Abstract

The article proposes that factual analysis in foreign component cartel cases in the U.S. should focus intensively on the other crucial inquiry under the Foreign Trade Antitrust Improvements Act (FTAIA). Topics covered include the application of U.S. antitrust laws in a cartel involving foreign sales of components, the "gives rise to" requirement of the FTAIA, and the application of U.S. antitrust laws in cases based on price-fixed components.
