Abstract

The article demonstrate the continued legality of Most Favored Nation Clause (MFN) when used by Indiana employers to provide health insurance for their employees, present MFNs as a safe and viable option for certain Indiana employers to pursue. Topics discussed include antitrust issues that Indiana employers should avoid when implementing MFNs into contracts with health care providers; the class action lawsuit against Blue Cross Blue Shield; and the Sherman Antitrust Act.
