This study aims to determine the policy of fulfilling electrical energy in Indonesia and the policy of developing liquified natural gas (LNG) infrastructure in the fulfillment of electrical energy in Indonesia. The method used in this research is normative research so that the data used is secondary data collected through literature study. The results of the study conclude that first, the laws and regulations related to electricity in Indonesia are described in several electricity policies including the General Plan for the Provision of Electricity (RUPTL). The electricity policy currently being worked on by the government is the 35 GW Electricity Development Program based on the 2019-2028 RUPTL. Second, electricity infrastructure development policies are spread across various laws and regulations and decisions. The LNG infrastructure development policy itself is contained in the Decree of the Minister of Energy and Mineral Resources Number 13K/13/MEM/2020 on the Assignment of the Implementation of the Supply and Development of LNG Infrastructure and the Conversion of the Use of Oil Fuel with LNG in the Provision of Electric Power. This policy encourages the development of LNG infrastructure and has an impact on accelerating development towards meeting the needs of electrical energy, especially for eastern Indonesia. The challenge is that there are still LNG export commitments with other countries that have the potential to hinder the fulfillment of domestic LNG needs. Key Words: LNG infrastructure development policy; LNG AbstrakKajian ini bertujuan untuk mengetahui kebijakan pemenuhan energi listrik di Indonesia serta kebijakan pembangunan infrastruktur liquified natural gas (LNG) dalam pemenuhan energi listrik di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian normatif sehingga data yang digunakan adalah data sekunder yang dikumpulkan melalui studi pustaka. Hasil penelitian menyimpulkan, bahwa pertama, peraturan perundang-undangan terkait ketenagalistrikan di Indonesia dijabarkan dalam beberapa kebijakan ketenagalistrikan diantaranya Rencana Umum Penyediaan Tenaga Listrik (RUPTL). Kebijakan ketenagalistrikan yang sedang dikerjakan oleh pemerintah saat ini adalah Program Pembangunan Ketenagalistrikan 35 GW berdasarkan RUPTL 2019-2028. Kedua, kebijakan pembangunan infrastruktur kelistrikan tersebar di berbagai peraturan perundang-undangan maupun keputusan. Kebijakan pembangunan infrastruktur LNG sendiri terdapat dalam Keputusan Menteri ESDM Nomor: 13K/13/MEM/2020 tentang Penugasan Pelaksanaan Penyediaan Pasokan dan Pembangunan Infrastruktur LNG serta Konversi Penggunaan Bahan Bakar Minyak dengan LNG dalam Penyediaan Tenaga Listrik. Kebijakan tersebut mendorong pembangunan infrastruktur LNG dan memberikan dampak bagi percepatan pembangunan menuju pemenuhan kebutuhan energi listrik khususnya bagi wilayah Indonesia timur. Tantangannya adalah masih terdapat komitmen ekspor LNG dengan negara lain yang berpotensi menghambat pemenuhan kebutuhan LNG dalam negeri. The latest law on the protection of Indonesian Migrant Workers (IMWs), Law Number 18 of 2017 (Law 18/2017), obliges the Indonesian government to conduct economic protection through remittance management by involving certain institutions. Nonetheless, there is a lack of clarity about how this intervention would occur. The private nature of migrant workers’ remittances leads to the question of constitutional justification essential for the government’s authority to intervene – particularly in Indonesia as a constitutional state in the form of a welfare state – besides skepticism concerning the applicability of the norm. This paper emphasizes the constitutional silence with regard to state intervention in human resources allocation, as it makes the deployment of Indonesian workers abroad constitutionally groundless. Consequently, the discretion infiltrates the remittance, a component of national income that is essentially a private transfer in which the management should be fully controlled by the families. Through review of the scientific literature and legal document analysis, this research found that the inclusion of a state intervention provision on human resources into the 1945 Constitution is still required., Advances in Southeast Asian Studies, Vol. 15 No. 1 (2022)

The preamble of 1945 Constitution have declared Indonesia as a welfare state. Post-amendment of the 1945 Constitution, the rights of Indonesian citizen to welfare is regulated in Article 28 H sections (1), (2), (3), and Article 34 sections (2) and (3), which then is subsequented by Law number 40 of 2004 on National Social Security System, followed by Law number 24 of 2011 on Social Security Agency (BPJS). However, both regulations instead created new problems: the government is monopolizing the business of security insurance, and the existence of double burden to the citizens in paying taxes as an obligation and paying insurance premium as contribution fee to get social security. This study will further elaborate: First, the concept of the welfare state of Indonesia; and Second, the consistency of social security regulations towards the effort to manifestation of Indonesia as a welfare state.IntisariPembukaan UUD NRI Tahun 1945 telah mendeklarasikan Indonesia sebagai negara kesejahteraan (welfare state). Pasca amandemen UUD NRI Tahun 1945 hak warga negara dalam kesejahteraan diatur dalam Pasal 28 H ayat (1), (2), (3) dan Pasal 34 ayat (2) dan (3), yang kemudian diejawantahkan dalam UU No. 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional yang ditindaklanjuti dengan UU No. 24 Tahun 2011 tentang Badan Penyelenggara Jaminan Sosial (BPJS). Namun kedua pengaturan tersebut justru menimbulkan permasalahan baru: pemerintah membuat monopoli dalam bisnis asuransi jaminan, dan ada beban ganda bagi warga negara dalam membayar pajak sebagai kewajiban membayar premi asuransi sebagai kontribusi untuk mendapatkan pertanggungan dari jaminan sosial. Penelitian ini akan mengkaji: Pertama, bagaimana konsepsi negara kesejahteraan Indonesia; dan Kedua, bagaimana konsistensi pengaturan jaminan sosial terhadap upaya mewujudkan konsepsi negara kesejahteraan Indonesia.

The Regional Budget Implementation Accountability (PPAPBD) mechanism is a part of the regional financing management process applicable subsequent to the formulation of draft APBD, approval ofthe draft APBD by the Regional House of Representatives, validation by the Central Government,enactment of draft APBD to be APBD, and implementation of APBD. In a normative manner, the PPAPBDmechanism is a series of supervisory procedures performed by budget-supervisory institutions, amongothers include the Board of Financial Audit (BPK), the Ministry for Domestic Affairs, and the RegionalHouse of Representatives. Within the field of administrative law, the PPAPBD mechanism is a form of administrative supervision performed in order to establish good governance in accordance with the General Principles of Good Governance (AUPB). Mekanisme Pertanggungjawaban Pelaksanaan APBD (PPAPBD) merupakan bagian dari proses pengelolaan keuangan daerah setelah proses penyusunan Rancangan APBD, persetujuan RAPBD oleh DPRD, pengesahan APBD oleh Pemerintah Pusat, penetapan menjadi APBD, dan pelaksanaanAPBD selesai dilakukan. Secara normatif, mekanisme PPAPBD merupakan suatu rangkaian prosedurpengawasan yang dilakukan oleh instansi-instansi yang memiliki fungsi pengawasan anggaran, antaralain Badan Pemeriksa Keuangan (BPK), Kementerian Dalam Negeri, dan Dewan Perwakilan RakyatDaerah (DPRD). Dalam konteks hukum administrasi negara, mekanisme PPAPBD merupakan bentukpengawasan demi terwujudnya pemerintahan yang baik sesuai dengan antara lain Asas-Asas UmumPemerintahan yang Baik (AUPB).

The Regional Autonomy Act 1999 started to give local government authority to regulate onhealth. This to be observed such as the implementation over local government’s authority toregulate over health’s issue and it’s positive implications as the result. This research shows thatimplementation of Yogyakarta City government’s authority to regulate over health’s area have gone well since many healthcare’s policies had been produced in accordance to society’s needs and capabilities. Moreover, those regulations has significantly improved the healthcare’s quality becausethe numbers of licensed health facilities and paramedics increased. Undang-Undang Nomor 22 Tahun 1999 memberikan kewenangan mengatur tentang kesehatan kepadapemerintah daerah sehingga menimbulkan dua hal yang perlu diteliti, yakni tentang pelaksanaan kewenangan mengatur pemerintah di bidang kesehatan dan implikasi positif dari peraturan yang dikeluarkan tersebut khususnya di Kota Yogyakarta. Hasil penelitian menyatakan bahwa: Pertama,pelaksanaan wewenang mengatur Pemerintah Kota Yogyakarta telah berjalan baik dengan dibentuknya kebijakan-kebijakan di bidang pelayanan kesehatan sesuai kebutuhan dan kemampuan daerah. Kedua, pengaturan mengenai pelayanan kesehatan di Kota Yogyakarta memiliki dampak signifikan bagipeningkatan pelayanan kesehatan, yang ditunjukan dengan peningkatan jumlah sarana dan tenaga kesehatan berizin pasca dikeluarkannya Peraturan Daerah oleh Dinas Kesehatan Kota Yogyakarta.

The enactment of Act Nr. 28 of 2009 on Local Taxes and Local Levies would allegedly pose some juridical impact on local tax collection at the provincial and district/cities throughout Indonesia. The juridical impact would at least occur to local regulations governing local taxes, Regional Government Revenue and Expenditure (APBD), and the oversight of local regulation by the provincial and district/ city governments. This research is a normative-empirical research, which aims to analyse changes of local taxes law in Act Nr. 28 of 2009. This study offers an insight of the impact of this Act on local tax collection in the special province of Yogyakarta. Pemberlakuan UU No. 28 Tahun 2009 tentang Pajak Daerah dan Retribusi Daerah disinyalir akan menimbulkan beberapa dampak yuridis terhadap pemungutan pajak daerah di tingkat provinsi dan kabupaten/kota di seluruh Indonesia. Dampak yuridis tersebut setidaknya terjadi terhadap produk hukum daerah yang mengatur tentang pajak daerah, Anggaran Pendapatan dan Belanja Daerah (APBD), dan pengawasan produk hukum daerah oleh pemerintah provinsi dan pemerintah kabupaten/kota. Penelitian ini merupakan penelitian normatif-empiris, yang bertujuan menganalisis perubahan pengaturan tentang pajak daerah dalam UU No. 28 Tahun 2009, sehingga melalui penelitian ini terlihat dampak yuridis penegakan UU ini pada pengumpulan pajak lokal di Provinsi DIY.
