Abstract

The Roman classical liberal conception of individual property greatly influenced European legislations. The idea that property is a subjective and nearly absolute right, although with some traditional limitations, was reflected in the Spanish Civil Code. Currently, this liberal notion is tempered by the recognition of the social function of private property, which restrains its content according to the laws. After the study of the limitations to the real property right, we'll focus on the most frequent actions brought for its protection, which - as we shall see - are still named and keep the general features they presented in Roman law.
