Abstract

Normally, insufficiency of power for subscribing an arbitration agreement is invoked by the principal in order to distance himself from the arbitration accepted at a given moment by a person claiming to be his representative. In the case that we shall examine here, however, the roles are reversed, since it is the other contracting party who argues this insufficiency and the consequent absence of ratification in time by the principal, in order to avoid being bound by the agreement to which he had subscribed. We shall examine the conditions in which it could be understood that this specific faculty may be conferred in the case of predisposed contracts in accordance with general conditions and the problems of ratification.
