After decades of rapid urban expansion, China's urban development has transitioned to focus on the quality improvement of existing spaces. Urban renewal is now a strategic measure crucial for advancing highlevel territorial spatial planning and intensive land use. In coastal regions that have experienced rapid urbanization, redeveloping underutilized collective construction land is essential for achieving high-quality urban development. China has experienced a path-dependent institutional change in collective land property rights, typically village-based institutions created by rural collectives. When the government aims to grant legal status to collective construction land by redefining property rights and promoting redevelopment, these informal institutions inevitably pose constraints. This study conducts a theoretical and empirical analysis of the roles, behaviors, and outcomes of local governments in constructing a collective land redevelopment market. First, it explores the relationship between the government and the market under gradual institutional change and how this relationship manifests in the redevelopment of collective construction land. Then, it empirically examines the case of Nanhai District in Foshan City, using data from the "Three Olds Reconstruction" database and a redevelopment project with which the authors are deeply involved. The study investigates the formation mechanisms of collective construction land, changes in land development institutions, constraints on redevelopment, and measures taken by local governments to construct the land redevelopment market. Despite the government's efforts to legitimize collective construction land through titling and market initiation, issues such as land fragmentation, involution of collective land management, and ambiguity in property rights persist, constraining further redevelopment. Local governments play an entrepreneurial role characterized by a negotiated relationship of both cooperation and competition with village collectives, the property rights holders. Cooperation involves the government acting as a 'transaction broker' between village collectives and investors, reducing institutional constraints and transaction costs. Competition arises as village collectives seek to capture land rents. The appreciation in land value, mainly generated by public investment, should benefit the general public. However, village collectives leverage their possession of land rights to "hold-up" the government, forcing compromises in profit-sharing. This capture of public value by village collectives jeopardizes social equity. To enhance collective land redevelopment and balance development efficiency with social justice, the following policy recommendations are proposed: 1) formalizing the government's informal role as a "transaction broker" to lower transaction costs and mitigate negative impacts; and 2) establishing clear standards for profit-sharing among stakeholders and a system for transferring land development rights to ensure equitable profit distribution. Informal development, as a unique phenomenon that has become widespread in China’s urbanization process in recent years, has continued to attract the attention of both the government and academia. Existing studies focus on urban village redevelopment strategies, and little research has been conducted on informal development in urban villages under the land property approach. In particular, research needs to further explore what impact China’s collective land property rights have had on informality in urban villages. This study mainly adopts a qualitative research method, including field observation and in-depth interviews. The research was conducted in urban villages in Guangzhou. The study finds that land property rights have an important impact on urbanization and property rights arrangements have an important impact on resource allocation efficiency. Due to the ambiguity of collective land property rights in China, informal development in urban villages is the result of the collective action of villagers, government, and enterprises under the stimulation of economic development. The interaction of the stakeholders has promoted the rapid development of informal housing in urban villages.

Informal housing accommodates a large number of populations in the worldwide and has received considerable attention. However, there is still a lack of understanding on the diversified informal settlers and their housing incentives, constraints, and risks they face. Based on existing research on property rights and informal settlements, this study presents a conceptual framework that includes four dimensions of property rights (the right of possession, the right of use, the right to earn rental income and the right of transfer) to explore the de facto property rights of Small Property Rights Housing (SPRH) owners for a better understanding on informal housing ownership and its relationship with formal and informal institutional arrangements in China. In-depth interviews with SPRH owners were conducted to explore the de facto property rights of SPRH ownership. Findings reveal that the “small” property rights shaped by formal and informal institutional arrangements have resulted in unique housing values of SPRH. Such housing values have met a wide range of housing needs and motivated heterogeneous social groups to obtain SPRH ownership in urbanizing China. Constructive attempts to clarify the “small” property rights of SPRH should consider the different social groups of informal housing owners and their diversified housing needs. The recent emergence in Morocco’s public debate of collective lands and their increased commodification is partly due to the protest actions that are led against the ways this commercialisation is taking place. The actions carried out by women have become the most visible ones today. Since 2007, they have been protesting against their exclusion from the right to use collective lands. This right was eventually given to them via a series of ministerial circulars that were issued by the ministry between 2009 and 2012. The article focuses on the legal and normative references used, at different scales, to legitimize the inclusion of women amongst the lists of those entitled to benefit from collective land. After a presentation of the gendered character of the regime regulating collective land, the article analyses how the ministry of the Interior justifies the obligatory inclusion of women within the lists of beneficiaries. Through the case of the Mehdawa community, it finally illustrates how the delegates of this community are legitimizing the implementation of the new ministerial directives at the local level by re-adapting the arguments put forward by the State.

Turbulent periods of transition from socialism to neoliberal capitalism, which have affected the relationships between holders of power and governing structures in Serbia, have left a lasting impact on the urban spaces of Belgrade’s cityscape. The typical assumption is that the transformation of the urban form in the post-socialist transition is induced by planning interventions which serve to legitimize these neoliberal aspirations. The methodological approach of this paper is broadly structured as a chronological case analysis at three levels: the identification of three basic periods of institutional change, historical analysis of the urban policies that permitted transformation of the subject area, and morphogenesis of the selected site alongside the Sava River in New Belgrade. Neoliberal aspirations are traced through the moments of destruction and moments of creation as locally specific manifestations of neoliberal mechanisms observable through the urban form. Comparison of all three levels of the study traces how planning and political decisions have affected strategic directions of development and, consequently, the dynamics and spatial logic of how new structures have invaded the street frontage. The paper demonstrates that planning interventions in the post-socialist transition period, guided by the neoliberal mechanisms, has had a profound impact on the super-block morphology.

This study uses the complete information dynamic game model to analyze the possible interests of local government in market transactions and thereby clarify local government’s role in collective management of land use in the market and the key points of the game,. The results show that under the current tax system and land expropriation system, if the local government really supports reform of the collective management of land for land use, it will meet four conditions: (1) increase the taxes and fees paid by the collective management of land use transactions; (2) promote "rural infrastructure investment" as a direct participant in the collective management of land for the construction of land revenue distribution (its only participation in the secondary distribution of income); (3) reduce the local government land transfer in the state land distribution share; and (4) increase local government land acquisition cost. This study contributes to the purpose of providing a reference for exploring the transfer of collective construction land into the market and constructing a unified urban and rural construction land market. Urban fringes are an important part of urban growth. In addition to formal land markets, a variety of informal land development methods make urban fringes the most dynamic and complicated areas. The analysis of land transfer and development systems in these areas opens a significant window to understanding the modern processes of urbanization and human and property rights in urban areas in China. This study uses Shanghai as a case study target and identifies specific modes of local land development and investigates how collective participants, government agencies, regulatory policies, and various actors are involved in land development and decision making. The in-depth analysis and case studies indicate that the variety of informal land markets in Shanghai reflects the inherent demands of the market for allocation of land resources within the constraints of the given system and against the given development background. However, conflicts between the mode of the market and the existing institutional constraints reflect the uncoordinated development of the land and the economic and social development around the urban fringe. The empirical results of this paper suggest that government administration should improve the land market system, strengthen the planning of control and guidance, rationalize the distribution of interests in land development, and strengthen the supervision of management of land development enterprises. Instead of fragmented aspects, this paper proposes a systematic analytical approach to understanding the informal land development in a city from an urban planning and land resource management perspective. Urban development in China is based on two types of land ownership, namely, state land owned by states and collective land owned by village collectives. Legally speaking, urban development must be based on state land. In practice, informal development based on collective land has played important roles in the rapid urbanization process over the past decades. Nonetheless, the vague property rights over collective land have led to inferior and suboptimal development outcomes in expansive urban areas. The redevelopment of collective land has become an important means to sustain urban development in an ongoing urbanization process. By adopting theoretical perspectives from New Institutional Economics, this study presents an integrated conceptual framework on the institutional arrangements of land property rights and transaction costs to understand the changes in land policies and their institutional implications for the redevelopment of collective land in Shenzhen, China. The findings reveal that the new policies have redefined the relationship among the government, village collectives, and real estate developers as well as their property rights over collective land. The change of institutional arrangements in land property rights has significantly reduced the transaction costs in the redevelopment process and effectively promoted land redevelopment activities. Making unified registration of rural coUective land and granting legal rights of rural coUective and farmer land are necessities for protecting the fundamental interests of farmers, implementing the party's rural policies, and the source of unified real estate registration, and wiil lay a solid foundation for smooth implementation of registration of real estate. According to requirements of Notice of the General Office of the People's Government of Anhui Province on Implementing the Confirmation and Registration of Ownership of Rural Collective Land, in order to integrate urban and rural development and safeguard the rights and interests of farmers, since January 2010, Ma'ansha Municipal Government has made an overall deployment in the whole city to carry out the confirmation and registration of rural coUective land. However, complex property situation of the collective land and the problems of existing registration system have brought about many problems. This article locates current debates concerning the gendered access to collective land in Morocco within the context of a wider discussion about colonial legacy and the construction of customary law. The colonial construction of the 'ethnic community' and the institutionalisation of 'customary law' have preserved custom as a legal category, but they have rigidified its application by integrating it to the framework of positive law. The way in which customary law and positive law mutually shape each other has produced a state-sanctioned system of structural exclusion of women from collective land. Today, various actors are challenging this system of exclusion. To do so they bring back to life colonial legal categories by using 'custom' to new ends and by reproducing the distinction between customary regimes that oppress women and a positive law that promotes equality. As the object of collective construction land use rights, land circulation is strictly regulated by law, it is a reasonable way in the field of public intervention in private law. Two land use control and planning management principle is the collective construction land use rights as the important characteristics of transfer object is different from other object, based on different value goals and management needs, different kinds of collective construction land shall be constrained by different factors. Management of collective construction land circulation should follow the principle of the single market; Non-operating collective construction land is similar to the public, the circulation should be more strict limits; And the current system of housing land use right based on the needs and welfare conditions and the restrictions on the land circulation should be depending on different circumstances and different subjects. Shantytown is a type of urban residential space with a long history in populated areas; it is a negative and stark space with a gradual decline in function and poverty. It is also a concentrated reflection of an unbalanced and inadequate development of the urban social space, which restricts the development of a high-quality and sustainable social economy. Taking shantytown reconstruction in Nanjing as an example, based on the information of 434 shantytown plots dating from 2008 to 2020, it combines the two typical cases of state-owned land: Xijie and collective land—Nanhe, and the questionnaire data regarding the removal and resettlement of residents, the driving mechanism and the effect of social space reconstruction of shantytown. Reconstruction is mainly discussed based on the overall understanding of the space–time characteristics of shantytown reconstruction in Nanjing. It is found that the top-down policy which transfer from the central government to the local government, the value orientation of urban growth alliance in pursuit of asset appreciation, and the interest demands and game attitude of shantytown residents from the bottom up are all important forces to promote shantytown reconstruction. Shantytown reconstruction plays a key role in improving the housing conditions of residents; it fully taps on the potential land value, thus enhancing the urban function and quality. However, the gentrification reconstruction of the original shantytown space, and the centralized resettlement of the poor groups in the urban fringes, have led to an unbalanced development of the new urban social space, with an insufficient guarantee for the removal and resettlement groups. In view of the social space problems caused by the poor people living in the outer suburbs, this paper puts forward some recommendations on policy optimization and plan adjustment of shantytown reconstruction. The history of this establishment tells of conflicts between the regimes of property of the estate (public or seigniorial) and peasant property for the control of forestry resources. This article explains how this method of community management has been incorporated into the socialist system and how it has been restored during a transition stage. The vitality of the urbariat is a testament to the strength of mobilisation among local actors.
