Abstract

This paper deals with the emergence of new forms of trade marks, non-conventional trade marks and their registration. The first chapter or the introduction, shows a general concept and a general framework of trademarks and a way on which trademark works on the market. The second chapter explains what does a trademark represents and what is its role and function on the market. It also discusses the different types of trademarks which exist and explains the criteria of distinctiveness of the sign which must be fulfilled in order to get a sign registered. The types of a well-known trademarks and generic trademarks are very interesting so the paper tries to explain their position, the way of forming those trademarks and the consequences of their appearance. The end of the chapter tries to explain the principle of territoriality and show different systems, international and regional in which trademark can on a more easier way be registered in many countries. The third chapter deals with the non-conventional trade marks, their types, the most famous examples of such trademarks and examples of their successful and unsuccessful attempts to register. It also discusses the most famous cases whose judicial decisions have a major impact on the establishment of rules and conditions to which a non-conventional sign must fulfill in order to be registered as trademark. Finally, the concluding forth chapter assesses the current status related to the quality of registration of such trademarks and the adaption to new market conditions, regarding the new directive related to trademarks which is in preparation.
