This paper presents interpretation of the article 8. of the Convention by the European court of human rights in case of surrogate motherhood, regarding medically assisted reproduction with foreign element. In this case Court takes some point of views that affect the interpretation of the article 8. of the Convention, especially regarding the best interest of the child. In the course of the paper factual state, the judgment itself, and the dissenting opinions from the judges are all shown. Furthermore the law and the legal practice relevant to this case are also shown, with special emphasis on European court of human rights and the implications witch this judgment might have in further interpretation of the article 8. of the Convention and in the interpretation of the principle of best interest of the child.
