Abstract: The article focuses on need for updating Rule 12(f) of Federal Rules of Civil Procedure on sua sponte. Topics discussed include opinion of U.S. District Judge Ellen Hollander that over-pleading is not grounds to grant a motion to strike, efficiently written opinion with authoritative citations that summarizes a specific point of procedural law, and a case Blevins v. Piatt in which applicable standards for evaluating a Rule 12(f) motion was reviewed.
