Westmont Mirador LLC (Westmont), Matthew and Whitney Shurtliff (the Shurtliffs), and Sydnie Shurtliff (Sydnie) raise several arguments on appeal arising from the trial court’s decision on a disputed residential rental agreement. We affirm.

Defendant Ronnie R. Wells was charged with eight counts of aggravated sexual abuse of a child and four counts of lewdness involving a child, all arising from alleged incidents that occurred during the summer of 2011. The eight-year-old victim (Child), her older brother, and their little sister stayed with Wells and his wife (Grandmother) for a month that summer. During that stay, Child asked to talk with Grandmother in private. Child told Grandmother that she had been playing a game with Wells that involved him holding her upside down in the air and that while they were playing, she thought she saw Wells’s penis and it made her uncomfortable. Both Grandmother and Child briefly spoke to Wells about the incident, and Wells apologized if anything had happened that had made Child uncomfortable.

Respondent William Hayes Wyttenbach contests the district court’s order denying his request to register a Texas judgment under the Utah Uniform Child Custody Jurisdiction and Enforcement Act (the UCCJEA), see Utah Code Ann. §§ 78B-13-101 to -318 (LexisNexis 2012). 2 We affirm the order of the district court and remand to the district court for the calculation of reasonable attorney fees incurred on appeal.

Defendant Scott Rice claims the trial court erred in concluding that he is personally liable on a contract he signed in his capacity as an officer of Memory Technologies, Inc. (MTI). The facts here are not in dispute, and we review the trial court's decision under a correction of error standard. See Zions First Nat'l Bank v. National Am. Title Ins. Co., 749 P.2d 651, 653 (Utah 1988) ("Questions of contract interpretation not requiring resort to extrinsic evidence are matters of law, and on such questions we accord the trial court's interpretation no presumption of correctness.").

We have determined that "[t]he facts and legal arguments are adequately presented in the briefs and record[,] and the decisional process would not be significantly aided by oral argument." Utah R. App. P. 29(a)(3). Moreover, the issues presented are readily resolved under applicable law.

The essential issue before us is whether the trial court's ruling on the parties' cross-motions for summary judgment and this court's subsequent review of that ruling in Dunlap v. Stichting Mayflower Mountain, 2003 UT App 283, 76 P.3d 711 (Dunlap I), cert. denied, 84 P.3d 239 (Utah 2004), effectively resolved all claims and issues arising out of this quiet title action, mandating on remand that the trial court simply quiet title to the Marsac Lode in Appellees (collectively, "Mayflower"). The trial court so ruled, determining that the issues Appellants, the Dunlaps, raised on remand are either barred by this court's ruling in Dunlap I or by res judicata, precluding the trial court from making findings of fact based on other evidence or from conducting further proceedings on those issues. We disagree.

Plaintiffs cross-appeal from the trial court's order declaring that Defendant and his wife, Lori L. Miller (Wife), are entitled to a primary personal residence homestead exemption (PPR exemption) in their property located at 358 North 100 East, Tooele, Utah (the property). Plaintiffs argue that the trial court erred in determining that the property qualified for the PPR exemption, see Utah Code Ann. § 78-23-3 (2002), at the time Plaintiffs established a lien on the property and that their prejudgment writ of attachment on the property was subject to Defendant's subsequent homestead declaration. We reverse.

Beiwei Li, as personal representative of the estate of Beizhong Li, appeals the trial court's grant of summary judgment to Enterprise Rent-A-Car Company of Utah. We conclude that Utah Code section 31A-22-314 does not relieve Enterprise of its duty to provide insurance coverage on its vehicles, even though there is other available insurance in excess of the statutory minimum coverage. See Utah Code Ann. § 31A-22-314 (2003). Accordingly, we reverse the trial court's summary judgment order and remand this matter for further proceedings.

Defendant M.E.P., a minor, seventeen years of age, appeals the juvenile court's order binding him over to the district court to stand trial as an adult under the Serious Youth Offender Act (the SYOA), see Utah Code Ann. § 78-3a-602 (2002), on a charge of aggravated assault, see id. § 76-5-103(1)(a) (2003). Defendant argues that the juvenile court should have retained jurisdiction over the case because he satisfied, by clear and convincing evidence, all three of the statutory retention factors. See id. § 78-3a-602(3)(b). This appeal turns on whether Defendant established the third factor--"that [his] role in the offense was not committed in a violent, aggressive, or premeditated manner." Id. § 78-3a-602(3)(b)(iii). We affirm.

Plaintiff 1-800 Contacts, Inc. appeals the trial court's ruling that the electronic mail (email) communications between Plaintiff and Defendants Randolph Weigner, Randolph Weigner DTVTV@yahoo.com, and Lensfast, LLC (collectively, Defendant) did not constitute a binding contract regarding the sale of Defendant's assets, and that there were no genuine issues of material fact. Plaintiff also argues that the trial court erred in concluding that, even if there was a contract for the sale of the subject assets, Defendant could rescind the contract at its sole discretion prior to the execution of the contract. We affirm.

Joseph O. Kingston and D.U. Company, Inc. appeal the trial court's grant of summary judgment in favor of Continental Insurance Company premised on a theory of misrepresentation in an insurance application. We conclude the insurance company waived any right it had to rescind the policy and reverse the summary judgment.

Mark and Nanalee Cook appeal the trial court's dismissal of their negligence claim against the City of Moroni (the City) pursuant to the Utah Governmental Immunity Act (the Act). See Utah Code Ann. §§ 63-30-1 to -38 (1997).

Defendant Alex Montiel appeals his conviction for aggravated robbery, a first degree felony, in violation of Utah Code Annotated section 76-6-302 (Supp. 2001), with an enhanced penalty pursuant to Utah Code Annotated section 76-3-203.1 (Supp. 2001). Defendant argues that the trial court abused its discretion when it rejected a plea agreement entered into by Defendant and the State because the court (1) failed to consider all legally relevant factors, (2) exceeded the scope of its authority, and (3) rejected the plea agreement arbitrarily. We affirm.

Defendant Frank Reyos argues that his statements "get the gun and shoot" and "shoot to kill" do not elevate his crime to aggravated robbery. We disagree.

Defendant, Dr. Nathaniel Penn, appeals his conviction of three enhanced second degree felony counts of Unlawful Possession of a Controlled Substance in a Drug-Free Zone, in violation of Utah Code Annotated sections 58-37-8(2)(a)(i) (Supp. 2003) and 58-37-8(4)(a) (Supp. 2003).(1) Penn argues that this court should reverse and remand for a new trial because (1) evidence obtained as a result of an invalid anticipatory warrant should have been excluded; (2) one of the jury instructions was plainly erroneous and denied Penn his right to a fair trial; (3) the State failed to disclose material information; (4) the trial court admitted prejudicial and irrelevant evidence of Penn's prior bad acts; and (5) the trial court failed to exclude statements obtained in violation of Penn's Miranda rights. We affirm in part and reverse in part.

Third-party plaintiffs, Shar's Cars, L.L.C., (Shar's Cars) and Jeffrey Birschbach (collectively Plaintiffs), appeal a judgment entered in their favor against third-party defendant Deloy Elder in the amount of $22,500. Plaintiffs argue that the trial court erred by (1) concluding that Elder is not liable for debts incurred by the partnership he originally established with Bruce Rutherford (the Elder/Rutherford partnership) after August 31, 1998, (2) concluding that Elder is liable for only one-half of the partnership's obligations prior to August 1998, and (3) awarding damages based upon the partnership's net loss, rather than the partnership's unpaid expenses as of August 31, 1998.

Fox Construction, Inc. (Fox) appeals from a trial court order granting summary judgment to Gary Porter Construction (Porter). We affirm. Porter appeals from a trial court order granting summary judgment and awarding attorney fees to National Surety Corporation (National). We reverse in part and remand. The appeals have been consolidated.

Appellant Barry Sanns (Sanns) appeals the trial court's grant of Appellee Butterfield Ford's (Butterfield Ford) Renewed Motion for Summary Judgment. Sanns argues that there exists a genuine issue of material fact as to whether Butterfield Ford was negligent in selling a fifteen-passenger van to the State of Utah without adequately warning of the van's propensity to roll over when loaded. Sanns further argues that even if Butterfield Ford was not negligent in selling the van, the Utah Liability Reform Act (ULRA) nevertheless allows Butterfield Ford to be apportioned fault under the doctrine of strict liability. We affirm.

Collins C. Nelson (Husband) appeals from the denial of his petition to modify the divorce decree to terminate his alimony obligation. Sharon B. Nelson (Wife) moves for summary affirmance, and Husband moves for summary reversal.

After a three-day trial, the juvenile court substantiated that Father, by a preponderance of the evidence, had sexually and emotionally abused his son, L.N. The court also found, by clear and convincing evidence, that L.N. and his sister, S.N., remained neglected and emotionally abused children. We affirm.

Carl William Fink brings this interlocutory appeal, challenging the trial court's denial of his summary judgment motion on Joseph Machock's claim for payment on a loan guaranty. We affirm.

Plaintiffs sought a declaratory judgment regarding the Interstate Compact on Placement of Children and its application to expectant mothers who travel to Utah to deliver their children and place them for adoption. The trial court, concluding Plaintiffs failed to request relief for an alleged violation of their own rights, granted Defendants' motions to dismiss for lack of standing. We affirm in part, but reverse and remand in part.

Clark Case (Father) appeals from the trial court's summary judgment in favor of Rebecca Case (Mother), ordering Father to pay $530 per month child support. Father argues that (1) the trial court lacked subject matter jurisdiction to modify the provision of the California Judgment of Dissolution addressing child support; (2) absent subject matter jurisdiction, the trial court erred in granting summary judgment in favor of Mother; and (3) the trial court erred in modifying the child support order without requiring a showing of a substantial change in circumstances. We reverse.

Jamie Evans appeals from the trial court's grant of the Board of County Commissioners' (the Board) motion for summary judgment. We reverse and remand.

The Utah Labor Commission (the Commission) appeals the trial court's grant of Florida Asset Financing Corporation's (Florida Asset) motion for partial summary judgment, and the trial court's order that the Commission pay $57,095.96 in damages to Florida Asset. Specifically, the Commission contends that the trial court erred in interpreting Utah Code Annotated section 34A-2-422 (2001). We reverse.

The State of Utah appeals a magistrate's dismissal of an information against Cory Virgin (Defendant) on one count of aggravated sexual abuse of a child, a first degree felony, in violation of Utah Code Annotated section 76-5-404.1 (1999). We reverse.

Jamil Corbitt appeals from an order of restitution stemming from his conviction for possession of a stolen vehicle, a second degree felony, in violation of Utah Code Annotated section 41-1a-1316(2) (1998).

The trial court's order denying Darryl Thurgood's motion to vacate a contempt order is the subject of this interlocutory appeal. Darlene Uzelac, Thurgood's former mother-in-law, filed a motion for order to show cause regarding Thurgood's failure to comply with an order granting her visitation with his daughter, S.T.T. The trial court found that Thurgood violated the visitation order and sentenced him to sixty days in jail for contempt, with the condition that he could purge the contempt by delivering S.T.T. to Uzelac for visitation every other weekend.

This appeal involves an action to quiet title to an eighty-three acre parcel of land that lies along the border between Utah County and Salt Lake County. It turns on the sudden appearance in a chain of title of the term "trustee."

Sean Sloan appeals from a conviction of sodomy on a child, in violation of Utah Code Ann. § 76-5-403.1 (1999), and a conviction of aggravated sexual abuse of a child, in violation of Utah Code Ann. § 76-5-404.1(3) (1999).

Michael Norton (Defendant) appeals his conviction for two counts of violating the Bail Bond Recovery Act, Utah Code Ann. § 53-11-107 (2002); one count of Assault, in violation of Utah Code Ann. § 76-5-102 (1999); and two counts of Unlawful Detention, in violation of Utah Code Ann. § 76-5-304 (1999). Defendant contends: (1) the trial court erred in rejecting his mistake of law defense, (2) the Bail Bond Recovery Act was applied as an unconstitutional strict liability offense, and (3) the trial court's refusal to hear requested testimony violated his due process right to a fair trial.

Gustavo Mora (Mora) appeals the trial court's(1) denial of his motion to withdraw his guilty plea to aggravated robbery, a first degree felony, in violation of Utah Code Ann. § 76-6-302 (1999). We reverse and remand.

A father appeals the juvenile court's order terminating his parental rights to his daughters, M.C. and S.C. The father seeks reversal of the termination order, arguing, inter alia, that the juvenile court failed to find that DCFS made "reasonable efforts to provide [reunification] services" pursuant to Utah Code Ann. 78-3a-407(3)(a) (2002). We hold that the father's arguments are without merit and affirm.
