life only by the interests of the inner circle of people and material prosperity. It is assumed that the experimentally recorded trend could be explained either by the ongoing gradual replacement of the values of traditional culture with the values of an individualistic society, or by the contradiction between social archetypes (according to K. Kasyanova), which determine the national type of linguistic personality (according to Yu.N. Karaulov) and the external form of the state as that society section, which quite rigidly tries to fix the main parameters of society of a certain state. It is argued that the lack of a clear understanding of the causes of what is going on, as well as the importance of the problem for society, determines the need for further research in this direction.

The relevance of the research is based on the heated discussion that has unfolded in recent years in connection with changes of the current legislation on legal regime of animals as objects of civil rights as well as awkward suggestions aimed at essentially reshaping the civilistic concept of animals and establishing their special legal status by recognizing them, albeit with some restrictions, as subjects of legal rights. The purpose is to analyze the genesis of animals legislation, including but not limited to international legislation, and to reveal the social significance of norms governing the conditions and procedure for acquisition of animals and the limits and principles of their treatment. The article also aims at voicing the authors position on participation in the civil circulation of animals. Research methods applied in the work are as follows: formal-legal, dialectical unity, system analysis, interpretation, modeling, and forecasting. The results of the study (conclusions) are realized in proposing to supplement Art. 128 of the Civil Code of the Russian Federation with a new term property as basic in relation to terms things, other property, and property rights. It is also recommended to expand the range of objects of civil rights by identifying animals as an independent object, clarify the revision of Art. 137 of the Civil Code, presenting in it the definition of an animal as an object of civil rights and reflecting the main criterion for classifying animals (turnover). In addition, a judgment was made on changes in Russian legislation introduced in 2020, including the Law On the Animal World, allowing amateur and sports hunting of animals in semi-free conditions and artificially created habitat. This law clearly contradicts international agreements that allow hunting (capture) of animals only for the maintenance of human livelihood.

The article examines a relatively new type of public administration acts for the Russian legal system - administrative regulations. Despite the widespread use of this type of act, its legal nature, features of the legal structure, and classification remain insufficiently studied, which determines the relevance of this study. The purpose of the study is to identify the specific characteristics of administrative regulations, allowing to classify them as a special tool for realisation of various public administration forms. Achieving this goal suggests analysis of regulatory legal acts, both Russian and foreign, as well as certain approaches to legal doctrine to determine the essence of administrative regulations, various public administration forms, and acts of public administration. Based on the analysis of theoretical and empirical data, the authors offer their definitions of acts of public administration, administrative regulations, and tools for realisation of public administration forms. In the process of research, the authors used a formal legal method that allows characterising the legal nature of administrative regulations, their role, and place in the system of acts of public administration, a comparative legal method to identify the general and the special when comparing domestic and foreign experience and general logical methods (analysis, synthesis, analogy).

Purpose: This study was conducted to evaluate the effects of a multicomponent peer-mediated intervention (PMI) on teaching adolescents with autism spectrum disorder (ASD) how to show interest in peer conversation partners by asking partner-focused questions about the person, their interests, or their experiences and by making partner-focused comments that positively affirm peer statements or express concern. Method: A multiple-baseline design across three verbally fluent high school students with ASD was used to assess the effects of the PMI, which involved training peers ( n = 10) to support conversation and the students' use of target skills, and training the students to use partner-focused skills with the aid of a self-reflection cue sheet during conversation with trained peers in a high school cafeteria. Ten-minute samples of student–peer conversations were transcribed and analyzed. Generalization with untrained peers was assessed. Results: The PMI was highly effective in increasing all students' use of partner-focused skills. Gains were maintained by two students in a return-to-baseline condition. Generalization was evident for all students with varied results. Peers and students with ASD perceived the intervention to be beneficial. Conclusions: This study adds to the limited research showing that PMI can be used in high school settings to improve target conversational skills and provides preliminary evidence that PMI can successfully address an underresearched pragmatic language difficulty (i.e., introducing and maintaining topics of conversation of relevance and interest to conversation partners) common among adolescents with ASD. BACKGROUND In recent years, the value of patient and public involvement (PPI) in developing research has become apparent. Patients and service users have insights that are essential to successfully developing and completing research. PPI collaborations may improve the scope, quality, relevance and impact of research. Nevertheless, there are challenges for nurse researchers in ensuring effective PPI is embedded in research proposals and practice. AIM To discuss the practical aspects of developing a PPI group, including one approach to convening a PPI group, and provide examples of where a PPI group has refined and improved the design of research. DISCUSSION Directly inviting patients and members of the public to collaborate in the research resulted in successful working relationships and tangible improvements to a study's methodology. None of the patients approached had considered collaborating in research before and so would not have been reached by any other means. CONCLUSION There are several approaches nurse researchers can take to convene a PPI group, including open forums and relevant charity groups. The authors' experience was broadly successful, although future research would involve collaboration with other teams to recruit more diverse groups. IMPLICATIONS FOR PRACTICE Nurse researchers are ideally placed to collaborate with patients and members of the public in designing and delivering research.

PurposeThe demand for construction-related occupations has increased consistently over many years in New Zealand (NZ). This has necessitated recourse to migrant workers to address capacity and capability requirements. Migrant construction workers hail from various backgrounds with a complex set of their needs being met through employment in NZ. Research on understanding the satisfaction levels of this category of construction workers is scarce. With recent insinuations about migrant exploitations, research investigations into this knowledge area are significant. In this study, the authors sought to establish the moderating effect of migrants' demography on the determinants of job satisfaction in NZ's construction sector.Design/methodology/approachData were obtained from migrant construction workers of Chinese extraction through a structured questionnaire survey. From 200 questionnaires administered, 108 samples were completed by migrant construction workers involved in major projects in Auckland city, NZ. Data obtained were analysed using descriptive and inferential statistics to establish the moderating effects of their demography on job satisfaction.FindingsResults from this study support the internal validity and reliability of these personal characteristics as moderators of job satisfaction for migrant construction workers. These results suggest the relevance of personal characteristics of Chinese migrants in any improvement initiatives being developed for this group of construction workers.Research limitations/implicationsThe findings from this study contribute to the discourse on the relevance of construction migrants as a strategic alternative to addressing skill shortages within the NZ construction sector. They also provide evidence that contributes to an improved understanding of the migrant workforce to meet their aspirations and enhance their general well-being.Originality/valueAlthough the study is ethnic-specific, the conclusions show the relevance of personal characteristics in the experiences of construction migrant workers. The study is representative of the catchment of temporary migrant workers in the construction industry in NZ. The study provides insights for organisations employing migrants about putting in place appropriate measures to enhance their satisfaction levels. Finally, this study's findings may contribute to policy initiatives on the optimal categories of migrants engaged on construction activities to derive the maximum benefits for NZ.

This study explores the experiences of a cohort of young, educated, internationally mobile Chinese consumers with cheese and other dairy products, and how these experiences shape their behavior toward cheese products. In total, 41 Chinese students studying at an Irish university participated in 5 focus groups (n = 41, n = 7-10). Thematic analysis identified important factors that influence consumer behaviors regarding cheese products. Individuals' expectations toward cheese were embedded in their knowledge structures, which were constructed from previous experience. Participants had general positive expectations toward cheese due to associations with western-style foods and nostalgia; however, direct eating experience determined long-term behavior. When making a purchase decision, choice motives were weighed and negotiated to establish a fundamental driving factor for purchase. Perceived probability of choice motive fulfillment was important in determining purchase decisions, with many participants having low perceived ability to select cheese and limited motivation to engage with cheese due to limited perceived relevance of cheese to their daily food life. Individuals' innovativeness was an important factor that influences their openness to cheese products when moving beyond familiar foods. Opportunities exist such as using nostalgic cues as marketing tools to increase consumers' interest in cheese or combining cheese with Chinese food to increase perceived relevance of cheese to their daily food life. Providing information at point of purchase could reduce the disconnect between expectation and actual experience, and innovative cheese products may be developed to better fulfill important choice motives.

Advances in genomic research, biobanking and DNA identification technologies are expanding the use of biological and genetic evidence in litigation. The discovery of DNA and one of its functions to transmit hereditary information made it possible to look differently at the theory of a genetic predisposition to deviant behavior. The relevance of the study is due to the fact that the availability and increase of genetic research allows, along with the traditional use of genetic expertise in litigation (search and identification of a criminal, establishment of paternity), to expand the possibility of using the achievements of genetics by the parties to prove other circumstances in court. In this article, the authors analyze the US jurisprudence regarding the possibility of a party using the protection of genetic evidence in order to present a position in justification of the mitigation of punishment for an accused due to her genetic predisposition to criminal behavior. The authors also paid attention to the consideration of the issue of using the results of genetic testing in civil proceedings in order to prove the fact of the influence of the inherited gene on deviant behavior. In carrying out this study, the authors used a significant number of Russian and foreign sources of scientific literature. General and specific scientific methods of cognition, including the formal legal and comparative legal method, were used as research methods

The legal framework for biosimilar medicinal product was first established in 2004 in the European Union and later in the USA. Since then, based on the scientific and regulatory experience with biosimilarity assessment, regulatory approaches have evolved considerably. A clear understanding of the capabilities of each development stage in assessing comparability in terms of power to identify differences and assess their relevance to the final clinical outcome gradually accumulated. In addition to the commitment to the biosimilarity approach, it is important to comply with the general requirements applicable to any drugs produced at an industrial scale. Experience showed that the demonstration of biosimilarity based on a range of analytical and functional tests and mainly clinical pharmacological studies is universal and allows extrapolating therapeutic indications. The establishment of biosimilar interchangeability, since the active substance by definition is a version of the active substance of the corresponding reference biological product, can introduce additional difficulties. A single approach to the establishment of biosimilar interchangeability has not yet been developed.

Propaganda is an attempt to spread social and political values to influence peoples thinking, as well as to control and shape their behavior. It is an inseparable tool of the North Korean state. In a totalitarian state where digital information is restricted, the standards of living are low, and access to education is limited, propaganda is a part of almost all everyday routines. Its key function is to support the existing regime and teach citizens to obey it. Drawing on semiotic methodologies, this article examines North Korean propaganda through the prism of visual art and identifies distinctive features of posters as one of the major elements of the complex system of North Korean propaganda. The relevance of this work lies in the permanent interest in the phenomenon of North Korean propaganda in the international arena. The purpose of this work is to study the distinctive features and characteristics of propaganda posters as an integral part of North Korean propaganda. The objectives of this work are a detailed consideration of the propaganda system, its distinctive features, structuring of campaign posters, slogans, and messages with their accompanying translation, embedded within this type of propaganda.

The relevance of the research topic is justified by the rapid technological development of genetics and genomics and introduction of genetic technologies and inventions in scientific and medical practice, which is not provided with a proper systematized legal protection in national and international legislation. The legislators problems are caused by the uniqueness and complexity of the genomic legal relationship. The subjects of knowledge in the framework of post-non-classical scientific rationality need to focus on the epistemological philosophical foundations of the knowledge of genomic legal relations. The purpose of the study is to identify and reflect the features of knowledge of the legal protection of genomic legal relations. Research tasks suggest defining the concept and composition of genomic legal relations, identifying the object and subject of legal protection of genomic legal relations, distinguishing between the concepts of "legal safeguard" and "legal protection" of genomic legal relations. The methodology of scientific research includes the dialectical method, general scientific logical operations (deduction and induction, analysis and synthesis), and private scientific methods (formal legal and comparative legal methods). Within the framework of the methodology of post-non-classical scientific rationality, a systematic approach to the study of the object of knowledge is used - the study of the structure, functional and instrumental aspects of the protective genomic legal relationship.

The article is devoted to the problems of formation and positioning of the category of factual communities in legal science. The relevance of this phenomenon in law is due to the need for a broader approach to the study of a set of factual circumstances that are the grounds for the emergence, change or termination of legal relations, which undoubtedly contributes to a more effective implementation of the goals of both lawmaking and law enforcement practice. The purpose of this article is to determine the prerequisites for the formation of the legal category under consideration, to identify the main types of factual communities, as well as to understand their functions. Achievement of this goal will make it possible with sufficient certainty to identify the main characteristics of the specified legal category, as well as to determine functional links with related legal concepts. The methodological basis of the article was made by modern achievements in the theory of knowledge. In the process of research, theoretical, general philosophical (dialectical, analysis, synthesis, deduction, systemic method), as well as traditional legal methods (formal-logical, normative-dogmatic and others) were used. In the course of the research, based on the analysis of the relationship of physical objects, phenomena and their groups among themselves, it was concluded that the term factual communities is a logical continuation of the development of the theory of legal facts, reflects the interconnected association of individual legal facts, as well as their actual composition. Such associations can have a different scope, as a result of which their functionality may also differ. The primary factual commonality is the actual composition. Factual systems are larger in volume and more complex in structure.

This article analyzes the effects of antipartisanship in explaining the Bolsonaro vote in the 2018 presidential elections. The expansion of the anti-Workers’ Party sentiment known in Portuguese as ‘antipetismo’ into an antipartisanship that accommodates a wider range of targets and a growing association between antipartisanship and political intolerance provide the context for and underscore the relevance of our tests. Our expectation is that the vote for Bolsonaro was strong related to both antipetismo and negative attitudes towards mainstream political parties, especially when such attitudes were intense. The empirical basis of the present work was data from the Barometer of the Americas (LAPOP), particularly from the 2018/2019 wave. Empirical tests indicate that antipartisanship in its varied forms is a relevant phenomenon and had a major role in defining the electoral choices of 2018, particularly in the vote for Bolsonaro.

In the context of the formation of civil society in modern Russia with the traditionally significant role of the state, the problem of studying the inclusion of young people in a particular model of the relationship between these two institutions is of particular relevance. This choice will determine a certain type of political system in Russia in the future. The purpose of the study is to identify empirically groups of young people who are determined by the direction of value orientations in public life and their involvement in various models of interaction between the state and civil society. The empirical basis of the study was a project conducted in 2019 by Saint Petersburg State University and Altai State University to study the political consciousness of Russian youth. As a result of using multidimensional methods of analysis, the connection between the involvement of the citizen-state models and the types of value orientations of Russian youth is revealed. Four groups of young people were obtained, stratified by value orientations, the specifics of relations between the state and citizens of our country, and the choice of the preferred type of state to live in.

O humor na formação do professor de química ainda é um assunto pouco explorado na literatura nacional. Embora alguns trabalhos apontem sua relevância, o tema ainda carece de estudos que mostrem as potencialidades e as lacunas de se trabalhar com o riso e o risível na formação do docente em química. De modo a contribuir com o tema, esse texto, de cunho teórico, busca definir o humor e o riso a partir de elementos histórico-culturais e, logo depois, fazer apontamentos sobre como o humor pode perpassar a formação do docente, contribuindo para que ele realize sua atividade pedagógica com consciência e destreza. O texto ainda apresenta elementos para que o professor possa pensar o uso do humor de forma prática na sala de aula, alertando para possíveis armadilhas que possam aparecer no percurso de tornar a aula mais engraçada. O artigo advoga pelo humor combativo, de modo que ele perpasse a formação do professor de química, pois só esse tipo de humor pode causar indignação e gerar a necessidade de um posicionamento diante da barbárie instaurada e vivenciada nestes tempos.

Postsecondary institutions’ responses to COVID-19 are a topic of immediate relevance. Emergent research suggests that partisanship was more strongly linked to institutions offering in-person instruction for Fall 2020 than was COVID-19. Using data from the College Crisis Initiative and a multiple group structural equation modeling approach, we tested the relationships between our outcome of interest (in-person instruction in Fall 2020) and state and county sociopolitical features, state and county COVID-19 rates, and state revenue losses. Our full-sample model suggested that County Political Preferences had the strongest association with in-person instruction, followed by Pandemic Severity and State Sociopolitical Features. Because institutional sectors may be uniquely sensitive to these factors, we tested our models separately on 4-year public, 4-year private, and 2-year public and 2-year private institutions. State Sociopolitical Features were significantly related to in-person instruction for 4-year private and 2-year public institutions but were strongest for 4-year public institutions. For 4-year private and 2-year public institutions, County Political Preferences’ effect sizes were 2–3 times stronger than effects from State Sociopolitical Features. Pandemic Severity was significantly, negatively related to in-person instruction for 4-year private and 2-year public institutions–similar in magnitude to State Sociopolitical Features. Our analysis revealed that COVID-19 played a stronger role in determining in-person instruction in Fall 2020 than initial research using less sophisticated methods suggested—and while State Sociopolitical Features may have played a role in the decision, 4-year private and 2-year public institutions were more sensitive to county-level preferences.
