Denna handbok är ett bakgrundsdokument till övervakningsprogrammet i Finlands havsförvaltningsplan och omfattar hela beskrivningen av programmet. Den uppdaterar övervakningsprogrammet 2014-2020 och tillämpar från juli 2020 till juli 2026. Övervakningsprogrammet är en del av havsvårdsplaneringen, som ingår i verkställandet av lagen om vattenvårds- och havsvårdsförvaltningen (272/2011) och statsrådets förordning om havsvårdsförvaltningen (980/2011). Med lagen och förordningen genomförs EU:s ramdirektiv om en marin strategi nationellt (Europaparlamentets och rådets direktiv 2008/56/EG om upprättande av en ram för gemenskapens åtgärder på havsmiljöpolitikens område, nedan MSD). I Finland kallas marina strategi för havsförvaltningsplan. Finlands övervakningsprogram består av 13 programhelheter med totalt 44 delprogram. Fyra nya delprogram lades till det uppdaterade övervakningsprogrammet, och flera delprogram reviderades antingen på grund av ändrade krav, mer avancerade metoder eller en förändrad operativmiljö. Nya krav under den andra havsförvaltningsperioden är uppdateringarna i bilaga 3 till ramdirektivet om en marin strategi (EU/2017/845) samt Europeiska kommissionens beslut EU/2017/848 om fastställande av kriterier och metodstandarder för god miljöstatus i marina vatten, specifikationer och standardiserade metoder för övervakning och bedömning. Övervakningshandboken består av tre delar: del I presenterar bakgrunden till övervakningsprogrammet, del II presenterar själva programmet och del III innehåller utvecklingsbehov, kostnader, övervakningens tillräcklighet och slutsatser. I enlighet med ekosystemansatsen omfattar övervakningsprogrammet olika variabler som dels beskriver vattnets egenskaper och kvalitet, dels ekosystemets delar och deras status samt mänsklig belastning på dessa. Handbokens presentationer av delprogrammen beskriver havsmiljöns egenskaper eller belastningar, övervakningsfrekvens, indikatorer för vilka övervakningsdata används, hantering av insamlade data och kopplingar till kvalitativa deskriptorer och kriterier för god miljöstatus enligt MSD.

On the EU level the main instrument to control industrial releases is the Industrial Emissions Directive (IED), particularly through the publication of BAT Reference documents (BREFs) and the corresponding key chapter, the BAT conclusions. The objective of the IED is to achieve a high level of environmental protection as a whole. This target can only be achieved when the BREFs include all chemicals and substances used in or potentially released from industrial processes, both the ones that have already been identified as hazardous and regulated, as well as the less known and non-regulated ones. At the centre of this report is the analysis of the information exchange under the IED, which results in BREFs and corresponding BAT conclusions. This report proposes how relevant information on chemicals used in or released from industrial processes can be more systematically addressed during BREF reviews. Special emphasis is given to possibilities to better use the available data generated in the context of other pertinent EU legislation such as REACH and POPs Regulation and Water Framework Directive (WFD). The HAZBREF project recommends further systemic cooperation and exchange of information between the European IPPC Bureau coordinating the BREF work and chemical experts from REACH, WFD and the POP convention community. To identify the hazardous chemicals relevant for a given industrial sector and to strengthen the measures to control them, BREF reviews require extended frontloading, systematic identification of chemicals and reinforcing the BREF Technical Working Group (TWG) with knowledge on chemicals. The HAZBREF project further recommends including a specific chapter on chemicals in all BREFs and BAT conclusions and proposes the key topics to be addressed. The proposals of this report seem to fall within a favourable political context with the recently published European Green Deal that defines a new policy framework requiring a deep transformation for the EU’s economy for a sustainable future. One of the key commitments of the EGD is the EU’s zero pollution ambition for a non-toxic environment, which is supported by the Chemicals Strategy for Sustainability published in October 2020. The proposals made by the HAZBREF project would further strengthen the future BAT conclusions and support the IED in achieving the abovementioned EU policy objectives.

This guidance report is a product of activity 4.1 under work package 4 “Best practices in chemicals management in the industry” of the HAZBREF-project. This report addresses the chemical industry and its two sub-sectors: manufacture of large volume inorganic chemicals (with the focus on production of fertilizers) and polymers. The other case sectors are textile industry and surface treatment of metals and plastics which are addressed in separate reports. Aims, areas of interest, methodology and structure This sector-specific report provides guidance to key actors at national level (chemical industries and competent authorities) on how to improve chemical management at installation level. In this respect, it takes reference to relevant requirements such as the Industrial Emission Directive (IED) and the sectoral Best Available Techniques Reference Documents (BREFs). The findings of the guidance, especially concerning BAT candidates in chapter 5, will also feed into the anticipated forthcoming revision of the BREFs for the Chemical industry sectors (LVIC and possibly others). They are further used for HELCOM recommendations on how to reduce the discharge of hazardous substances into the Baltic Sea. The document summarises key findings of interviews and discussions with HAZBREF experts, representatives from chemical industry and relevant authorities as well as insights from case studies in Finland, Estonia and Sweden. In addition to that two polymer installations in Poland were selected for analysing circular economy issues. The report focuses on prevalent practices and challenges related to the IED permitting process, with special reference to hazardous chemicals for polymer and fertilizer installations. The report also reflects findings of other Work packages under HAZBREF and refers to recommendations published under the European Union Network for the Implementation and Enforcement of Environmental Law (IMPEL). The first chapter of the report provides a short introduction to the scope of this report. The second chapter provides an introduction to the chemical sector, focusing on Europe and the production of fertilizers and polymers. The third chapter describes relevant hazardous chemicals related to the production of fertilizers and polymers, regulatory framework for the hazardous chemicals and both regulatory and non-regulatory chemical reference lists. The section also describes how identification of relevant substances in the polymer and fertilizer industry can be done. The fourth chapter describes legal obligations laid down in IED, REACH, CLP, WFD and other relevant legislation as well as recommendations from HELCOM. It also contains information about using and producing safety data sheets and exposure scenarios. Furthermore, it describes how chemical inventories can be developed and how substance flow analysis (SFA) and material flow analysis (MFA) can be used. It also contains a short description of how to use an interactive scheme, developed in HAZBREF, for the identification of relevant hazardous substances. Best practice in chemical management and identification of BAT candidates are described in the fifth section. The section also contains guidance on chemical management system (CMS), chemical and raw material inventories, chemical storage and transportation, optimization of process integrated recycling, substitution, process mapping of hazardous substances, management of hazardous waste and waste water treatment. The section contains both generally applicable practices and recommendations on BAT candidates. Most of the BAT candidates are applicable to all installations. All the BAT candidates are described in detail in Annex 1. The sixth section explains the different steps of the IED permitting procedure and provides guidance and good practices and recommendations to both operators and permitting authorities on how to carry out the respective steps with particularly focusing on good chemicals management. Circular economy issues in the polymer sector and findings from the case studies are described in the seventh section. Main findings and proposals Chemical industry covers many types of different processes and installations. There are many laws regarding the installation, and this leads to challenges in chemical management for both operators and authorities. The requirements from authorities are based on law but often the companies have their own programs and rules which are stricter than the requirements based on current law. The authorities need a lot of knowledge on chemical issues, but this information is not always readily available. Proposal for improvement of chemical management system A Chemical Management System (CMS) provides a systematic way of managing chemicals. The CMS can be integrated with the Environmental Management System (EMS). The purpose of the CMS is to control the chemicals and hazardous substances at the site, increase knowledge of the characteristics, risks and impact and improve the processes to reduce emissions of hazardous substances. The HAZBREF project recommends the use of a CMS following the principles described as BAT candidate 1 in Annex 1. HAZBREF also recommends that a requirement to establish and maintain a CMS at installations is included to the revised BREFs. Proposal for development of inventories and databases In order to know which hazardous substances are used or generated at the site, a chemical inventory is needed. It is important to list all types of chemicals and raw materials used in all processes and activities at the site in a database. The chemical list or database is a key part of chemical management allowing for systematic risk assessment, management of chemicals flows and their storage. It is also useful in the permitting processes as it provides easy access to data for chemicals used in the installations. The information in the chemical list/database must be searchable and the list should be updated regularly. Most of the information needed is available in the safety data sheets (SDS). If some information is missing from the SDS, the supplier should be asked to provide this. The HAZBREF project recommends the development and use of a chemical and raw material inventory following the principles described as BAT candidate 2 in Annex 1. HAZBREF also recommends that such a requirement to perform inventories at installations is included to the revised BREFs. Proposal for quality and use of safety data sheets To allow for efficient chemicals management, it must be assured that all SDS keep a good quality level. If a chemical supplier fails to provide SDS with good quality, it is the duty of both the operator and the competent authority to demand the missing information from the chemical supplier. Better SDSs, including improved data on environmental hazards, and exposure scenarios would make risk assessment of individual chemicals in specific process easier for the installations. This would lead to more efficient monitoring and help to focus more on most the problematic substances. The SDSs of raw materials should contain more information on impurities. Also, the chemical inventory could be improved if detailed data about the impurities or intentionally added constituents would be available in SDS. Exposure Scenarios are not usually directly usable for the operators. Sector specific environmental release categories (SPERCs), based on measurements and info about the typical environmental fate of substances in the sites could help but they have not yet been developed for many industrial uses. Proposal for process mapping of hazardous substances In order to be able to take measures to reduce emissions of hazardous substances, good knowledge of the production processes is needed. One way to do this is to use process mapping of hazardous substances. The purpose of the method is to identify the mass flows and release routes of the substances. The purpose is also to optimise monitoring and identify cost efficient ways to reduce emissions. The process mapping is a tool which supports the chemical inventory. The HAZBREF project recommends mapping of hazardous substances following the principles described as BAT candidate 3 in Annex 1. Proposal for substitution Substitution is an important measure to minimise chemical risks at the installation. A successful substitution work can be performed in four stages; Identification of hazardous substances - Screening for possible alternatives - Evaluation and choice of alternatives and Development of new alternatives. Regrettable substitution should be avoided. Proposal for the permitting process The permit process should be streamlined with more communication during the application phase between the applicant and permitting authorities and communication with WWTP operators should be ensured in case of indirect emissions. More co-operation between chemical, environmental and occupational health authorities is suggested to achieve smooth information flow and reduce double work. More exchange of information and good experiences between Member States would in the long run also contribute to more harmonised and better practices on European level. The format for a chemical inventory should be standardised. An appropriate approach is given in Annex 5. It is the duty of the operator to provide information in a way that it can be quickly assessed and that conclusions in the form of permit requirements, stipulations and conditions can be more easily drawn. Denna vägledningsrapport har tagits fram inom aktivitet 4.1 i arbetspaket 4 ”Bästa praxis för kemikaliehantering i branschen” i HAZBREF-projektet. Rapporten behandlar den kemiska industrin och dess två delsektorer: produktion av oorganiska högvolymkemikalier (med fokus på produktion av gödselmedel) och polymerer. Textilindustrin och ytbehandling av metaller och plast behandlas i separata rapporter. Mål, intresseområden, metodik och struktur Denna sektorsspecifika rapport ger vägledning till nyckelaktörer på nationell nivå (kemiska industrier och behöriga myndigheter) om hur man kan förbättra kemikaliehanteringen på anläggningsnivå. I detta avseende hänvisas till relevanta krav, såsom industriutsläppsdirektivet (IED) och referensdokumenten för bästa tillgängliga teknik (BREF). De resultat som redovisas i vägledningen, särskilt beträffande BAT-kandidater i kapitel 5, kommer också att ingå i kommande revision av BREF-dokument för kemisk industri (LVIC och eventuellt andra). De används vidare för HELCOM-rekommendationer om hur man kan minska utsläppen av farliga ämnen i Östersjön. Rapporten sammanfattar viktiga resultat från intervjuer och diskussioner med HAZBREF-experter, representanter från kemisk industri och relevanta myndigheter samt från genomförda fallstudier i Finland, Estland och Sverige. Även två polymerverksamheter i Polen har analyserats med avseende på cirkulär ekonomi. Rapporten fokuserar på tillämpningar och utmaningar relaterade till IEDtillståndsprocessen, och speciellt på användningen av farliga kemikalier i polymeroch gödselmedeltillverkning. Rapporten återspeglar också slutsatserna från andra arbetspaket i HAZBREF-projektet och hänvisar till rekommendationer som publicerats av Europeiska unionens nätverk för genomförande och efterlevnad av miljölagstiftningen (IMPEL). Det första kapitlet i rapporten ger en kort introduktion av tillämpningsområdet. Det andra kapitlet ger en introduktion till den kemiska sektorn med fokus på Europa och produktion av gödselmedel och polymerer. Det tredje kapitlet beskriver relevanta farliga kemikalier relaterade till produktion av gödselmedel och polymerer, regelverk för de farliga kemikalierna och både reglerande och icke-reglerande kemiska referenslistor. Kapitlet beskriver också hur identifiering av relevanta ämnen i polymer- och gödselmedelsindustrin kan göras. Det fjärde kapitlet beskriver krav enligt IED, REACH, CLP, WFD och annan relevant lagstiftning samt rekommendationer från HELCOM. Det innehåller också information om användning och framtagande av säkerhetsdatablad och exponeringsscenarier. Vidare beskrivs hur kemikalieinventeringar kan utvecklas och hur substansflödesanalys och materialflödesanalys kan användas. Den innehåller också en kort beskrivning av hur man använder ett interaktivt verktyg, utvecklat i HAZBREF, för identifiering av relevanta farliga ämnen. Bästa praxis för kemikaliehantering samt identifiering av BAT-kandidater beskrivs i det femte kapitlet. Kapitlet innehåller också vägledning om kemikaliehanteringssystem, kemikalie- och råvaruinventeringar, lagring och transport av kemikalier, optimering av processintegrerad återvinning, substitution, processkartläggning av farliga ämnen, hantering av farligt avfall och avloppsvattenbehandling. Kapitlet innehåller både allmänt tillämplig praxis och rekommendationer om BATkandidater. De flesta av BAT-kandidaterna är allmänt tillämpliga. Alla BATkandidater beskrivs i detalj i bilaga 1. Det sjätte kapitlet förklarar de olika stegen i tillståndsförfarandet enligt IED och ger vägledning, goda exempel och rekommendationer till både verksamhetsutövare och tillståndsmyndigheter om hur man utför respektive steg med särskilt fokus på bra kemikaliehantering. Frågor om cirkulär ekonomi inom polymersektorn och resultat från fallstudier beskrivs i det sjunde kapitlet. Huvudsakliga resultat och förslag Kemisk industri omfattar många olika typer av processer och verksamheter. Det finns många lagar som gäller för verksamheterna, och detta leder till utmaningar i kemikaliehantering för både operatörer och myndigheter. Kraven från myndigheter är lagbaserade men ofta har företagen egna program och regler som är strängare än kraven enligt gällande lag. Myndigheterna behöver mycket information om kemikaliefrågor, men denna information är inte alltid lättillgänglig. Förslag till förbättring av kemikaliehanteringssystem För att veta vilka farliga ämnen som används eller uppkommer i verksamheten krävs en kemikalieinventering. Det är viktigt att lista alla typer av kemikalier och råvaror som används i verksamheten i en databas. Kemikalielistan eller databasen är en viktig del av kemikaliehanteringen och möjliggör systematisk riskbedömning, hantering av kemikalieflöden och kemikalielagring. Det är också användbart i tillståndsprocesserna eftersom det ger enkel åtkomst till data för de kemikalier som används i verksamheterna. Informationen i kemikalielistan/databasen måste vara sökbar och listan bör uppdateras regelbundet. Merparten av den information som behövs finns i säkerhetsdatabladen. Om viss information saknas i säkerhetsdatabladet bör leverantören uppmanas att lämna denna. HAZBREF-projektet rekommenderar framtagande och användning av en kemikalie- och råvaruinventering enligt principerna som beskrivs som BAT-kandidat 2 i bilaga 1. HAZBREF rekommenderar också att framtagande och användning av kemikalie- och råvaruinventeringar förs in som krav i de reviderade BREF-dokumenten. Förslag rörande kvalitet och användning av säkerhetsdatablad För att möjliggöra effektiv kemikaliehantering måste det säkerställas att alla säkerhetsdatablad håller en god kvalitetsnivå. Om en kemikalieleverantör inte tillhandahåller säkerhetsdatablad av god kvalitet, är det både operatörens och den behöriga myndighetens skyldighet att kräva den saknade informationen från kemikalieleverantören. Bättre säkerhetsdatablad, inklusive förbättrad data om risker för miljön, och exponeringsscenarier skulle göra riskbedömning av enskilda kemikalier i specifika processer enklare för verksamheterna. Detta skulle leda till effektivare övervakning och bidra till att fokusera på de mest problematiska ämnena. Säkerhetsdatablad för råvaror bör innehålla mer information om ingående föroreningar. Kemikalieinventeringen skulle också kunna förbättras om detaljerade data om föroreningar eller avsiktligt tillsatta beståndsdelar skulle finnas tillgängliga i säkerhetsdatabladen. Exponeringsscenarier är vanligtvis inte direkt användbara för operatörerna. Sektorsspecifika miljöutsläppskategorier (SPERC), baserade på mätningar och information om ämnens karakteristik och typiska rörelsemönster på anläggningen kan hjälpa, men de har ännu inte utvecklats för många industriella användningar. Förslag till processkartläggning av farliga ämnen För att kunna vidta åtgärder för att minska utsläppen av farliga ämnen behövs god kunskap om produktionsprocesserna. Ett sätt att få det är att göra processkartläggningar av farliga ämnen. Syftet med metoden är att identifiera ämnets massflöde och läckagevägar. Syftet är också att optimera övervakningen och identifiera kostnadseffektiva sätt att minska utsläppen. Processkartläggningen är ett verktyg som stöder kemikalieinventeringen. HAZBREF-projektet rekommenderar kartläggning av farliga ämnen enligt principerna som beskrivs som BAT-kandidat 3 i bilaga 1. Förslag till substitution Substitution är en viktig åtgärd för att minimera kemiska risker vid verksamheten. Ett framgångsrikt substitutionsarbete kan utföras i fyra steg; Identifiering av farliga ämnen - Screening efter möjliga alternativ - Utvärdering och val av alternativ och Utveckling av nya alternativ. Substitution som senare kan komma att ångras bör undvikas. Förslag till förbättring av tillståndsprocessen Tillståndsprocessen bör effektiviseras genom mer kommunikation under ansökningsfasen mellan den sökande och tillståndsmyndigheterna och även med reningsverkets operatörer vid indirekta utsläpp. Mer samarbete mellan kemikalie-, miljö- och arbetsmiljömyndigheter föreslås för att uppnå ett smidigt informationsflöde och minska dubbelarbete. Mer utbyte av information och goda erfarenheter mellan medlemsstaterna skulle på sikt också bidra till mer harmoniserad och bättre praxis på europeisk nivå. Hur en kemikalieinventering ska vara utformad bör standardiseras. En lämplig metod ges i bilaga 5. Det är operatörens skyldighet att tillhandahålla information så att den lätt kan bedömas och att slutsatser i form av tillståndskrav och villkor lättare kan dras.

Background The main instrument on EU level to control industrial releases is the Industrial Emissions Directive (IED), particularly through the publication of BAT reference documents (BREFs) and related BAT Conclusions, which is the reference for setting the permit conditions throughout EU for IED installations. However, the BREFs published so far do not contain adequate information on specific hazardous chemicals used and released from industry which makes the control difficult for the industry and the permitting and supervising authorities. One of the case sectors in the HAZBREF project is the surface treatment of metals and plastics (STM). This sector was chosen due to the use of chemicals, potential emissions, the wide range of products as well as technological processes and the upcoming STM BREF review. The other HAZBREF case sectors are textile industry and chemical industry which are addressed in separate reports. The lack of knowledge on the use and flow of specific hazardous chemicals in the industrial processes makes chemical control and reduction measures difficult. The problem is that often neither plant operators nor authorities know which substances are relevant to be treated and which handling measures are needed. Surface treatment of metals and plastics is covered by the STM BREF document, published in 2006. According to the last work programme of the EIPPCB the review of the EU STM BREF is planned to start in 2021. Purpose of the document This sectoral guidance contains information on uses of hazardous chemicals, the best practices in chemical management and recommendations on enhancing the permitting process in the STM sector. This document sums up the findings from HAZBREF project and is based on industrial case studies, interviews with authorities and expert judgment. The aim is to describe good practices in chemical management to be utilized by STM installations as well as environmental and chemical authorities. These include technical, organisational and management aspects and concrete tools supporting chemical management. The report addresses the STM sector as a whole in Europe, although the main part of the findings is generated from HAZBREF case installation and other experiences in the Baltic Sea Region. The document provides also general descriptions of BAT proposals related to management of hazardous chemicals and substances. These findings of the guidance will feed into in the forthcoming revision of the STM BREF. They are also to be used for HELCOM recommendations on how to reduce the discharge of hazardous substances into the Baltic Sea. Moreover, the document provides an overview of applicable legal requirements, procedures and other obligations of installation operators regarding use of chemicals and releases of hazardous substances. This includes guidance for tools to identify and assess relevant hazardous substances used and released from the STM installations. Main findings and proposals Improvement of chemical management system A Chemical Management System provides a systematic way of managing chemicals through the whole process on the site. Most of the companies have implemented quality management standards such as ISO 9000, ISO 14000, EMAS and integrated EHS programs which also address certain aspects of chemical management. The quality of chemical management systems in the companies differs depending on the scale of operation, ownership and awareness. Integration of good practices of chemical management within already implemented management systems strengthens the ability to reduce environmental risks. HAZBREF project strongly recommends the establishment and regular use of a chemical management system at IED installations. Development of a chemical inventory The establishment and maintenance of a chemical inventory is an importantprerequisite for effective and responsible chemicals management in the STMsector. All chemicals and raw materials along with information on their propertiesused in all processes and activities at the site should be listed in a database. Such adatabase is a key part of chemical management allowing for systematic riskassessment, management of chemicals flows and their storage. The information in the chemical list/database must be searchable and should be updated regularly. Most of the information needed is available in the safety datasheets (SDS). If some information is missing from the SDS, the supplier should be asked to provide this. Good routines to handle new and updated SDSs are crucial to have an up to date and reliable chemical database. These routines should involve on-site handling and updates as well as communication with suppliers on how SDSs are delivered. Well-managed chemical inventories can significantly simplify the environmental permit application process both for the operators and the permitting authorities. Better use of Chemical Management Tools and training of staf Numerous references and tools are available to support STM companies and competent authorities in implementing the good chemical management required in the IED. HAZBREF recommends that operators use proper tools for risk assessment and evaluation of the efficiency of chemical management. Use and improvement of risk assessment tools such as extended SDS and material flow analysis should be promoted among installation operators in this respect. The HAZBREF project has developed a comprehensive tool that helps the operators to identify the site-specific hazardous substances that should be considered in strategic and operational decisions. Awareness raising and training of staff in the use of chemical management tools and systems is crucial for implementation of good chemical management practices at the installations. Substitution A regular check aiming at identifying potentially new available and safer alternatives to the hazardous chemicals used is an important measure to minimise chemical risks at the installation. A successful substitution work can be performed in four stages: - Identification of hazardous substances - Screening for possible alternatives - Evaluation and choice of alternatives and Development of new alternatives. Substitution can be aimed for any hazardous chemical used at installation level where it is needed in order to protect environment or human health. However, regrettable substitution (i.e. move to use new chemical that is equally or more hazardous than the substituted chemical or results in cross-media effects) must be avoided. Assessment and improvement of SDS Efficient chemicals management requires high quality of the Safety Data Sheets (SDS). The SDS should sufficiently describe the chemical properties and include information about exposure (including use and emissions), eco-toxicology and proper storage and handling. A SDS must also contain information on whether the chemical product contains substances on the SVHC list, priority substances under the Water Framework Directive WFD and the POPs convention. In case a chemical supplier fails to provide a SDS of sufficient quality, it is the duty of both the operator and the competent authority to demand the missing information. This is already required by law in some countries, e.g. Germany. It is also important that the operators know how to extract and consolidate the relevant information from the SDS to their permit applications and verify the quality of different information sources. The development of an extended SDS including exposure scenarios and improved data on environmental effects would facilitate better risk assessment of individual chemicals used in specific processes. This would lead to more efficient monitoring and help focusing on substances of concern. Improved SDSs for raw materials with information on impurities or additives would facilitate more complete chemical inventories. Continuous improvement of BAT implementation The implementation of BAT needs to be continuously monitored and improved at the installation considering site specific technological, economical and environmental aspects. The findings from Polish HAZBREF case studies is that fulfilment of BAT requirements can be challenging if all improvements need to be done in a short time period. For example, closed-loop systems are considered necessary additional process-integrated techniques that it is important to implementstep by step in the installations. Circular economy The STM sector is a significant user of non-renewable resources (metals), and recycling of recovered metal containing materials such as metal substrates orelectrolytes back to the process is good practice. Such recovery processes are widely used for basic metals, such as zinc, copper and nickel, which are used as valuable secondary raw materials SRM. High costs of recovery processes and high energy consumption as well as the variety of chemicals and metals used in STM processes often hinders recycling. In cases where recycling is not feasible, pretreatment of contaminated waste water on site and subsequent off-site treatment of generated metal containing sludges is standard practice. Permitting process Beside best practices in chemical management, the project also elaborated recommendations on enhancing the permitting process in the STM sector. It can be concluded that the existing general structure and content of the permit application procedures are as such sufficient to deal with hazardous substances and chemicals. Nevertheless, in practice the permit process could be improved with more communication between the applicant and the permitting authority during the application phase. More co-operation between chemical, environmental and occupational health authorities is suggested to achieve a smooth information flow and reduce double work regarding requirements under different legislations concerning chemicals and hazardous substances. In some countries, for example in Finland, the supervising practices in different parts of a given country need harmonising so that all installations are treated equally. This requires more and better communication between the respective environmental and chemical authorities within the country. The improved exchange of information and examples of good experiences between Member States would also, in the long run, contribute to more harmonised and better practices on European level. Bakgrund Det huvudsakliga instrumentet på EU-nivå för att kontrollera utsläpp från industrin är industriutsläppsdirektivet (IED), särskilt genom publicering av BATreferensdokument (BREF) och relaterade BAT-slutsatser, som är referensen för att fastställa tillståndsvillkoren i hela EU för IED-verksamheter. De hittills publicerade BREF-dokumenten innehåller emellertid inte tillräckligt med information om specifika farliga kemikalier som används och släpps ut från industrin vilket gör kontrollen svår för industrin och tillstånds- och tillsynsmyndigheterna. En av sektorerna som valts ut i HAZBREF-projektet är ytbehandling av metaller och plast (STM). Denna sektor valdes på grund av användningen av kemikalier, potentiella utsläpp, det breda utbudet av produkter samt tekniska processer och den kommande STM BREF-revideringen. De andra sektorerna HAZBREF har fokuserat på är textilindustri och kemisk industri, som behandlas i separata rapporter. Bristen på kunskap om användning och flöde av specifika farliga kemikalier i de industriella processerna gör det svårt att kontrollera och minska kemikalierna. Problemet är ofta att varken verksamhetsutövare eller myndigheter vet vilka ämnen som är relevanta att åtgärda och vilka skyddsåtgärder som behöver vidtas. Ytbehandling av metaller och plast omfattas av STM BREF-dokumentet, som publicerades 2006. Enligt EIPPCB: s senaste arbetsprogram planeras revideringen av STM BREF att börja 2021. Dokumentets syfte Denna vägledning innehåller information om användning av farliga kemikalier, bästa praxis inom kemikaliehantering och rekommendationer för att förbättra tillståndsprocessen inom STM-sektorn. Detta dokument sammanfattar resultaten från HAZBREF-projektet och baseras på fallstudier, intervjuer med myndigheter och expertbedömning. Syftet är att beskriva god praxis inom kemikaliehantering som ska användas av STM-verksamheter samt miljö- och kemikaliemyndigheter. Dessa inkluderar tekniska, organisatoriska och hanteringsaspekter och konkreta verktyg som stöder kemikaliehantering. Rapporten behandlar STM-sektorn som helhet i Europa, även om huvuddelen av resultaten härrör från verksamheter som har deltagit i fallstudierna och andra erfarenheter i Östersjöregionen. Dokumentet innehåller också allmänna beskrivningar av BAT-förslag relaterade till hantering av farliga kemikalier och ämnen. Dessa resultat i vägledningen kommer att ingå i den kommande revideringen av STM BREF. De kan vidare användas för HELCOMrekommendationer om hur man kan minska utsläppen av farliga ämnen i Östersjön Dessutom ger dokumentet en översikt över tillämpliga lagkrav, förfaranden och andra skyldigheter för verksamhetsutövare beträffande användning av kemikalier och utsläpp av farliga ämnen. Detta inkluderar vägledning för hur man kan identifiera och bedöma relevanta farliga ämnen som används och släpps ut från STM-anläggningarna. Huvudsakliga resultat och förslag Förbättring av kemikaliehanteringssystemet Ett kemikaliehanteringssystem ger ett systematiskt sätt att hantera kemikalier genom hela processen på anläggningen. De flesta av företagen har implementerat olika standarder som ISO 9000, ISO 14000, EMAS och integrerade EHS-program som också behandlar vissa aspekter av kemikaliehantering. Kvaliteten på kemikaliehanteringssystem i företagen varierar beroende på deras storlek, ägarförhållanden och medvetenhet. Integrering av god praxis för kemikaliehantering i redan implementerade ledningssystem stärker förmågan att minska miljörisker. HAZBREF-projektet rekommenderar upprättande och regelbunden användning av ett kemikaliehanteringssystem vid IED-verksamheter. Utveckling av en kemikalieinventering Att upprätta och underhålla en kemikalieinventering är en viktig förutsättning för en effektiv och ansvarsfull kemikaliehantering inom STM-sektorn. Alla kemikalier och råvaror som används i alla processer och aktiviteter på anläggningen bör, tillsammans med information om deras egenskaper, listas i en databas. En sådan databas är en viktig del av kemikaliehanteringen och möjliggör systematisk riskbedömning, hantering av kemikalieflöden och lagring. Informationen i kemikalielistan/databasen måste vara sökbar och bör uppdateras regelbundet. Merparten av den information som behövs finns i säkerhetsdatabladet (SDS). Om viss information saknas i säkerhetsdatabladet bör leverantören uppmanas att lämna denna. Bra rutiner för att hantera nya och uppdaterade säkerhetsdatablad är avgörande för att ha en uppdaterad och pålitlig kemikaliedatabas. Dessa rutiner bör omfatta hantering och uppdateringar på plats samt kommunikation med leverantörer om hur säkerhetsdatablad levereras. Välskötta kemikalielistor/databaser kan avsevärt förenkla ansökan om miljötillstånd för både verksamhetsutövare och tillståndsmyndigheter. Bättre användning av verktyg för kemikaliehantering och utbildning av personal Många referenser och verktyg finns tillgängliga för att stödja STM-företag och behöriga myndigheter i genomförandet av den goda kemikaliehanteringen som krävs i IED. HAZBREF rekommenderar verksamhetsutövare att använda lämpliga verktyg för riskbedömning och utvärdering av kemikaliehanteringens effektivitet. Användning och förbättring av riskbedömningsverktyg som utökade säkerhetsdatablad och analys av materialflöden bör främjas bland verksamhetsutövare i detta avseende. HAZBREF-projektet har utvecklat ett omfattande verktyg som hjälper verksamhetsutövarna att identifiera platsspecifika farliga ämnen som bör beaktas i strategiska och operativa beslut. Att öka medvetenheten och att utbilda personal i användningen av verktyg för kemikaliehantering och kemikaliehanteringssystem är avgörande för genomförandet av god kemikaliehanteringspraxis vid verksamheterna. Substitution En regelbunden kontroll som syftar till att identifiera potentiellt nya tillgängliga och säkrare alternativ till de farliga kemikalier som används är en viktig åtgärd för att minimera kemiska risker vid verksamheten. Ett framgångsrikt substitutionsarbete kan utföras i fyra steg: - Identifiering av farliga ämnen - Screening efter möjliga alternativ - Utvärdering och val av alternativ och Utveckling av nya alternativ. Substitution kan riktas mot alla farliga kemikalier som används på verksamheten där det behövs för att skydda miljön eller människors hälsa. Substitution som senare ångras (dvs. byta till att använda en ny kemikalie som är lika eller mer farlig än den substituerade kemikalien eller som resulterar i tvärmedieeffekter) måste undvikas. Bedömning och förbättring av säkerhetsdatablad Effektiv kemikaliehantering kräver hög kvalitet på säkerhetsdatablad (SDS). Säkerhetsdatabladet bör beskriva de kemiska egenskaperna tillräckligt och innehålla information om exponering (inklusive användning och utsläpp), ekotoxikologi och korrekt lagring och hantering. Ett SDS måste också innehålla information om huruvida den kemiska produkten innehåller SVHC-ämnen, prioriterade ämnen enligt vattendirektivet WFD och POPs-konventionen. Om en kemikalieleverantör inte tillhandahåller ett säkerhetsdatablad av tillräcklig kvalitet är det både verksamhetsutövaren och den behöriga myndighetens skyldighet att kräva informationen som saknas. Detta krävs redan enligt lag i vissa länder, t.ex. i Tyskland. Det är också viktigt att verksamhetsutövarna vet hur man tar fram och sammanfattar relevant information från säkerhetsdatabladet till sina tillståndsansökningar och verifierar kvaliteten på olika informationskällor. För att förbättra riskbedömning av enskilda kemikalier, som används i specifika processer, kan ett utökat säkerhetsdatablad inklusive exponeringsscenarier och förbättrade data om miljöeffekter underlätta. Detta skulle leda till effektivare övervakning och hjälp med att fokusera på ämnen som är farliga. För att få mer fullständiga kemikalieinventeringar kan förbättrade säkerhetsdatablad för råvaror med information om föroreningar eller tillsatser underlätta. Kontinuerlig förbättring av implementeringen av BAT Implementeringen av BAT måste kontinuerligt övervakas och förbättras vid verksamheten med beaktande av platsspecifika tekniska, ekonomiska och miljöaspekter. Resultaten från de polska HAZBREF-fallstudierna är att uppfyllandet av BAT-kraven kan vara utmanande om alla förbättringar behöver göras på kort tid. Till exempel anses slutna system vara nödvändiga ytterligare processintegrerade tekniker som det är viktigt att implementera steg för steg i verksamheten. Cirkulär ekonomi STM-sektorn är en betydande användare av icke förnybara resurser (metaller), och återvinning av återvunna metallinnehållande material såsom metallsubstrat eller elektrolyter tillbaka till processen är god praxis. Sådana återvinningsprocesser används ofta för basiska metaller, såsom zink, koppar och nickel, som används som värdefulla sekundära råvaror (SRM). Höga kostnader för återvinningsprocesser och hög energianvändning samt de många olika kemikalier och metaller som används i STM-processer hindrar ofta återvinning. I de fall återvinning inte är möjlig är förbehandling av förorenat avloppsvatten på plats och efterföljande behandling av genererat metallhaltigt slam praxis. Tillståndsprocessen Förutom bästa praxis inom kemikaliehantering utarbetades även rekommendationer för att förbättra tillståndsprocessen inom STM-sektorn. Man kan dra slutsatsen att den befintliga allmänna strukturen och innehållet i tillståndsansökningsförfarandena som sådana är tillräckliga för att hantera farliga ämnen och kemikalier. I praktiken kan tillståndsprocessen ändå förbättras med mer kommunikation mellan den sökande och tillståndsmyndigheten under ansökningsfasen. Mer samarbete mellan kemikalie-, miljö- och arbetsmiljömyndigheterna föreslås för att uppnå ett smidigt informationsflöde och minska dubbelarbete avseende krav enligt olika lagstiftning om kemikalier och farliga ämnen. I vissa länder, till exempel i Finland, måste praxis för tillsyn och övervakning i olika delar av landet harmoniseras så att alla verksamheter behandlas lika. Detta kräver mer och bättre kommunikation mellan miljö- och kemikaliemyndigheter i landet. Det förbättrade informationsutbytet och exempel på goda erfarenheter mellan medlemsstaterna skulle också på sikt bidra till mer harmoniserad och bättre praxis på europeisk nivå.

The main instrument at the EU level to control industrial releases is the Industrial Emissions Directive (IED), particularly through the publication of BAT reference documents (BREFs) for industrial sectors, which include a BAT conclusions chapter setting a reference for permit conditions throughout the EU for IED installations. The EU action plan for the Circular Economy states that Circular Economy in industry will be promoted through the BREF documents, but so far this aspect is not reflected in concrete requirements in BREFs. The aim of this study is to provide input on how circular economy issues can be addressed in the BREFs in accordance with this new EU policy in order to facilitate recycling, reuse and improve the uptake of secondary raw materials. A general finding is that CE objectives cannot be reached by amending single regulatory frameworks and, instead, a systematic review of the whole regulatory system is required. IED and BREFs can promote CE objectives only to a limited extent, but, however, more can be done by making better use of the existing mechanisms in a systematic way. Many BREFs already include BATs on waste recovery and treatment, but requirements promoting non-toxic cycles should be more concrete than at present. For example, cross-contamination of waste materials should be prevented through requirements on source separation in BREFs. More emphasis could also be put on the practical implementation of waste hierarchy, which is the leading principle in supporting efficient material cycles. The traditional scope of IED and BREFs covers a single industrial installation from gate to gate, whereas the promotion of CE requires life cycle thinking and better connections to upstream and downstream processes. HAZBREF-project recommends introducing a BAT for chemical inventory in sectoral BREFs to support information on the chemical content of the products throughout the whole supply chain. Product requirements may limit the use of secondary raw materials and quantitative BATs (BAT-AEPLs) in BREF documents are rarely feasible, but increased information on possibilities to use secondary raw materials would support the recovery of waste and prevent waste generation.
