The right to accommodation in student dormitory is one of the basic elements of the right to education and significantly affects the quality of studying. However, its protection is not proportional to the degree of its importance. The only relevant regulation that specifically regulates the right to accommodation in a student dormitory is the Regulations on conditions of students accommodation in student dormitories, which governs the rights and obligations of student tenants and student dormitories. As regulation of the rights of the student accommodation by subordinate regulation does not correspond to the needs and specificities of student tenant - SC relation, the question is which regulation would be more appropriate. Based on the analysis, the paper proposes contractual regulation of issues concerning accommodation in student dormitories in order to achieve a greater degree of legal protection and elaborates which legal nature, content and form of contract would best suit the needs of the specified legal relation. With the improvement of the protection in the substantive field, it also proposes an improvement of procedural protection between subjects in mentioned relation. [ABSTRACT FROM AUTHOR]
