3. Têtes to tails : eighteenth-century underwear and accessories in Britain and colonial America

Over the past thirty years, the study of dress has flourished as a field of interdisciplinary enquiry, emerging from consumer studies by economic historians and artefact-based research. More recent scholarship has addressed clothing in terms of material culture and as a marker of identity, adopting approaches from anthropology, cultural studies, history of art, material culture studies and history. However, despite these advances in understandings of eighteenth-century dress, the social and cultural consequence of many garments has yet to be fully teased out. This thesis aims to amend that oversight and shed light on the significance of underwear and accessories in Britain and, to a lesser extent, colonial America from the period of 1666 to 1819. Five garments, each stemming from a different region of the body, form the chapters of this thesis: banyans, cork rumps, calashes, muffs, and stays. As structural undergarments, accessories and undress, these objects were auxiliary to the main garments of eighteenth-century dress, a man’s three-piece suit and woman’s mantua or polonaise gown. However, they were fashionable necessities, required to give the essential shape to the silhouette, complete an ensemble, or sartorially facilitate the expression of politeness and sociability. This discussion looks beyond these items as articles of fashion to establish their cultural currency through the study, where possible, of surviving material artefacts and their visual and discursive representations in painted portraiture, graphic satire, archival manuscripts, and published newspapers and magazines. Marrying aspects of artefact-based approaches with visual analysis exposes the discourses between the material artefacts and their representational constructions. First, the thesis discusses the banyan’s relation to time, exposing it as an agent of time that thwarted the chrononormative paths of the male sex. Issues of evidence, or the lack thereof, are addressed in Chapter Two, through an examination of the cork rump in satirical prints. The third chapter charts the material, spatial and social mobility of the calash and its wearer. Addressing embroidered and satin print silk muffs, the fourth chapter positions the silk muff as a haptic receptacle of expression, as well as portable canvas of female art and patronage. The final chapter examines the divergent associations of the stay, both as a mediator of gender normativity, and as an iconographic vessel of gender, class and national anxiety. Through the close analysis of these previously overlooked articles of dress, this thesis reveals the charged and weighted associations embedded within and ascribed to underwear and accessories in the long eighteenth century.

6. Party autonomy, venue risk and jurisdiction agreements – the Singapore position reappraised.

Party autonomy is the defining principle of private international law today. Notwithstanding its broad acceptance, what does party autonomy mean in the context of jurisdiction agreements? The lack of commercial certainty in how the agreement to "submit" to the jurisdiction of the courts in the chosen forum will be interpreted and enforced by the courts defeats the very purpose of party autonomy itself, which is the management of venue risk by commercial parties in entering into cross-border transactions. In light of recent developments, the Singapore court has blurred the distinction between exclusive and non-exclusive jurisdiction agreements by holding that the same requirement of "strong cause" applies if a party reneges on its agreement to "submit". This is premised on the same strict contractual analysis and enforcement of both types of agreements. It is against this background that the approach of the Singapore courts in determining the exercise of their own jurisdiction under the common law will be reappraised, along with a comparison with the practice of the English courts. The issue of immigration status has become the focal point in some cases arising under the 1980 Hague Convention on Child Abduction. Asylum claims affect both substantive and procedural issues that are presented to state and federal courts. A nexus has developed between undocumented immigrants who are parties to a Hague case, and issues of habitual residence, acclimatization, and grave risk. Asylum claims have forced courts to consider the viability of such claims, requests for stay of Hague cases pending the outcome of asylum claims, the likelihood of deportation, and the effect of grants of asylum on the particular issues in the case. Where asylum has been granted to either a parent or child, substantial consideration has been given to the asylum determination by the court hearing the Hague case. This research investigates how the intercultural approach was implemented in the educational strategy ‘I learn at home’ during the pandemic caused by COVID-19. In high school students of the San Antonio educational institution in the district of Tanta in the province of Yauyos. Therefore, the article analyzes the perspectives of students, parents, teachers and the school administration regarding their daily activities, adaptation of classes to the local context, priority of customs during the educational strategy ‘I learn at home’, students’ school dropout, and the application of the intercultural approach., La presente investigación indaga cómo se implementó el enfoque intercultural en la estrategia educativa ‘Aprendo en casa’ durante la pandemia ocasionada por la COVID-19. En los estudiantes de secundaria de la institución educativa San Antonio del distrito de Tanta en la provincia de Yauyos. 9. Interim remedies and constitutional rights.

Interim remedies are granted before the court has been able to come to a final determination of the issues raised by the case. Canadian courts are reluctant to grant interim remedies that would restrain the application of a constitutionally challenged law. Ordinarily, the public interest in the orderly administration of duly enacted laws has been found to prevail over the claimant's right to interim protection of a claimed constitutional right. This article examines the reasons used to justify this cautious approach and argues that it is not entirely consistent with the Charter's promise of effective remedies. The rule limiting consideration of the merits of the claim on interim applications should be relaxed, especially where refusing an interim remedy will cause the immediate and irretrievable loss of a constitutional right. This would bring Canadian law into line with English, American and international law and would better protect fundamental rights and freedoms. Greater use should be made of interim remedies that exempt litigants from constitutionally challenged laws rather than suspend the operation of the law entirely. [ABSTRACT FROM AUTHOR]

10. Interpreting non-exclusive jurisdiction agreements.

This article will argue that exclusive and non-exclusive jurisdiction clauses are in some respects more similar but conversely in other respects less similar than is currently accounted for. Both involve a party submitting to the jurisdiction of a named court or courts which means that the result in cases involving stays or service out should usually be the same. Conversely, a key difference, which is not always given proper weight, is the preclusive effect of exclusive jurisdiction agreements on foreign proceedings. This should usually lead to a different result where a party is seeking an anti-suit injunction to restrain proceedings in a non-chosen court. It is crucial to start by identifying and construing the contractual promises contained in a jurisdiction agreement, both express and implied and both positive and negative. The present work follows on the master’s research of the author and aims to investigate, through the studies of Elizabeth Badinter (1985), the relations between breastfeeding and the moralistic criticism directed to the use of stays and corsets, which mainly took place in France, England and Germany urban regions from 18th and 19th centuries. The qualitative research with bibliographic and museum sources demonstrates that the State's concerns with the maintenance and increase of human capital impacted the way such garments were perceived. The changes occurred in the shape and structure of stays and corsets are, therefore, witnesses of the process responsible for incorporating the practices of motherhood within the notion of femininity. El trabajo se trata de un desdoblamiento de investigación de maestría y se propone a sondear a través de los estudios de Elizabeth Badinter (1985) las relaciones entre el amamantamiento materno y las críticas moralistas direccionadas al uso de stays y corsets, que se dan principalmente en Francia, Inglaterra y Alemania urbanas del siglo XVIII y XIX. La investigación cualitativa con fuentes bibliográficas y museologicas, demuestra que las preocupaciones del Estado con el mantenimiento y aumento del capital humano impactaron la manera como esas vestimentas fueron percibidas. Los cambios que se dieron en el modelado y estructura de stays y corsets, son por lo tanto, testigos del proceso responsable por inscribir las prácticas de la maternidad en el interior de la noción femineidad. O presente trabalho se trata de um desdobramento da pesquisa de mestrado da autora e se propõe a investigar, através dos estudos de Elizabeth Badinter (1985), as relações entre a amamentação materna e as críticas moralistas direcionadas ao uso de stays e corsets, que se dão principalmente na França, Inglaterra e Alemanha urbanas do século XVIII e XIX. A pesquisa qualitativa com fontes bibliográficas e museológicas, demonstra que as preocupações do Estado com a manutenção e incremento do capital humano impactaram a forma como tais vestimentas foram percebidas. As alterações que se deram na modelagem e estrutura de stays e corsets são, portanto, testemunhas do processo responsável por inscrever as práticas da maternidade no interior da noção de feminilidade.

12. “Tierras de compartes”: Historias familiares, derechos y disputas por las tierras en el agro tucumano

The article analyzes certain forms of peasant land tenure that persist in the rural area of Tucumán. They were recognized, during the colonial period and until the provisions imposed by nineteenth-century legislation, as “share lands” or “undivided estancias”. This characteristic form of access to land “in ownership” was configured from the end of the 17th century due to the growing demand and commodification of ranches. The household combined the possibility of subsistence with agricultural production and few animals for regional markets. There is a lack of literature on this topic. The provincial jurisdiction implies recognizing the rights of possession and domain protecting the rural inhabitants. Moreover, it includes cultural guidelines on the land’s use. This situation was not exclusive to the territory of Tucumán but a common practice in almost all of northwestern Argentina. The analysis of this type of ancestral but current territorial formations in several provinces of nowadays NOA contributes to understanding deeper the situation, customs, and strategies of the peasantry in the past and present., El objetivo del trabajo es analizar ciertas formas de tenencia de las tierras campesinas que persisten en el ámbito rural de Tucumán y que fueron reconocidas, durante el período colonial y hasta las disposiciones impuestas por la legislación decimonónica, como “tierras de compartes” o “estancias indivisas”. Esta característica forma de acceso a la tierra “en propiedad” se fue configurando desde fines del siglo XVII por la creciente demanda y mercantilización de las estancias, en un contexto de unidades familiares que combinaban la posibilidad de la subsistencia con la producción agraria y algunos animales destinados a los mercados regionales. Se trata de un tema poco explorado en la jurisdicción provincial que implica no sólo reconocer los derechos de posesión y dominio que les amparaba a los pobladores rurales, sino también las pautas culturales sobre el uso de la tierra. Dicha situación no fue exclusiva del territorio tucumano sino común en casi todo el noroeste argentino. 13. Higher-order moments of eigenvalue and eigenvector distributions for the nonlinear stochastic dynamics of cable networks.

Cross-ties are employed on cable-stayed bridges to reduce wind-induced stay vibration. The occurrence of a number of failures has motivated investigations on the nonlinear dynamics of these systems. The non-linear behavior is possible at incipient failure of the cross-tie. This paper combines the features of the Equivalent Linearization Method, recently derived to study non-linear behavior in the cross-ties at moderate stay vibration amplitudes, with implementation of the Stochastic Approximation (SA) to account for the presence of parameter variability during aeroelastic vibration. The problem becomes an equivalent random eigenvalue problem with eigenvalues (equivalent frequencies) depending on a random vibration amplitude parameter. Novel implementations of the SA are considered to evaluate higher-order statistical moments of eigenvalue distributions; the consequent randomness in the eigenvectors is also examined. 14. Analysis and Design of Cable-Stayed Steel Columns Using the Stiffness Probe Method.

- Abstract
The stiffness probe method (SPM) is a new numerical procedure that calculates buckling loads. SPM probes the local stiffness of a given structure at the point of application of a small transverse perturbation force as the applied load is increased. The local stiffness degrades from a maximum for an unloaded structure to zero at the buckling load. An artifice spring is added to the original structure that eventually absorbs the full perturbation force at a prescribed small deflection, thereby keeping structural deformations small as the buckling load is approached. As a result, using an indicator that approaches zero at buckling rather than having to rely on increasingly larger deflections at buckling as in conventional P-A methods, SPM ensures an accurate numerical result for the critical load. We use SPM herein to study the behavior of one and two cross-arm cable-stayed columns under applied load. A formula is given to calculate the minimum slenderness that justifies converting a tube into a cable-stayed column. Various factors such as cable prestrain, cable cross-sectional areas, and tiers of cross-arms affecting column strength are examined for a series of cable-stayed columns. We find that cable-stayed columns may buckle either in a one-lobe symmetrical mode or two-lobe anti-symmetrical mode, the latter case being contrary to conventional thinking. A design example for a given cable-stayed column using the AISC Specification is presented. The effect of optimum cable prestrain to enhance column buckling strengths is discussed. A strength enhancement ratio (SER) is defined that evaluates the additional column strength gained after transforming a given steel tube into a cable-stayed column. [ABSTRACT FROM AUTHOR]

Las relaciones entre abuelos y nietos constituyen un derecho para ambos, que nace con un límite intrínseco, lo que supone que el derecho se puede ejercitar si es en “interés del menor”. Tras la reforma de 2003 del CC en esta materia, pretendemos analizar el estado de la cuestión en la jurisprudencia del TS desde 2016 a 2020. A nuestro juicio estamos ante un derecho personalísimo que está íntimamente conectado con los artículo 9.2, 10, 16 y 39 de la Constitución español de 1978 Relationships between grandparents and grandchildren constitute a right for both, which arises with an intrinsic limit, which means that the right can be exercised if it is in the “interest of the minor”. After the 2003 reform of the CC in this matter, we intend to analyze the state of the art in the jurisprudence of the Supreme Court from 2016 to 2020. In our opinion we are dealing with a very personal right that is closely connected with article 9.2, 10, 16 and 39 of the Spanish Constitution of 1978.

16. Estimating the standard deviation of eigenvalue distributions for the nonlinear free-vibration stochastic dynamics of cable networks.

Cross-ties are used on cable-stayed bridges for mitigating wind-induced stay vibration. The system obtained by connecting two adjacent stays with a transverse cross-tie is the basic component of an 'in-plane cable network'. Failures in the restrainers of cable networks have motivated investigations focusing on the nonlinear dynamics of cable networks. In these problems, the nonlinearity in the restoring force transferred by the cross-tie is used to simulate the behavior at incipient failure. The 'equivalent linearization method' can be used to reduce the system of nonlinear dynamic equations to an equivalent eigenvalue/eigenvector problem, which is solved algebraically as a function of a reference amplitude parameter. Since the value of the initial vibration amplitude during aeroelastic vibration is affected by uncertainties, simulations based on stochastic processes must be considered. The resulting random nonlinear eigenvalue problem can be solved with an implementation of the standard stochastic approximation (SA). We propose here a novel numerical procedure, based on a 'layered' SA algorithm, to estimate not only the mean but the standard deviation of the eigenvalue distribution as well. This method is computationally efficient and can accurately evaluate the average and standard deviation of the random eigenvalue (frequency), mode by mode. Bi-concave cable truss systems are not only aesthetically appealing but they also offer elegant solutions for spanning large spans required in modern buildings such as convention centres, sport arenas and bridges. These structures, however, are notoriously difficult to model correctly using non-numerical based methods. The existing analytical methods are limited to uniformly distributed loads on half or the entire span, and do not include the stays in the calculations. This paper details a novel analytical method that not only covers wide spectra of loads, including both uniformly distributed and concentrated loads on any part of the span, but also includes the stays in the calculations. The mathematical formulation was based on the fundamental assumption that the hangers form a continuous and inextensible diaphragm. The main two nonlinear equations describing the cable thrusts, unknowns of the problem, were calculated using an orthogonal displacement equation based on the boundary conditions of the cable ends at the anchorages. The predicted results are compared to finite element analysis, and good agreement was found across all the load configurations. The presented method was found to be very efficient and reliable. 20. Partial Elastic Scheme Method in Cantilever Construction of Concrete Arch Bridges.

In this paper, a study about stay stressing procedures of concrete arch bridges built by cantilevering with temporary stays is presented. Particularly, the partial elastic scheme method is proposed to find the initial cable forces, and a forward procedure is implemented to follow the actual sequence of construction by extending a procedure already applied to concrete cable-stayed bridges. The theoretical treatment is followed by a numerical application on a case study of a concrete arch bridge, and a comparison between initial cable forces found by the partial elastic scheme method and classical backward analysis is presented here. A cable-stayed bridge is built by following a construction sequence of different subsequent stages that imply changes of the geometric configuration, restraints and consequently stress and strain patterns. A study is presented about stay stressing sequences in cable-stayed bridges with composite deck for the case of construction made by the cantilever method. Initial cable forces are found through partial elastic schemes of construction stages. Different stay stressing procedures are implemented and a comparison between them is proposed in order to evaluate the differences in terms of deformed shape and internal force distribution of the deck and the pylon. Finally, it allows understanding of the means of transportation used by visitors according to their geographical origin as well as a set of added independent variables: accommodation establishment, length of stay, season, and other demographic variables (educational level, gender, and age). Also, more importantly, we have obtained segments with no overlap configured according to all the aforementioned variables. Teror Viaduct is a bridge located over a difficult-to-reach gorge and was designed keeping in mind the aesthetic requirements so as to achieve the structure's full integration with the existing landscape. The deck is rigidly fixed to piers and is supported by extra-dosed bracing. The V-shaped piers laterally 'embrace' the deck, that is the piers integrate with the deck, forming a monolithic whole as the pylons extend above. The stays supporting the deck penetrate the pylon without friction during construction and are locked in service to withstand the effect produced by differential forces on both sides of the saddles due to the traffic load. The deck was built using the balanced cantilever system starting from the two piers. Following the deck's construction and prior to the two halves of the deck meeting in the centre and forming a single component, it was left open in the centre of the main span in order to partially reduce the long-term effects due to the concrete's strain (shrinkage and creep). In this paper, a study about stay stressing procedures of concrete arch bridges built by cantilevering with temporary stays is presented. Particularly, the partial elastic scheme method is proposed to find the initial cable forces, and a forward procedure is implemented to follow the actual sequence of construction by extending a procedure already applied to concrete cable–stayed bridges. The theoretical treatment is followed by a numerical application on a case study of a concrete arch bridge, and a comparison between initial cable forces found by the partial elastic scheme method and classical backward analysis is presented here. Results show the effectiveness of the proposed procedure to achieve the requested design geometry of the arch and for limiting the variation of bending moments and stay forces in construction stages.

Presentamos aquí las series completas de ingresos de enfermos y enfermos militares del Hospital Real de Santiago desde su inicio -1630 y 1740, respectivamente- hasta 1840. A través del análisis de los datos anuales, con el complemento de la duración media de las estancias por enfermo, llegamos a saber que la actividad del Hospital se incrementó considerablemente en el curso de la primera mitad del siglo XVIII, si bien una parte de la misma pasó entonces a orientarse a la atención del personal militar presente en la ciudad. Con la Guerra de la Independencia, esta orientación se vería enormemente potenciada, para luego remitir en una medida bastante apreciable, pero manteniendo en el resto de los años estudiados un nivel francamente elevado.

- Abstract
A seal structure for an air cushion vessel includes an inflatable bag secured to the hull and a transversely stiffened lobe portion maintained therebeneath. The stiffened lobe portion consists of a membrane with an array of spaced, transverse stiffener members connected thereto. The colinear stiffener members are interconnected in end-to-end relationship. Generally, the end portions of the stiffener members are connected to support stays which are connected either to the bag structure or to the forward portion of the hull. The support stays may comprise cable elements or membranes which form continuations of the stiffened lobe membrane. Additional support for the stiffened lobe portion is provided in the form of a plurality of rear support elements which set the orientation and configuration of the stiffened lobe portion and limit the downward deflection of the stiffened lobe portion. The rear support elements may comprise cables or membranes, which are supported from elongated bars, catenary cable supports, or cable elements., Supersedes PAT-APPL-114 455-80.

40. Fatigue Damage Factor Calibration for Long-Span Cable-Stayed Bridge Decks

Part 2 of the Eurocode 3 (EN 1993-2) proposes a straight forward fatigue verification method using a single heavy vehicle model (FLM3) and a damage equivalent factor, lambda, to represent the fatigue damaging effects of the real traffic on road bridges. The method is very appealing for bridge design. However, the lambda-factor has limitations and is not defined in the EN1993-2 for some load cases or "span lengths" above 80 m, renamed here as "critical lengths". This is the case of cable-stayed bridge decks, where a combination of two internal forces-bending and compression (induced by the stays)-is a characteristic of this bridge system, and stay-cables, with specific shapes of influence lines. To address the above issues a variant solution of the Vasco da Gama Bridge is taken as the case study. In this paper, the results of the lambda-factor computed for different critical lengths are compared with previous studies and the original work that led to the current EN formulas for lambda. Based on these results, a constant lambda value for critical lengths above 80 m is proposed to update the EN for the "mid-span case". For the fatigue design of stays and steel girders, recommendations are given for determining the critical length based on the influence line of the bending moments.
