Abstract

Considering the particular circumstances of the case and notably the importance of the decisions to be taken, the applicant had not been involved in the decision-making process, seen as a whole, to a degree sufficient to provide her with the requisite protection of her interests. The failure of the Regional Court to inform the applicant of the additional evidence obtained during the appeal proceedings which deprived her of the possibility to react thereto revealed an insufficient involvement of her in the decision-making process.
