Abstract
- The article discusses the conduct which requires truncated rule of reason analysis by federal antitrust agencies in enforcement actions, factors for truncation described by the U.S. Federal Trade Commission in its case, Massachusetts Board, and its modification in the case of music record company Polygram. Topics include the departure from rule of reason by the Supreme Court and the Commission's Detroit Auto Dealers case showing the evidence of anticompetitive effects as a basis for truncation.
