Abstract

The article discusses the risks of parallel jurisdiction between different courts for the very same dispute. Topics covered include the issue of jurisdiction in the arbitration between the Philippines and China in their United Nations Convention on the Law of the Sea (UNCLOS) dispute, how international courts and tribunals ascertain their jurisdiction, and the element of jurisdiction ratione materiae.
