La disponibilidad de predios en los proyectos de infraestructura en Colombia: una alternativa.

This paper analyzes the causes and proposes possible solutions for one of the principle reasons of Colombian backwardness in infrastructure: properties availability. The paper discusses "systemic" and "specific" causes. In relation to the systemic ones, it highlights the need of demanding proper feasibility studies, of changing the moment in which the properties are being acquired and of establishing a government institution that coordinates the entire process more effectively. In relation to the specific ones, it discusses the necessity of determining that a resolution of expropriation based on an infrastructure project should be considered a motive of public utility without discussion. In addition, it proposes to abolish the "pre-judicial process" on the basis of understanding what the Constitutional Court have said as well as establishing a faster and more reliable mechanism of setting the price of the property.
