Abstract

The article explores the reason Title II of the Americans With Disabilities Act (ADA) prohibits the practice approved in the case, Buck v. Bell, written by Justice Oliver Wendell Holmes Jr., wherein states were free to forcibly sterilize persons with disabilities on the basis of disability alone. Topics discussed include background on ADA and Title II of the ADA, historical setting of Buck v. Bell, and arguments on the validity of Title II in the forced sterilization context.
