Abstract

The following reflection is about the elements and horizons of meaning that relate the discourse of human rights with the subject and its political ethical training. The first part of the paper addresses the discursive ground that allowed the emergence of human rights in the spirit of modernity from the perspective of the subject and the state. The second part presents the main currents of thought and approaches human rights present in the construction of the modern state and its epistemological debate between liberalism and communitarianism. The objective of searches by re-orienting the direction of reflection from human rights, its phenomenological and discursive understanding that will enable their survival in the world of life, from a political culture of human rights.
