4. Assessing America’s Access to Civil Justice Crisis

Abstract

Many strongly believe the United States faces a crisis in access to civil justice but differ starkly in what they believe that means. Some observers believe the key issue is unrepresented litigants in trials and hearings, while others point to the tens of millions of people facing justice problems outside of the courts with no assistance. We offer definitions of three concepts central to assessing the crisis—justiciable events, legal needs, and cases—and examine the availability of consistently collected, nationally representative data measuring these three phenomena. Such data are sparse. Some information about justice experiences is collected for those justiciable events—a bare minority—that become court cases, but these data are not collected in uniform ways, nor are they always made available to researchers for analysis. The past few years have seen a growth in the number of civil justice surveys of the public, which give insight into the prevalence of specific kinds of justiciable events and their impacts on those who experience them. The concept at the core of the dominant understanding of the access to justice crisis, legal need, is ironically the phenomenon about which we have the least information. We draw on ideas from the field of public health to develop two measures of access to justice that shift analytic focus away from granular experience with problems, court processes, or legal services to summarize Americans’ justice experiences: Civil Justice Problem-Free Life Expectancy and Civil Justice Hardship-Free Life Expectancy. The measures report how many years of life people can expect to spend dealing with civil justice problems and experiencing health, economic, or relationship hardships as a result of those problems. Americans spend large proportions of their lives experiencing civil justice problems and suffering consequent hardships. For example, a typical woman in midlife can expect to be experiencing civil justice problems for over half of her remaining years, while a typical eighteen-year-old can look forward to spending thirteen years of their life experiencing health, economic, or interpersonal hardships as a result of civil justice problems. The new measures permit comparisons across groups, geography and time, and constitute new tools for assessing the impact of policy changes. more...

6. Reports of Self-Harm and Social Stressors among Early Adolescents: A Brief Report

Abstract

This study examined reports of self-harm by early adolescents as well as associations between salient interpersonal stressors and self-harm. While attending health education centers located in Illinois, Indiana, North Carolina, and Pennsylvania, early adolescents (n = 737) responded to a questionnaire measuring stressors, coping, and self-harm. Approximately 19% of early adolescent students reported some type of self-harm. Those reporting parents as a source of stress more frequently reported self-harm, compared to those who did not report parents as a source of stress. The results of this study further evidence the problem of self-harm during adolescence. Due to the prevalence of self-reported self-harm and the long lasting consequences of self-harm, prevention or early intervention is crucial to the well-being of some youth. Self-harm, especially self-harm that includes the use of objects, and self-harm's association with parent-focused stress deserve further research. 8. Overweight in Children: The Perspectives of 9-13 Year Olds

Abstract

Children and adolescents in the United States are increasingly overweight at younger ages. Many studies have investigated the issue from the perspective of professionals and other adults. This study assessed early adolescents' perceptions regarding the magnitude of, effects of, causes of, solutions for, and learning preferences related to overweight. Data were obtained from 1,168 students, grades four to eight, who visited nine health education centers. Data were collected anonymously via electronic keypads. Analyses were based on multivariate and nominal logistic regressions. The majority of students believed childhood overweight is a problem (52%), and thought overweight is primarily caused by (55%) and can be addressed through (68%) nutrition and exercise. Most preferred to learn through doing (joining an active group or cooking demos, 43%) instead of listening (school lessons, 8%). Further, most (60%) perceived that overweight children and adolescents have a more difficult time making friends. Girls were more likely to report that they were worried about their weight (AOR = 2.9, CI = 1.6-3.8; p = 0.00), have been spoken to about their weight (AOR = 2.0, CI = 1.6-2.7; p = 0.00), and have tried to lose weight (AOR = 1.8x, CI = 1.4-2.5; p less than 0.01). Students who perceived themselves to be about the right weight were more likely than those who described themselves as underweight to say they have tried to lose weight (AOR = 2.3, CI = 1.6-3.3; p = 0.00). 11. Evaluation of a Peer-Led, Low-Intensity Physical Activity Program for Older Adults

Abstract

Background: Physical inactivity is a primary contributor to decreasing functional physical fitness and increasing chronic disease in older adults. Purpose: This study assessed the health-related benefits of ExerStart for Lay Leaders, a 20-week, community based, peer-led, low-impact exercise program for older adults. ExerStart focuses on aerobic endurance, muscular strength, flexibility, and balance. Methods: Using a pre/posttest evaluation design, researchers examined the effects of the program on 432 older adults in St. Louis, Missouri, and Houston, Texas. Participants completed self-report surveys as well as observed functional physical fitness assessments. Results: Participants in ExerStart for Lay Leaders significantly improved their perceived satisfaction with body function, functional physical fitness, perceived overall health, and body mass index. Discussion: This study adds to the evidence that older adults benefit from structured, peer-led exercise programs. The increased physical fitness, if maintained, may lead to a decrease in falls, adult obesity, and nursing home placements. Translation to Health Education Practice: The current research has important implications for implementing outcome-based and cost-effective health education programs for older adults, including using peer leaders as a cost reduction technique to implement and disseminate research informed programs into community settings. more...

12. Active Generations: An Intergenerational Approach to Preventing Childhood Obesity

Abstract

Background: Over the last 3 decades, US obesity rates have increased dramatically as more children and more adults become obese. This study explores an innovative program, Active Generations, an intergenerational nutrition education and activity program implemented in out-of-school environments (after school and summer camps). It utilizes older adult volunteers to implement a version of the evidence-based childhood obesity prevention program, Coordinated Approach to Child Health, in 8 US cities. Methods: Approximately 760 children in third- to fifth-grade participated in Active Generations, a 10-lesson, intergenerational, childhood obesity prevention program. Children completed an age-appropriate survey instrument, the Active Generations survey (AGS). The AGS is a valid and reliable, self-administered, self-report, paper-and-pencil survey designed to assess knowledge, attitudes, and behaviors. It was administered by trained volunteers on the first day and last day of the program. Constructs assessed included physical activity, nutrition, and media use. Results: Students significantly increased their reported fruit and vegetable consumption post-program. For example, the percentage of students reporting eating 3 or more servings of vegetables per day was 16% greater post-program. Students were more likely to report reading food labels and greater confidence that they could participate in physical activity. They also significantly decreased their daily screen time. 13. Are Kids Too Busy? Early Adolescents' Perceptions of Discretionary Activities, Overscheduling, and Stress

Abstract

Background: The activity patterns of children, especially after-school patterns, are receiving more professional attention. However, evidence regarding the value of various activities in children's lives is contradictory. The purpose of this study was to assess perceptions of discretionary activities, overscheduling, and levels of stress from adolescents' perspective. Methods: A sample of 882 children, ages 9 to 13, recruited at 9 health education centers in the United States was selected for this study. Children answered questionnaires using remote, handheld devices. Data were analyzed using descriptive statistics and multivariate logistic regression. The outcomes of interest were activity-based stress and desire for more free time. Results: The primary predictor for the desire for more free time was hours of screen time (television, computer, video games): those who reported 3 or more hours were nearly 3 times more likely to desire more free time. Further, children who chose their own activities experienced more activity-related stress than those who shared decisions with parents. The single greatest predictor of activity-related stress was the reported number of hours spent on homework. Students who averaged at least 2 hours on homework per night were nearly twice as likely to report frequent activity-related stress. Conclusion: Parents of school-aged children should assess activity-related stress and the degree to which children perceive they are busy. Teachers, school counselors, and school administrators should be aware of these perceptions as they are making decisions regarding school schedules and should teach personal skills such as time management and stress control. 14. Early Adolescents Perceptions of Health and Health Literacy

Abstract

Background: Health illiteracy is a societal issue that, if addressed successfully, may help to reduce health disparities. It has been associated with increased rates of hospital admission, health care expenditures, and poor health outcomes. Because of this, much of the research in the United States has focused on adults in the health care system. This study investigated the effect of aspects of health literacy on the motivation to practice health-enhancing behaviors among early adolescents. Methods: Measures were generally based on 3 National Health Education Standards for grades 5-8. Data were obtained from 1178 9- to 13-year-old students visiting 11 health education centers in 7 states. Students responded via individual electronic keypads. Results: Multivariate logistic regression revealed that, in addition to age, difficulty understanding health information and belief that kids can do little to affect their future health, decreased the likelihood for interest in and desire to follow what they were taught about health. Further, low interest independently decreased motivation to follow what was taught. Girls were more likely to turn to school, parents, and medical personnel for health information. Older students were more likely to turn to school and to the Internet. Conclusions: Programs and curricula should be designed to increase student interest in health issues and their self-efficacy in controlling their own health destinies. 15. Effects of a Single-Lesson Tobacco Prevention Curriculum on Knowledge, Skill Identification and Smoking Intention

Abstract

One in five students report experimenting with tobacco before the age of 13 and most prevention efforts take place in the school setting. This study measures the effect of a single-lesson tobacco prevention curriculum, conducted by a health education center, focusing on knowledge of tobacco, ability to identify refusal techniques, and intent not to smoke. Data were collected,via electronic keypads, from students visiting a non-school, health education center in Michigan (n = 704 intervention and 85 comparison). Contingency table Chi-squared tests and t-tests demonstrated that a single lesson can improve general knowledge and ability to identify appropriate refusal techniques. Improvement in intent not to smoke was not significant because both groups had very high intent prior to implementation. Similar to results from other programs, multivariate logistic regression of gender, general knowledge, and skill identification revealed that only the skill variable was associated with intent not to smoke at pretest. 16. Gender, Age, and Behavior Differences in Early Adolescent Worry

Abstract

Early adolescents in the United States are increasingly exposed to a culture of worrisome messages. A degree of adolescent worry is normal, but the likelihood of a young person being anxious or depressed increases with the perceived number of worries. This study examined the effect of age, gender, and worry behavior on frequency of 8 adolescent worries. Data were obtained from 1004 9- to 13-year-old students visiting 10 health education centers in 7 states. Students responded via individual, electronic keypads. Multivariate logistic regression revealed that boys worry more about the future, whereas girls worry more about being liked or being overweight. The oldest adolescents worry most about their appearance, being overweight, their friends, and problems at home. Adolescents who prefer talking to parents when worried are less likely to worry about being liked, while those who keep worries to themselves have more worries about grades. Those who turn to parents for information are less likely to worry about being liked, failure, their future, and their friends than those who turn to other sources (teachers, Internet, and friends). Recommendations are given to assist health educators and other school staff to recognize frequent worriers and plan school-based approaches to address their needs. more...

Early adolescents reported less than adequate sleep, and sleep deprivation was associated with later bed times, decisional control over sleep, and sleep routines among early adolescents. Previous studies have indicated that many adolescents (estimates range from 28% to 64%) begin using alcohol under the age of thirteen (Centers for Disease Control and Prevention, 2004; DuRant, Smith, [...], This study investigated associations of self-reported alcohol exposure among early adolescents with normative belief, motivational, and environmental influences. Data were obtained, via anonymous, electronic keypads, from 690 4-8 graders, visiting six health education centers. Multivariate logistic regression showed that reports of being offered alcohol and of drinking alcohol were associated with favorable attitudes toward adolescent drinking and perceptions of frequent peer drinking. The majority of children thought "teen" drinking was "un-cool. " More than half thought the primary explanation for adolescent drinking was that drinkers think it will make them cool.
