The aim of this paper is to analyze how the low prosecution of the crime of false testimony affects on the guarantees system of the due process and on the credibility of the witness testimony evidence as a whole. It is also analyzed the causes and motives that explain such a relative low prosecution of false testimony. In light of the whole analysis, the authors outline some proposals addressed to fostering a higher proactivity in prosecuting false testimony offenses in order to avoid a weakening effect on procedural guarantees and reinforce the realiability on witness testimony evidence.
